Abstract

Indonesia and the European Union are involved in an international trade dispute over palm oil, which has been addressed through the Dispute Settlement Body (DSB) of the World Trade Organization (WTO). The dispute was triggered by the European Union's policies, such as the Renewable Energy Directive II and regulations related to palm oil-based biofuel, which are considered discriminatory and detrimental to Indonesia's exports. The WTO, through the DSB, successfully mediated the trade dispute between Indonesia and the European Union. From the perspective of international law, the WTO serves as an institution that enforces binding rules, enabling it to resolve trade disputes fairly. The WTO panel reviewed the Technical Barriers to Trade Agreement and the General Agreement on Tariffs and Trade 1994, which were the core of Indonesia's objections. The panel's findings revealed that certain European Union policies violated the principle of non-discrimination, while some of Indonesia's claims were not substantiated. This article also examines the implications of the decision through the lens of the theory of comparative advantage, which supports Indonesia's right to utilize its natural advantages in efficiently producing palm oil. The WTO's decision is expected to encourage the European Union to revise its policies and strengthen Indonesia's position in global trade.

Abstract

International business disputes are increasing in line with the development of trade between countries. The resolution of cross-border legal disputes through national courts often faces various obstacles, so international arbitration is a widely recognized alternative solution. This study analyzes the role of arbitration as an international business dispute resolution mechanism and the legal options used in international arbitration. Arbitration is one of the mechanisms for resolving international business disputes that tends to be chosen over the courts because of its advantages which include confidentiality, trust from business people, the expertise of arbitrators, and a fast and final process. In international arbitration, the parties have the freedom to determine the applicable law.

Abstract

The purpose of this study is to analyze gambling from the perspective of Indonesian and Thai law. From the perspective of Indonesian criminal law, the crime of gambling is threatened by the laws and regulations in force in Indonesia, namely Law Number 7 of 1974 concerning the Control of Gambling, Article 303 of the Criminal Code, Article 303 bis of the Criminal Code and Government Regulation Number 9 of 1981 concerning the Implementation of Gambling Control. Meanwhile, Thailand legalizes gambling by dividing it into two categories that have been stated in a regulation, namely the Thai Civil and Commercial Code B.E. 2466 (1923) or the Civil and Commercial Code B.E. 2466, Gambling Act, B.E. 2478 (1935) or the Gambling Law B.E. 2478 and the Government Lottery Office Act B.E. 2517 (1974) or the Government Lottery Office Law B.E. 2517 which regulates gambling currently in Thailand. Articles 835 – 855 of the Civil and Commercial Code. This research is a normative legal research with a comparative approach, using library research data collection tools as data collection techniques and analyzed using qualitative methods.

Abstract

The Indonesian criminal justice system faces significant challenges in balancing legal certainty and the protection of suspects' human rights. Although the presumption of innocence principle is enshrined in various laws and regulations, pretrial detention practices are often misused by law enforcement officials as a psychological pressure tool against suspects. Article 21 of the Indonesian Criminal Procedure Code (KUHAP) grants broad discretionary powers to investigators and prosecutors in determining detention, without stringent judicial oversight. This situation creates a high risk of arbitrary criminalization, which contradicts the fair trial principle as stipulated in the International Covenant on Civil and Political Rights (ICCPR). This article analyzes the fundamental weaknesses in the criminal procedural law system, particularly in detention mechanisms and pretrial judicial oversight, and proposes a more just and accountable system reconstruction. KUHAP reform is necessary to establish stricter minimum evidence standards before detention, expand pretrial judges' authority to assess the substance of evidence, and strengthen independent oversight of detention decisions made by law enforcement officials. By implementing these reforms, Indonesia's criminal justice system can become more transparent, accountable, and aligned with internationally recognized human rights protection principles.

Abstract

The rapid development of the digital world has had a significant impact on people's lives in the form of positive and negative impacts, one of these developments has an impact in cyberspace as well as legal aspects, especially in the protection of personal data in Indonesia. The increasing use of technology and the internet increases the risk of privacy violations, making strong regulations crucial. The method used is a qualitative approach with in-depth literature study and analysis of related laws and regulations. This research analyzes how digital developments influence legal policies related to Personal Data Protection and evaluates the challenges and effectiveness of regulations in dealing with cyber threats. The research results show the need to strengthen laws and enforce regulations to protect an individual's privacy rights in the digital era.

