Abstract

Corruption have widespread and even became a culture of Indonesia that the government set up a new system, known as Reversal Burden Of Proof. Even though the model is considered to be contrary to the fundamental principle of the rule of law, but in Islamic law and the evidence, it is legally seen as a necessity to eradicating corruption. It is based on the demands and the welfare of Reversal Burden Of Proof Formulation.

Abstract

Dalam kehidupan bermasyarakat dan beragama, sudah seharusnya kita mengenal tentang perkawinan atau ikatan pernikahan antara satu dengan yang lainnya, karena menurut ajaran Islam hal ini dianjurkan untuk mendapatkan ketentraman dan juga keturunanbagi yang melakukannya. Pernikahan yang dilakukan menurut fiqih munakahatt selain memenuhi rukun nikah, juga harusdicatat oleh PegawaiPencatat Nikah di Kantor Urusan Agama, karenadalamhukum Indonesia terdapat pada pasal 2 Undang-Undang No 1 Tahun 1974 ayat 2 dinyatakanbahwa“tiap-tiap perkawinan dicatat menurut peraturan perundang-undangan yang berlaku”. Namun sejalan dengan perkembangan zaman juga dinamika yang terjadi dalam masyarakat kita, maka banyak sekali terdapat perubahan, dan di masa sekarang masyarakat modern menginginkan akra surat untuk dapat dijadikan bukti otentik, karena tidak cukup hanya saksi hidup saja.Atas dasar ini sangatlah diperlukan sebuah bukti kuat dan mengikat yang disebut dengan akta. Dengan demikian akta adalah salah satu ketentuan pernikahan yang harus dipenuhi.

Abstract

Mayoritas ulama’ telah sepakat bahwa syarat sah shalat berjamaah adalah (1) Niat bermakmum, (2) Posisi makmum tidak di depan imam, (3) Mengetahui gerak perpindahan imam, (4) Imam dan makmum berkumpul dalam satu tempat, (5) Makmum tidak tertinggal dalam rukum Fi’li pada imam, (6) Makmum tidak tertinggal dari imam tiga rukun Fi’li secara berturut-turut, (7) Tidak bermakmum pada imam yang diyakini batal shalatnya, (8)Tidak bermakmum pada orang yang menjadi makmum, (9) Orang yang bacaannya bagus tidak boleh bermakmum pada orang yang Ummi. Dari ketentuan ini, shalat berjamaah secara virtual, tidak mengikuti ketentuan di atas, Pertama, bisa saja posisi makmum lebih maju dari pada imam, misalnya, imam shalat di masjid yang lokasinya ada di jantung kota, sedangkan makmum shalat di rumahnya yang lokasi di sebelah barat masjid, tentu ini, sudah tidak memenuhi syarat sah shalat berjamaah. Kedua, imam dan makmum berkumpul dalam satu tempat Mafhum Mukhalafah-nya, jika antara imam dan makmum di tempat berbeda, maka tidak sah shalatnya.

Abstract

Direktur Jenderal Organisasi Kesehatan Dunia (WHO) Tedros Adhanom Ghebreyesus secara resmi mengumumkan virus Corona (COVID-19) sebagai pandemi, Pandemi terjadi jika suatu penyakit menular tersebar dengan mudah dari manusia ke manusia di berbagai tempat di seluruh dunia. Berangkat dari data tersebut, Keluarga sebagai miniature dunia, rumah tempat pulang, bergantung dan saling menopang antara anggota keluarga yang satu dengan anggota keluarga yang lainnya menjadi tempat yang paling dasar untuk menjadi pijakan bagaimana menyikapi virus corona tersebut, Suami dan Istri sebagai penggerak kehidupan di dalam rumah tangga dipaksa untuk merekonstruksi ulang hak dan kewajiban masing-masing, Prinsip Persamaan (Kesetaraan dan Keadilan) Substantif memastikan bahwa lak-laki dan perempuan memiliki persamaan kedudukan di muka hukum secara de yure dan de facto. Prinsip ini juga memastikan bahwa perempuan dan laki-laki memiliki akses yang sama terhadap sumber daya, memiliki peluang atau kesempatan yang sama, dan menikmati manfaat yang sama dari pembangunan atau kebijakan, Undang-Undang memperkuat apa yang merupakan hal yang sepatutnya menjadi kewajiban suami isteri. Suami yang lalai memberikan hal-hal yang perlu kepada isterinya, itu dapat dipaksakan dengan melalui pengadilan. Isteri yang meninggalkan rumah tanpa alasan-alasan yang sah, maka ia kehilangan hak untuk pemberian nafkah. Jika suami/isteri melalaikan kewajibannya masing-masing dapat mengajukan gugatan ke Pengadilan Agama.

