Abstract

The background to this research is that the enactment of Law No. 30 of 2014 concerning State Administration has provided space for public advocacy lawsuits, such as citizen lawsuits and class actions, to be included in the disputes in state administrative courts. This demonstrates the government's commitment to upholding citizens' rights as subjects who can participate in reviewing and controlling government policies. However, the resolution of citizen lawsuits continues to be fraught with various obstacles, one of which is the overlapping dualism of adjudicating authority between general courts and state administrative courts. Based on this description, it is important to further examine the urgency of citizen lawsuits within the framework of welfare law. The objectives of this research are: a) to explain the implementation of citizen lawsuits in general in Indonesia; b) to explain the urgency of citizen lawsuits within the framework of a welfare state. The stages of this research method are divided into three: preparation, implementation, and completion. Starting from the preparation stage during the pre-research phase, literature related to legal issues related to citizen lawsuits was collected to formulate the research problem. The second phase is the implementation phase, which continues with a literature review aimed at reconceptualizing citizen lawsuits in resolving state administrative disputes. The next step is to develop a concept by synchronizing the laws of the State Administrative Law and the State Administration Law.

Abstract

This article examines the legal challenges of interfaith marriage in Indonesia through a juridical and philosophical approach, focusing on the disharmony between positive law, constitutional principles of religious freedom and the right to form a family, and the value of pluralism. Article 2 paragraph (1) of Law No. 1 of 1974, which requires that marriage validity be based on each party’s religious law, often becomes a legal barrier for interfaith couples. Through an analysis of the Ramos Petege case, Constitutional Court rulings, and Supreme Court Circular No. 2 of 2023, this article reveals the absence of a clear legal mechanism for recognizing the legality of interfaith marriage. The study applies legal theories from prominent legal philosophers, including Hugo Grotius’ natural law, Lon L. Fuller’s morality of law, and the principle of Bhinneka Tunggal Ika, to examine the gap between positive law and substantive justice. The findings indicate that Indonesia’s legal system remains influenced by religious interpretations, lacks inclusivity, and fails to ensure equal protection of individual rights in a multicultural society. Therefore, legal reform through more progressive legislation and judicial interpretation is necessary.

Abstract

This study examines the acquittal decision in Case Number 93/Pid.Sus-LH/2024/PN Pdl concerning the alleged possession of Javan rhino horn, a species protected under Indonesian law. Despite the presence of electronic evidence, the court ruled that the criminal elements were not proven beyond reasonable doubt. Juridical analysis shows that the legal framework, particularly Undang-Undang Nomor 5 Tahun 1990, is normatively strong but weak in implementation. The decision reflects a gap between ecological justice and formal legal interpretation. Strengthening judicial capacity and integrating ecological perspectives are essential to ensure optimal protection of endangered species.

Abstract

Beauty clinics are growing very rapidly in Indonesia but have many negative sides, sometimes patients experience side effects in their use and actually worsen the patient's beauty condition. This research delves into the nature of the doctor-patient interaction and the factors that give rise to consumer lawsuits over filler procedures that end up costing people money. From a Normative Juridical perspective, the research demonstrates that filler operations are founded on inspanning verbintenis, a legal connection between patients and doctors that establishes rights and responsibilities for both parties. The patient can seek material and immaterial damages as compensation in an action for Unlawful Acts based on Article 1365 of the Civil Code if they suffer losses as a result of a doctor's filler operations.

Abstract

The changing global order and the growing interaction among nations demand a governance system capable of adapting to globalization dynamics without neglecting the principle of national sovereignty. In this context, examining regional government law becomes crucial to ensure that the implementation of regional autonomy remains consistent with Indonesia’s constitutional framework. This study aims to identify the role of regional autonomy in the governance system amid globalization. The research employs a normative juridical method with statutory and conceptual approaches. The data consist of secondary sources, including legislation, books, academic journals, and other relevant official documents. The results show that the implementation of regional government law aligns with Indonesia’s constitutional system in the globalization era. The manifestation of democratic and autonomy principles is evident through the decentralization of local governance, although the central government retains the main responsibility for regional administration. The novelty of this study lies in its comprehensive analysis of how globalization challenges Indonesia’s regional governance framework, emphasizing the need to strengthen regional government law to enhance independence, accountability, and public welfare. The findings imply that legal reform at the regional level is essential to balance local autonomy with national integration in facing global pressures.

