Abstract

The development of information technology in the health sector has triggered the need for a strong and integrated patient personal data protection system. In the midst of the digital transformation of hospitals, the vulnerability to data leaks is increasing. The problem faced is how positive legal provisions in Indonesia regulate the protection of patient personal data in hospitals in the context of digital transformation and what challenges hospitals face in implementing regulations on patient personal data protection, and what efforts can be made to overcome them in the digital era. The research method used is normative juridical legal research. The results of the study show that positive legal provisions in Indonesia that regulate the protection of patient personal data include Law No. 27 of 2022 concerning Personal Data Protection which classifies health data as sensitive data, Law No. 36 of 2009 concerning Health which guarantees the confidentiality of medical information, and Permenkes No. 24 of 2022 concerning Medical Records which requires hospitals to maintain data security, both manual and digital. These provisions are the legal basis in the era of digital transformation of health services. The main challenges for hospitals are minimal infrastructure, low understanding of human resources, cyber threats, and overlapping regulations. Solution efforts: technology improvement, HR training, appointment of DPO, and preparation of SOPs and routine audits.

Abstract

Restorative justice in Indonesia is regulated differently by the Police, the Prosecutor's Office, and the Supreme Court without synchronization, resulting in inconsistent norms. This has an impact on implementation that is not in line with the criminal justice system, because case resolution is still carried out partially according to the rules of each institution. This study aims to analyze and determine the regulation of restorative justice in the current Indonesian criminal justice system; analyze inconsistencies in the regulation of restorative justice in Indonesia; and analyze steps that can be taken to overcome the inconsistency of restorative justice regulations in the criminal justice system in Indonesia. This study uses a normative legal research method that is descriptive analytical with a statutory approach and a conceptual approach. The data used are secondary data including primary, secondary, and tertiary legal materials obtained using literature study and document study techniques. The data collected are analyzed qualitatively and conclusions are drawn seductively. Based on the results of the study, the regulation of restorative justice in the Indonesian criminal justice system has been regulated in various legal instruments such as the SPPA Law, the 2023 Criminal Code, as well as regulations from the Police, Prosecutor's Office, and the Supreme Court. However, normatively, the regulation is still sectoral and not yet integrated, thus causing inconsistencies in norms and procedures between law enforcement agencies and potentially violating the principle of legal certainty. To overcome this, an integrated legal umbrella is needed that binds across sectors, synchronization of regulations, changes in the implementation mechanism that are integrated and oriented towards victim recovery, as well as strengthening coordination, supervision, apparatus capacity, and ongoing public socialization.

Abstract

The Complete Systematic Land Registration Program (PTSL) is a government effort to accelerate land registration, including in Bantul Regency. This study examines its implementation by analyzing each stage, from planning to certificate submission. The study also identified supporting factors, such as community participation and clear regulations, as well as inhibiting factors such as inherited land and disputed land. With more than 90% of land certified, PTSL has proven effective in improving land administration and legal certainty over land ownership in Bantul Regency.

Abstract

This article discusses a comparative analysis of the gold installment product offered by Bank Syariah Indonesia (BSI) from the perspective of Islamic law and Indonesian positive law. The gold installment product is a form of innovation in Islamic financial services that combines Islamic principles with modern market needs through the murābaḥah contract scheme. In Islamic law, transactions of usurious commodities such as gold require strict requirements to avoid usury and gharar. Meanwhile, in the Indonesian positive legal system, the legality of this product is determined by compliance with formal regulations, including Law Number 21 of 2008 concerning Islamic Banking and supervision by the Financial Services Authority (OJK). This study uses a normative approach with a descriptive-analytical method to examine the meeting point and potential disharmony between the two legal systems. The results of the analysis show that there is consistency in principle in the aspects of prudence, transparency, and the prohibition of usury, but there are still gaps in implementation, especially if the contract is only carried out formally without considering the substance of ownership and the validity of the transaction according to sharia. Therefore, the synergy between DSN-MUI fatwas, OJK regulations, and Islamic banking operational practices needs to be strengthened to ensure substantive compliance with the two applicable legal systems.

Abstract

Breach of contract disputes is one of the problems that often occurs in civil legal relations, especially in agreements. Breach of contract occurs when one party to the agreement does not fulfill its obligations as agreed. This study aims to analyze the mechanism for resolving breach of contract disputes from the perspective of Indonesian civil law. The research method used is normative juridical, with an approach through literature studies of relevant laws and regulations, doctrines, and court decisions. The results of the study indicate that the resolution of breach of contract disputes can be carried out through two channels, namely litigation (court) and non-litigation (alternative dispute resolution), such as mediation, arbitration, or negotiation. The choice of settlement mechanism is highly dependent on the agreement of the parties, time effectiveness, costs, and confidentiality. In practice, although the court is still the main choice, the use of non-litigation mechanisms is increasing because it is considered more efficient and flexible. This study is expected to contribute to the development of civil dispute resolution practices in Indonesia.