Abstract

Ada beberapa definisi nikah yang dikemukakan ulama fiqh, tetapi seluruh definisi tersebut mengandung esensi yang sama meskipun redaksionalnya berbeda. Ulama Mazhab Syafi’i mendefinisikannya dengan “akad yang mengandung kebolehan melakukan hubungan suami istri dengan lafaz nikah atau kawin atau yang semakna dengan itu”. Sedangkan ulama Mazhab Hanafi mendefinisikannya dengan “akad yang memfaedahkan kehalalannyauntuk melakukan hubungan suami istri antara seorang laki-laki dan seorang perempuan selama tidak ada halangan syara’.

Abstract

Agama Islam diturunkan untuk menjawab persoalan manusia secara keseluruhan yang dalam fungsinya manusia sebagai khalifatullah fil ardh (God Vicegerent en earth) menggunakan ajaran agama Islam untuk mewujudkan misi Allah dimuka bumi ini. Oleh karena itu ajaran agama Islam harus dilaksanakan dalam segala aspek kehidupan. Dalam pelaksanaannya ajaran agama Islam sebagai pesan gaib perlu diterjemahkan, ditafsirkan, dan dicari relevansinya, sehingga dapat mewarnai tata kehidupan sosial-ekonomi, politik, dan budaya masyarakat. Dengan demikian agama tidak selalu berada dalam tataran normatif saja. Permasalahan selanjutnya yang muncul adalah barang atau jasa apakah yang perlu disediakan masyarakat atau pemerintah. Dari mana sumber dana yang digunakan untuk menyediakan barang atau jasa tersebut, bagaimana alokasi dan distribusi barang atau jasa yang disediakan oleh masyarakat atau pemerintah tersebut, apakah kriteria untuk menyediakan barang atau jasa tertentu layak disediakan oleh pemerintah atau masyarakat, dan sebagainya. Oleh karena itu, dalam tahap awal perlu dikaji bagaimana keuangan publik ini dipraktikan oleh Rosulullah SAW. dan para sahabatnya, prinsip-prinsip apakah yang bisa disarikan dari sunnah Rosulullah SAW. Abstract

One form of corruption is gratification. This crime is an important element in the reward exchange system and mechanism. The article regulating gratification is Article 12 C of Law 20/2001. The article states that officials who receive gratuities then report them to the Corruption Eradication Commission (KPK), so that in a formal juridical manner, such gifts are not considered bribes and cannot be criminalized. This article is considered to provide wider space and freedom for criminals because it is considered a space of tolerance for those who have received gratuities so that the perpetrators can easily repeat their actions. Therefore it is important to understand these rules with the Dzariah Sadd approach. Based on the concept of Sadd Dzariah, punishment for the perpetrator of gratification is not necessary to reject mafsadat. Thus, this rule of elimination is not justified because it will give mafsadat that is greater than benefit. Abstract

