Abstract

This study discusses the status of children from unregistered marriages from the perspective of Islamic law and Indonesian positive law. The results of the study show that the two legal systems provide different approaches. Islamic law recognizes children from unregistered marriages as legitimate children who have a blood relationship, rights to support, and inheritance, as long as the marriage meets the pillars and requirements of validity according to sharia. In contrast, Indonesian positive law requires official registration as a form of legal recognition of marriage, so that children from unregistered marriages initially only have a civil relationship with their mother. Although the Constitutional Court Decision Number 46/PUU-VIII/2010 opens up space for recognizing the relationship between children and their biological fathers, complex legal evidence procedures still make it difficult for children to access their legal rights. The difference between the substantial approach in Islamic law and the formal approach in national law creates gaps in legal protection for children. Therefore, it is necessary to harmonize the two legal systems through simplification of marriage confirmation procedures, increasing legal education, and reforming technical regulations to ensure legal certainty and protection of the rights of children from unregistered marriages.

Abstract

Verbal bullying is a problem that haunts society today. Verbal bullying is one type of bullying that has fatal consequences. Verbal bullying has the potential to cause serious psychological disorders, even to the point of causing the victim's death. However, criminal regulations against this form of violence are still inadequate, both for children and adults. This article examines the penal and non-penal criminal policies for cases of verbal bullying that have fatal consequences. Research shows that there is a legal gap that needs to be filled by updating the Criminal Code and strengthening community-based prevention. Interconnectedness of penal and non-penal criminal policies is needed to prevent verbal bullying and protect victims comprehensively.

Abstract

The development of Artificial Intelligence (AI) raises legal issues in copyright protection, especially for scientific works produced without human involvement. Law Number 28 of 2014 concerning Copyright does not explicitly regulate the ownership status of the work. This study uses a normative legal method to examine the legal protection of scientific works produced by AI, by examining laws and regulations and principles of intellectual property rights. The results of the study are expected to provide input for the formulation of adaptive regulations and guarantee legal certainty in the era of technological development.

Abstract

This study aims to analyze the legal protection of consumers who are victims of fake doctors from the perspective of UUPK and its relation to malpractice. This research method is normative juridical with a statutory and conceptual approach. The results of the study indicate that patients who suffer losses due to the actions of fake doctors can claim compensation based on Article 19 of UUPK and file a civil or criminal lawsuit for alleged malpractice. In addition, fake doctors can be subject to criminal sanctions in accordance with Article 62 of UUPK and the Medical Practice Law. However, there are still obstacles in law enforcement, especially in the supervision of licensing of medical personnel in beauty clinics. Therefore, strengthening regulations and supervision is needed.

Abstract

The Regional Elections are a democratic process of electing regional heads. In its implementation, the regional elections must reflect the principles of electoral justice. However, the experience of the regional elections that have been passed does not reflect the fairness of the election so that the principles of direct, public, free, secret, honesty, and fair do not run well. The importance of this electoral justice system is to prevent fraud, money politics, and maintain voting rights. Thus, the implementation of the Regional Elections must be oriented towards justice and guarantee the right to vote and be elected. It is very important to deeply understand the role of electoral justice in building the election system so that the democratic process that runs in the regions can be carried out in a fair, transparent, and upholding the sovereignty of the people.

Abstract

This study analyzes the efforts of the Audit Board of the Republic of Indonesia (BPK RI) in preventing and addressing integrity crises through value enforcement, violation prevention, and the development of a crisis management system. Employing a qualitative case study approach, data were collected through interviews, observations, and document analysis. The main findings indicate that BPK RI has established instruments for strengthening integrity. However, challenges remain in terms of oversight and the dissemination of ethical values. Integrity enforcement has been carried out through exemplary leadership and firm sanctions. Meanwhile, the crisis management system has not yet been formally structured. It is recommended that BPK RI develop a comprehensive crisis management system, strengthen the culture of integrity, and enhance ethical leadership and post-crisis evaluation to build a resilient and adaptive organization.

Abstract

Children as the nation's next generation are influenced by various factors in their growth and development, including the environment which can cause legal conflicts. Law No. 11 of 2012 provides the basis for handling children in conflict with the law (ABH) through a restorative justice approach. This approach resolves problems by involving all relevant parties for recovery, not revenge. Diversion, as part of restorative justice, transfers settlements outside of court to reduce negative impacts on children. However, understanding of diversion remains limited among the families of both perpetrators and victims, making the role of law enforcement officers (LEOs), particularly in the Polewali area of West Sulawesi, crucial to achieving this goal.

Abstract

With the increasing population and consumption activities, Semarang City generates approximately 1,110–1,200 tons of waste daily, all disposed at the Jatibarang Final Processing Site (TPA). This study employs an empirical juridical approach using qualitative methods, including interviews with the Environmental Agency (DLH) and field observations. Findings show that DLH’s waste management practices do not fully comply with Regional Regulation No. 6/2012, particularly Article 22 on final-stage principles. Due to budget constraints, controlled landfill is used instead of sanitary landfill. Despite efforts in public education, infrastructure development, and green technology planning (PSEL), systemic improvements and broader community participation remain essential.

Abstract

 This study aims to analyze law enforcement against the criminal act of road blockades carried out during demonstrations, particularly in the jurisdiction of the Bima Police, West Nusa Tenggara. In a democratic country, demonstrations are a fundamental right guaranteed by law, but their implementation must remain within legal boundaries to avoid disrupting public order. This research employs an empirical legal method with statutory and sociological approaches. Data were obtained through interviews and field observations, as well as literature studies on relevant laws and legal references. The findings indicate that road blockades conducted illegally—such as placing stones, wood, or burning tires on public roads—constitute criminal offenses. These actions violate provisions under Article 192 of the Indonesian Penal Code (KUHP), Article 63 of Law No. 38 of 2004 on Roads, and Article 274 of Law No. 22 of 2009 on Road Traffic and Transportation. In addition, violators may also be subject to sanctions under Law No. 9 of 1998 and Police Regulation No. 7 of 2012. In the Bima Police case, law enforcement authorities applied persuasive and, when necessary, limited repressive measures in accordance with legal procedures to resolve traffic obstruction caused by demonstrations. The study highlights the importance of balancing democratic freedoms with firm law enforcement to safeguard public interest and order.

Abstract

This research analyzes online gambling crimes involving children and their legal implications. The growing presence of online gambling poses risks to children's mental, social, and economic aspects. A normative juridical approach is used by analyzing related regulations, such as Law No. 1 of 2024 on Information and Electronic Transactions and Law No. 35 of 2014 on Child Protection. The findings indicate that online gambling is subject to criminal sanctions, with the crucial role of parents, the government, and society in prevention. Recommendations are also made to tighten supervision and enhance legal understanding among children and teenagers.
