Abstract

Abstract: The relocation of the National Capital City (IKN) from Jakarta to East Kalimantan, as outlined in Law No. 3/2022, poses a serious challenge to the recognition and protection of the customary rights of indigenous peoples. Although Article 18B paragraph (2) of the 1945 Constitution and its derivative regulations (UUPA, UU IKN, PP 65/2022, Permen ATR 18/2019) provide a juridical basis, implementation in the field is still hampered by the absence of a Regional Regulation on customary recognition, overlapping land claims, and low participation of indigenous peoples. This study employs an analytical normative-descriptive legal approach, utilizing secondary data sources to map the legal framework, document forms of tenure conflicts, and assess the gap between juridical expectations and the reality of implementation. The results of the analysis revealed that the absence of a formal mechanism for recognition and SOPs for customary land registration led to the vulnerability of customary rights to land conversion. Constitutional Court Decision No. 35/PUUX/2012, which recognizes customary forests, has not been followed by concrete legislative steps. As a solution, it is suggested to revise and harmonize UUPA regulations, ratify customary recognition regulations, participatory mapping, prepare SOPs for customary land registration, and FPIC-based dispute resolution mechanisms to realize inclusive and equitable IKN development. Abstract: Pemindahan Ibu Kota Negara (IKN) dari Jakarta ke Kalimantan Timur melalui UU No. 3/2022 menimbulkan tantangan serius bagi pengakuan dan perlindungan hak ulayat masyarakat adat. Meskipun Pasal 18B ayat (2) UUD 1945 dan regulasi turunannya (UUPA, UU IKN, PP 65/2022, Permen ATR 18/2019) memberikan landasan yuridis, pelaksanaan di lapangan masih terhambat oleh ketiadaan Perda pengakuan adat, tumpang‑tindih klaim lahan, dan rendahnya partisipasi masyarakat adat. Studi ini menggunakan pendekatan hukum normatif-deskriptif analitis dengan sumber data sekunder untuk memetakan kerangka hukum, merekam bentuk-bentuk konflik tenurial, serta menilai kesenjangan antara harapan yuridis dan realitas implementasi. Hasil analisis mengungkap bahwa kurangnya mekanisme formal pengakuan dan SOP pendaftaran tanah ulayat menyebabkan rentannya hak ulayat terhadap alih fungsi lahan. Putusan MK No. 35/PUU‑X/2012 yang mengakui hutan adat belum diikuti oleh langkah legislatif konkret. Sebagai solusi, disarankan perevisian dan harmonisasi regulasi UUPA, pengesahan Perda pengakuan adat, pemetaan partisipatif, penyusunan SOP pendaftaran tanah ulayat, dan mekanisme penyelesaian sengketa berbasis FPIC untuk mewujudkan pembangunan IKN yang inklusif dan berkeadilan. Abstract

Abstract: Restorative justice is a new paradigm in the criminal justice system that focuses on restoring social relations between perpetrators, victims, and society. This study aims to analyze restorative justice as the implementation of the values of maqāṣid al-sharī'ah in the Indonesian legal system. This research uses a normative legal approach and a descriptive qualitative method, drawing on relevant laws and regulations and Islamic legal literature. The results of the study show that the application of restorative justice in Indonesia, as stipulated in Law Number 11 of 2012, Prosecutor's Regulation Number 15 of 2020, and Police Regulation Number 8 of 2021, represents the values of ḥifẓ al-nafs, ḥifẓ al-māl, and ḥifẓ al-'ird in maqāṣid al-sharī'ah. The principles of peace (ṣulḥ), forgiveness ('afw), and social restoration are reflected in efforts to resolve cases outside the judicial channels. Thus, restorative justice not only offers a humanist and participatory legal settlement but also affirms the relevance of sharia values in the reform of national law, grounded in benefits and social justice. Keywords: Restorative justice, maqāṣid al-sharī'ah, Islamic law, benefits, Indonesian legal system.   