Abstract

Perkembangan pertumbuhan sistem ekonomi syariah, menuntut terhadap adanya penyesuaian-penyesuaian aturan hukum yang diberlakukan, khususnya terkait dengan penyelesaian sengketa yang terjadi. Baik secara litigasi maupun secara non litigasi. Termasuk bagian upaya penyelesaian ekonomi syariah, adalah melalui badan arbitrase syariah. Namun dalam perspektif yuridis, aturan mengenai kewenangan memberikan putusan eksekusi dan pembatalan terhadap putusan arbitrase syariah masih terjadi dualisme antara Peradilan Umum dan Peradilan Agama. Hal ini mencerminkan adanya ketidakpastian hukum dalam masalah tersebut. Melalui penelitian hukum normatif atau penelitian hukum doktrinal ini, penelitian ini bertujuan untuk menemukan jawaban-jawaban yang benar dengan melakukan pembuktian kebenaran yang dicari dari preskripsi-preskipsi hukum yang tertulis dalam kitab Undang-Undang serta sumber hukum lainnya. Penelitian ini menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan historis (historical approach). Penelitian ini difokuskan untuk mengkaji penerapan kaidah-kaidah atau norma norma dalam hukum positif tentang kepastian hukum pelaksanaan eksekusi dan pembatalan putusan arbitrase syariah, khususnya pasca Putusan Mahkamah Konstitusi Nomor 93/PUU-X/2012. Pertentangan norma hukum tentang kewenangan pelaksanaan eksekusi dan pembatalan putusan arbitrase tersebut, meskipun secara yuridis terdapat pertentangan, namun  Mahkamah Agung telah melakukan langkah politik hukum untuk menyelesaikan dualisme kewenangan tersebut yang dapat menyelesaikan dalam jangka waktu pendek. Namun untuk penyelesaian jangka panjang, perlu adanya pembenahan terhadap peraturan perundang-undangan yang ada, guna menjamin kepastian hukum bagi para pencari keadilan.The development of the growth Islamic economic system requires the adjustments to the rule of law applied, particularly related to the settlements of disputes that occur, both litigation and non-litigation. One of the parts of  efforts to solve sharia economics is through Islamic arbitration bodies. But in a juridical perspective, the rules regarding the authority to give execution decisions and cancellation of sharia arbitration decisions still occur between the General Justice and the Religious Courts. This reflects the legal uncertainty for the case. Through normative legal research or doctrinal legal research, this study aims to find the correct answers by carrying out the verification of the truth sought from the legal prescriptions written in the law and other legal sources. By using statute approach and historical approach, this research is focused on examining the application of norms in positive law regarding legal certainty in the execution and cancellation of sharia arbitration decisions, especially after the Decision of the Constitutional Court Number 93/PUU-X/2012. Contradicting legal norms regarding the authority to carry out the execution and cancellation of the arbitration decision, even though there is a juridical conflict, the Supreme Court has taken legal political steps to resolve the dualism of authority which can be resolved in the short term. Yet for long-term solutions, it is necessary to reform existing laws and regulations to ensure legal certainty for justice seekers.

