Abstract

In safeguarding the strategic geographical area of Indonesia for security and defense, the immigration sector plays a pivotal role. This role is crucial in protecting the diverse interests of the Republic of Indonesia, particularly in terms of security and prosperity. To effectively support these interests with foreign parties, government institutions require efficient and effective legal instruments in the immigration domain. However, the immigration function, currently under the Directorate General of Immigration at the Ministry of Law and Human Rights, faces challenges due to bureaucratic complexities, resulting in a perceived sluggishness in its implementation.In the era of globalization, there is an urgent need for an independent immigration agency outside the Ministry of Law and Human Rights. This agency, directly responsible to the President, is envisioned to enhance the implementation of the immigration function, particularly in efficiently monitoring the influx of foreigners. The revision of Law Number 6 of 2011 concerning Immigration provides the legal foundation for establishing an independent immigration institution in Indonesia directly accountable to the President.This writing, utilizing the normative legal writing method, aims to explore and analyze the necessity and structure of an independent Indonesian immigration agency. The focus is on optimizing the functions, duties, and authorities of immigration, aligning them with the demands of the globalization era.

Abstract

Bidan paktik mandiri pada kenyataannya saat ini kurang memperhatikan dan memenuhi kelengkapan praktek serta kebutuhan kliennya. Salah satu tindakan terhadap pasien yang sering terjadi di BPM adalah komplikasi persalinan, di mana banyak kasus komplikasi persalinan yang tidak terungkap karena menganggap hal tersebut bukan suatu perbuatan melawan hukum, melainkan hal biasa yang dapat terjadi saat pasien melahirkan. Tujuan penelitian ini untuk mengetahui dan menganalisa tanggung jawab bidan praktik mandiri terhadap pasien yang mengalami komplikasi persalinan berdasarkan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, serta untuk mengetahui dan menganalisa komplikasi persalinan yang dilakukan oleh bidan praktik mandiri yang dikategorikan sebagai perbuatan melawan hukum. Adapun jenis penelitian yaitu penelitian hukum normative, dengan pendekatan penelitian yaitu pendekatan undang-undang, konseptual, dan kasus. Sumber data adalah sekunder dan primer. Teknik pengumpulan data studi pustaka dan wawancara. Analisis data adalah kualitatif.

Abstract

This article discusses child custody after divorce of parents from the perspective of legal philosophy and the best interests of the child, legal philosophy, looking for the best application of child custody between the two and analyzing the factors that cause judges to decide on single and joint custody. The research method used is normative legal research using statutory and conceptual approaches. The results of the study state that joint child custody has more benefits in preventing children as objects of custody ownership in parental disputes and ensuring the psychological condition of children is maintained in the context of child development. In addition, in practice, judges still apply hadhanah singly as stipulated in the Compilation of Islamic Law, but there one PA Decision, PA Gedong Tataan Decision Number: 0334/Pdt.G/2019/PA Gdt which decides child hadhanah comprehensively and refers to the best interests of the child and sees more maslahah for the child, rather than the interests of the parents

Abstract

The Pandeglang Regency, as defined by Law Number 12 of 2011 on the Formation of Legislation promulgated on August 12, 2011, plays a pivotal role in regional regulatory preparation. Law Number 12 of 2011 mandates technical regulations, in the form of government regulations and presidential regulations, to be developed around 2012. Regional Regulations (Raperda), as products of regional law, constitute a subset of statutory regulations. Positioned within the legal hierarchy under the Constitution, MPR Decrees, Laws/Government Regulations in lieu of Laws, and Presidential Regulations (Article 7, paragraph (1) of Law No. 12 of 2011), these regulations encompass legally binding norms. This paper employs a qualitative, normative juridical approach, involving the study and interpretation of legal literature and laws to address the issues at hand. Operationally, it relies on library research, delving into books, laws, and related documents. Focused on the return of evidence by the prosecutor, the study combines normative and empirical research for enhanced precision. Key findings include: 1) Raperda on Regional Legal Products serves as a guiding instrument for the formulation of regional legal products, fostering improved administrative arrangements and orderly documentation in Pandeglang Regency. 2) These regulations function as references derived from higher laws, establishing a framework for regional legal product creation. The study advocates for a comprehensive understanding of the legal hierarchy and underscores the significance of Raperda in shaping a well-organized administrative landscape in the Pandeglang Regency.

