Abstract

The Village Fund is a strategic instrument to promote the development and welfare of rural communities, as stipulated in Law Number 6 of 2014 concerning Villages. However, its implementation is often hampered by aspects of transparency, accountability, and community participation. This article examines the implementation of the Village Fund program in Boro Village, Sanggar District, Bima Regency, from a legal perspective using an empirical juridical approach. The results indicate that implementation is suboptimal due to weak apparatus capacity and minimal community participation. The principles of transparency and accountability have not been fully implemented. Regulatory strengthening, capacity building, and community oversight and participation are needed for the Village Fund to have a significant impact.

Abstract

Legal protection for landowners holding land title certificates is a fundamental aspect of Indonesia's land system, which is normatively guaranteed through Law concerning Basic Regulations and Government Regulation, The research method employed is normative juridical approach conducted through literature study to obtain secondary data. certificates function as strong evidence. However, in practice, legal uncertainty still exists due to various factors such as land disputes, overlapping certificates, and weak supervision systems in the land registration process. Analysis of Supreme Court Decision Number 309 PK/Pdt/2021 shows that the Panel of Judges reinforces legal protection for certificate holders who registered legitimately and in good faith by applying the principle of registration time priority, where the party who registers first has stronger rights. This decision also affirms the rejection of overlapping certificates containing legal defects to strengthen legal certainty in the land system.

Abstract

The Regional Secretary (Sekda) has a strategic role in the implementation of local government as the highest leader of the civil service and the driving force of the bureaucracy. However, in practice, the replacement of the Sekda by a new head of region often causes controversy, especially if it occurs within the first six months of the term. Based on Law Number 10 of 2016, newly appointed regional heads are prohibited from replacing officials, including the Regional Secretary, within six months of their appointment, except with written approval from the Minister of Home Affairs. This study aims to examine this restriction from a legal perspective and its implications for the principle of the rule of law. The research method used is normative juridical, with an approach based on regulations and the principles of state administrative law. The results of the study indicate that the limitation aims to prevent the abuse of power, maintain bureaucratic neutrality, and ensure the continuity of a professional and accountable government. However, in Article 162 paragraph (3) of the Regional Election Law, there is a lack of legal certainty; the regulation should end at the time of the election organizers, so the actions of the newly appointed regional heads are no longer under the legal authority of the Regional Election Law.

Abstract

Land disputes are a common legal problem in Indonesia, especially related to land ownership and use. Conflicts often arise due to overlapping interests between Land Use Rights (HGU) holders and communities claiming rights to the land. One prominent case is the dispute between PT. Emha as the HGU holder and the Sekar Rukun Farmers Group in Sei Suka District, Batu Bara Regency. This study uses an empirical legal approach, a research method that not only examines written legal norms or rules but also examines how the law applies in practice in society. This dispute reflects the complexity of agrarian issues in Indonesia, such as weak land administration, lack of community participation in licensing, and legal uncertainty for small farmers. Dispute resolution has taken administrative, civil, criminal, and even involved independent institutions such as Komnas HAM, showing the importance of reforming agrarian policies that are more in favor of social justice.

Abstract

The simultaneous election of Village Heads (Pilkades) in South Konawe Regency on September 24, 2023 is crucial after the issuance of Law Number 3 of 2024. Although the Constitutional Court in Decision Number 92/PUU-XXII/2024 stated that the Regional Elections were in accordance with Law Number 6 of 2014 concerning Villages, the facts are contrary to Article 32 paragraph 1 of the Village Law regarding the notification of the end of the term of office of the village head. This research aims to analyze the Constitutional Court's considerations in case 92/PUU-XXII/2024 from the perspective of justice and the principle of the rule of law. This research employs a normative legal method, utilizing both a statutory approach and a case approach, with a focus on examining Article 118, letter e of Law Number 3 of 2024. The Constitutional Court judge's consideration that the Regional Elections in South Konawe were by the Village Law factually contradicted Article 32 paragraph 1 of Law Number 6 of 2014. A total of 94 village heads still have 7 months remaining in office and 2 other village heads 14 months when the election is held, even though the notice of term of office should have been made 6 months in advance. This makes the Constitutional Court's consideration juridically flawed and contrary to the principle of the rule of law, so that the applicant's application should be rejected.

