Abstract

Local Election is considered not to reflect democracy, there are still obstacles in the form of a large percentage of support requirements that make it difficult for independent candidates. Responding to these problems, this study aims to explain the large percentage of support requirements that are burdensome for independent candidates and the importance of independent candidates in the local election. The research method used is literature study with a legal philosophy approach. The data are literature literacy materials related to the research theme. The results showed that the percentage of support for independent candidates in the local election was considered too large. So that it hinders and makes independent candidates unable to become candidates in the elections. This kills the life of democracy that is being built by Indonesia. Whereas the existence of independent candidates is important as a counterweight and a new color giver in the political saturation of the old ways that do not produce quality leaders. It is necessary to change the percentage of support for independent candidates so as not to hinder democracy.

Abstract

This study aims to determine whether the settlement of criminal cases through restorative justice is an effort to fulfill the constitutional rights of citizens. The method used in this research is normative legal research with a statutory approach and a conceptual approach. The results of the study show that the settlement of cases through restorative justice is an effort to fulfill the constitutional rights of citizens because the principle of resolving cases through restorative justice can be said to be more able to guarantee justice and equality before the law (equality before the law) as regulated in Article 27 paragraph (1), Article 28D paragraph (1) and Article 28I paragraph (2) of the 1945 Constitution of the Republic of Indonesia.

Abstract

The Anthropocene era was marked by a decline in the quality of the environment including being influenced by the law itself, for example the Job Creation Law was considered to have a negative impact on efforts to protect the environment. This research will analyze the development of legal instruments and the role of the Constitutional Court in environmental protection. This research will be conducted by studying legal literature. The urgency of changing the environmental law political paradigm (green policy) in Indonesia based on the ecocentrism paradigm will provide stronger environmental law political guidelines. Efforts to strengthen the paradigm of environmental protection are carried out by reconstructing the 1945 Constitution of the Republic of Indonesia by granting rights to the environment and setting state obligations. There is a role for the Constitutional Court through Decision Number 32/PUU-VII/2010 and Number 18/PUU-XII/2014 by providing guidelines for the development of more comprehensive environmental law.

Abstract

Public participation is the heart of the legislative process. Participation is crucial to ensure that the laws produced genuinely reflect the needs and aspirations of society, as well as to embody democracy and strengthen legitimacy. Through a normative juridical approach, the research aims to compare public participation in law-making in five democratic countries, namely Indonesia, the United States, the Philippines, South Africa, and South Korea, by analyzing their Constitutions and laws and regulations. The findings can then be used as best practices that can be adopted by Indonesia. The results of the study show that the Constitutions of the United States, the Philippines, South Africa, and South Korea guarantee public participation in the legislative process. In contrast, the Indonesian Constitution only affirms People’s Sovereignty. However, normatively, Indonesia regulates the role of the public more comprehensively and technically in the law-making process at every stage, further reinforced by the Constitutional Court Decision No. 91/PUU-XVIII/2020, which mandates that the role of the public be more meaningful in law-making, as participation is a constitutional right held by citizens.

Abstract

This research focuses on the constitutionality of the Regional-Owned Enterprises authority in the management of New and Renewable Energy. There are two research objectives to be obtained. First, the classification of EBT in the major production branches and the dominance over people’s lives refers to the dynamics of laws and decisions of the Constitutional Court. Second, the determination of BUMD's authority over the management of EBT refers to the state's control rights according to MK. This research is normative legal research based on secondary data. This research showed two conclusions. First, the classification of EBT includes nuclear, coal methane gas, liquefied and gasified coal, geothermal, and water flows and waterfalls. Second, the position of BUMD is classified into two models; (1) BUMN is prioritized over BUMD; and (2) BUMD is equivalent to BUMN. However, for SDA which are not included in this qualification, the position of these entities are equal.

