Abstract

The implementation of mutations is a policy regulated by the government to improve public services and government administration functions. Transfers between agencies in Asahan Regency are carried out by rotating employees and fulfilling needs according to competency, educational background and performance assessment. It is hoped that civil servant transfers will have a better impact on regional administration. The research method used in this thesis analysis is an empirical legal research method with the primary material being interview studies and observations through direct observation and receiving information from respondents. The results of research conducted by the author in analyzing the implementation of Civil Servant transfers between agencies in Asahan Regency, show that the role of civil servant transfers between agencies in the Asahan Regency Government aims to optimize the performance of agencies in Asahan Regency, including technical staff, teachers and health workers. That the existence of an inter-agency transfer system can meet the needs and shortcomings of civil servants in Asahan Regency in accordance with the performance, educational background and competencies possessed by Civil Servants. The obstacles faced in the Civil Servant mutation process are in accordance with the author's direct observation that Civil Servants who wish to apply for a mutation do not understand the procedures and requirements for submitting a mutation, apart from that, civil servants who are in the 2018 formation cannot apply. transfer because they have to follow the provisions in Government Regulation Number 11 of 2017 concerning Management of Civil Servants. Abstract

Abstract One type of rights protected by Intellectual Property Rights (HKI) is trademark. In order to create legal certainty and legal protection of trademark rights to each legal subject, the Ministry of Law and Human Rights via DJKI organizes trademark registration based on the first to file rule. Implementation of trademark registration based on the first to file rule has had both positive and negative impacts. This research discusses trademark registration based on the first to file rule. In this regard, this research is focused on examining the negative impacts of carrying out trademark registration based on the first to file rule. This is a normative research. The method used is normative juridical. This research is prescriptive analysis, using various types of data in legal research. The results show that the negative impact of implementing trademark registration based on the first to file rule is in the form of the actions of individual legal subjects who submit applications for registration of trademark rights to the Minister of Law and Human Rights via DJKI, which violates the rights of legal subjects who use the trademark for the first time (first to use) Key words: impact, registration, trademark

Abstract

The heir who dies is a Muslim, so his inheritance rights are Islam, so that the settlement of inheritance for heirs can be carried out according to Islam and can be resolved in the Religious Courts. If the heir has a different religion from the heir, then the inheritance settlement is carried out in the District Court. Heirs of different religions still receive inheritance through a mandatory will with the acquisition of inheritance rights for heirs of different religions whose share is not more than 1/3 of the inheritance. So that in Islamic law, non-Muslim heirs of different religions with Muslim heirs still get their rights as heirs through a mandatory will. Keywords: Inheritance, Religion, Islamic Law, Civil Law

Abstract

The purpose of this article is to discuss the impact of polygamous marriages without the consent of the wife from the perspective of positive and Islamic law. Polygamy that is carried out secretly without the wife's permission or knowledge causes many disputes that disrupt household harmony and even lead to divorce. This is because the wife does not accept it, feels betrayed, and hurt. Indonesian marriage law basically adheres to the principle of monogamy. However, there are exceptions for men who can have more than one wife, with the condition of the wife's permission. The method used is normative legal research through a conceptual approach and legislation, whose data comes from primary, secondary and tertiary legal materials. The data is then collected and analyzed qualitatively. The results showed that polygamous marriages secretly without the knowledge and consent of the wife are unlawful. The legal consequences of such violations can be prosecuted criminally as stipulated in Article 279 of the Criminal Code and can be requested for annulment to the court. From the point of view of Islamic law, polygamous marriages are allowed in emergency situations that prioritize justice and the goal of benefit. If these conditions cannot be met and the marriage is detrimental to the household, then polygamy is haram.  Keywords: Marriage, Polygamy, Wife's Permission, Islamic Law, Positive Law

