Abstract

This agreement essentially constitutes a sale of services that binds the parties to fulfill their obligations in accordance with the terms of the contract. However, in practice, discrepancies in the contract terms occur, resulting in a breach of contract, primarily by the Developer. Common forms of breach include delays in construction and building specifications that do not conform to the agreement. A concrete case occurred between Iin Sulhiah and PT. Graha Artha Kencana, which was reported to the Consumer Dispute Settlement Body (BPSK) WKP II Banten for alleged breach of contract. The purpose of this study is to understand the dispute resolution mechanism for consumer complaints regarding Developer’s breach of contract in the shop-house credit agreement handled by BPSK WKP II Banten, and to examine the responsibility of the business actor to the harmed consumer based on Law Number 8 of 1999 concerning Consumer Protection. The research method used is normative legal research with a juridical normative approach. In this study, the researcher uses statute approach and case approach. The researcher also uses primary legal materials obtained through interviews, secondary legal materials from literature, and tertiary legal materials. Data collection techniques used in this research include literature study and qualitative descriptive data analysis. The research results conclude that consumer dispute resolution regarding the developer's breach of contract in a shop-house (ruko) credit agreement through non-litigation at BPSK (Consumer Dispute Settlement Agency) by means of mediation has proven to be ineffective. This is because no agreement was reached between the parties during the hearing process. Therefore, a more effective resolution is through arbitration, namely by fully submitting the dispute resolution to BPSK to be decided by the Panel, thereby allowing an agreement to be reached between both parties. Business actors are held responsible for breaches of contract in standard agreements that cause harm to consumers. In accordance with Law Number 8 of 1999 concerning Consumer Protection, there is legal accountability imposed on business actors.

Abstract

This research discusses the absence of severance pay provisions in the Collective Labor Agreement (CLA) between workers and employers, as well as its legal implications, with a focus on the Decision of the Industrial Relations Court of Yogyakarta No. 19/Pdt.Sus-PHI/2022/PN Yyk. Severance pay is a right granted to workers who experience termination of employment (dismissal) not due to serious misconduct. However, in practice, many CLAs do not explicitly include such provisions. This raises issues when termination occurs, particularly concerning legal certainty and the protection of workers' rights. This study discusses the registration of marriage agreements in the city of Serang from the perspective of law number 16 of 2019 concerning amendments to law number 1 of 1974 concerning marriage and the Constitutional Court Decision number 69/PUU-XIII/2015. A marriage agreement is a written agreement between a prospective husband and wife made before or during the marriage period to regulate the separation of property, responsibilities, and rights of each party. This Agreement is valid if it is notarized and registered in accordance with the provisions of applicable law. The purpose of this study is to find out and analyze the process of registering marriage agreements in the city of Serang before and after the Constitutional Court Decision Number 69/PUU-XIII/2015 and to find out and analyze the legal consequences if the marriage agreement is not registered in accordance with the Constitutional Court Decision Number 69/PUU-XIII/2015. In this method, the approach used is normative juridical In this study, the researcher also uses the approach, the statute approach, the conceptual approach, the case approach, In this study, the researcher also uses Primary legal materials, secondary legal materials and Tertiary legal materials. The data collection technique used in this study is by literature study, qualitative descriptive data analysis procedures. The results of the study show that marriage agreements made before marriage must be registered before the date of marriage registration in order to have legal force, while marriage agreements made after marriage must be ratified and must also be registered in order to bind third parties. Registration functions an important function in ensuring legal certainty, transparency of assets, and legal protection for the parties. In conclusion, the registration of marriage agreements, both before and after the Constitutional Court Decision Number 69/PUU-XIII/2015, has an important role in providing legal certainty, binding power, and legal protection for husband and wife and third parties. Without official registration, the agreement is only valid privately and has the potential to cause legal uncertainty, third-party losses, and abandonment in divorce, inheritance, or mixed marriage cases. Registration is not just an administrative formality, but an essential requirement for the agreement to be valid and recognized in the legal system and state administration

Abstract

This research examines the taxation between CV Utama Jaya Selular as a Taxpayer and the Directorate General of Taxes regarding the imposition of administrative fines based on Article 14 paragraph (4) of the Law on General Provisions and Tax Procedures on Tax Invoices (STP) for Value Added Tax (VAT) for the June 2020 Tax Period. The dispute focuses on the discrepancy in tax collection alleged by the Plaintiff for the delivery of Taxable Goods (BKP) to consumers according to the end. The research method used is the normative legal research method, namely research that emphasizes the study of laws and regulations, jurisprudence, and legal doctrine with a qualitative approach. The results show that the Plaintiff claims to have delivered BKP and issued a tax invoice in accordance with the regulations, without harming the state because the final buyer cannot credit VAT. On the other hand, the Defendant considers that there is a delivery to a buyer who is not the final consumer so that a standard invoice must be issued and violations are subject to administrative sanctions. The Tax Court stated that the invoice in question was valid because the buyer data was incomplete and the VAT reporting did not harm the state, so the STP and sanctions were canceled. The research emphasizes the importance of understanding the characteristics of end consumers and the provisions of tax invoices in the implementation of VAT and their impact on administrative sanctions, contributing to the tax law literature in Indonesia.

Abstract

The existence of an agreement that creates a contractual obligation subsequently imposes obligations that must be fulfilled by the parties, or what can be called performance. Performance arising from a contractual obligation must be carried out to prevent harm to the other party. This study aims to further examine the role of civil law principles and principles of transportation law in the delivery of goods. It is important for the parties to understand that their respective rights and obligations are regulated by applicable legal regulations.

