Abstract

Narcotics abuse is a serious global problem that is currently faced by many nations in the world. Because the interest or presentation of its use always never stops completely. This phenomenon is like an iceberg, only a small part of the surface is visible and most of it is invisible. For example, it is estimated that there are 100 narcotics abusers but only 1 person has been identified as the abuser. This narcotics problem is so disturbing and worrying because various kinds of damage and crime will emerge from it. At the Sibolangit Center Rehabilitation Home, understanding of the law for narcotics abuse for narcotics users in general is very low, which causes many people to use prohibited narcotics because there is little information available. Likewise, the results of the survey questionnaire prove that the average of 45 respondents answered that almost no never or rarely received information about the dangers of narcotics use. However, legal awareness of narcotics abusers who are in rehabilitation centers regarding the impact of criminal narcotics sentences in Indonesia tends to develop along with the rehabilitation process that has been undertaken, because narcotics users in rehabilitation are given an understanding of the dangers of narcotics abuse both in terms of health and the applicable law.

Abstract

Indonesia is a rule-of-law country that requires the law to be upheld, respected, and obeyed by everyone without exception. This includes the right of every individual to receive healthcare, which is guaranteed by the constitution and enforced in any country that adheres to this law to improve healthcare services for all its citizens and achieve its welfare goals. The rampant sale of drugs without a distribution license in society is concerning. One example is the widespread sale of drugs without approval from the National Agency of Drug and Food Control (BPOM), which poses a threat to public health and safety because there is no guarantee of safety from BPOM. This research uses normative legal research with a descriptive approach. The legal materials used include both primary and secondary legal sources. In this context, the author is interested in the criminal liability of individuals selling Hexymer without a license in society. The research questions are: What is the criminal responsibility of individuals selling Hexymer without a license in society? What are the judges' considerations in dealing with offenders who sell Hexymer without a license in society? Based on the findings, the author concludes that the criminal act of selling Hexymer without a license in society can be charged under Articles 196 and 197 of Law No. 36 of 2009 on Health, and in the judges' considerations, the offender may be subjected to a fine of IDR 5,000,000.

Abstract

This article aims to analyze the existing provisions in the Criminal Code of Indonesia regarding a trial period for the death penalty for convicts who do not regret their criminal conduct. It can be said that the convict has been sentenced twice. This method is a normative juridical because the focus of the study departs from the vagueness of norms, using approaches such as the statute approach and the conceptual approaches. This technique for searching legal materials uses document study techniques and normative analysis. Based on the results of the analysis, the trial period for the death penalty for convicts who do not regret their actions is ineffective. It is because it violates the human rights of the convict. After all they torture the convict by giving him probation for 10 years. Basically, the convict does not regret his actions so without having to wait a long time the death execution can be carried out. Keywords: Death Penalty; Human Rights, Trial Period;

Abstract

The title of this article is “Anti-corruption Education for Students and Vocational High School Students in Salatiga”. The purpose of the implementation of this activity is to disseminate anti-corruption education to the community, in this case for the younger generation. The method of implementation is by conducting socialization and training by using game tools to the participants. The results of this anti-corruption education provide more understanding to the participants about the basic concepts of corruption, corruption crimes, corruption behaviors, and how to prevent corruption with anti-corruption education. In this case, students are expected to become agents of change and the agents help to socialize anti-corruption education to other students, friends and the wider community. Corruption is a crime that destroys the joints of the state, so the government and the people of Indonesia society should have a zero tolerance towards corruption, namely advancing anti-corruption education from an early age and making it a subject in schools.

Abstract

Notary as a member of the Financial Action Task Force (FATF) to eradicate money laundering. At the level of the Notary Regional Supervisory Council which has the authority and obligation to carry out guidance and supervision of Notaries in the Region (Regency/City Level). In the research location at MPD Deli Serdang. This research method is a type of empirical juridical research. The results of the research and discussion are that the main basis that supports the involvement of a notary is as a Gatekeeper through the Implementation of Beneficial Owner Recognition. Implementation of these recommendations in Serdang delis faces obstacles, such as Capacity and Knowledge Constraints: Not all notaries fully understand FATF regulations or have adequate training regarding the obligation to report suspicious transactions.

Abstract

This research analyzes the effectiveness of the implementation of Supreme Court Regulation (PERMA) no. 1 of 2016 in resolving civil cases at the Denpasar District Court Class IA through mediation. The research uses empirical legal methods, with a statutory approach to analyze legal principles and a factual approach to describe the practical implementation of mediation. Data was obtained through interviews, observations and document studies, and analyzed descriptively qualitatively to understand the empirical reality, views and constraints from various perspectives, including judge mediators, disputing parties and private mediators. The research results show that although mediation increases the efficiency of the dispute resolution process, its success is still low compared to the number of cases submitted, due to the limited number of certified mediators and lack of public understanding. Recommendations include increasing mediator training, outreach on the benefits of mediation, and adoption of technology to increase efficiency and accessibility.

Abstract

State Receivables is one type of state revenue that must be paid to the Central Government. One form of State Receivables is Non-Tax State Revenue (PNBP). In the bankruptcy process, the State represented by the Ministry / Institution can become a Creditor. Creditors in bankruptcy itself are divided into 3 (three) levels. The problem is how the position of the state as the holder of PNBP itself in the bankruptcy process and how it is implied in one of the Commercial Court decisions, namely Decision Number 18/Pdt.Sus-Renvoi/2023/PN Niaga Medan. The results of the study show that, based on positive law in Indonesia, the position of the State as a holder of non-tax revenues in the bankruptcy process is as a Preferred Creditor. Furthermore, the consideration of the panel of judges in Decision Number 18/Pdt.Sus-Renvoi/2023/PN Niaga Medan can be said to be less precise in accommodating the position of the State itself.

Abstract

 Cooperatives are a form of group of people and also legal enities that have a joint work system in a family principle for the common interest, in a cooperative there is an agreement both from the community and cooperative members, therefore this agreement is to bind the parties who have a common interest. There is an impact arising from an agreement both in achievement and deault where every agreement made in this cooperative always raises the law for that there needs to be legal efforts to proctect the rights of the cooperative. This research aims to find out about legal protection efforts for cooperatives that are defaulted by debtors.

Abstract

Trade cooperation is a part of contract law within the scope of Indonesian civil law, which often involves both written and unwritten agreements. Business disputes in trade cooperation arising from unwritten agreements are unavoidable risks that can be resolved through arbitration or court proceedings. This study aims to examine the resolution of disputes in unwritten agreements from the perspective of Indonesian civil law. The findings indicate that all types of agreements, whether written or oral, are considered valid as long as they meet the requirements stipulated in Article 1320 of the Indonesian Civil Code. Furthermore, dispute resolution in trade cooperation relationships can be conducted through litigation or non-litigation mechanisms, including arbitration.

Abstract

This study aims to analyze the legal politics of customary law in preserving the Kawin Cai tradition in Maniskidul Village, Kuningan Regency. Kawin Cai is a Sundanese traditional ceremony with a sacred meaning, symbolizing gratitude for water sources and maintaining harmony between humans and nature. In the national legal system, customary law is recognized under Article 18B(2) of the 1945 Constitution; however, its implementation faces challenges due to tourism village policies that lean towards commercialization. This research employs a normative juridical method with a statutory approach and document analysis. The findings indicate that customary law plays a crucial role in maintaining the social and spiritual legitimacy of the Kawin Cai tradition, while local legal politics should serve as an instrument for legal protection rather than merely a tool for tourism development. This study recommends the establishment of more specific regional regulations to ensure the sustainability and authenticity of Kawin Cai in the face of modernization.
