Abstract

A sale and purchase agreement is an important instrument in economic transactions, which is regulated extensively in the Civil Code (Civil Code). With advances in technology, electronic buying and selling transactions via the internet or e-commerce are becoming increasingly relevant. This research aims to understand and examine sales and purchase agreements in e-commerce from the perspective of the Civil Code, including the validity of the agreement, the responsibilities of each party, and the application of tort law. This research methodology is qualitative, with a normative juridical approach to analyzing data from primary, secondary and tertiary legal literature related to conventional and electronic sales and purchase agreements. This research is expected to provide insight into the legal dynamics of sales and purchase agreements in the digital era, as well as strengthen the laws arising from e-commerce transactions. This is important to ensure adequate legal protection for all parties involved in e-commerce transactions, while supporting the growth of the digital economy. By understanding these legal aspects, it is hoped that we can make a theoretical contribution to the development of legal and practical knowledge for legal defenders, business actors and the general public in carrying out electronic buying and selling transactions.

Abstract

This research discusses legal protection for consumers in online buying and selling transactions using a normative juridical approach. Through analysis of legal sources, legislation, relevant literature, and transaction data from e-commerce platforms, this study highlights various issues faced by consumers in the e-commerce context, such as product discrepancies, fraud, dispute resolution difficulties, and data security issues. The research also explores the role of the Civil Code (KUH Perdata) and other relevant regulations in providing a framework to protect consumer rights. In the context of breach of contract, the study shows that consumers have rights guaranteed by law to receive compensation if they are affected by a seller's breach of contract. However, challenges such as difficulties in enforcing consumer rights across different jurisdictions remain an issue to be addressed. This research emphasizes the importance of solutions such as cross-border cooperation and online alternative dispute resolution systems in enhancing consumer protection. Abstract

In handling criminal acts, the Police have begun to use a restorative justice approach based on Perpol 8/2021, but there is legal ambiguity regarding whether or not labor crimes can be resolved based on Perpol 8/2021. The problem formulation in this article is 1. What are the characteristics of handling labor crimes? 2. Does the police's handling of labor crimes based on a restorative justice approach conflict with Perpol 8/2021? The results of this research are that employment crimes can be resolved by the police based on a restorative justice approach, because they do not conflict with Perpol 8/2021.

Abstract

Empirical research is the research method used. Primary and secondary data sources form research data sources. The formulation of the problem in this research is what are the actions of law enforcement in eliminating illegal online gambling (slot gambling) in Kuantan Singingi? and what are the obstacles to law enforcement efforts to crush illegal on-line gambling (slot gambling). Research findings show that Law enforcement used criminal efforts to eradicate illegal online gambling (also known as “slot gambling”) in Kuantan Singingi after crimes were committed under the criminal code. There are challenges facing Kuantan Singingi Regency law enforcement in their efforts to crush illegal internet gambling (slot gambling).

Abstract

The rise of information technology has significantly impacted the way business disputes are resolved. With a high volume of online trade, disputes can arise as frequently as they do in traditional business dealings. The increase in trading activities naturally leads to an increase in disputes that need resolution. One approach to resolving these disputes efficiently and fairly for both parties is through arbitration and alternative dispute resolution (ADR). Over time, this has evolved into Online Dispute Resolution (ODR). At a regulatory level, the implementation of ODR is guided by rules issued by the International Chamber of Commerce (ICC), which is recognized as a global authority. The issuance of the 2021 Arbitration Rules brings significant changes to the implementation of ODR. Previously, ODR required the consent of the parties, but now it is possible to carry out ODR regardless of the objections of the parties.