Abstract

Corruption in Indonesia is increasingly happening and has an impact on the people. The people must bear the consequences of corruption. The impoverishment of corruptors is considered a new breakthrough in cracking down on cases of corruption. The concept of impoverishment of corruptors can be carried out by confiscation of assets resulting from criminal acts of corruption and compensation for losses caused by criminal acts of corruption. The concept of impoverishment of corruptors is considered capable of providing a deterrent effect as well as a form of reducing corruption.The impoverishment of corruptors in Indonesia has not been implemented explicitly. The implementation of criminal sanctions for impoverishing corruptors is only by confiscation of assets resulting from criminal acts of corruption, the amount of which is adjusted to the state's financial losses. This cannot be said to impoverish corruptors because only assets originating from criminal acts of corruption are confiscated and not necessarily the corruptors will become poor. The impoverishment of corruptors is carried out by confiscation of all objects that are the result of a criminal act of corruption and/or by payment of replacement money in the amount of which is in accordance with the state financial losses taken and arising from corruption. The impoverishment of corruptors has not become a legal breakthrough for law       enforcement in Indonesia in eradicating corruption.Law enforcement officials in eradicating money laundering are still lacking experience in implementing the law, in other words, they lack a broad and in-depth understanding of Number 25 of 2003 concerning the crime of money laundering, especially the provisions regarding the confidentiality of witnesses/reporters and proof of money laundering cases in relation to money laundering. predicate offense (original crime).There needs to be a reconceptualization of the concept of impoverishment of corruptors. Reconceptualization by providing clear directions for law enforcement regarding the concept of impoverishment of corruptors, so that the implementation of impoverishment of corruptors can be carried out as a legal breakthrough that provides a deterrent effect in corruption. Keywords: Crime, Corruption, Money Laundring,

Abstract

National law has an order of related legal systems. Law has an important role in regulating the order of society which is also interrelated with the development of the development of national law. The development of national law carried out by a country can be carried out with the existence of quality human resources which can be obtained through education. The academic community is the community within the university environment which consists of lecturers and students. The academic community has a relationship with national law because the academic community is part of the community which includes organized life, and plays a role in the formation of quality human resources. Another role of the academic community is to form programs to assist the government, such as making regional regulations in the area around the university. Then the role that can be carried out by students and lecturers is to be able to provide counseling regarding national law and open public legal awareness so that the goals of developing national law can run according to its provisions. In carrying out its role, the academic community certainly experiences obstacles or obstacles. Obstacles that may be faced are that it is difficult for the community to receive counseling regarding national law because their thinking is already bad about the development of national law or other obstacles encountered are such as making programs to help the government to make regional regulations, the government does not just glance directly at it so that the program develops it takes a short amount of time. Keyword : The Role of the Academic Community, Development, National Law, Universities

Abstract

The restorative justice approach through rehabilitation in narcotics abuse cases in Indonesia is important because apart from being able to recover addicts from their dependence on narcotics, it can also overcome the problem of overcrowding in prisons.According to data from the Directorate General of Pas on May 9 2022, the number of convicts and detainees throughout Indonesia reached 273,982 people. Meanwhile, the ideal capacity of prisons and detention centers is only able to accommodate around 124,696 prisoners and detainees. Nearly 60% (sixty percent) of prison inmates are narcotics related and more than 80% (eighty percent) of that number are narcotics abusers. Keyword : Restorative Justice, Abuse, Narcotics, Progressive Law