The pros and cons of adultery are increasingly interesting to discuss. Especially the difference in views between the Constitutional Court and the MUI in deciding on the nasab relationship of the adulterous child. According to the Constitutional Court, children out of wedlock still have civil relations with men which can be proven based on science and technology and/or other evidence. Meanwhile, according to the MUI, to sue the biological father to support or receive inheritance, the lineage of the child does not need to be determined by the lineage with the biological father. This MUI decision refers to the opinions of scholars scattered in several tours. The method used in this study is a qualitative method, namely describing the views of fuqaha 'about adultery children. Data collection techniques used in this research are editing, coding, and tabulating. After the data has been collected, it is then analyzed using content analysis in the sense of capturing the implied message of one or several statements. To test the validity of the data in this study, the researcher took several steps, namely making careful observations, triangulating sources, and conducting discussions with colleagues. The finding of this study is that there are several opinions of fuqaha' who discriminate against adulterous children. From these findings, the researchers produced answers to the problem formulation. First, of the three issues related to adultery, the majority of jurists agree on the issue of lineage and inheritance. In terms of lineage, and inheritance, the child of adultery does not get the slightest rights from his biological father. Meanwhile, regarding the issue of adulterous children becoming prayer priests, the fuqaha' differed in opinion. Second, From some of the opinions of the scholars above, regarding the issue of an adulterous child becoming a prayer priest, it is Hanafiyah's opinion that discriminates more against an adulterous child. Likewise in the matter of lineage, although most scholars agree, including Imam Syafii, socially, the conclusion tends to discriminate against adulterous children, even though by argument their footing can be accounted for.

Abstract

Tajdid Nikah is renewing the marriage, with the meaning that there has been a valid marriage contract according to the syara', then with the intention of being Ihtiyath (be careful) and making the heart comfortable, the marriage contract is carried out one more time or more. If we classify the occurrence of tajdid Nikah in the hamlet of Dawuhan Suco Lor, there are two kinds, first the newlyweds, this part is divided into two more, namely; (1) based on auspicious days (according to Javanese calculations), for example when registering, KUA determines the date of August 15, 2022, while according to Javanese calculations it is a good day on August 2, 2022, then the newlyweds have a contract first with the Kiai, then on August 15, 2022, the contract will be again at KUA for the second time. (2) the newlywed couple or one of them, whose age does not meet the marriage law, then the marriage is still carried out, after the age meets the marriage law, the contract is again held at the KUA. Second, old brides, these two also have two, (1) because there, for one year, must occur, experiencing difficulties, difficulties in overcoming difficulties, words are thrown out without realizing it. (2) based on a figure's suggestion, for example, if the contract is repeated, the sustenance will be increased, the household life will be more harmonious and so on. With regard to the 'ulama' Tajdid Nikah, there are several differences of opinion. The first is of the opinion that the Tajdid Nikah is not acceptable because it can damage the first marriage contract. The second opinion of the majority of scholars, who say that the Tajdid Nikah is legal and does not damage the marriage contract, not as an acknowledgment of the damage to the first contract. So that it does not reduce the number of talak counts, because most of the purposes of tajdid are as a form of confirmation or caution.

Abstract

In the modern era, career women are in fact something that we cannot deny. Even though conceptually, it raises the pros and cons of thinking. On the one hand, career women are seen as moving towards equality with men. On the other hand, career women are seen as a step backwards in maintaining an eastern self-image. Based on this background, the objectives of this research are: 1). Knowing the efforts of career women in realizing a sakinah family. 2). Knowing the position of career women in the sakinah family. This research was conducted on female lecturers at Bondowoso University, using a descriptive qualitative approach, which attempted to describe some of the data obtained from the field, either by interview, observation, or documentation. Then proceed with the data analysis process. The results of this study indicate: 1). The efforts of women who have a career as lecturers at Bondowoso University in realizing a sakinah family include: a. Quality Time, in the sense that we must be able to maximize time with family, so that the importance of our existence is felt by them. b. Maintain good communication. c. Mutual open attitude. d. Mutual understanding. e. Time management. f. Husband's support for his wife for a career. g. Keeping the family intact. 2) Based on Islamic law, the position of a career woman in the concept of a sakinah family is to remain in the position of her husband so that she must still be obedient and obedient to her husband, because, in fact The husband is the leader of the family. eye of law.