Abstrak: Keadilan restoratif merupakan paradigma baru dalam sistem hukum pidana yang menitikberatkan pada pemulihan hubungan sosial antara pelaku, korban, dan masyarakat. Penelitian ini bertujuan untuk menganalisis keadilan restoratif sebagai implementasi nilai-nilai maqāṣid al-sharī‘ah dalam sistem hukum Indonesia. Penelitian ini menggunakan pendekatan hukum normatif dengan metode kualitatif deskriptif, melalui kajian terhadap peraturan perundang-undangan dan literatur hukum Islam yang relevan. Hasil penelitian menunjukkan bahwa penerapan keadilan restoratif di Indonesia, sebagaimana diatur dalam Undang-Undang Nomor 11 Tahun 2012, Peraturan Kejaksaan Nomor 15 Tahun 2020, dan Peraturan Kepolisian Nomor 8 Tahun 2021, merepresentasikan nilai-nilai ḥifẓ al-nafs, ḥifẓ al-māl, dan ḥifẓ al-‘ird dalam maqāṣid al-sharī‘ah. Prinsip perdamaian (ṣulḥ), pengampunan (‘afw), dan pemulihan sosial tercermin dalam upaya penyelesaian perkara di luar jalur peradilan. Dengan demikian, keadilan restoratif tidak hanya menghadirkan penyelesaian hukum yang humanis dan partisipatif, tetapi juga menegaskan relevansi nilai-nilai syariah dalam pembaruan hukum nasional berbasis kemaslahatan dan keadilan sosial. Abstract

Abstract: Domestic conflicts often stem from gender inequality, which triggers role tensions, communication dysfunction, and violence. This study analyzes the relevance of the concept of mubādalah (the principle of reciprocity) in Islamic family law as a structural-functional solution for building domestic harmony. Through a qualitative approach using library research methods, this study integrates the analysis of Islamic texts (the Qur'an, hadith, Indonesian positive law) and family sociology theory. The results show that: First, the concept of mubādalah is manifested in five operational pillars: (1) shared responsibility (mitsāqan ghalīẓan), (2) husband-wife partnership (zawj), (3) proper social interaction (mu‘āsharah bil ma‘rūf), (4) dialogue (tasyāwur), and (5) mutual affection (tahābub). Second, these pillars reconstruct gender relations through mutuality, thereby overcoming conflicts caused by injustice. Third, the sociological perspective of the family confirms mubādalah as an adaptive mechanism, whereby role flexibility strengthens household resilience in the face of socioeconomic change. This study concludes that mubādalah is not only a normative framework, but also a practical solution for Muslim couples to achieve equal and substantive household harmony. Keywords: Mubādalah, Family Law, Gender, Functional Sociology, Conflict.   Abstrak: Konflik rumah tangga sering kali berakar dari ketidakadilan gender yang memicu ketegangan peran, disfungsi komunikasi, dan kekerasan. Studi ini menganalisis relevansi konsep mubādalah (prinsip kesalingan) dalam hukum keluarga Islam sebagai solusi struktural-fungsional untuk membangun keharmonisan rumah tangga. Melalui pendekatan kualitatif dengan metode penelitian kepustakaan, penelitian ini mengintegrasikan analisis teks-teks Islam (Al-Qur'an, hadis, hukum positif Indonesia) dan teori sosiologi keluarga. Hasil penelitian menunjukkan bahwa: Pertama, konsep mubādalah termanifestasi dalam lima pilar operasional: (1) tanggung jawab bersama (mitsāqan ghalīẓan), (2) kemitraan suami-istri (zawj), (3) pergaulan yang patut (mu‘āsharah bil ma‘rūf), (4) dialog (tasyāwur), dan (5) kasih sayang timbal balik (tahābub). Kedua, pilar-pilar ini merekonstruksi hubungan gender melalui mutualitas, sehingga mengatasi konflik yang ditimbulkan oleh ketidakadilan. Ketiga, perspektif sosiologi keluarga mengonfirmasi mubādalah sebagai mekanisme adaptif, dimana fleksibilitas peran memperkuat ketahanan rumah tangga menghadapi perubahan sosioekonomi. Studi ini menyimpulkan mubādalah bukan hanya sebagai kerangka normatif, tetapi juga sebagai solusi praktis bagi pasangan Muslim untuk mewujudkan keharmonisan rumah tangga yang setara dan substantif. Abstract