Abstract

The establishment of OJK is to organize an overall supervisory and regulatory system, especially in financial sector activities, both in non-bank and banking institutions. OJK has three objectives, namely creating a financial services sector that is contributive to equal distribution of wealth, creating a financial services sector that is stable, foreign-powered, and realizing financial services that are inclusive for society by providing credible protection to the consumers. This study aims to find out what regulations are issued by the Financial Services Authority institutions to protect the consumers who use peer to peer lending services and what sanctions are issued by the Financial Services Authority institutions if the perpetrators of financial services violate the provisions in the Financial Services Authority regulations. The method used in this research is descriptive method with a qualitative approach.In this case the Financial Services Authority issues regulations concerning the Consumer Protection in the Financial Services Sector. And if a financial service actor violates or does not comply with the regulations made by OJK, he will receive sanctions as stated in the regulation Number: 1/POJK.07/2013, if a financial service actor violates the provisions in OJK regulations, he will be subject to administrative sanctions, namely written regulations, Fines or paying a certain amount of money, Limitation of business activities, Freezing of business activities, as well as revocation of licenses for business activities. Keywords: Role, OJK, Protection, Consumers, Sharia Maqasid.

Abstract

PT. Pegadaian sebagai Badan Uusaha Milik Negara yang mempunyai misi khususnya yaitu memenuhi kebutuhan dana skala kecil, dan pada akhir-akhir ini PT. Pegadaian semakin membudaya dan memasyarakat di kalangan masyarakat kelas bawah dan masyarakat kelas atas. Pelaksanaan hak retensi dan lelang di PT. Pegadaian  Merupakan salah satu perusahaan Badan Usaha Milik Negara (BUMN) yang bergerak di bidang jasa keuangan yang berfokus membantu masyarakat yang membutuhkan pendanaan dengan cara menggadaikan berbagai barang berharga dan surat-surat berharga lainnya. Akibat hukum yang timbul jika terjadi pelelangan terhadap barang jaminan di PT. Pegadaian  adalah pihak PT. Pegadaian mengambil sejumlah dana yang dipinjamkannya kepada pihak debitur setelah dipotong bunga, modal sewa dan juga biaya pelelangan. Oleh karena itu disarankan agar dalam hal pelaksanaan lelang atas barang-barang bergerak pada PT. Pegadaian  dilaksanakan sesuai dengan ketentuan yang berlaku  dan agar pihak PT. Pewgadaian  menjelaskan akibat hukum jika terjadi pelelangan kepada debitur.Kata Kunci : Retensi, Pelelangan, Pegadaian, Wanprestasi

Abstract

The existence of Qanun Number 3 of 2013 concerning Regional Flags and symbols refers to the provisions of Article 246 and Article 247 of Law Number 11 of 2006 concerning the Government of Aceh, which stipulates that the Aceh government has the authority to stipulate the Aceh regional flag as a symbol of privilege and specificity. But recently published PP. No. 77/2007 concerning Regional Emblems, which in the provisions of Article 6 Paragraph (4) stipulates a prohibition for regions to make regional flags and symbols that resemble prohibited organizations and separatist movements. As a result, the existence of the Aceh flag as regulated in Qanun Number 3 of 2013, is considered contrary to the provisions of Article 6 Paragraph (4) PP. No. 77/2007 concerning Regional Coat of Arms. The use of the Aceh flag in the framework of implementing special autonomy in Aceh is a symbol of the community that shows the identity of the people and region of Aceh, and is not a symbol of sovereignty, this is in accordance with Article 246 paragraph (3) of Law no. 11/2006 concerning the Government of Aceh. Thus, the existence and use of the Aceh flag, seen from its sociological aspect, is a reflection of the Acehnese people themselves. Judging from the process of its formation, the process of forming Qanun Number 3 of 2013 concerning the Aceh Flag and Coat of Arms has met the requirements of legal certainty. When viewed from the legal substance contained therein, there is still a clash of norms between the Qanun on the Aceh Flag and the PP. No. 77/2007 concerning Regional Coat of Arms. Judging from the implementation aspect, until now the provisions of the Qanun have not been implemented, even though they have been ratified by the Aceh government together with the DPRA. Thus, the Qanun concerning the Aceh Flag has not obtained legal certainty in totality, because of the conflicting norms of the legal substance contained in it, so it cannot be implemented. Keywords:     Existence, Flag and Coat of Arms of Aceh, Perspective of Tiered Norm Theory.
