Abstract

The case of Mary Jane Veloso, a Filipino domestic worker sentenced to death in Indonesia for drug trafficking, highlights systemic failures in ensuring justice, legal certainty, and utility. Despite claims of being an unwitting victim of human trafficking, she faced trial with inadequate legal counsel and translation, raising concerns about due process and fairness. Viewed through Natural Law Theory, her case demonstrates a disregard for universal morality and human dignity. The analysis underscores the urgent need for legal reform in Indonesia to address procedural flaws, recognize trafficking contexts, and prioritize rehabilitation over retribution in line with human rights standards.

Abstract

In Indonesia, drug abuse and distribution are still serious problems. The absence of a threshold for drug possession for abusers causes ambiguity in law enforcement. This study analyzes the regulation of the threshold for drug possession for drug abusers as seen from two Karawang District Court Decisions used as comparative references so that there is a disparity in decisions reviewed from evidence that exceeds its abuse. Evidence can be used as a reference to determine whether the goods exceed the personal consumption limit. This study uses a normative legal approach by analyzing qualitatively, the results show that there is a lack of guidelines on the threshold for possession. Judges' interpretations often affect evidence, and inconsistent guidelines lead to differences in sentences.

Abstract

Various skincare products that do not have a distribution permit from the Food and Drug Supervisory Agency (BPOM), this study aims to analyze the role and effectiveness of the POM Agency in supervising and taking action against the circulation of skincare products and describing the legal protection situation for consumers. This study uses an approach that is an empirical juridical method, with primary data collection carried out through interviews with consumers and business actors. This study concludes that even though regulations related to Law No. 8 of 1999 have been enacted, there are still many obstacles and challenges in the field.

Abstract

Judicial review (PK) is an extraordinary legal effort that allows criminal cases to be reopened even though they already have permanent legal force (res judicata). This mechanism aims to correct judicial errors that can occur due to novum, judge's error, or conflicting decisions. However, in the Indonesian legal system, PK can only be submitted by the convict or his heirs, which has given rise to debate regarding limited access to justice. This study highlights the relevance and implications of these limitations and compares them with legal systems in other countries, such as Germany, which implements the Wiederaufnahme des Verfahrens mechanism in the Strafprozessordnung (StPO). Through comparative analysis, it was found that the Indonesian legal system still has normative ambiguity in determining the limits of judge error and the category of novum that can be used as the basis for a PK. This study proposes a reformulation of the PK concept that is more inclusive, by expanding the subjects who have the right to apply for a PK not only limited to the convict or his heirs, but also other parties who have legal interests. In addition, stricter regulations are needed regarding the limits of judge error and the validity of the novum, as implemented in Article 359 of the German StPO.

Abstract

Marriage in Indonesia is regulated by Law Number 1 of 1974 concerning Marriage in conjunction with Law Number 16 of 2019. One form of dissolution of marriage is through divorce decided by the court. This study examines the application of the principle of ne bis in idem in divorce cases, namely the legal principle that prohibits the retrial of the same case that has obtained permanent legal force. This study found differences in academic opinion regarding its application in divorce cases. Some legal experts argue that ne bis in idem applies in divorce cases, while others consider this principle inappropriate to apply considering the dynamics of emotional relationships and the possibility of new legal facts emerging. This study also discusses the regulation of divorce law in Indonesia, both for Muslims and non-Muslims, divorce procedures, and the legal consequences that arise, such as child custody and division of joint property. The findings indicate the need for special regulations, for example through a Circular of the Supreme Court, to provide legal certainty in the application of the principle of ne bis in idem in divorce cases.

Abstract

Pretrial motion in Indonesia, inspired by the principle of habeas corpus, has the authority to test the legality of law enforcement actions, including searches and seizures. However, this mechanism is *post-factum* and limited to formal aspects, such as the completeness of the warrant, without assessing the material requirements that determine the legality of the action. This limitation has the potential to cause injustice, especially in cases of urgent searches and seizures, where officers often act without prior court permission. This study aims to reconstruct the authority of pretrial motion by integrating the Plain View Doctrine (PVD), a doctrine from the common law system that allows the seizure of evidence without a warrant if it meets three requirements: (1) officers are legally present at the location, (2) the evidence is clearly visible (immediately apparent), and (3) there is a probable cause that connects the object to the crime. The research method used is normative juridical with a conceptual and statutory approach. The results of the study indicate that the application of PVD can strengthen the pretrial control function by expanding the scope of testing from merely formal to substantial aspects. In addition, this study proposes the optimization of digital systems such as *E-Berpadu* to accelerate the licensing process in urgent circumstances. Thus, the reconstruction of pretrial authority based on PVD is expected to ensure a balance between the effectiveness of law enforcement and the protection of human rights.

Abstract

A medical certificate (sick note) is a document often requested by patients as an administrative requirement for their absence from work or education due to illness. However, the request for this note is often misused, whether by patients, supervisors, or medical personnel. This article discusses how the request for a sick note is viewed from Indonesian civil law’s perspective, including when the note is requested with a backdated date or under pressure/intimidation. This study also compares regulations in Germany and Japan as a basis for system improvement. Through a juridical-normative approach and literature review, it is found that such actions can be classified as unlawful acts that have implications for the civil liability of various parties. This article recommends the establishment of specific regulations to regulate the issuance of sick notes within the framework of civil legal protection and medical professional ethics.

Abstract

Mut’ah marriage or contract marriage is a temporary marriage that is carried out in a secret manner. It is often done for sexual and economic reasons. From the perspective of positive Indonesian law, mut’ah marriage is contrary to the essence of eternal marriage as stated in the Marriage Law and the Compilation of Islamic Law. From the perspective of Islamic law, mut’ah marriage is declared haram by the majority of scholars because it is not in accordance with the purpose of marriage which prioritizes continuity, responsibility, and protection of the rights of the wife and children. Mut’ah marriage can also give rise to several criminal problems such as adultery, embezzlement of the origin of marriage, and other criminal acts. This study was conducted to examine the urgency of the probability of criminalization of perpetrators of mut’ah marriage.

Abstract

Inheritance law is closely related to various aspects of human life, as every individual will inevitably encounter the legal event of death. Upon the death of a person, land ownership certificates forming part of the estate are transferred to the heirs. Heirs may initiate a name transfer and certificate splitting process if there are multiple heirs. This study is a normative juridical legal research with a descriptive nature. The research employs a statutory approach and a case approach. The data used is secondary data, consisting of primary, secondary, and tertiary legal materials. Data collection techniques involve literature study, and data collection tools include document review. The data gathered is analyzed qualitatively. The findings indicate that the splitting of land certificates inherited from the deceased can be legally valid without the consent of all heirs, provided there is a court ruling in which one of the heirs has filed a lawsuit. The legal consideration of the judges in case number 137/Pdt.G/2023/PN.Mdn essentially explains that the Panel of Judges ultimately granted the Plaintiffs’ claim in full and validated the splitting of the inherited land certificate, despite the absence of the Defendants’ signatures.

Abstract

Diversion is an alternative to formal criminal proceedings for juvenile offenders that focuses on restorative justice. In decision No. 10/Pid.Sus Anak/2024/PN Unr, a procedural settlement was attempted, but it failed due to the economic disparity between the perpetrator and the victim. Despite the fact that the peace process had not proceeded smoothly, the judge still imposed a non-criminal sentence to safeguard the child's future. This study indicates that the success of diversion does not solely depend on legal procedures but also on the social readiness and fairness of the parties involved in resolving the conflict equitably. A deep understanding of the importance of restorative efforts is crucial for the effective implementation of diversion.
