Abstract

Maltreatment of children, a persistent issue in Indonesia, including Batam City, often manifests through physical, emotional, or sexual abuse in households, schools, and public spaces. Such crimes cause profound psychological and physical harm, highlighting the urgent need for effective solutions. This study explores the application of restorative justice in handling child maltreatment cases in Batam City, emphasizing its future-oriented accountability, discussion-based negotiation, and healing-focused approach. Employing an empirical legal and social methodology, the research incorporates primary data through in-depth interviews with stakeholders, including prosecutors, police, victims, and relevant agencies, and secondary data from legal documents, books, and scientific publications. Findings reveal that while Batam’s law enforcement supports restorative justice, challenges and differing perspectives persist. This research contributes by proposing restorative justice as a progressive strategy to address child maltreatment, aiming for long-term benefits for victims, perpetrators, and society.

Abstract

Beneficial Owner is currently the main focus in discussions regarding Good Corporate Governance ("GCG") in a corporation, including SOE as a corporation owned by the state and managed by the government which is an important subject in the application of the Beneficial Owner context. Therefore, the aim of this research is to analyze the concept of Beneficial Ownership in Indonesia and examine the position of the Minister of SOE as the Beneficial Owner of the SOE Groups (SOE, SOE Subsidiaries and SOE Affiliated Companies). This writing uses normative juridical methods by conducting a literature review. The research results show that in Indonesia the implementation of Beneficial Owners has been regulated through Presidential Decree 13/2018 which has provided definitions and characteristics regarding Beneficial Owners, and in supporting the existence of Presidential Decree 13/2018, several regulations have also been issued, namely Permenkumham No. 15/2019 and Permenkumham 21/2019, each of which regulates procedures for implementation and supervision of Beneficial Owners for SOE Groups. The position of the Minister of SOE as Beneficial Owner is divided into 3 types, namely in BUMN and BUMN Subsidiaries the position of the Minister of BUMN as Beneficial Owner, while SOE affiliated companies, the position of the Minister of SOE can be the Beneficial Owner or not.

Abstract

The rise of virtual money, particularly cryptocurrencies as a means of e-commerce payment, has spurred global interest in Central Bank Digital Currency (CBDC). In Indonesia, however, the absence of a legal framework for CBDC creates a regulatory vacuum, highlighting the urgent need for banking law reform. This study examines the role of CBDC as legal tender, emphasizing its necessity for modernizing Indonesia's financial system. Using a normative juridical approach, supported by primary and secondary data, the research identifies critical gaps in existing legislation, particularly Law No. 7 of 2011 on Currency and Law No. 3 of 2004 on Bank Indonesia. The study proposes three applicable CBDC design models: instrument, ledger, and incentive design. These models address the practical and legal challenges of CBDC implementation. The findings underscore the need for comprehensive legal reform to establish CBDC as a secure, regulated, and universally accepted payment system in Indonesia.

Abstract

This study examines the application of legal theory in the notary profession through the lens of justice-based balance theory. As public officials, notaries represent the state in civil matters and must navigate complex legal and social dynamics while ensuring justice, legal certainty, and utility—three often-conflicting legal values. Prioritizing justice is essential, as it embodies the ultimate goal of law: fostering societal fairness. Notaries face significant risks of legal entanglement—criminal, civil, or administrative—stemming from the deeds they create, highlighting the urgency for robust legal protections. By addressing these challenges, this research contributes a novel perspective on integrating justice-based balance theory into notarial practices, ensuring notaries can uphold their duties effectively while minimizing legal vulnerabilities. The findings underscore the necessity of a justice-centered approach, offering insights for strengthening notarial governance and enhancing legal frameworks to align with societal needs and values.

Abstract

The age limit for local government leaders is a crucial aspect of administrative law systems that impacts the effectiveness and quality of local leadership. This study aims to explore the effects of age limits on local leadership through a comparative analysis of Germany, the United States, and Sweden. The research employs a comparative legal approach and document analysis to assess how age limits influence effectiveness and diversity in local leadership. The findings indicate that strict age limits, as in Germany, support stability but constrain innovation, while flexible age limits in the United States enhance inclusivity but may reduce quality. The moderate approach in Sweden effectively balances experience with innovation. The study suggests the need for a balanced age limit policy to improve the effectiveness of local leadership and accommodate candidate diversity. This research concludes that policy adjustments and regular evaluations can optimize age limit policies in the context of regional government.