Abstract

Dalam melindungi pihak yang beritikad baik dalam suatu perjanjian maka dibutuhkan peraturan yang dapat memberikan kepastian hukum. Pada tahun 2016 Mahkamah Agung melakukan rapat pleno dan menerbitkan Surat Edaran Mahkamah Agung (SEMA) Nomor 4 Tahun 2016, yang memberikan rumusan mengenai kriteria pembeli yang beritikad baik dalam pembelian tanah. Dalam penelitian ini mengkaji mengenai pertama, implementаsi Surаt Edаrаn Mаhkаmаh Аgung Nomor 4 Tаhun 2016 dаlаm putusаn-putusаn pengаdilаn. Kedua, pertimbаngаn hаkim dаlаm memutus perkаrа berkаitаn dengаn pembeli beritikаd bаik sudаh sesuаi dengаn perаturаn yаng berlаku. Jenis penelitian ini adalah penelitian normatif. Hasil penelitian menunjukan bahwa pаdа prаktiknyа sepаnjаng putusаn yаng dikeluаrkаn setelаh terbitnyа SEMА Nomor 4 Tаhun 2016, dаlаm menggunаkаn SEMА sebаgаi dаsаr pertimbаngаn untuk menentukаn kriteriа pembeli beritikаd bаik, hаkim telаh melаkukаn sesuаi petunjuk yаng terterа dаlаm SEMА. Dаri kаsus-kаsus yang sudah diteliti, sаtu diаntаrаnyа telаh mendаsаrkаn pаdа SEMА No. 4 Tаhun 2016, lаlu putusаn yаng keduа mendаsаri pаdа SEMА yаng terbit sebelum SEMА No. 4 Tаhun 2016, dаn putusаn hаkim yаng ketigа tidаk menimbаng berdаsаrkаn SEMА. Sehinggа, pemberlаkuаn SEMА Nomor 4 Tаhun 2016 mаsih belum diikuti oleh pаrа hаkim, sebаgаi pedomаn dаlаm penаngаn perkаrа mengenаi juаl beli tаnаh yаng terjаdi setаlаh dikeluаrkаnnyа SEMА Nomor 4 Tаhun 2016.In protecting parties with good faith inside an agreement, regulations that provide legal certainty are needed. In 2016 the Supreme Court conducted a plenary meeting and issued a Letter of the Supreme Court (SEMA) Number 4 Year 2016, which provided the criteria of buyers with good intentions in purchasing land. In this study, we examine two things. The first is, the implementation of Letter of the Supreme Court (SEMA) Number 4 Year 2016 in court injunctions. The second, has the judge consideration followed applicable regulations in deciding the case related to buyer with good faith. The type of this study is normative study. The result of this study shows that practically the judge has followed the regulations in SEMA as the consideration material to determine the criteria of buyer with good intention since SEMA Number 4 Year 2016 was issued. From the cases examined, one of them took SEMA Number 4 Year 2016 into consideration, and then the second injunction took SEMA that issued before SEMA Number 4 Year 2016 into consideration, and the third injunction does not take SEMA into consideration. Thus, the enforcement of SEMA Number 4 Year 2016 is still not used by all the courts yet, as a consideration material in handling cases of land selling-purchasing since SEMA Number 4 Year 2016 issued.

Abstract

Pasal 18B ayat (2) UUD NRI 1945 mengatur mengenai penghormatan dan pengakuan atas satuan-satuan masyarakat hukum adat beserta hak-hak tradisionalnya sepanjang keberadaannya masih ada. Salah satu hak masyarakat adat di masyarakat pesisir di Provinsi Lampung ialah hak rumpon sebagai hak ulayat laut. Rumpon laut secara bahasa merupakan jenis alat bantu penangkapan ikan yang dipasang di laut, baik laut dangkal maupun laut dalam. Saat ini eksistensi rumpon laut terancam keberadaannya karena untuk menjaga dan melestarikan sistem pengelolaan perikanan ini tidak didukung oleh tindakan nyata oleh Pemerintah dan masyarakat sekitar pesisir. Tulisan ini melakukan pengkajian atas hak masyarakat hukum atas hak ulayat rumpon di Provinsi Lampung dengan fokus penelitian pada eksistensi hak ulayat laut rumpon pada masyarakat Lampung dan perlindungan konstitusional atas hak ulayat rumpon laut. Metode penelitian yang digunakan yaitu metode socio-legal yang melakukan kajian terhadap aspek hukum dalam ranah das sollen dan das sein.Article 18B paragraph (2) of the 1945 Constitution of the Republic of Indonesia regulates the respect and recognition on customary law community units and their traditional rights as long as they still exist. One of the rights of indigenous peoples in coastal communities in Lampung Province is rumpon’s right as the ulayat right of the sea. Literaly, Rumpon laut is a type of fishing gear installed in the sea, both the shallow and the deep one. Currently the existence of rumpon laut is threatened because the maintenance is not supported by concrete actions by the Government and coastal communities. This paper conducts an assessment of the community’s right on customary rights of rumpon laut in Lampung Province. This paper focuses on the existence of the ulayat right of rumpon laut in Lampung and the constitutional protection of the ulayat right of rumpon laut. The research method used is a sociolegal method that studies the legal aspects in the realm of das sollen and das sein.