Abstract

This research aims to analyze the underlying considerations of the judges in the Constitutional Court Decision Number 70/PHPU.BUP-XXIII/2025 and to examine law enforcement and oversight challenges in the 2024 Serang Regency Simultaneous Regional Elections based on Law No. 10 of 2016. The main focus is on violations of the neutrality of state apparatus that are structured, systematic, and massive (TSM), accompanied by political intervention and weak oversight coordination. It employs a normative legal method with a qualitative approach. The research results indicate the existence of TSM violations involving abuse of power by state officials, but law enforcement is hampered by the limited authority of the Election Supervisory Body (Bawaslu) and political intervention. This study recommends strengthening the role of the Constitutional Court, revising the Regional Election Law, and improving oversight synergy and legal protection for ASN to ensure democratic and accountable regional elections.

Abstract

The skincare industry in Indonesia has experienced rapid growth in recent years, leading businesses to innovate their beauty products and then promote or advertise them. However, many businesses are currently making exaggerated claims when promoting their products, and some even have products whose contents do not match their labels or promotional claims, causing consumers to suffer losses. The problem addressed in this study is how to regulate overclaiming and product inconsistencies based on the Consumer Protection Law and how to hold business actors accountable for such violations. The method used is normative legal research with a qualitative approach, based on the search and analysis of primary, secondary, and tertiary legal materials, which include legislation (particularly the UUPK and BPOM regulations in the field of cosmetics), legal literature, scientific journals, and other relevant sources. The results of the study show that the practice of overclaiming and product content inconsistencies in skincare products constitute violations of basic consumer rights, particularly the right to safety and the right to accurate, clear, and honest information. In the event of a violation, business actors can be held civilly liable through compensation obligations as stipulated in Article 19 of the UUPK, or criminally liable through the threat of sanctions under Article 62 in conjunction with Article 8 of the UUPK. The research findings also confirm that BPOM supervision and test results play a strategic role as the basis for law enforcement against business actors. Therefore, administrative, civil, and criminal sanctions are expected to have a deterrent effect and strengthen consumer protection in the skincare industry.

Abstract

The phenomenon of deepfake pornography has caused serious violations of women’s dignity and privacy in the digital sphere. This study examines the normative gap within Indonesian law, which has yet to explicitly regulate deepfake practices, despite their severe impacts including psychological trauma, social stigma, and reputational damage for victims. The findings indicate that the existing legal framework remains fragmented and ineffective, thus failing to provide comprehensive protection. Consequently, this research recommends reconstructing legal protection based on human rights, gender justice, and digital ethics. It concludes that new technology-responsive regulations are urgently needed to safeguard women’s rights and ensure victim recovery.

Abstract

Corruption is one of the very serious problems that almost every country in the world, including Indonesia, is currently facing. This crime not only harms the country's finances but also disrupts social relationships and governance, hinders national development, and undermines public trust in the government.   This study aims to discuss and examine the factors that cause the occurrence of corruption crimes in Indonesia. This research uses a literature study method that refers to books, scientific journals, legislation, and relevant documentation data. The literature analyzed in this study employs a descriptive qualitative approach to comprehensively understand the factors and aspects that are the reasons and causes of corruption crimes in Indonesia.   There are four aspects that contribute to the occurrence of corruption crime in Indonesia, and it is very difficult to address this issue without a strong and collective commitment to eradicate it. The aspects are: Political Aspect, Legal Aspect, Economic Aspect, and Institutional or Organizational Aspect. All of these aspects are closely interconnected, making it necessary to have solid synergy to eliminate corruption at its roots and achieve the aspirations desired by all Indonesian people.

Abstract

This study aims to evaluate the effectiveness of enforcing Buru Regency Regional Regulation No. 20 of 2011 on Waste Management and Sanitation Service Retribution. The research employed a qualitative approach with data collected through observation, interviews, questionnaires, and documentation. Data were analyzed using Miles and Huberman’s interactive model, which includes data reduction, data display, and conclusion drawing. The findings reveal that the enforcement of the regulation has not been fully effective. Public understanding of the regulation remains relatively low due to limited socialization, differences in educational background, and a lack of legal literacy. Institutionally, the number of supervisory officers is inadequate, resulting in weak monitoring and sanction implementation. Limited facilities and infrastructure also hinder effectiveness; only six garbage trucks are available, whereas the ideal requirement is twelve units. This shortage leads to uneven service distribution, particularly in rural areas. The study concludes that the enforcement of the regulation is ineffective due to weak socialization, insufficient infrastructure, and low public compliance. It is recommended that the local government increase the intensity of socialization, improve service quality, provide adequate facilities and infrastructure, and strengthen collaboration with communities to achieve sustainable cleanliness and sanitation services in Buru Regency.

Abstract

The attractiveness of apartment buildings for many parties, especially in urban areas with limited land, is undeniable. However, within these buildings, the possibility of issues such as damaged or deteriorating structures remains, which requires accountability from the owners of individual apartment units. This study explores the legal responsibility of building developers toward the owners of SHM Sarusun for building damage, as well as the legal actions available to SHM Sarusun owners. The research findings indicate that developers are obligated, in accordance with the Apartment Law, to maintain the building's quality and provide guarantees to owners. In case of damage, SHM owners are entitled to claim compensation through civil lawsuits, consumer mechanisms, or alternative dispute resolution.