Abstract

This article focusing on the ex-convict with sentence of 5 (five) years or more with his position as will candidate contestant election general and chief area. In study This writer lift a number of problem related laws with provisions for a 5 (year) cooling off period for ex- convict, that provision the own Lots allusion with Human Rights Man, Constitution, as well rule related legislation with election general and election head area. Methodology research used in study This that is juridical normative with do approach to theories laws, regulations, as well analysis cases that have been own strength law fixed (inkracht). As for sources internal primary law study This namely the 1945 NRI Constitution, law election head area, law election, verdict Court Constitution, as well decision relevant Supreme Court with case in study. That in policy gap of 5 (years) for ex-prisoner will arise problem new if “ex-prisoner” at the time has served 2/3 of the sentence Then submit liberation conditional so that must serve the legal term addition in the form of a trial period for 1 (one) year. Even post Decision Court Constitution Number 42/PUU-XIII/2015 and the Constitutional Court 56/PUU-XVII/2019, this condition is becoming increasingly controversial, because precisely give rise to uncertainty law related with calculation of the cooling off period will be started from finished punishment principal or from completion of the trial period the. Abstract

Kabupaten Pesisir Barat memiliki potensi wisata sangat kaya terletak hampir seluruh desa, akan tetapi sampai saat ini potensi wisata tersebut belum memiliki kebijakan yang komprehensif padahal potensi wisata tersebut memiliki peran penting dalam menumbuhkan perekonomian masyarakat. Tujuan penelitian akan mengkaji terhadap kebijakan Kabupaten Pesisir Barat terkait dengan pengelolaan potensi wisata yang ada. Metode pedekatan yang digunakan adalah Studi dokumen, archival record terkait potensi wisata dan kebijakan serta penelitian lapangan dengan mengunakan alat pengumpulan data melalui interview, direct observation, observastion partisipan, yang dilakukan dalam rangka memperkuat kebijakan. Hasil penelitian menunjukan bahwa Kabupaten Pesisir Barat memiliki banyak potensi wisata yang secara prinsip membutuhkan kebijakan yang akan mendukung pengembangan dan keberlanjutan seluruh potensi wisata. Potensi wisata Kabupaten Pesisir Barat terdiri 3 jenis yaitu wisata pantai, wisata alam dan wisata religi, yang sangat diminati oleh wisatawan mancanegara maupun lokal, sehingga potensi tersebut membutuhkan kebijakan terhadap daya tarik wisata yang akan berkunjung kesetiap destinasi. Kebijakan terkait pengembangan pariwisata di Kabupaten Pesisir Barat masih terjadi inkonsistensi sehingga diperlkukan sinergitas terhadap RTRW, RIPDA dan kebijakan lainnya sampai dengan Kebijakan yang ada di pemerintahan desa, sehingga dapat meningkatkan kemakmuran dan kesejahteraan masyarakat yang didasarkan pada komunitas. Saran seharusnya kebijakan terhadap pengembangan dan pengelolaan wisata di Kabupaten Pesisir Barat diatur secara komprehensif yang didasarkan pada konsep komunitas masyarakat desa atau CBT.

Abstract

This research emphasizes the urgent need to update legal protections for student rape victims to ensure their right to formal education. Many victims face barriers to education following rape, losing opportunities to continue their studies. This study critically examines the need for legal reform to safeguard their educational rights, focusing on legislative frameworks and provisions. Using a case-based methodology and juridical-normative analysis, the research explores existing legal approaches, such as the General Law No. 12 of 2022 and Government Regulation No. 43 of 2017, which address restitution for child victims of criminal acts. The findings stress the responsibility of educational institutions and stakeholders to uphold education rights for all students, regardless of circumstances. The research contributes to the discourse on restitution, suggesting legal reform to ensure perpetrators cover the costs of education and support for victims, thereby offering a path forward in protecting vulnerable students.

Abstract

This paper critiques the dominant intercultural discourse of universally understandable and testable knowledge, focusing on the role of intersubjectivity in modern science. It argues that the validation of knowledge and the condemnation of inappropriate practices, particularly in legal contexts, are crucial in contemporary society. The study emphasizes that constitutional decisions are shaped not only by legal provisions but also by the search for values tied to truth. It explores how constitutional justice hinges on a judge’s ability to discover truth and value free from external influences. The paper also highlights the importance of legal knowledge following established rules, stressing that while judges apply legal principles and juries determine facts, legal rules must be continually critiqued to ensure just and reasonable adjudication. The research contributes to understanding the intersection of law, truth, and objectivity in the evolving landscape of constitutional decision-making.

Abstract

Central Bank Digital Currency (CBDC) has emerged as focal point for global monetary policy authorities as an effort to enhance financial inclusion. This study aims to investigate the regulation and implementation of CBDC in Indonesia by referring to China's experience in implementing e-CNY or China’s CBDC. The method used is a normative legal research method with a statutory and comparative approach through the exploration of regulations and governance that can be adopted by Indonesia in implementing CBDC as an instrument to improve financial inclusion. The analysis reveals that China's experience in implementing e-CNY provides valuable insights for Indonesia in designing and implementing CBDC. Prerequisites in implementing CBDC includes a strong blockchain technology infrastructure, strict data protection, and partnerships between the central bank and financial service providers. This study further illustrates the potential for CBDC’s implementation and implications for the financial sector.
