Abstract

The land conflict on Rempang Island, triggered by the national strategic project development of Rempang Eco-City, has sparked a sharp juridical debate between the aspects of state power (Machtsstaat) through investment policy instruments and the principles of the Rule of Law (Rechtsstaat) which emphasizes individual rights protection. This study aims to analyze the root causes of overlapping juridical claims between the Land Management Rights (HPL) held by BP Batam and the traditional physical land possession of the Rempang indigenous community based on the concept of the State's Right to Control (HMN), as well as to examine the legal standing and protection of uncertified land civil rights of the indigenous community viewed from the pillar of substantive justice in a Rule of Law. The research method applied is normative legal research utilizing a statute approach and a conceptual approach. The secondary data, consisting of primary, secondary and tertiary legal materials, were collected through literature review and analyzed qualitatively. The results indicate that the overlapping claims occurred due to the government's unilateral issuance of HPL over customary lands (tanah ulayat) that had been physically possessed peacefully, openly and generationally by the indigenous peoples (the Malay, Orang Laut and Orang Darat tribes) long before BP Batam or modern regulations were established. Within the perspective of substantive justice under the Rule of Law and the Basic Agrarian Law (UUPA), a land certificate is not the absolute source of rights but merely an administrative proof; thus, long-term physical possession in good faith (bezit/rechtsverwerking) by indigenous peoples constitutes a legally valid civil right that is constitutionally protected under Article 18B Paragraph (2) of the 1945 Constitution. Consequently, the civil legal protection for the Rempang indigenous community must be fulfilled through equal deliberation mechanisms (the right to consent or object to the project), fair compensation (covering both material and immaterial losses), or the granting of Communal Ownership Rights/land-sharing schemes to ensure that the indigenous people are treated as subjects of development rather than objects of land eviction for investor interests.

Abstract

The enactment of Law Number 1 of 2023 on the Criminal Code and Law Number 20 of 2025 on the Criminal Procedure Code elevates restorative justice into statutory law, raising questions regarding its position within the doctrine of grounds for excluding criminal liability. This normative legal research employs statutory, conceptual and analytical approaches. The findings indicate that restorative justice satisfies neither justificatory nor excusatory grounds because it does not eliminate the unlawfulness of the act or the offender’s culpability. The study concludes that restorative justice is more appropriately classified as a procedural, opportunistic ground for excluding prosecution, contributing to the reform of Indonesia’s criminal law system.

Abstract

This study examines the legal status of tanah perwatasan in Tarakan City and formulates its integration with land administration. Using normative legal research with statutory and conceptual approaches, this study finds that tanah perwatasan is merely a local social term rather than a category of land right. Therefore, physical possession and statements acknowledged by a village head must be assessed alongside possession history, parcel boundaries, land records and third-party objections. To connect social recognition with legal certainty, this study proposes an eleven-stage, non-constitutive Gradual Integration Model. The model neither replaces land registration nor assumes ATR/BPN authority and suspends routine procedures whenever material objections or disputes arise.

Abstract

The digital transformation of land administration in Indonesia, including for waqf (endowment) land, has reached a significant milestone with the release of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (ATR/BPN) Number 1 of 2021 concerning Electronic Certificates. The purpose of this study is to offer a legal analysis of the rules pertaining to electronic certificates (E-certificates) for waqf land and its consequences for the preservation of waqf assets and legal certainty. Both statutory and conceptual methods were used in a normative legal approach. The results of the study show that there is a strong legal basis for the integration of Ecertificates for waqf land, which harmonizes electronic land rules with Law Number 41 of 2004 concerning Waqf. Although the system helps mitigate risks such as forgery, land disputes and physical document damage, its implementation still faces obstacles including limited digital infrastructure in remote areas, vulnerabilities during data migration and low digital literacy among. Nazhir (endowment administrators). Therefore, synergy between the Ministry of ATR/BPN and the Ministry of Religious Affairs, alongside continuous guidance for Nazhir, is essential to ensure legal certainty and the protection of waqf land in Indonesia.