Abstract

Pada hakikatnya judicial review dilaksanakan demi terciptanya keseimbangan hukum dan terpenuhinya hak konstitusional setiap pemangku kepentingan untuk bertindak dan mengajukan permohonan pembatalan suatu undang-undang kepada Mahkamah Konstitusi dengan menyatakan undang-undang tersebut telah bertentangan dengan UUD RI 1945. Pengujian undang-undang terhadap UUD 1945 dilakukan dalam upaya penyempurnaan hukum yang berlandaskan konstitusi. Setiap undang-undang haruslah dilandasi oleh aturan dasar yang tidak hanya tercantum pada konsiderannya saja, melainkan dibuat serta dilaksanakan berlandaskan nilai dan norma konstitusionalitas. judicial review yang selama ini dilakukan oleh banyak pihak pada Mahkamah Konstitusi membuktikan bahwa kualitas produk hukum atau aturan hukum yang selama ini dilahirkan oleh pembuat undang-undang seringkali bertolak belakang dengan keteraturan hukum, sehingga diperlukan langkah hukum preventive demi menjaga integritas lembaga pembentuk undang-undang agar tidak dianggap melahirkan produk hukum yang asal-asalan. Oleh karena itu, di dalam penelitian ini akan mengkaji dan menginisiasi pembentukan produk hukum yang berkualitas konstitusi sehingga Mahkamah Konstitusi sebagai lembaga pengawal konstitusi memberikan kontribusi dengan cita konstitusi dan melahirkan produk hukum dengan kualitas konstitusi. Dalam penelitian ini metode yang yang digunakan adalah yuridis normatif dengan menggunakan pendekatan undang-undang dan konseptual. Hasil penelitian ini menggambarkan betapa pentingnya upaya preventive sebelum suatu aturan hukum kemudian ditetapkan, disahkan dan dilaksanakan, dimana ada persoalan konstitusionalitas terhadap implementasi suatu produk hukum yang kemudian oleh Mahkamah Konstitusi dinyatakan bertentangan dengan Undang-Undang Dasar Republik Indonesia 1945.Basically, judicial review has done to create a balance of law and to fulfill the constitutional right for every stakeholder to act and apply for application to constitutional court by stating the rule was contradicted to the constitution of Republic of Indonesia 1945. The application was made as an effort to perfect the law which is based on the constitution. Each rule has to be based on the basic rules, not only on its consideration but also is made and implemented in basic values and norms of contitutionality. Judicial review done by many people on constitutional court has proven that the quality of law product or rules of law made by the legislative often contradict with constitutional order of law, so it is necessary to take a step on preventive legal measurer to keep up the integrity of the rule maker of being judged making unqualified legal products. Therefore, this research reviews and initiates the production of law product so that the Constitutional Court can give preventive contribution on each legal products made, to be able to run with the ideals of the constitution and create legal products with constitution quality. This research used juridical normative method with legal and conceptual approaches. The results of this study illustrate how important preventive efforts before a rule of law are then set, ratified and implemented. In which there is a constitutional issue on the implementation of a legal product, that will be later declared by the Constitutional Court to be contradictory to the 1945 Constitution of the Republic of Indonesian.

Abstract

Justice should be clearly presented in the wording of written law since it will serve as a basis by law enforcement officer and judges in adjudicating cases. The spirit of justice that is contined in the written law should also inspire the way law is enforced and decision made. This paper tries to reflect the essence of justice and law through various plots and characters in Victor Hugo’s novel Les Miserable by looking at it from the perspective of various schools of legal thought. The reflection made shows that a legal event can be studied using various perspectives based on schools of thought in legal science. In the analysis, natural law schools of thought, positivism and feminist jurisprudence were used. Dialoguing these various schools of thought leads to a perspective on how law and justice should be perceived and then expressed normatively before being applied to society.

