Abstract

The distribution of stepchildren's rights in inheritance according to Islamic law is an important thing that we must know and need to understand. The technique for preparing this article uses research from previous research results after collecting several journals and information that has been searched through social media. Stepchildren in Islamic inheritance law are not directly classified as heirs because there is no hereditary cause (asbabul miirats). (deliberation). As a result, according to the general view, stepchildren do not automatically have the right to inherit their stepparent's inheritance. However, by using other alternatives (other methods) in Islamic inheritance law, stepchildren will not lose their right to receive protection from their parents, as the inherited children of their biological father and mother. And in Islamic inheritance law, stepchildren can inherit assets from the marriage of their biological father or new mother (their new family) by means of Qiyas and Wasiat Wajibah in the amount of 1/3. The aim is to find out the position and understanding of stepchildren's inheritance rights in Islamic inheritance law and how to obtain a share of stepchildren's inheritance rights in Islamic inheritance law.

Abstract

Forest and land rehabilitation is one effort that can be made to overcome this problem. Mining activities always have positive and negative impacts. The positive impact is to spur the country's economic prosperity, while the negative impact is the emergence of environmental damage. The objectives of this research are: 1) to describe the implementation of Forest and Land rehabilitation policies in Seteluk District, West Sumbawa Regency. This research uses descriptive research with a qualitative approach, data collection techniques through interviews, observation and documentation, with key informants such as the Head of the West Sumbawa Regency LHK service, the Secretary of the Seteluk Sub District office, the Head of Kelanir Village, the head of Meraran Village. The research results show that the implementation of the Barapan Kebo cultural tourism promotion policy by the Regency government is in accordance with the policy implementation indicators according to Edward III, namely: 1) Communication, 2) Resources, 3) Disposition, 4) Bureaucratic Structure. Meanwhile, inhibiting factors are regulations, network development and funding. Community participation includes 1) planning role, 2) implementation role, 3) monitoring role, 4) evaluation role.

Abstract

Penelitian ini mengulas tentang Epistemologi Keadilan Hukum Waris Islam dalam Perspektif Filsafat Hukum Islam bahwa Hukum kewarisan Islam pada dasarnya berlaku untuk umat Islam di mana saja di dunia ini. Sungguhpun  demikian, corak suatu negara Islam dan kehidupan masyarakat di negara atau daerah tersebut memberi pengaruh atas hukum kewarisan di daerah itu. Pengaruh itu adalah pengaruh terbatas yang tidak dapat melampui garis-garis pokok dari ketentuan hukum kewarisan Islam tersebut. Namun pengaruh tadi dapat terjadi pada bagian-bagian yang berasal dari ijtihad atau pendapat ahli-ahli hukum Islam sendiri (Sajuti (1995)). Dalam ajaran Islam tidak membedakan gender baik itu laki-laik maupun perempuan semuanya sama rata kedudukannya dalam hal apapun, kecuali kodrat yang dianugerahkan Allah yang membedakannya yang merupakan fitrahnya itu. Demikian juga dalam hal waris semuanya itu berimbang dan adil dalam hal  pembagian harta warisan, tidak ada lagi yang namanya 2: 1 tapi semuanya itu dibagikan sama rata, berdasarkan faktor sosiologis dan perubahan status sosial yang berkembang dalam masyarakat. Karena pada hakekatnya ayat-ayat al-Qur’an yang berkaitan dengan waris itu sifatnya bilateral/parental bukan yang selama ini dipahami secara patrilineal.Dari hasil penelitian ini diharapkan dapat member kegunaan secara akademis dan praktis, dari sisi akademis kegunaan penelitian di samping berguna bagi pengembangan ilmu penulis juga dapat bermanfaat bagi peneliti-peneliti yang akan datang. Pentingnya hasil penelitian ini bagi peneliti-peneliti yang akan datang terutama terletak pada sisi ketersediaan data awal, karakteristik termasuk masalah-masalah yang belum mendapatkan analisis yang fokus. Secara praktis penelitian ini berguna bagi informasi. Penelitian ini adalah penelitian pustaka (library research), bersifat kualitatif, deskriptif analitis.

Abstract

This study aims to determine the Implementation of Restorative Justice in Traffic Accident Crimes Committed by Children in the Gorontalo City Police Department and the Constraining or Inhibiting Factors in the Implementation of Restorative Justice in the Gorontalo City Police Department. This study uses the Juridical Sociological research method, Juridical Sociological is a legal research using secondary data as its initial data, which is then continued with primary data in the field or on the community, examining the effectiveness of a Regulation and research that wants to find a relationship (correlation) between various symptoms or variables, as a data collection tool consisting of document studies or library materials and interviews (questionnaires). The results of the study show; The implementation of restorative justice in resolving traffic accident cases in the Gorontalo City Police Department jurisdiction has been in accordance with the provisions of laws and regulations, especially Perpol Number 8 of 2021, which is carried out after a request for a peaceful settlement of the case and an agreement from the perpetrator and victim signed by all parties involved in the traffic accident which is then followed up by investigators until a Termination of Investigation Order is issued. Obstacles or Constraints that arise in the Implementation of restorative justice, namely; first is the legal factor. Then the second is the factor from the perpetrator's and victim's families who have not reached a peace agreement. And the last is the Facilities and Infrastructure Factor. Law enforcers cannot work well if they are not equipped with adequate facilities and infrastructure.