Abstract

This case study examines the obstacles to the execution of religious civil court decisions due to clerical errors in the dispositive part of the decision, specifically in Decision Number 2499/Pdt.G/2018/PA.JB. The research employs a normative juridical approach using a library research method, analyzing relevant legislation, legal doctrines, and jurisprudence. The findings reveal that clerical errors, even if they do not alter the substance of the case, can create legal uncertainty, hinder execution, and force the aggrieved party to undergo additional legal processes, such as a Judicial Review and a new lawsuit. This highlights that clerical errors are not merely administrative issues but also impact justice and the effectiveness of the law. The study recommends increased diligence in reviewing and correcting the dispositive part of decisions, developing efficient repair mechanisms, raising public legal awareness, developing standards and guidelines for writing dispositive parts of decisions, and improving the quality of human resources in the religious court system.

Abstract

This study analyzes the internal sovereignty of the Indonesian government in the implementation of cooperation in Islamic boarding school funding programs as regulated in Article 46 of Law Number 18 of 2019 concerning Islamic Boarding Schools. to find out what challenges and obstacles the government faces in maintaining internal sovereignty in the Islamic boarding school funding program, to find out how to implement Article 46 of the Islamic boarding school law from the perspective of state sovereignty. This study uses a normative juridical method with a statutory and conceptual approach. The results of the study indicate that the implementation of the Islamic boarding school funding program based on Article 46 of the Islamic Boarding School Law requires a balance between openness to external funding sources and protection of the government's internal sovereignty in determining the direction of Islamic boarding school education policy. The main challenges identified include the potential for foreign interest intervention, financial dependence, and harmonization of funding policies with the characteristics and independence of Islamic boarding schools. This study recommends strengthening the supervisory mechanism, preparing comprehensive derivative regulations, and a funding cooperation model that focuses on strengthening the autonomy and independence of Islamic boarding schools.

Abstract

The eradication of narcotics crime is a national priority due to its impact on public health, social stability, the economy, and national security. This study aims to examine state sovereignty through the harmonization between the National Narcotics Agency and the State Intelligence Agency in combating narcotics crimes. The research uses a normative juridical method with the theory of the rule of law and law enforcement theory. The results show that cooperation between the two institutions is not yet optimal due to overlapping authorities and lack of integrated intelligence data, requiring regulatory strengthening and systematic inter-agency coordination.

Abstract

This research aims to analyze the legal politics of digital banking in Indonesia in the context of protecting the personal data of digital banking customers. The method employed in this study is normative juridical, using statutory and conceptual approaches. The legal politics of digital banking in Indonesia are directed towards providing legal protection for customer data amidst the rapid development of financial technology. The government has formulated various regulations, such as the ITE Law and regulations issued by the Financial Services Authority, to safeguard the digital banking system from cybercrime. Nevertheless, challenges remain in implementing these regulations due to infrastructural disparities and low levels of digital literacy among the public. In addition, coordination between law enforcement agencies and financial authorities needs to be strengthened to ensure effective customer protection. Therefore, digital banking legal policies must be responsive to technological advancements and capable of upholding consumer rights. In conclusion, regulatory harmonization and institutional capacity-building are essential to achieving optimal legal protection in the digital banking sector.

Abstract

The advancement of digital technology has posed new challenges in personal data protection, especially in the banking sector where sensitivity and trust are crucial. With increasing reliance on digital financial services, personal data has become highly vulnerable to misuse. Public trust in banking institutions depends on their commitment to safeguarding the confidentiality and security of customer data. Existing regulations, though evolving, have not yet fully addressed the growing threat of cybercrime. This study aims to examine the urgency of legal protection for personal data in the banking sector in the digital era. The research uses a normative juridical method with statutory and literature approaches. Findings show that although various laws such as the Indonesian Electronic Information and Transactions Law, the Personal Data Protection Law, and Financial Services Authority regulations exist, their implementation still faces major obstacles, particularly in supervision, sanctions, and technological safeguards. The principles of trust and confidentiality form the basis of bank-customer relationships, yet are often not supported by adequate digital protection systems. Integration between national legal norms and international standards, such as the APEC Privacy Framework, is essential to enhance data security. Therefore, government and financial authorities must strengthen cybersecurity systems, clarify legal consequences for violations, and ensure full compliance with data protection principles to build customer trust and maintain financial system stability.