Abstract: Islamic Halal Law in the Shafi'i school in Brunei Darussalam is firmly rooted in the country's constitution, which stipulates the Shafi'i school as the basis of Islamic law, including meat and poultry products. This article analyzes the application of the fiqh of the Shafi'i madhhab in the Brunei Darussalam halal legal system, especially in meat and poultry products. This research is normative juridical. Data collection is carried out through a study of halal regulations in Brunei Darussalam and through literary studies of books or articles on halal, especially in fiqh and legal studies. The collected data were analyzed descriptively. This study concludes that, constitutionally, Brunei establishes the Shafi'i school as the basis for binding Islamic law in the formulation of laws, including the Halal Meat Law (Article 183) and the Halal Certification and Labeling Order 2005. The application of Shafi'i fiqh in Brunei is carried out through three models: textual adoption of fiqh law, substantive adaptation in industrial technical standards, and modern ijtihad to contemporary issues such as stunning and basmalah reading. The principle of halalan ṭayyiban translates into a strict system of sanitary supervision, certification, and halal audits. This application reflects the harmonization between classical Islamic law and modern needs by maintaining the maqāṣid al-sharī'ah, in particular ḥifẓ al-dīn and ḥifẓ al-nafs. The Brunei model shows that Shafi'i fiqh can be institutionalized in a contemporary way without losing its theological authenticity and ethical foundations in sharia. Keywords: Fiqh Shafi'i, halal law, meat, poultry, regulations.   Abstrak: Hukum Halal Islam dalam mazhab Syafi’i di Brunei Darussalam berakar kuat pada konstitusi negara yang menetapkan mazhab Syafi’i sebagai dasar perundangan Islam, termasuk produk daging dan unggas. Artikel ini menganalisis penerapan fiqh mazhab Syafi’i dalam sistem hukum halal Brunei Darussalam, khususnya pada produk daging dan unggas. Penelitian ini adalah yuridis normatif. Pengumpulan data dilakukan melalui studi regulasi halal di Brunei Darussalam dan studi literer dari buku atau artikel yang membahas tentang halal, khususnya dari kajian fikih dan hukum. Data yang terkumpul dianalisis secara deskriptif. Penelitian ini menyimpulkan bahwa secara konstitusional, Brunei menetapkan mazhab Syafi’i sebagai dasar hukum Islam yang mengikat dalam pembentukan undang-undang, termasuk Halal Meat Law (Pasal 183) dan Halal Certification and Labeling Order 2005. Penerapan fiqh Syafi’i di Brunei dilakukan melalui tiga model: adopsi tekstual terhadap hukum fiqh, adaptasi substantif dalam standar teknis industri, dan ijtihad modern terhadap isu kontemporer seperti pemingsanan (stunning) dan pembacaan basmalah. Prinsip halalan ṭayyiban diterjemahkan menjadi sistem pengawasan kebersihan, sertifikasi, dan audit halal yang ketat. Penerapan ini mencerminkan harmonisasi antara hukum Islam klasik dan kebutuhan modern dengan mempertahankan maqāṣid al-sharī‘ah, khususnya ḥifẓ al-dīn dan ḥifẓ al-nafs. Model Brunei menunjukkan bahwa fiqh Syafi’i dapat diinstitusionalisasi secara modern tanpa kehilangan otentisitas teologis dan etika syariah. Abstract