Abstract

Putusan Mahkamah Konstitusi No. 3/PUU-VIII/2010 menganulir konsep Hak Pengusahaan Perairan Pesisir (HP–3) yang ditetapkan dalam Undang-Undang No. 27 tahun 2007. Putusan ini memunculkan konsep baru yaitu izin pemanfaatan pulau-pulau kecil. Terdapat dua konsep yang berbeda antara hak dan izin, sehingga perlu dijelaskan perbedaan konsep dan implementasi keduanya dalam pemanfaatan pulau-pulau kecil. Penelitian ini menggunakan metode penelitian hukum normatif yang menekankan kajian perundang-undangan dan putusan hakim yang mengatur pemanfaatan pulau-pulau kecil. Penelitian ini menjelaskan bahwa izin pemanfaatan lebih tepat digunakan daripada hak pengelolaan karena menekankan agar pemerintah lebih memiliki peran dan tanggung jawab dalam pengelolaan wilayah pesisir dan pulau-pulau kecil, dengan konsep perizinan memberikan ruang yang luas kepada pemerintah untuk melaksanakan aktivitas kerja yang solid baik mulai perencanaan, pelaksanaan, dan pengawasan.Decision of the Constitutional Court No. 3/PUU-VIII/2010 annulled the concept of Coastal Water Concessions (HP-3) are defined in the Law No. 27 year 2007, this decision gave rise to a new concept that permits the use of small islands. There are two different concepts of “rights” and “permissions”, so it is necessary to explain the differences both in concept and implementation in those small islands utilization. This study uses normative legal research method that emphasizes the review of legislation and judgment decisions governing the utilization of small islands. This research explains that utilization permits are more appropriately used than management rights because it emphasizes that the government has more roles and responsibilities in the management of coastal areas and small islands, with the concept of licensing provides widespread space to the government to carry out solid work activities from starting planning, implementation, until supervision.

Abstract

Indonesia is a democratic state based on law (constitutional democratic state), with understanding that Constitution has a position as the supreme law, because the whole administration of the state should be based on the Constitution. The Constitutional Court was present as the guardian of the constitution to realize realization of ideals of Indonesia as a democratic state based on law. The research entitled Rechtsvinding and Jurisprudence Used by the Constitutional Court examines the importance of rechtsvinding and the attachment of using jurisprudence in deciding cases according to the authority possessed by the Constitutional Court. This research uses the Socio Legal method, which is a research method that examines a problem through normative analysis, then uses a non-legal science approach that develops in society. The results of the research that has been done are; 1) penemuan law by the Constitutional Court interpreted as an effort to how the Constitutional Court interpreting the Constitution (1945), testing the laws against the 1945 Constitution, to decide the other cases the authority granted by the 1945 Constitution, 2) The Constitutional Court there is no obligation to be bound and is not there is a prohibition to use the jurisprudence of the Supreme Court and other courts under its environment as well as the jurisprudence of the Constitutional Court itself.

Abstract

Pembentukan Organisasi Advokat sebagaimana diamanahkan dalam Undang-Undang Nomor 18 Tahun 2003 tentang Advokat ternyata menimbulkan polemik mengenai Organisasi Advokat yang mana yang diakui keberadaannya oleh undang-undang tersebut. Sebagaimana diketahui bahwa UUD 1945 telah memberikan perlindungan yang mendasar atas kebebasan berserikat dan berkumpul maka terhadap ketentuan pasal tersebut memberikan dasar secara konstitusional bahwa setiap Advokat sebenarnya berhak untuk mendirikan lebih dari satu Organisasi Advokat, sehingga dari hal ini ditemukan kesalah pemahaman dalam Undang-Undang Advokat, yang mencampur-adukkan pengertian suatu organisasi dan pembentukannya dengan apa makna hakiki dari tujuan pembentukan wadah tunggal dalam profesi Advokat. Tulisan ini ditujukan agar dalam dalam pembentukan wadah tunggal tersebut tidak menimbulkan konflik perebutan antar Advokat dengan tanpa mengesampingkan kebebasan dan kemandirian Advokat yang sejalan dengan tujuan negara hukum modern yang demokratis yang didalamnya mensyaratkan adanya peran pemerintah dalam pembentukan wadah tunggal tersebut.The formation of Advocate Organization as mandated in Law No. 18 of 2003 concerning Advocate turn polemical issue regarding Advocate Organization which is recognized by the law. Actually, the Indonesian 1945 Constitution has provided basic protection for freedom of association and assembly, so the provision provides constitutional rights that every Advocate actually have the right to establish more than one Advocate Organization. There exists misunderstanding entrenched in the Advocate Law, which confounds the understanding of an organization and its formation to what the true meaning of the purpose of the establishment of a single body of advocates professions. It is intended that in the formation of a single bar can avoid the potential conflict between the advocates without prejudice to the freedom and independence of advocates rights to assembly consistent with the goals of modern democratic constitutional state in which requires the government role in the formation of a single bar.

