Abstract

Law enforcement should ideally uphold the values of human rights, transparency, non-discrimination, anti-corruption. In fact, the opposite, so created a corrupt legal culture in the law enforcement process. The research aims to explore the various dominant factors created by a corrupt culture in the law enforcement process. The results of the study, namely the conditions of the existing legal culture of the police environment in the law enforcement process, showed a tendency opposite to the one that should be in the legal process. The driving factors include hedonism, low incomes, permissive police leadership, lack of sovereignty, pressure from various sides. The ideal legal culture model is to change the sanctioning of violations of the law enforcement process through disciplinary sanctions.

Abstract

Poor compliance with Law Number 22 of 2009 concerning Traffic and Road Transportation (UU LLAJ) indicates a lack of effectiveness in traffic law enforcement in Indonesia. The Indonesian National Police Regulation Number 8 of 2023 on Electronic System-Based Implementation currently governs ETLE (Electronic Traffic Law Enforcement) operations. Various AI technologies used in ETLE mechanisms include static, mobile, portable, drone, and face recognition systems. On toll roads, ETLE with Weigh-In-Motion (WIM) sensors is employed to address over-dimension and overloading (ODOL) trucks. The Traffic Law Enforcement Subdirectorate (Ditgakkum Subdit Dakgar) successfully increased ETLE enforcement by 35.7% in 2023. The types of ETLE are adapted to the specific needs of each region.

Abstract

The process of forming regulations is often not in line with existing theories. Based on Article 56 paragraph (2) of Law Number 12 of 2011, it basically states that Regional Regulations need to be accompanied by information and/or Academic Papers. This can raise doubts about the position and importance of Academic Manuscripts in the preparation of the Draft Regional Regulations. The results of the study state that the position of the Academic Manuscript in the formulation process of the current Regional Regulation formation is a mandatory requirement to provide a scientific basis to support data-based decision-making and objective analysis for the making of Regional Regulations that reflect community participation. After the promulgation of Law Number 13 of 2022, the preparation of Academic Manuscripts not only applies normative juridical and empirical juridical methods, but should also be accompanied by an impact analysis method from the presence of Regional Regulations that are being prepared through the RIA and ROCCIPI methods.

Abstract

The development of national law is part of the national development system aimed at realizing the goals of the state. The guidelines and foundations for legal development in Indonesia are contained in the National Legislation Program (Prolegnas), the medium-term Prolegnas is carried out for a period of 5 years. Legal development in Indonesia seems slow, this is possible because of the current concept of Prolegnas. The results of the study stated that the Prolegnas should be conceptualized to be prepared every 1 year, this is so that there is a good evaluation, the community can participate in the formation of the Law, in accordance with the annual principle in state finance, and the Law made by the House of Representatives can follow the development of the times and people's lives.

Abstract

Mining activities often cause negative impacts, such as environmental pollution, environmental damage, pollution from mining activities, and damage to road access which leads to a conflict problem, whether it is between community conflicts with companies or communities with the government. The purpose of this research is to find out the potential irregularities of the Mining Business License (IUP) ormas after the enactment of Government Regulation Number 25 of 2024. The results of this study are that Article 83A paragraph (1) is contrary to Law Number 3 of 2020 concerning Amendments to Law Number 4 of 2009 concerning Mineral and Coal Mining (Minerba Law), this is not in line with the legal principle of lex superior derogate legi inferiori. The potential deviations are lack of experience and competence, potential internal conflicts, weak supervision and regulation, local economic instability, and corruption and abuse of authority. Abstract

In the adversarial justice system in Indonesia, advocates play an important role in realizing justice for the parties involved in the legal process. As legal representatives, advocates serve to ensure that their clients receive equal protection of legal rights. The role of advocates in realizing justice in the Indonesian adversarial justice system is very important. Advocates act as legal advisors who help suspects, defendants, and convicts understand the legal process and ensure that their rights are not violated. Advocates act as a counterweight to the coercive efforts of law enforcement, maintaining justice and the supremacy of law. In Law No. 18 of 2003. This study aims to analyze and highlight the importance of the role of advocates in the context of adversarial justice in Indonesia and its impact on law enforcement and human rights protection. Abstract

