Journal of Legal Research is a peer-reviewed journal on legal research published quarterly (February, May, August, November) since 2019 by Departemen Legal Studies Faculty of Sharia and Law Universitas Islam Negeri Syarif Hidayatullah Jakarta in cooperation with Center for the Study of Constitution and National Legislation (POSKO-LEGNAS). Journal of Legal Research aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning Indonesian laws. The Review, hence, welcomes contributions from international legal scholars and professionals as well as from representatives of courts, executive authorities, and agencies of development cooperation. The Review basically contains any topics concerning Indonesian laws and legal system. Novelty and recency of issues, however, is a priority in publishing. It aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning Indonesian laws and legal system. Published exclusively in English, the Review seeks to expand the boundaries of Indonesian legal discourses to access English-speaking contributors and readers all over the world. The Review, hence, welcomes contributions from international legal scholars and professionals as well as from representatives of courts, executive authorities, and agencies of development cooperation. The Review basically contains any topics concerning Indonesian laws and legal system. Novelty and recency of issues, however, is a priority in publishing. The range of contents covered by the Review spans from established legal scholarships and fields of law such as privacy laws and public laws which include constitutional and administrative law as well as criminal law, international laws concerning Indonesia, to various approaches to legal studies such as comparative law, law and economics, sociology of law and legal anthropology, and many others. Specialized legal studies concerning various aspects of life such as commercial and business laws, technology law, natural resources law and the like are also welcomed.

Abstract

Indonesian halal product regulation has changed. These arrangements have been in numerous rules, but they have not been binding and strong legal instruments. Halal product assurances in the micro industry, especially in Depok City, are continually failing. Sate Taichan Cihuy and Mie Ayam Pelita Solo production research demonstrates that halal product promises have failed. Doctrinal legal study uses qualitative data for normative legal research. The study examined legislative structure, substance, and culture in relation to the implementation of halal product assurances based on Law Number 33 of 2014. The study found that Indonesia's Halal Product Guarantee Act has inspired a system of regulating halal product guarantees to provide certainty, protection, and guarantees for halal items entering, circulating, and trading in Indonesia. Despite legal clarity, the Halal Product Guarantee Act has been poorly implemented. Micro enterprises, mainly in Depok City, have found food goods without halal certificates. Abstract

This home worker in the Muara baru area of North Jakarta is one of the informal sector workers who are still not regulated in Law Number 13 year 2003 concerning Manpower. The situation causes homeworkers have not received recognition and certainty of their work status, they often forgotten in manpower planning policies and have to deal with various obstacles as workers, including the non-fulfillment of their rights as workers in Indonesia. This thesis aims to find out how the mechanism should be taken to ensure the fulfillment of the rights of homeworkers in the regions Muara Baru, North Jakarta and what is the government's role in providing legal protection of the home work system in Indonesia in general and in Muara Baru area, North Jakarta in particular, by knowing in advance how is the legality of work agreements made between homeworkers in the regions Muara Baru, North Jakarta with an employer intermediary. This research using the type of empirical juridical research by conducting interviews fieldwork for homeworkers in the Muara Baru area of North Jakarta, then conduct a study of library materials by reading, studying, review and analyze the literature to develop related studies with the title of this thesis. The results of this study indicate that the legality of the work agreement established between homeworkers in the Muara Baru area of North Jakarta with intermediaries the employer is only limited to a verbal work agreement, while the mechanism must be done in order to create guarantees for the fulfillment of the rights of homeworkers in the regions Muara Baru North Jakarta is through the mobilization of law and the Government in this has not yet come into play. In order to prevent this from happening prolonged, it is necessary to revise Law Number 13 Year 2003 concerning Manpower or the enactment of new Laws and Regulations related to the work-home system.

Abstract

This thesis is descriptive normative legal research on the Trustees' duty to bondholder investors under the Capital Market Law, hence no hypotheses are needed. Data collecting strategies using library research to trace legal documents to books, periodicals, seminar papers, and related laws and regulations, notably in the Investment industry. Data management techniques include editing and categorizing data, followed by qualitative data analysis to draw a conclusion, which is that the Trustee's obligation to bondholder investors under the Capital Market Law is to act only for the benefit of all investors and avoid a conflict of interest between the trustee's interests and those of bondholder investors (duty of loyalty and good faith). According to the Capital Market Law, these include researching prospective issuers, determining the rights of debt/bond holders, and drafting contracts/agreements.

