Abstract

Prosecution of children's cases in the juvenile criminal justice system in Indonesia focuses on the principles of restorative justice, which aims at the rehabilitation and social reintegration of children. Even though Law no. 11 of 2012 concerning the Juvenile Criminal Justice System (JCJS) regulates the protection of children's rights, prosecution practices often face obstacles, such as a lack of understanding by law enforcement officials regarding restorative approaches and limited rehabilitation facilities. This research aims to analyze the prosecution mechanism, the role of prosecutors, and the challenges that exist in the juvenile criminal justice system. The research results show the need to strengthen the capacity of law enforcement officers, improve rehabilitation facilities, and community understanding to realize the goals of an effective and fair juvenile criminal justice system.

Abstract

Malpractice is an error or negligence committed by professional staff, such as doctors, lawyers, accountants, dentists or veterinarians, which do not comply with professional standards. In reality, malpractice still often occurs, both in hospitals and medical personnel, even though there are several legal instruments that regulate hospitals and medical practice with sanctions for violators of health laws. The aim of this research is to explore existing deficiencies in legal policies, and propose new legal policies in order to optimally prevent and overcome hospital malpractice. The research method used is a normative research method by examining aspects of criminal law in health law regarding malpractice, as well as theories and expert opinions for better legal policy proposals. From the qualitative analysis of data on primary and secondary legal materials, the following results were obtained: first, there are weaknesses in the health law policy so that it cannot prevent and deal with malpractice optimally, namely the lack of completeness and lack of clarity regarding the formulation of malpractice and its strict sanctions, and a turn towards acts of resistance. the law and limitations of the hospital's responsibility for malpractice committed by doctors or medical personnel. Second, a new legal policy that can be proposed is by formulating clearly and in detail the limits of hospital malpractice in health law, accompanied by strict sanctions or accountability both criminally, civilly and administratively, hospitals.

Abstract

This article aims to see how press neutrality is in responding to the 2024 election from the perspective of law and proffesional ethics. The press, as the fourth pillar of democracy, plays a role in educating the public and serves as a platform for the public to help oversee the democratic process. In practice, the press has an important role during elections, as it can provide information about the electoral process, allowing the public to have multiple references before voting. However, in the modern era, the neutrality of the press is increasingly being questioned due to the fact that many media company owners are also involved in politics. So, how do law and professional ethics view this. Understanding this issue is crucial for the public to know the true position of the press in elections. In the Press Law itself, there is no mention of the word “neutrality” but what exists is “independence”.

Abstract

This research aims to discuss comparative laws regarding same-sex marriage in Indonesia and Thailand, with a focus on legal policy, social implications, and impact on generations. This research uses normative legal methods using secondary data sources originating from library materials and legislation. The research results show that Thailand, which is a country that tends to be progressive in recognizing LGBT rights, has initiated legislative steps that provide legal protection for same-sex couples, including the "Civil Partnership" Bill. In contrast, Indonesia, with a more conservative legal and cultural background, does not yet have a legal framework that supports the recognition of same-sex marriages. This research examines the legal frameworks of both countries, legislative challenges, and the social implications of same-sex marriage. This study seeks to provide policy recommendations based on a comparison of the two legal systems.

Abstract

The integration of the legality principle and the opportunity principle in prosecutorial practice in Indonesia is a complex issue that requires in-depth study. The legality principle, which demands legal certainty, often clashes with the opportunity principle, which grants prosecutors discretion in decision-making. This study analyzes the dynamics of the interaction between these two principles through a literature review and case studies. The findings indicate challenges in achieving a balance between the two, particularly in defining the boundaries of prosecutorial authority and objective criteria for applying the opportunity principle. The study concludes that there is a need for regulatory improvements, increased transparency, and effective oversight mechanisms to ensure that the application of the opportunity principle does not deviate from the principles of justice and legal certainty.

Abstract

Freedom of opinion and protection of whistleblowers are two critical aspects in maintaining transparency and accountability in Indonesia, particularly within the context of a healthy democracy. Article 28E, Paragraph (3), and Article 28F of the 1945 Constitution guarantee the right of every individual to express opinions, access information, and communicate freely. However, the implementation of freedom of opinion often faces obstacles, especially in relation to the ITE Law, which contains multi-interpretive articles, such as Article 27, Paragraph (3), and Article 28, Paragraph (2). These provisions are frequently used to criminalize individuals who express criticism or file public reports. This creates an imbalance between the right to freedom of expression guaranteed by the constitution and the inconsistent application of the law. This article also underscores the importance of legal protection for whistleblowers, who often face both physical and legal threats. While existing legal protections, such as Law No. 13 of 2006 in conjunction with Law No. 31 of 2014 regarding Witness and Victim Protection, provide a legal foundation, their implementation remains limited in the digital context. Therefore, harmonizing regulations, including revising the ITE Law, is essential to ensure that both freedom of expression and whistleblower protection are properly safeguarded. Reform in Indonesia's legal system is urgently needed to create a safe environment for the public to voice their opinions and report violations. This, in turn, will strengthen transparency, prevent corruption, and bolster democracy in Indonesia.

Abstract

This article discusses the legal politics of customary rights in land reform in Indonesia, as well as the concept of reform. Through the legal norms approach, several problems were found in managing agrarian affairs, including: inequality in state land control, overlapping land distribution policies in the past, the emergence of social and ecological crises in rural areas and the non-functioning of UUPA. So to overcome this problem, the Government needs to take strategic steps to reform the existing agrarian law. Pancasila and the constitution must be the spirit and soul of national agrarian law reform. So that existing land and agrarian resources will no longer be used as trading material.

Abstract

The reform of labor law in Indonesia, particularly through the Job Creation Law, aims to adapt labor policies to the demands of the global market and strengthen the national economy. This study evaluates the effectiveness of Law Number 13 of 2003 on Manpower and the changes brought by the Job Creation Law, focusing on the protection of workers' rights and its effect on social justice. The analysis shows that while the new law offers greater flexibility in employment contracts and working period arrangements, there is a significant risk of a reduction in worker protection standards. The study underscores the urgent need for more effective oversight mechanisms and policy advice to ensure that the legal changes contribute positively to workers' lives without compromising their rights.

Abstract

The phenomenon of online prostitution in Indonesia presents complex legal challenges, triggered by the rapid development of information technology and the shift in prostitution operations from conventional to online. This study examines Indonesia's criminal legal framework in relation to online prostitution, highlighting the absence of specific legal norms to regulate online prostitution service users. This causes service users to often escape the law, even though their activities clearly violate social and moral norms. A normative juridical approach was used in this research, involving the analysis of relevant legislation and legal doctrine. The results show that existing regulations have not effectively addressed online prostitution, often excluding service users as criminal subjects. This study recommends revising and strengthening regulations to close legal loopholes, improve law enforcement, and protect vulnerable groups against sexual exploitation, ultimately ensuring justice and legal certainty for all parties concerned.

Abstract

A house lease agreement is a legal relationship that often occurs in the community, but its implementation still faces many challenges. This study aims to analyze the implementation of such agreements from a normative juridical perspective, identify the main problems, and provide strategic recommendations to create fairer and more effective agreements. Using the literature study method, it is found that the imbalance of bargaining position, lack of clarity of rights and obligations, and lack of legal literacy are the main causes of disputes. Unharmonized regulations and the lack of efficient dispute resolution mechanisms exacerbate the situation. This study recommends drafting written agreements with balanced clauses, strengthening legal literacy, harmonizing regulations, and developing alternative dispute resolution mechanisms. This study is expected to provide practical and theoretical contributions in the management of house lease agreements that are more fair and responsive to the needs of the community.