Abstract

Pasca Putusan MK No.93/PUU-X/2012, masih terdapat sengketa perbankan syariah yang kemudian diadili dan diselesaikan melalui Peradilan Umum. Seperti dalam Putusan Pengadilan Negeri Padang No. 27/Pdt.G.S/2022/PN Pdg. Penelitian ini bertujuan untuk mengurai titik singgung wewenang penyelesaian sengketa perbankan syariah pasca Putusan MK No.93/PUU-X/2012. Penelitian ini dilakukan dengan menggunakan jenis penelitian yuridis normatif. Hasil penelitian menunjukkan bahwa Pasca Putusan MK No.93/PUU-X/2012, masih terjadi ketidakpastian hukum dalam penyelesaian sengketa perbankan syariah disebabkan keberadaan Pasal 50 ayat (2) UU Peradilan Agama. Ketentuan tersebut mengakibatkan kekaburan titik singgung wewenang mengadili Peradilan Agama dan Peradilan Umum dalam penyelesaian sengketa hak milik, sengketa perbuatan melawan hukum (PMH), dan sengketa konsumen. Agar nasabah ataupun perbankan syariah mendapatkan kepastian hukum dalam penyelesaian sengketa sesuai amanaat Pasal 28D ayat (1) UUD 1945, diperlukan perubahan terhadap norma dalam Pasal 50 ayat (2) UU Peradilan Agama dan juga UU 8/1999.

Abstract

The 1945 Constitution of the Republic of Indonesia (UUD 1945) does not explicitly define “election result disputes.” This definition is only found in several laws and Constitutional Court (MK) Regulations, limited to the context of “vote counting errors.” This research aims to reformulate the concept of election results as an object of dispute in the MK to ensure certainty and justice for candidates and/or candidate pairs. This study uses a normative juridical research method. Elections, as an embodiment of the people’s sovereignty, result in the acquisition of votes and the determination of elected candidates and/or candidate pairs to occupy political positions in government. The resolution of election result disputes in the MK relates to objections to the validity of the vote count, both quantitatively and qualitatively. The examination of the validity of vote acquisition maps the MK’s authority into two scopes: absolute competence and relative competence. The MK’s absolute competence relates to resolving disputes over vote acquisition, while relative competence pertains to ensuring constitutionality, including adherence to election regulations by election organizers during the election stages.

Abstract

Penelitian ini berupaya untuk menjawab persoalan hukum terkait pembatasan partisipasi publik dalam proses penyusunan dokumen lingkungan di dalam Pasal 22 angka 4 dan Pasal 22 angka 5 Undang-Undang Cipta Kerja. Problematika hukum tersebut menarik untuk diteliti utamanya jika dikaitkan dengan hak konstitusional setiap warga negara untuk ikut berperan serta dalam perlindungan dan pengelolaan lingkungan hidup. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan filosofis. Hasil penelitian dan analisa terhadap hasil penelitian menyimpulkan bahwa partisipasi publik merupakan hak konstitusional, sehingga pembatasan terhadap partisipasi publik merupakan bentuk pelanggaran konstitusional; pembatasan partisipasi berpotensi menimbulkan antinomi atau konflik norma antara satu pasal dengan pasal lainnya dalam satu peraturan perundang-undangan dan antara satu undang-undang dengan undang-undang yang lain; dan dalam lingkup yang lebih luas, pembatasan partisipasi publik juga bertentangan dengan prinsip hukum lingkungan internasional, khususnya hukum lingkungan yang bersifat prosedural.

Abstract

The arbitrariness of creditors in carrying out parate executions is very disturbing and causes material and immaterial losses for debtors, this is because there are inappropriate norms in a quo article in the form of the phrase that the strength of a fiduciary guarantee certificate is equal with a valid court decision. fixed law and the phrase breach of contract. This research aims to describe changes in the implementation of parate execution as regulated in Article 15 paragraph 2 and paragraph 3 of Law 42/1999 before and after the Constitutional Court Decision and the implications of the Constitutional Court decision for the current fiduciary concept. This research uses a type of normative juridical research. The research results show that Article 15 paragraphs 2 and 3 conflict with the 1945 Constitution, this is because the basic norms contained in this Article do not have a single interpretation so they can be misused by creditors against debtors. With the Constitutional Court’s decision regarding the material review of the a quo article, it provides a clear picture of the current fiduciary guarantee mechanism. In order to follow up on justice and equality between debtors and creditors, it is necessary for the government to play a role in regulating it more efficiently.
