Abstract

This study aims to analyze legal protection for acts of land grabbing and to analyze the prevention and handling of acts of land grabbing. The type of research used is normative legal research, relying on and using library data, namely secondary data in the field of law. The technique of obtaining legal materials is by means of library research by collecting legal materials by reading, quoting, recording and understanding various legal literature and laws. The results of the study show that 1) The legal provisions themselves have accommodated land grabbing in both criminal and civil aspects. 2) Enabling legal sanctions in forcing someone's obedience to the law as above contains aspects of prevention and enforcement aspects.

Abstract

Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara memiliki peran penting dalam pengamanan kawasan pertambangan pada PT. Nusa Halmahera Mineral. Peran tersebut terdiri dari peran preemtif dan peran preventif yang merupakan peran sebagai upaya pencegahan serta peran represif sebagai upaya penindakan dalam hal ini penegakan hukum (law enforcement) bagi pelaku yang melakukan tindak pidana pada objek vital di kawasan pertambangan PT. Nusa Halmahera Mineral. Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara menghadapai berbagai kendala dalam melaksanakan pengamanan kawasan pertambangan pada PT. Nusa Halmahera Mineral. Tidak berjalan optimalnya peran Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara disebabkan karena masih kurangnya jumlah personil pada Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara serta masih terbatasanya sarana dan prasarana yang memadai dalam mendukung pelaksanaan pengamanan. Kemudian lemahnya pelaksanaan koordinasi oleh manajemen PT. Nusa Halmahera juga menjadi kendala bagi Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara dalam melaksanakan perannya secara optimal untuk  pengamanan kawasan pertambangan pada PT. Nusa Halmahera Mineral.

Abstract

The State of Israel has been in the midst of armed conflicts for many decades with Palestines Hamas while Lebanonas Hezbollah and Yemens Houthi have been involved in solidarity conflict. The fresh conflicts began in October 7, 2023 when Hamas launched an unprecedented attack on Israel which took the lives of over 1000 Israelis. The conflicts have intensified with the Hezbollah and Houthi attacking Israel. Israel had carried out attacks on Lebanon and Yemen in retaliation. This ongoing conflict has greatly affected these countries stability, peace, and security, threatening further humanitarian crises. This article discusses the source of the conflict, the current situation of the conflict, and ways to resolve the conflict. In discussing the above, this article adopts a theoretical and doctrinal study of primary and secondary sources as contained in the United Nations Charter, international treaties, conventions and protocols, journal articles, books, newspapers, and materials sourced from the internet.  The article argues that though, the United Nations General Assembly in September 2024 resolved that Israel should vacate Palestinian territory, there is a need for peace-building intervention and enforcement by the United Nations to forestall further humanitarian crises in the Middle East.

Abstract

Aceh, as one of the autonomous regions in the context of the Unitary State of the Republic of Indonesia, in the practice of implementing Local Government, repeatedly not only positions the type and hierarchy of laws and regulations following Law No. 12 of 2011 on the Establishment of Laws and Regulations but also positions the Helsinki MoU as one of the legal sources. The thing that is the practice in this writing is related to how the implementation of the Helsinki MoU in criminal law policy in Aceh. Research methods are conducted with normative legal research methods and prescriptive research. Data collection in this study is done through literature research. Data analysis is done with qualitative analysis; the process of data analysis and using legal data is also possible to use non-legal data. This study showed that after the MoU of peace between the Indonesian government and GAM was marked on August 15, 2005, in Helsinki, Finland, 24 governments then passed Law No. 11 of 2006 on the aceh government. This law is a political commitment of the Indonesian government in following up on the results of the peace agreement in Helsinki. One of the authorities (autonomy/self-government) granted in the law is to implement Islamic sharia in Aceh in a kaffah both in terms of worship, education, muamalat, shiar, civil law, and criminal law. While implementing the Helsinki MoU is, the regulation related to Jinayat (Criminal Law) has strengthened. Other judicial institutions are also concerned about implementing criminal law in Aceh, although the rules about Criminal Law still cause debate.