Abstract

Taxes are the primary source of state revenue, serving as a tool for financing development and regulating the economy. Local governments have the authority to provide tax incentives to attract investment; however, without clear regulations, this may potentially reduce regional revenue. This study discusses the urgency of regulating tax incentives and implementing maximum limits to ensure effectiveness, fairness, and support for sustainable development. The findings indicate the need for rules regarding the forms, mechanisms, criteria, and limitations of tax incentives to maintain regional fiscal stability. Proper tax incentive regulation is a key strategy to enhance investment and improve public welfare.

Abstract

Divorce is the termination of a marriage by a court decision or at the request of one of the partners. One of the impacts of a failed marriage due to divorce is related to custody. Determination of the granting of child custody due to divorce should be carried out by applying the principle of the best interests of the child (Best Interest of Child) because basically the relationship between children and parents is not broken due to divorce. The consequence of the end of a marriage due to divorce is that both the mother and father are still obliged to care for and educate their children, solely based on the interests of the child if there is a dispute regarding the control of the children, the court makes a decision. The research method used in this study is the doctrinal method, using the type of normative juridical research. The results of the study indicate that the Supreme Court Decision Number 395 K/AG/2020 did not apply Article 105 of the Compilation of Islamic Law which states that children who are not yet 12 years old or not yet mummayiz are the rights of their mothers. However, the author believes that Article 105 letter a of the Compilation of Islamic Law can be applied to this case because in this decision, both in the considerations and evidence, there is nothing that can cause the mother to lose custody of the child. This is also reinforced by the fact that the divorce was filed on the husband's initiative and it was not proven that the wife was the cause of the rift in the household.

Abstract

In this study, the legal consequences of Notarial Deeds related to incorrect documents submitted by the appearers to the Notary and the Notary's legal protection in the use of exoneration clauses are discussed. From the research results, it can be obtained that the legal consequences of an authentic deed that is intentionally made with false information included, the Notarial Deed is null and void by court decision and the Deed becomes null and void by law its evidentiary force from the original authentic Deed to a Deed under hand and the inclusion of an exoneration clause as a form of legal protection for the Notary is not a guarantee of certainty for the Notary so that he will not be sued or sued in civil or criminal cases.

Abstract

The Constitutional Court Decision No. 83/PUU-XXII/2024 declares Article 251 of the Indonesian Commercial Code conditionally unconstitutional. Consequently, annulment of contracts, particularly insurance agreements, is unconstitutional unless based on mutual consent between the insurer and the insured, or by court ruling. The Court emphasized that Article 251 contradicts principles of justice, legal certainty, and consumer protection guaranteed by the 1945 Constitution. This decision reinforces that annulment of insurance contracts cannot be imposed unilaterally but must reflect a fair balance of rights, thus strengthening constitutional protection for consumers in contractual relations.

Abstract

Public participation is a vital element in a democratic rule of law as it ensures the involvement of society in the legislative process. In the Indonesian legal system, this principle is regulated under Law No. 12 of 2011 on the Formation of Legislation as amended by Law No. 13 of 2022, which grants the public the right to provide input, either orally or in writing, at every stage of lawmaking. The Constitutional Court, through Decision No. 91/PUU-XVIII/2020, emphasized that meaningful public participation must be carried out from the planning stage, be open and inclusive, and ensure that every public input is substantively considered. In the context of the Draft Law on the Indonesian National Armed Forces (RUU TNI), various perspectives have emerged regarding the extent to which these principles are truly implemented, particularly with respect to transparency and civil society involvement. This situation raises important juridical and sociological considerations regarding the benchmarks of meaningful participation as well as its implications for the validity of legislation and its acceptance within society.
