Abstract

Legal protection for all workers/employees, especially for lecturers who work under foundations, is absolutely necessary, considering that there are still many cases involving universities and foundations. These problems still haunt lecturers, so there needs to be a joint effort to minimize existing problems. Even though there are already regulations governing the relationship between workers/laborers and employers, in practical terms they have not yet been fully implemented. This is related to several problems, one of which is the position of lecturers at the subordinate level more than the foundation. This phenomenon will not occur when educators take advantage of legal protection that has been regulated in legislation. This study will elaborate on legal protection for workers, especially for educators. The research method used is a normative juridical approach using a statutory approach. The result is legal protection for educators as stipulated in Law Number 21 of 2000 concerning Trade Unions, in particular regarding the purpose of the formation of trade unions. In addition, Law no. 13 of 2003 concerning Manpower has protected workers/employees, including educators, namely through trade unions/employees.

Abstract

The tourism literature of today frequently combines all of the Mughal contributions to Kashmir. Kashmir had a significant role in the magnificent Mughal Empire. The Valley was close to the Central Asian border in the Kabul area. Strong dynastic monarchs like Akbar, Jahangir, Shah-i-Jahan, and Aurangzeb ruled it. The region's trade and commerce were boosted by the Mughals' conquest because it put an end to the region's long-running domestic fighting, built a centralized government, did away with toll charges, and improved and widened its highways. The damaged economy of the province was also fixed by the maintenance of stability and the agriculture system changes. By taking a number of initiatives for the development of the tourism industry in Jammu and Kashmir, it protected the region's emperors from squandering their enormous wealth on the construction of temples, parks, and wellness resorts and inns, effectively transforming the territory into a "Heaven on Earth." Hence, this paper discusses the influence and contribution of the Mughals for transforming Kashmir a beautiful tourist spot of the world.

Abstract

Most people consider Jammu and Kashmir to be heaven on earth. If there is heaven on earth, it is this, this, and this, according to the Farsi couplet (Amir Khusrau). The couplet encouraged numerous kings to exercise control over Kashmir. In the metrical chronicle known as Rajatarangni, dynasties in ancient Kashmir that dated from the time of the Mahabartha epic to the reign of Sangrama Deva are vividly portrayed. Of all the kings of ancient Kashmir, Avantivarman, who established the Utpalas dynasty in 1855 A.D., was the most magnificent. He didn't start any battles, not even to retake the areas that his forefathers had recently lost. In terms of prosperity, he ruled during the rippling times of peace and plenty, which coincided with Kashmir reaching its pinnacle around a quarter of a century into his rule. The people had never been happier than they were in his day, nor had they been for generations. Therefore, Avantivarman rule represents a very wonderful era in Kashmir's history. A new period in that nation's history began with Avantivarman taking control of events in the valley. His rule not only provided respite to Kashmir's suffering people, but it also significantly restored the Karkota's former luster, as will be seen. Avantivarman, a descendant of the Kalyapala family and the grandson of Utpalas, who had played a crucial role in the final years of the Karkota monarchy, was previously mentioned. Avantivarman has the traits of intellect and heart that allow him to be recognised as one of the valley's most capable kings, while not being by any means a member of some aristocratic and distinguished family. The study's goal is to explain and analyze Avantivarman legacy and reign during the Utpalas Dynasty in Jammu and Kashmir. It also highlights his contributions during his time in power there.

Abstract

The cultural history of Kashmir can be explained in part by its geographical position. Because of Kashmir's natural beauty and moderate climate, it's possible that Kashmiris have a long history of artistic expression. As a result of Kashmir's seclusion, security afforded by the surrounding mountains, and its distance from the centre of Indian culture, Kashmiri philosophy might be unique. Because of the harsh weather and long winters, it's possible that Kashmiris are drawn to philosophical inquiry. The geographic centre of the Puranic world is Kashmir. In this system, Kashmir's significance was recognised as a meeting ground for trade and ideas between the four major regions of the Old World. For the first time ever, the land of opposites attempted to be reconciled through a deeper examination and a more ambitious notion. The study is an attempt to explore the rich cultural heritage of Kashmir in an analytical manner.

Abstract

At first 10 (ten) cases studied by the author were cases of divorce applications. However, in the trial process, the wife filed a counterclaim called a reconvention lawsuit to claim her rights. The rights demanded are such as living, mut'ah, iddah, madhiyah, or hadhanah as well as gono-gini assets. However, not all counterclaims were granted by the panel of judges based on various considerations. To find out, the researcher formulated two problem formulations, namely: 1. How is the legal protection for the plaintiffs of reconciliation if their rights are not obtained in accordance with the Court's decision which has permanent legal force, 2. Can the implementation of the Court's decision be carried out effectively. This research is an empirical research that uses descriptive analysis method with a qualitative approach. Sources of data were collected through interviews with several relevant informants, namely the panel of judges, the Registrar of the Banyuwangi Religious Court. Literature and documentation in the form of copies of decisions, books were also used as further data sources. After the data is collected, the data is processed by editing, classifying, and grouping according to the problem formulation. Then, it is reviewed and analyzed by connecting the data and literature review. The conclusions of this study are: 1) Efforts to protect the wife by providing a living have been carried out to the maximum. However, these efforts do not always run smoothly, because the husband does not make it happen. In article 34 of Law Number 1 of 1974 in conjunction with article 80 (4) the Compilation of Islamic Law, it has been determined about the kinds of rights that a wife can claim when divorced by her husband in court, and if the husband is unable to fulfill the expenses decided by the Religious Court, the panel of judges will postpone the implementation of the ikrtalak for 6 (six) months. 2) The implementation of the Court's decision is not all carried out effectively and according to expectations, this is due to the husband's mediocre level of economic ability.