Abstract

The significance of assess instruction for the community is one of the keys to victory in expanding assess mindfulness and citizen compliance. This article talks about the part of assess instruction as a key instrument to extend understanding of assess commitments and assess benefits for national advancement. The creator analyzes variables that impact the open understanding of tax collection, calculating negligible data, negligible proceeding instruction programs, and negative discernments of tax collection. In expansion, this article highlights the significance of collaboration between the government, educational education, and the media in dispersing compelling and easy-to-understand charge instruction to all levels of society. The most discoveries appear that organized charge instruction makes strides tax compliance, makes clarity, and increases open trust within the government. In this manner, making strides charge instruction programs is useful for the government not as it were in optimizing charge incomes but moreover in understanding the part of the community as citizens. In brief, comprehensive and ceaseless charge instruction is the most established for a reasonable, successful, and economical charge framework.

Abstract

Cyber notary is a concept that utilizes technological advances in carrying out the duties and authority of a notary. Document digitization is a challenge for notaries, especially related to document authentication and legalization, but Indonesia does not yet have specific rules regarding this matter, especially in the formation of electronic certificates and signatures. The purpose of this study was to determine and analyze the making of a notary deed electronically in terms of a cyber notary along with an electronic signature on the deed. This research is a juridical-normative research with descriptive analysis. The result of this research is that the making of an electronic deed is legal and binding as a notary deed even though the making of an electronic deed is not specifically regulated. The use of digital signatures can be done with the agreement of the parties as a simplification of business practices in Indonesia, especially in the implementation of mortgage rights.

Abstract

Legal protection efforts for workers in Indonesia through the Social Security Agency on Health (BPJS) are one of the strategic steps in ensuring worker welfare, both in the formal and informal sectors. This study aims to analyze the company's obligation to register its workers in BPJS membership and the legal protection efforts that can be provided through social security programs organized by BPJS Kesehatan and BPJS Ketenagakerjaan. First, the company's obligation to register its workers in BPJS membership is regulated in Law Number 24 of 2011 concerning BPJS, which mandates that every company is required to register all its workers in the social security program. Although there are clear legal provisions, implementation in the field still faces challenges such as low awareness from some companies and workers themselves. Second, legal protection efforts for workers through BPJS can be seen from two main aspects, namely health insurance and employment insurance. The health insurance program provides protection for workers and their families from unexpected health risks, while employment insurance provides protection against socio-economic risks faced by workers, such as work accidents, death, or retirement. With this program, workers have the right to obtain health services and financial compensation that can ease the burden of life due to the occurrence of these risks. This study reveals that although BPJS plays an important role in providing legal protection for workers, there are challenges in its implementation, such as gaps in equal access to services and non-compliance by several companies with registration obligations. Therefore, stricter supervision, increased legal awareness, and stricter law enforcement are needed against companies that do not register their workers with BPJS. With these steps, it is hoped that the social security program can run effectively and provide maximum protection for workers in Indonesia.

Abstract

Cybercrime, especially hacking, is a major challenge in the digital era, especially when perpetrators operate across countries. This study analyzes the effectiveness of Law Number 11 of 2008 concerning Electronic Information and Transactions (UU ITE) in combating international hacking crimes and evaluating international cooperation in cyber law enforcement. Using a normative legal approach, this study shows that although the ITE Law provides a strong legal basis, its application to perpetrators abroad faces jurisdictional challenges, differences in legal systems, and limitations in international cooperation. Technical obstacles in identifying and prosecuting perpetrators are also significant. To overcome this problem, it is necessary to strengthen international cooperation through extradition agreements and mutual legal assistance (MLA), as well as participation in international conventions such as the Budapest Convention. Increasing the technical capacity of law enforcement officers is also important to strengthen law enforcement against transnational hacking crimes. This study concludes that legal arrangements in Indonesia need to be improved through regulatory reform and more effective international cooperation so that Indonesia can protect national interests in the increasingly complex digital era.

Abstract

This article discusses the crucial role of effective management in spurring economic growth in developing countries. Good management is the basis for designing, implementing and optimizing economic policies that support the development of key sectors, factors such as operationally efficient human resource management, innovation and stability. proven to be a key driver in achieving sustainable growth through case study analysis and literature review. This article outlines the positive impact of effective management on company productivity and national economic growth. A comparison of successful management practices with less successful cases provides insight into the strategic importance of directed management and adaptive in facing economic challenges. Apart from that, this article highlights the importance of building managerial capacity through education and training. Improving material skills at various levels of the organization can strengthen economic foundations and open up new opportunities for innovation and investment. Based on these findings, this article concludes that effective management is not only the key to company success but also the main factor that can encourage economic growth in developing countries. Therefore, stakeholders from both the public and private sectors need to work together to strengthen managerial capacity and create an environment which supports exclusive and sustainable economic growth

Abstract

This research aims to explain the role of mixed marriage organizations in the process of obtaining residence permits for foreign nationals. This research uses the normative juridical method, with data obtained from the identification and clarification of legal facts from mixed marriage organizations. In recent years, population migration between countries has continued to increase. Along with the times, more and more foreign nationals choose to live in Indonesia, one of which is due to mixed marriages. A mixed marriage is a marriage between two individuals who are subject to different legal systems in Indonesia, usually due to differences in citizenship, where one of the spouses is an Indonesian citizen. Foreign nationals married to Indonesian citizens are required to apply for a residence permit in Indonesia, such as a permanent residence permit (ITAP). To obtain an ITAP, the applicable requirements must be met according to the purpose of the application. This process includes applying for a status change from a limited stay permit (ITAS) for family unification to a permanent residence permit (ITAP). The Mixed Marriage Organization plays an important role in helping to resolve the various issues faced by families in mixed marriages. The organization carries out its activities through three main pillars: Advocacy, Socialization, and Consultation. This topic was chosen by the author because it has not been discussed in previous articles.
