Abstract

Artikel ini menganalisis paradoks pengakuan hak ulayat masyarakat adat dalam kebijakan ketahanan pangan di Indonesia, khususnya ketika agenda food estate dan ekspansi pangan berbasis lahan skala besar beririsan dengan wilayah adat. Secara normatif, hak ulayat telah memperoleh dasar pengakuan melalui Pasal 18B ayat (2), Pasal 28I ayat (3), dan Pasal 33 UUD 1945, Pasal 3 Undang-Undang Pokok Agraria, serta Putusan Mahkamah Konstitusi Nomor 35/PUU-X/2012 yang menegaskan bahwa hutan adat bukan hutan negara. Namun, pengakuan tersebut belum sepenuhnya menjamin perlindungan substantif karena masyarakat adat masih menghadapi fragmentasi regulasi, tumpang tindih izin, lambannya pengakuan administratif, lemahnya pelaksanaan free, prior and informed consent (FPIC), serta dominasi paradigma pembangunan pangan yang menempatkan tanah sebagai faktor produksi. Artikel ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kontekstual-kasus. Analisis dilakukan melalui dua tahap, yaitu analisis koherensi normatif terhadap pengakuan hak ulayat dalam kebijakan food estate, dan analisis preskriptif-rekonstruktif untuk merumuskan model ketahanan pangan berbasis keadilan tenurial. Hasil kajian menunjukkan bahwa food estate berpotensi menciptakan paradoks konstitusional: negara mengejar ketahanan pangan nasional, tetapi pada saat yang sama berisiko melemahkan ketahanan pangan masyarakat adat melalui konversi ruang hidup, hilangnya pangan lokal, dan terganggunya sistem ekologis adat. Artikel ini menegaskan bahwa hak ulayat bukan hambatan bagi pembangunan pangan, melainkan prasyarat bagi ketahanan pangan yang adil, berkelanjutan, dan sesuai dengan keadilan konstitusional. This article analyzes the paradox of the recognition of Indigenous Peoples’ customary land rights within Indonesia’s food security policy framework, particularly where food estate initiatives and large scale land based agricultural expansion intersect with customary territories. Normatively, customary land rights have been constitutionally and legally recognized through Article 18B paragraph (2), Article 28I paragraph (3), and Article 33 of the 1945 Constitution of the Republic of Indonesia, Article 3 of the Basic Agrarian Law, as well as Constitutional Court Decision No. 35/PUU-X/2012, which affirmed that customary forests are not state forests. Nevertheless, such recognition has not yet ensured substantive protection, as Indigenous communities continue to face regulatory fragmentation, overlapping land use permits, protracted administrative recognition processes, inadequate implementation of the principle of Free, Prior and Informed Consent (FPIC), and the predominance of a food development paradigm that treats land primarily as a factor of production. This study employs a normative legal research method, utilizing statutory, conceptual, and contextual case approaches. The analysis is conducted in two stages: first, a normative coherence analysis of the recognition of customary land rights within food estate policies; and second, a prescriptive reconstructive analysis aimed at formulating a food security model grounded in tenure justice. The findings reveal that food estate development may generate a constitutional paradox: while the state seeks to strengthen national food security, it simultaneously risks undermining the food security of Indigenous communities through the conversion of customary living spaces, the erosion of local food systems, and the disruption of customary ecological structures. This article argues that customary land rights should not be perceived as an obstacle to food development. Rather, they constitute a fundamental prerequisite for achieving food security that is equitable, sustainable, and consistent with the principles of constitutional justice.

Abstract

Penelitian ini bertujuan untuk menganalisis aspek hukum perceraian yang disebabkan oleh kekerasan dalam rumah tangga (KDRT) di Pengadilan Agama Makassar Kelas IA, khususnya terkait perlindungan hukum terhadap korban serta efektivitas upaya pencegahan perceraian akibat KDRT. Permasalahan KDRT tidak hanya menimbulkan dampak fisik dan psikis bagi korban, tetapi juga menjadi salah satu faktor dominan yang menyebabkan disharmonisasi rumah tangga hingga berujung pada perceraian. Dalam perspektif hukum, KDRT merupakan pelanggaran terhadap hak asasi manusia dan bertentangan dengan tujuan perkawinan sebagaimana diatur dalam peraturan perundang-undangan. Oleh karena itu, diperlukan analisis terhadap penerapan hukum dalam penyelesaian perkara perceraian yang dilatarbelakangi oleh KDRT di lingkungan peradilan agama. Penelitian ini menggunakan metode penelitian hukum yuridis normatif dan yuridis empiris. Pendekatan normatif dilakukan melalui pengkajian peraturan perundang-undangan, literatur hukum, serta putusan pengadilan yang berkaitan dengan perceraian dan KDRT. Sementara itu, pendekatan empiris dilakukan melalui wawancara dengan pihak terkait di Pengadilan Agama Makassar Kelas IA guna memperoleh gambaran mengenai penerapan hukum dalam praktik peradilan. Data yang diperoleh dianalisis secara kualitatif untuk menghasilkan kesimpulan yang komprehensif. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap korban KDRT dalam perkara perceraian pada dasarnya telah memiliki landasan hukum yang memadai, baik melalui Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan dalam Rumah Tangga maupun ketentuan hukum perkawinan dan peradilan agama. Dalam praktiknya, hakim telah berupaya memberikan perlindungan melalui proses pemeriksaan perkara, mediasi, serta pertimbangan hukum yang memperhatikan kondisi korban. Namun demikian, efektivitas upaya pencegahan perceraian akibat KDRT masih menghadapi berbagai hambatan, antara lain faktor budaya, ketergantungan ekonomi, rendahnya kesadaran hukum, dan sulitnya pembuktian kekerasan dalam rumah tangga. Oleh karena itu, diperlukan penguatan sinergi antara aparat penegak hukum, lembaga peradilan, dan masyarakat dalam memberikan perlindungan hukum serta mencegah terjadinya KDRT yang berujung pada perceraian. This study aims to analyze the legal aspects of divorce caused by domestic violence (DV) in the Makassar Class IA Religious Court, specifically regarding legal protection for victims and the effectiveness of divorce prevention efforts due to DV. The problem of DV not only causes physical and psychological impacts for victims, but also becomes one of the dominant factors causing household disharmony that leads to divorce. From a legal perspective, DV is a violation of human rights and contradicts the objectives of marriage as regulated by laws and regulations. Therefore, an analysis is needed on the application of law in resolving divorce cases motivated by DV in the religious court environment. This study uses normative and empirical legal research methods. The normative approach is carried out through a review of laws and regulations, legal literature, and court decisions related to divorce and DV. Meanwhile, the empirical approach is carried out through interviews with relevant parties in the Makassar Class IA Religious Court to obtain an overview of the application of law in judicial practice. The data obtained are analyzed qualitatively to produce comprehensive conclusions. The research findings indicate that legal protection for victims of domestic violence in divorce cases is fundamentally well-established, both through Law Number 23 of 2004 concerning the Elimination of Domestic Violence and provisions in marriage law and religious courts. In practice, judges have attempted to provide protection through case examinations, mediation, and legal considerations that take into account the victim's circumstances. However, the effectiveness of efforts to prevent divorce due to domestic violence still faces various obstacles, including cultural factors, economic dependence, low legal awareness, and the difficulty of proving domestic violence. Therefore, strengthening synergy between law enforcement officials, judicial institutions, and the community is necessary to provide legal protection and prevent domestic violence that leads to divorce.