Abstract

During the election quiet period, campaign activities, including the use of Campaign Props (APK), are strictly prohibited. This study investigates the authority to regulate and remove APKs during this critical phase. Employing a normative doctrinal research method, the study reveals that Election Participants hold primary responsibility for removing APKs. However, if they fail to comply, Regional Governments are empowered to act, citing the need to maintain public order, cleanliness, and aesthetic standards. Such actions must be coordinated with the Election Commission (KPU) and Election Supervisory Body (Bawaslu) to ensure proper documentation and facilitate sanction recommendations against non-compliant participants. This research highlights the urgent need for clearer regulatory enforcement mechanisms to uphold fairness and order during elections, contributing to the broader discourse on electoral governance and accountability.

Abstract

The Role of the Election Organization Ethics Council's (DKPP) in Elections and Constitutional Law was established in response to frequent ethical violations by election organizers. This research aims to gain a deep understanding of the process of conducting ethical hearings for election organizers and to explain human rights in providing testimony during DKPP hearings. Additionally, this study analyzes the proof process in DKPP to determine whether it adheres to the applicable laws and regulations. The research methodology used is normative juridical legal research, which combines a legislative approach with a conceptual approach. The legislative approach involves the analysis of various applicable legal rules, while the conceptual approach focuses on the understanding and application of relevant legal concepts in this context.

Abstract

The COVID-19 pandemic has heightened the vulnerability of women and children to violence, necessitating prompt and effective legal assistance. This research addresses this urgent issue by developing the Perada application, a digital platform for reporting and seeking legal consultation and assistance for victims of violence. The study is conducted by the Faculty of Law at Untirta, aligning with its vision of an integrated, smart, and green campus. The application leverages smartphone technology to provide accessible support, utilizing the expertise of faculty members and students while collaborating with the Women's and Children's Protection Agency and law enforcement. Employing the Waterfall development model, the research combines descriptive, quantitative, and inferential analyses to evaluate the app’s creation process, usability, and alignment with legal principles. This study contributes to innovative, tech-driven solutions for enhancing legal protection and underscores the role of academia in addressing societal challenges.

Abstract

The practice of dual ministerial roles, including leadership in sports federations, is a growing phenomenon in Indonesia, despite being explicitly prohibited by Article 23 of Law Number 39 of 2008. This study investigates the legal and constitutional implications of such dual roles, particularly focusing on ministers concurrently serving as heads of sports federations. Employing a normative research method, the findings reveal a conflict between the legal framework and current practices. Although the law forbids ministers from holding dual positions in organizations funded by state budgets, such roles remain valid under state recognition, creating a significant legal paradox. This paper argues that the President must enforce dismissal for ministers violating Article 23 to uphold the rule of law and prevent potential abuse of power. The study underscores the urgency of addressing this issue to safeguard public trust and ensure compliance with Indonesia’s constitutional principles.

Abstract

The accountability of the board of directors as an organ that holds a fundamental role in the management of a limited liability company is based on the obligations of fiduciary duties and fiduciary of care. A limited liability company is a legal entity that employs the basic concept of limited liability as a means of accountability. This principle also applies to the accountability of the board of directors. Actions taken by the board of directors in managing the company will be considered as actions of the company itself, and the company will be responsible for the consequences of these actions as long as they do not contradict the company’s Articles of Association and are not due to the negligence or fault of the directors. The principle of limited liability may not apply if, in the execution of their fiduciary duties and fiduciary of care, the directors commit ultra vires acts, pierce the corporate veil, or act contrary to the Business Judgment Rule. The Business Judgment Rule is a principle that can protect the directors from personal liability if the management actions or business decisions they make result in harm to the company. The concept of limited liability in Indonesia is regulated in Article 7 of Law Number 40 of 2007 concerning Limited Liability Companies. Directors will be exempted from personal liability for their actions in running the company as long as it is based on the Company's Articles of Association/Bylaws and not due to negligence and errors of the directors. If the company experiences losses, the directors can be held personally liable if it is proven that the losses were caused by actions that are not in accordance with the Articles of Association/Bylaws and meet the elements of negligence, bad faith, carelessness, conflict of interest and absence of preventive measures.

Abstract

The legal politics of regional government in Indonesia is intrinsically tied to regional autonomy, a constitutional pillar of governance. This research examines the causal relationship between the political and legal subsystems in implementing regional autonomy. Using a normative juridical approach, it highlights how legal policies—whether through new laws or amendments—reflect political dynamics. Grounded in the Critical Legal Studies (CLS) perspective, the study critiques the notion of legal neutrality, arguing that positive law, both in its formulation and application, is deeply embedded in political interests. This interdependence underscores how laws on regional autonomy, including those under Law Number 23 of 2014, are shaped by societal and political contexts. The research contributes by revealing how the CLS framework explains the fluid dynamics of regional autonomy, emphasizing the interplay between law and politics in shaping governance. It offers critical insights into achieving balanced autonomy within Indonesia’s unitary state framework.