Abstract

This article examines "Tri Tangtu" as an indigenous philosophy of law that has developed among the Sundanese people in West Java and Banten. Tri Tangtu forms part of the foundational philosophical knowledge and worldview of the Sundanese community in practicing the ancestral traditions of their cultural heritage. Accordingly, this study employs a descriptive-analytical approach, focusing on the philosophical analysis, mythological symbols, customary norms, and the practical implementation of Tri Tangtu. The analysis reveals that Tri Tangtu is not merely a body of knowledge or a set of ethical guidelines but also serves as a foundation for developing customary legal norms, maintaining social order, and resolving issues in daily life.

Abstract

This research aims to analyze the extent to which the fulfillment of rights and protection of religious believers in Dusun Air Abik, Bangka Belitung,based on a human rights perspective. The community of religious believers still faces social problems that affect the fulfillment of their basic rights. Based on socio-legal methods and empirical approaches,this study found that the fulfillment of the rights of religious believers LOM tribe has not been fully fulfilled.The local government must play an important role in encouraging the protection of rights through fair and equal policies. The conclusion shows that the government, especially the village government,must pay more attention to their rights that have not been fully fulfilled to ensure the fulfillment of equal human rights for all citizens.

Abstract

The case of embezzlement or human crime is a very serious case and the perpetrators should be punished as severely as possible. There are inhibiting factors such as laws and regulations, law enforcement officers and public awareness. This type of research is empirical juridical supported by library data and related laws and regulations. The specification of this research is descriptive analytical, the data used is primary data and secondary data sourced from primary, secondary and tertiary legal materials. Based on the results of the study, it was found that law enforcement in cases of embezzlement in the jurisdiction of the OKU Police was carried out through prevention efforts with non-penal means with a restorative justice (RJ) approach and crime prevention with penal means or using criminal law means.

Abstract

The restorative justice approach (restorative justice) is a breakthrough to realize legal justice that humanizes humans by using conscience which also fights the negative stigma in society, that the law is blunt upwards, but sharp downwards, so that cases that are simple and trivial or light can be resolved outside the court do not need to be submitted to the court. The research problem is how is the law enforcement of minor criminal cases with a restorative justice approach that is rejected by the victim in the Lahat Resort Police and what factors hinder the handling of minor criminal cases with a restorative justice approach at the Lahat Resort Police. The research uses an empirical juridical approach complemented by literature data and the nature of this research is descriptive analytical. The result of the research is in the handling of minor criminal cases with a restorative justice approach at Lahat Police Station carried out as usual according to the Indonesian criminal justice system, namely by preventive action using non-penal means or also repressive action with penal means. For handling tipiring cases, Lahat Police investigators prioritize and prioritize the restorative justice (RJ) approach. However, if the use of the restorative justice approach is rejected by the victim or the perpetrator after the mediation step is attempted in such a way as to be guided by the provisions of Articles 5 and 6 of the Indonesian National Police Regulation Number 8 of 2021, but still fails, then the case file is forwarded to the next stage, namely being submitted to the prosecutor's office. The obstacle factors encountered by the Lahat Police investigating officers include the weak rules regarding restorative justice that are not enough to guarantee legal certainty, because they are still in the form of regulations under the law (legal factors), the lack of understanding of investigating officers regarding restorative justice, where the police still believe that law enforcement must be in accordance with the criminal justice system and the professionalism of investigating officers is still low (apparatus factors) and the lack of understanding, knowledge and understanding of the community about the importance of using restorative justice in resolving tipiring cases (community factors).

Abstract

Control of the land plot must be proven through a valid certificate of ownership. In its development, it was found that there were duplicate certificates that overlapped each other. This study aims to provide an analysis related to the issuance of double certificates and the mechanism for their completion. This research is a normative juridical research with a legislative approach and a conceptual approach. The results of the study show that double certificates arise as a result of various factors, including administrative errors, lack of supervision, and the practice of abuse of authority in issuing certificates, thus creating legal uncertainty for land rights holders. The legal settlement requires a comprehensive approach, involving the improvement of the land administration system, and strict enforcement of any violations.