Abstract

The purpose of community service with the title is to understand the important role and strategy of school teachers in instilling anti-corruption. so that teachers can be agents of change in their schools for anti-corruption. After a long time moving for students, teachers play a strategic role. Because teachers are continuously in schools. To measure how much teachers understand anti-corruption for younger generation for a new sky and a new earth in the future that is free from corruption. from the pre-test it is known that only about 10% of teachers have received material on anti-corruption and have anti-corruption activities in schools that continue to exist until now and only a few are no longer there. What already exists in schools must be maintained and developed while continuing to motivate teachers / schools that do not yet have anti-corruption activities. Anti-corruption education in this city with a game model obtained from the Indonesian KPK-SPAK is indeed new. Anti-corruption models with games must continue to be developed together with new partners, the regional inspectorate of this city is valuable, especially in the post-test participants were known to get new ideas to carry out and develop anti-corruption, even though the school curriculum has not accommodated it.

Abstract

This research analyzes the overlapping case of HGB Certificate Number 00538/Lingkuang Aua under PT. PLN's name with 11 community property rights certificates in West Pasaman Regency. The overlap occurred due to manual administration systems in 1994, loss of PT. PLN's HGB documents, and land abandonment for 25 years. The community has physically occupied the land for residential purposes and obtained certificates through complete procedures. Consequently, both parties cannot conduct legal transactions on their land due to dispute status. The Land Office neglected to supervise abandoned land and failed to prevent overlapping certificate issuance. Mediation resolution failed, requiring settlement through Administrative Court to obtain binding legal certainty.

Abstract

Certificates serve as valid proof of ownership under Indonesian law with the primary objective of providing legal certainty’. However, why is it that a land certificate must sometimes be annulled? Such situations may lead to ambiguity in legal implementation and result in a lack of legal certainty and protection for certificate holders. This study raises several legal issues: How is the application of the negative publication system with a positive tendency in land registration able to ensure legal certainty over the status of land certificates issued by the Land Office? How should the legal reasoning of judges in annulling Certificate of Ownership No. 212/Pasar Pangururan through Decision No. 35/G/2020/PTUNMDN be analyzed in relation to the value of justice? What are the legal responsibilities of the Head of the Land Office of Samosir Regency in issuing Certificate of Ownership No. 212/Pasar Pangururan to the aggrieved party?. This study is a normative juridical research employing a descriptive analytical approach. he findings indicate that the implementation of the negative publication system with a positive tendency in land registration has not yet maximally provided legal certainty regarding the status of ownership certificates issued by the Land Office, as such certificates can still be subject to legal challenge

Abstract

Land acquisition for infrastructure development in Indonesia as a developing country often leads to disputes regarding compensation determination, as in the case of Bener Dam in Purworejo Regency decided through Supreme Court Decision Number 1382 PK/Pdt/2022. This normative legal research with a descriptive-analytical approach examines compensation mechanisms based on legislation, the validity of deliberations in determining compensation, and legal considerations in dispute resolution. The results indicate that legal defects in compensation determination can occur due to non-communicative deliberation procedures, non-compliance with Law No. 2 of 2012, or violations of time limits. The Supreme Court rejected the judicial review application because the applicants failed to file objections to the District Court within 14 days as required by the applicable Supreme Court Regulations.

Abstract

Abandoned land is a serious problem in land management in Indonesia that requires appropriate supervision and control mechanisms. This research analyzes the annulment of decisions on the determination of abandoned land originating from Building Use Rights through a case study of Decision Number 150/G/2019/PTUN-JKT. The research method uses a normative juridical approach with court decision analysis. The research results show that the annulment of the decision was caused by violations of administrative procedures and administrative law principles, particularly in the identification, evaluation, and warning stages. This research concludes the need to apply the principle of prudence and good governance in determining abandoned land to ensure legal certainty and protection of rights.