Abstract

Resolving land acquisition disputes for the public interest, it is fitting for the state to pay attention to values outside of the rule of law itself, including the value of social justice and the value of benefits to guarantee the basic rights of affected communities. This study aims to find out provisions for land acquisition for development in the public interest and implementation of Law Number 2 of 2012 concerning Land Procurement in the construction of New Yogyakarta International Airport. The process of land acquisition for development in the public interest is carried out in the stages of planning, preparation, implementation, and submission of results. The implementation of land acquisition is intended as an instrument for infrastructure development programs for community welfare as mandated by Law Number 2 of 2012 concerning Land Procurement for Development in the Public Interest.

Abstract

Settlement of problems that arise in sharia banking contracts for guarantees of mortgage rights is based on the binding principle of the contract (Mabda' Wujub Al Wafa' Bi Al' Aqad/Asas Pacta Sunt Servanda) which means that the contract of the parties made legally binds the parties as a law. In the settlement of disputes in one of the financing contracts through Islamic banking, there are options for settlement methods including settlement by deliberation and consensus, settlement through Alternative Dispute Resolution (APS), including Mediation, Arbitration, Conciliation, and Expert Assessment and settlement through the Religious Courts. This type of research uses descriptive qualitative research methods. Basyarnas was formed because PA at that time did not yet have the authority to examine Islamic economic cases, so Basyarnas was formed because of an urgent need to resolve the possibility of civil disputes between Islamic banks and customers.

Abstract

Article 64 paragraph (1) of the Regulation of the Minister of Energy and Mineral Resources of the Republic of Indonesia Number 7 of 2020 states that if the holder of an IUP or IUPK wishes to make changes to its shares, it must first obtain the approval of the Minister or the Governor in accordance with their authority before registering with the Indonesian ministry in charge of government administration. the practice of law In actuality, however, the buyer has paid the seller in full for the shares under the Sale and Purchase of Shares Agreement, and it turns out that the seller cannot obtain approval from the Minister of Energy and Mineral Resources of the Republic of Indonesia. This is a normative legal study employing a statute, case, conceptual, and analytic method. According to the results of the study, the transfer of shares that does not receive approval from the Minister of Energy and Mineral Resources of the Republic of Indonesia cannot be continued with the signing of the transfer of rights to shares because the objective requirements cannot be met. This is due to the fact that shareholders of a limited liability company holding an IUP are required to get prior approval from the Minister of Energy and Mineral Resources of the Republic of Indonesia. In order for the disapproval of the change in shares to render the Sale and Purchase of Shares invalid.

Abstract

Coronavirus Disease 2019 (COVID-19) has become a terrible pandemic and has an impact on the global economic crisis, including the southern hemisphere. Solidarity, collaboration and cooperation among southern countries are demands in fighting the economic crisis due to the Covid-19, one of which is through the G-20. This is shown by the G20 in the theme carried out in 2022, namely “Recover together, recover stronger” through strengthening global solidarity. This study aims to analyze the efforts of the G20 in encouraging the economic recovery of the southern hemisphere countries, during the Covid-19 pandemic. Descriptive-qualitative research method is used in analyzing the issue, accompanied by data collection techniques through literature study. The results of this study indicate that the G20 has attempted several ways to encourage post-pandemic economic recovery in the southern hemisphere, through: International Financial Architecture, Financial Sector Reform, Sustainable Finance. Abstract

Pengembang selaku pelaku usaha bidang Real Estat jenis apartemen, hubungan hukum antara pengembang dan pembeli berdasarkan perjanjian Surat Pesanan unit apartemen, pengembang telah melakukan wanprestasi atas perjanjian yaitu tidak realisasi pembangunan apartemen sesuai waktu yang dijanjikan, hal tersebut sudah menjadi fenomena hukum di Indonesia. Berdasarkan uraian dalam penulisan ini, maka permasalahan yang dikemukakan dalam tesis ini adalah 1) bagaimana akibat hukum dari perjanjian Surat Pesanan unit apartemen bagi para pihak terhadap pengembang yang melakukan wanprestasi? 2) Bagaimana bentuk perlindungan hukum yang dapat diperoleh pembeli atas tidak terealisasinya pembangunan apartemen. Dari hasil penelitian normatif yang dianalisa secara kualitatif ini dapat diperoleh bentuk akibat hukum atas tindakan wanprestasi oleh pengembang dan bentuk perlindungan hukum bagi pembeli. Solusi kongkrit dari pengembang saat ini untuk penyelesaian permasalahan adalah relokasi unit, maka harus mencarikan solusi terkait tuntutan pengembalian uang, denda dan ganti rugi kepada pembeli yang tidak memiliki kejelasan pembayaran kepada pembeli dan belum ada upaya untuk memperoleh perlindungan hukum yang dijamin oleh undang-undang, karena kurang edukasi dan literasi pembeli sehingga sangat diperlukan peran dan perhatian pemerintah, agar eksistensi lembaga pemerintahan dan non pemerintahan dalam penyelesaian masalah bagi pembeli yang dirugikan.