Indonesia's nickel ore export ban through the Minister of Energy and Mineral Resources Regulation No. 11 of 2019 prompted European Union to bring the case to the WTO Panel, which concluded that Indonesia has violated Article 11 of the General Agreement on Tariffs and Trade (GATT). Using normative juridical research methods, this article examines Indonesia's justification for its export ban from the international trade law perspective. This study indicates Indonesia's uncertainty due to the dysfunctional WTO Appellate Body for an indefinite period, compelling Indonesia to consider a beneficial middle-ground approach for the economy while maintaining Indonesia's position in international trade.

Abstract

ABSTRACTMarriage often occurs and disputes can lead to a marriage becoming untenable,resulting in divorce. A marriage that ends in divorce will have legal consequencesfor both spouses and the children born from the lawful marriage. This studyexamines Legal Protection of Children's Rights in Divorce Cases in Semarang Cityusing a normative juridical approach. The findings show the need for strengtheninglaws and regulations, as well as public education programs regarding children'srights. The challenges faced include a lack of public education and complicatedbureaucratic procedures. Abstract

ABSTRACT Thrift shopping, known as buying quality used goods at affordable prices, has become an important trend in society. In fact, even though some used goods have been banned for decades, the smuggling of these goods causes losses to the Indonesian state and violates existing laws and regulations. Apart from that, the rise of the second-hand goods business has reduced the absorption capacity of domestic clothing production. So the author is interested in researching how the regulations regulate the thrifting business, and the impact of the thrifting business on sustainable business and how the Government can overcome this. This research was conducted using a normative juridical approach. The research results show that according to regulations, the import and distribution of used clothing is actually prohibited by law in Indonesia due to several laws and regulations. However, thrift shopping activities remain widespread due to high consumer demand and weak law enforcement. Second-hand shopping activity is still widespread. This activity has a negative impact on local clothing MSMEs because they have to compete with cheaper imported products. It is estimated that imports of used clothing will reduce the MSME market share by 12-15%. The main obstacles in overcoming thrift shopping are high consumer demand, weak law enforcement, and still limitations in monitoring and evaluating the ban on importing used clothing. Government initiatives include strengthening border security, confiscation and demolition. Keywords: Thrift shopping, Indonesian law, MSMEs, regulations.

Abstract

In 2018 the Ciletuh-Palabuhanratu Geopark, Sukabumi Regency received Global recognition from the United Nations Educational, Scientific and Cultural Organization (UNESCO), UNESCO Global Geoparks are defined as an integrated geographical area where international geological sites and landscapes are managed with the concept of holistic protection. The existence of Indigenous Peoples in the forest area will be related to the forest. Customary law communities in forest areas can use forest, even Article 37 of the Forestry Law regulates customary forests. According to its function. Constitutional Court Decision No. 35/PUU-X/2012, based on the judicial review, it is hoped that there will be no more problems related to forest status between customary law communities and the state or companies. In fact, in the life of the Ciptagelar kasepuhan community there is still overlapping of laws. From this, problems arise (1) How is the management of the customary land of the Ciptagelar community in the Ciletuh Geopark area, (2) What are the rights for the Ciptagelar community in the Ciletuh Geopark area, (3) How is the management of land conflict resolution between indigenous peoples, indigenous peoples and the government? regional and national, and indigenous peoples and corporations. This study uses a combined Normative and Empirical research method with the Statute Approach, Analytical and Conceptual Approach, Case Approach and perceptual approach. The results of this study are that so far, there have been many regional regulations in regencies/cities, provinces that give recognition to Indigenous Peoples, Indigenous Peoples who carry out their traditional work have the potential to lose their land. This happens because the Job Creation Law generally regulates the ease of investing. There is still a lack of guarantees for customary rights to control their customary areas if they are clashed with the principle of public interest by the government. Until now, there is no legislation that is lex specialist for the protection of the rights of indigenous peoples.