Abstract

Pretrial has the authority under the Criminal Procedure Code to order law enforcement agencies (KPK / Police / Prosecutors) to continue the legal process of someone suspected of committing a criminal act of corruption and this does not conflict with the legality principle of criminal procedure as affirmed in Article 2 and Article 3 of the Criminal Procedure Code. The pretrial judge's action is the application of the principle of judicial independence to resolve legal issues. Thus the pretrial judge's ruling does not conflict with the legal principles of procedural law in Article 2 and Article 3 of the Criminal Procedure Code

Abstract

This article discusses legal considerations in court decisions on corruption of village funds at two different court levels based on Decision Number 5/Pid.Sus-TPK/2022/PN Tte at the first level and Decision Number 6/Pid.Sus-TPK/2022/PT Tte at the appeal level. The legal issue lies in the difference in judges' legal considerations related to the application of Article 2 paragraph (1) and Article 3 of the Corruption Eradication Law. This research uses normative legal research with secondary data sourced from primary and secondary legal materials. In the data collection process, data collection techniques are used by means of literature studies which are then processed and analyzed qualitatively. The panel of judges who examined and tried the case of corruption of village funds based on the Corruption Court Decision at the North Maluku High Court Number 6/Pid.Sus-TPK/2022/PT Tte after examining based on legal facts had a different view from the panel of judges at the previous level. The judge at the high court level after examining the case file and based on the legal facts in the trial at the first level concluded that what was proven was not the primary charge of Article 2 paragraph (1) but the secondary charge of Article 3 with all legal considerations. However, in relation to the punishment imposed by the judge at the higher level, there is no difference with the form of punishment imposed by the judge at the first level. Both the imposition of imprisonment, fines and additional punishment in the form of payment of restitution.

Abstract

Crime is a very anti-social act that consciously gets a reaction from the state in the form of giving suffering (punishment or action). Crime as a behavior is an act of deviance, is against the law or violates statutory regulations and is detrimental to the community in terms of decency, decency and order of community members. Crime can be defined juridically and sociologically. Crime is part of people's lives and is an everyday event. A philosopher named Cicero said Ubi Societas, Ibi Ius, Ibi Crime which means there is a society, there is law and there is crime. The benefit of studying criminology is that criminology contributes to the formulation of new legislation (the Criminalization Process), explaining the causes of crime (Criminal Ethylogy) which in turn creates efforts to prevent crime. Another issue regulated in the child protection law is how to punish adults who commit crimes against children and also the responsibility of parents, society and the state in protecting children. This research was conducted in North Maluku, precisely in the city of Ternate. This research will use a descriptive type of analysis with a qualitative approach. Abstract

The recognition and respect for the indigenous people along with their traditional rights is affirmed on the article 18B verse (2) of the 1945 Constitution of the Republic of Indonesia; that includes the indigenous people of Hibualamo in North Halmahera regency.  The spatial planning contect requires the involvement of the indigenous people to achive a balance between development and tenure rights so that it will be in line with the local wisdom to support sustainable development.

Abstract

Dengan di undangkannya Undang – Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum memberikan peluang untuk peningkatan demokrasi dengan memperhatikan adanya pelanggaran yang dilakukan dan menjadi tugas pokok dari Badan Pengawas Pemilihan Umum Kabupaten/kota. Efektifitas penegakan pelangaran administrasi oleh BAWASLU Kabupaten Halmahera Selatan berdasarkan Pasal 240 Ayat (1) Huruf (k) dan (m) Undang – undang Nomor 7 Tahun 2017 tentang PEMILU, belum maksimal dalam memberikan keputusan kepada Calon Anggota DPRD Kabupaten Halmahera Selatan Dapil II Makian Kayoa yang telah memenuhi unsur formil maupun materil dalam pemeriksaan Persidangan Pelanggaran Administrasi. Selain itu, Faktor yang mempengaruhi penegakan Pelanggaran Administrasi pada Pemilihan Umum serentak Anggota DPRD oleh BAWASLU Halmahera Selatan tahun 2019 yaitu jumlah personil dan sarana fasilitas penunjang dalam pemeriksaan persidangan tidak memadai, antara tugas dengan dana operasional tidak sebanding dalam penganan kasus pelanggaran Administrasi.

Abstract

This research aims to discuss the background to the policy on the obligation to change Village-Owned Enterprises (BUMDes) from business entities to legal entities and the development of BUMDes legal entity status in Banyudono District, Boyolali Regency. Law Number 11 of 2020 concerning Job Creation in Article 117 amends Article 1 (6) of Law Number 6 of 2014 concerning Villages. Before the changes to the Village Law, BUMDes were described as business entities, whereas in the Job Creation Law BUMDes were described as legal entities. The research method used is empirical juridical, located in Banyudono District, Boyolali Regency, Central Java. The results of the discussion showed that 1) The aim of the promulgation of Article 117 of the Job Creation Law is to be able to absorb the widest possible Indonesian workforce amidst increasingly competitive competition and the demands of economic globalization, including at the village level by optimizing BUMDes. 2) In Banyudono District, Boyolali Regency, there are 15 (fifteen) villages and only 5 (five) BUMDes, but there are 2 (two) BUMDes that have not yet been incorporated, namely BUMDes Banyudono and BUMDes Hamlet.