Abstract

This research aims to identify and reconstruct Quo Vadis regarding the increase in the term of office of village heads after the issuance of Law no. 3 of 2024 concerning Villages. The type of research used is normative juridical. The results of the study were obtained by confirming that term limits are a principle of constitutionalism to prevent abuse of power. The proposal to extend the term of office of the village head does not always mean increasing the effectiveness of performance and can affect the dynamics of democracy at the village level. Therefore, the political and legal system must be able to create a healthy and fair principle of leadership rotation. The urgency and value of extending the term of office of village heads needs to be reviewed, considering the potential negative impact on village development and democracy. Furthermore, the urgency of extending the term of office is based on the need to increase productivity and complete village development as well as reduce post-election polarization. However, negative implications such as potential authoritarianism, abuse of power, and stagnation of leadership regeneration make this proposal controversial. In addition, extending the term of office for too long can cause political boredom and decreased community participation in village democracy

Abstract

War crimes in the Charter of the International Military Tribunal 1945 and listed in the Treaty of London 8 August 1945. War crimes are extraordinary crimes as gross violations of human rights. Therefore, in 1998 in Rome, 120 UN member states enacted the statute establishing the International Criminal Court (ICC). The ICC aims to provide human rights protection to victims and law enforcement of war crimes perpetrators. This article aims to examine the important role of the ICC in the enforcement of war crimes in the aspect of contemporary criminal law, based on the nortmative legal research method. The results show the important role of human rights enforcement in the criminal law aspect of war crimes.

Abstract

Transnational crime law enforcement Sometimes the perpetrators of the offence to be prosecuted, tried, or executed are not in the territory of the State to carry out the proceedings, but in another State. The objective of the study is to identify and analyze efforts to eradicate drug trafficking in cases of smuggling of smugglers worth 1.7 million Ringgit or the equivalent of Rs. 5.7 billion to Indonesia and to find and analyse the appropriate law enforcement to prosecute cases of the drug traffic. The regulation on drug trafficking in Southeast Asia is considered insufficient to eradicate the black circulation of narcotics in South-East Asia as there are vague norms in law enforcement related to drug problems in ASEAN countries.

Abstract

Purchasing land is one of the transactions that carries a high risk in Indonesia, especially related to the legality and ownership of the land. Land buyers who have good intentions are often faced with various complex legal issues that have the potential to harm them. Therefore, legal protection for buyers who have good intentions is crucial to guarantee security and legal certainty in these transactions. This research aims to examine in depth the concept of Good Faith in determining land rights and explore the views of judges regarding buyers of land rights who have good intentions. The approaches used are the Legislative Approach, Conceptual Approach and Interpretation Approach. The results and findings show that there are several main legal risks in purchasing land. Firstly, the validity of documents is often a big problem, with many well-meaning land buyers getting stuck with invalid or fake documents. Careful examination of legal documents such as land certificates, permits, and proof of ownership is very important to ensure the validity of transactions. Second, ownership disputes often occur, where land purchased by buyers with good intentions turns out to be the object of dispute due to overlapping ownership claims or heir disputes. Although existing laws and regulations are designed to protect buyers in good faith, research shows that their implementation in practice is still less than effective. To minimize legal risks, it is important to carry out thorough due diligence before carrying out a land purchase transaction, including checking the history of the land, the validity of the documents, and the legal status of the land both in relation to physical data and juridical land data. To reduce this risk, buyers are advised to use professional services such as notaries and lawyers who are experienced in land transactions.

Abstract

The control exercised by business actors over supporting facilities in rest areas must be a serious concern, as it infringes upon tourists' rights. This research is analyzed using a normative legal method with an inconcrete approach and analytical descriptive elaboration, exploring the freedom rights of tourists in utilizing supporting facilities, the obligations of vendors as business actors to provide comfort to tourists, and the legal consequences of violations of tourists' rights. The findings indicate that, according to Law Number 1 of 2009 on Tourism, tourists' rights to comfort in using supporting facilities are regulated, along with the obligations of business actors to provide comfort to tourists. Additionally, legal consequences in the form of sanctions are found in Magetan Regency Regional Regulation Number 7 of 2013 on Tourism.