Abstract: The large number of unregistered marriages in Gresik causes problems in population administration. Therefore, the Gresik Religious Court and the Gresik Regency Government collaborated to hold an Integrated Isbat Nikah for married couples who have not registered their marriage. This study aims to examine the implementation of the Integrated Isbat Nikah in Gresik Regency from the perspective of Maqāṣid al-Sharī'ah. This research uses a qualitative approach with a type of field research. Data were obtained through interviews, document studies, and literature studies. The collected data were analyzed descriptively with the theory of Maqāṣid al-Sharī'ah. The study concluded that the integrated isbat nikah was conducted in accordance with Gresik Regent Regulation Number 74 of 2023 and PERMA Number 1 of 2015, which concern integrated services for circumference sessions. The main goal is to provide legal certainty for marital status, protect women and children, and ensure easy access to marriage legality at no cost. The trial was held in a religious court, and participants obtained three legal products simultaneously: court determination, marriage book, and population documents (KTP, KK, and child birth certificate). From the perspective of Maqāṣid al-Sharī'ah, this program embodies the five main objectives of the shari'a (al-uṣūl al-khamsah), namely the maintenance of religion (ḥifẓ al-dīn), the soul (ḥifẓ al-nafs), intellect (ḥifẓ al-'aql), heredity (ḥifẓ al-nasl), and wealth (ḥifẓ al-māl). The most dominant aspects reflected in the implementation of this program are ḥifẓ al-nasl and ḥifẓ al-māl, because both directly protect the clarity of the child's destiny and the economic rights of the family. Keywords: Integrated Isbat Nikah, Religious Courts, Maqāṣid al-Sharī'ah, Protection of Descendants, Islamic Family Law.   Abstrak: Banyaknya perkawinan yang tidak tercatat di Gresik, menimbulkan masalah dalam administrasi kependudukan. Karena itu, Pengadilan Agama Gresik dan Pemerintah Kabupaten Gresik bekerjasama mengadakan Isbat Nikah Terpadu bagi pasangan suami istri yang belum mencatatkan perkawinannya. Penelitian ini bertujuan mengkaji pelaksanaan Sidang Isbat Nikah Terpadu di Kabupaten Gresik dalam perspektif Maqāṣid al-Sharī‘ah. Penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian lapangan. Data diperoleh melalui wawancara, studi dokumen dan studi literatur. Data yang terkumpul dianalisis secara deskriptif dengan teori Maqāṣid al-Sharī'ah. Hasil penelitian menyimpulkan bahwa isbat nikah terpadu dilaksanakan berdasarkan Peraturan Bupati Gresik Nomor 74 Tahun 2023 dan PERMA Nomor 1 Tahun 2015 tentang pelayanan terpadu sidang keliling. Tujuan utamanya ialah memberikan kepastian hukum terhadap status perkawinan, perlindungan terhadap perempuan dan anak, serta kemudahan akses legalitas perkawinan tanpa biaya. Sidang dilakukan di pengadilan agama dan peserta memperoleh tiga produk hukum secara bersamaan: penetapan pengadilan, buku nikah, serta dokumen kependudukan (KTP, KK, dan akta kelahiran anak). Dari perspektif Maqāṣid al-Sharī‘ah, program ini mewujudkan lima tujuan pokok syariat (al-uṣūl al-khamsah), yaitu pemeliharaan agama (ḥifẓ al-dīn), jiwa (ḥifẓ al-nafs), akal (ḥifẓ al-‘aql), keturunan (ḥifẓ al-nasl), dan harta (ḥifẓ al-māl). Aspek yang paling dominan tercermin dalam pelaksanaan program ini adalah ḥifẓ al-nasl dan ḥifẓ al-māl, karena keduanya secara langsung melindungi kejelasan nasab anak serta hak-hak ekonomi keluarga. Kata kunci: Isbat Nikah Terpadu, Pengadilan Agama, Maqāṣid al-Sharī‘ah, Perlindungan Keturunan, Hukum Keluarga Islam.