Abstract

Dalam pasal 833 ayat (1) KUHPerdata ditentukan bahwa ahli waris dengan sendirinya karena hukum memperoleh hak milik atas segala barang, segala hak dan segala piutang dari si pewaris. Fenomena dalam masyarakat banyak terjadi harta warisan (boedel warisan) yang belum dibagi tetapi telah dipergunakan sebagai jaminan dalam fasilitas kredit dari bank, tanpa persetujuan ahli waris yang lain. Metode yang digunakan dalam penelitian ini dengan jenis penelitian yuridis normatif yaitu penelitian hukum kepustakaan atau data sekunder dengan sumber bahan-bahan hukum primer, sekunder dan tersier. Hasil penelitian menunjukkan bahwa akibat hukum pembebanan hak tanggungan atas boedel warisan harta bersama yang belum dibagi yaitu tetap sah apabila dalam pelaksaan pembebanan hak tanggungan tersebut melalui persetujuan dari seluruh ahli waris. Namun apabila tanpa persetujuan seluruh ahli waris, maka pembebanan hak tanggungan tersebut batal demi hukum, tidak sah, serta tidak berkekuatan hukum karena dalam pembebanan tersebut merupakan perbuatan melawan hukum karena pemberi hak tanggungan tidak mempunyai kewenangan yang mutlak atas objek hak tanggugan yang dijaminkan. Adapun perlindungan hukum bagi ahli waris terhadap pembebanan hak tanggungan atas boedel warisan harta bersama yang belum dibagi yaitu dilakukan pemisahan dan pembagian terlebih dahulu, namun apabila pemisahan dan pembagian belum dapat dilakukan, maka sebelum melakukan pembebanan hak tanggungan terlebih dahulu meminta persetujuan dari seluruh ahli waris. Sedangkan apabila pembebanan hak tanggungan atas boedel warisanyang belum dibagi tanpa adanya persetujuan ahli waris, maka ahli waris berhak untuk mengajukan gugatan ke pengadilan dengan dalih bahwa ia tidak pernah memberikan persetujuannya untuk menjaminkan boedel warisan tersebut, sehingga hak ahli waris dikembalikan seperti semula.

Abstract

Dalam penelitian ini digunakan teori kepastian hukum yang dikemukakan Gustav Von Radburch, yang menyatakan kepastian hukum "that law should be certain, that it could not be interpreted and applied in one way today and in another tomorrow, in one way here and in another way there.” Yang artinya (Hukum itu harus pasti, bahwa itu tidak dapat ditafsirkan dan diterapkan dalam satu cara hari ini dan dengan cara lain besok, dalam satu cara di sini dan dengan cara lain di sana). Jenis Penelitian yang dipergunakan dalam penelitian ini yaitu penelitian hukum yuridis normatif, dimana penelitian hukum yuridis normatif adalah penelitian hukum yang dilakukan secara meneliti bahan Pustaka atau data sekunder saja. Penelitian ini disebut juga dengan penelitian hukum kepustakaan. Sedangkan yang menjadi hasil dari penelitian ini adalah agar dalam pembentukan maupun perbaikan peraturan terkait jual beli saham mengharuskan dibuatnya akta pemindahan hak termasuk jual beli saham, agar dibuat dengan akta otentik yang dibuat oleh pejabat yang berwenang melakukan pembuatan akta otentik yaitu Notaris, guna meminimalisir terjadinya sengketa dalam jual beli saham akibat akta/perjanjian yang dibuat adalah akta/perjanjian yang dibuat dengan akta dibawah tangan.