Abstract

Artikel ini membahas peran Mahkamah Konstitusi dalam memperkuat prinsip-prinsip demokrasi di Indonesia, khususnya prinsip Pemilu yang teratur, bebas, dan adil (regular, free and fair elections). Analisis dilakukan terhadap putusan-putusan monumental (landmark decisions) dalam pengujian konstitusionalitas undang-undang yang dikeluarkan oleh Mahkamah Konstitusi terkait dengan penyelenggaraan Pemilu. Penelitian ini didasarkan pada metodologi kualitatif dengan menggunakan studi kepustakaan yang bersumber dari putusan-putusan Mahkamah Konstitusi, peraturan perundang-undangan, buku, dan artikel jurnal ilmiah. Artikel ini menyimpulkan bahwa Mahkamah Konstitusi telah turut membentuk politik hukum terkait dengan sistem Pemilu di Indonesia dan berbagai aturan pelaksanaannya. Selain itu, Mahkamah Konstitusi juga telah memperkuat prinsip Pemilu yang teratur, bebas, dan adil dengan cara melindungi hak pilih warga negara, menjamin persamaan hak warga negara untuk dipilih, menentukan persamaan syarat partai politik sebagai peserta Pemilu, menyelamatkan suara pemilih, menyempurnakan prosedur pemilihan dalam Pemilu, dan menjaga independensi penyelenggara Pemilu.This article discusses the Constitutional Court’s role in strengthening the principles of democracy in Indonesia, particularly the principle of regular, free, and fair elections. An analysis was conducted towards landmark decisions declared by the Constitutional Court regarding general elections. This research is based on qualitative research by undertaking library-based research using the Court’s decisions, legislations, books and journal articles. It concludes that the Constitutional Court has established legal policies concerning electoral system in Indonesia and other related implementing regulations. Furthermore, the Constitutional Court has also strengthened the principle of regular, free and fair elections by protecting citizens’ right to vote, guaranteeing equal right of citizens to be elected, determining the same requirements for political party participating in the elections, saving citizen’s votes, improving electoral procedures and maintaining the independence of election organisers.

Abstract

Pemberian bantuan hukum merupakan salah satu cara untuk mewujudkan access to law and justice bagi rakyat miskin yang diberikan oleh negara atas amanat dari konstitusi. Beberapa regulasi mengenai bantuan hukum telah dikeluarkan oleh negara melalui Undang-Undang dan peraturan pelaksananya maupun dari Mahkamah Agung ataupun Mahkamah Konstitusi melalui Peraturan Mahkamah Agung maupun putusan Mahkamah Konstitusi. Akan tetapi fakta di masyarakat, regulasi yang dibuat itu belum efektif dijalankan sehingga makna access to law and justice menjadi bias. Belum efektifnya penerapan dalam pembenrian bantuan hukum di Indonesia merupakan suatu legal issue yang menarik untuk dikaji lebih dalam agar dapat mengetahui permasalahan utama yang menyebabkan belum efektifnya pemberian bantuan hukum di Indonesia yang nantinya dicarikan solusi dari gagasan yang menjadi formulasi sebagai optimalisasi pemberian bantuan hukum di Indoensia. Legal Issue yang dicari yaitu persoalan-persoalan dalam penerapan pemberian bantuan hukum dan Formulasi bagaimana penerapan pemberian bantuan hukum dapat berjalan secara optimal. Artikel ini akan memaparkan secara sistematis dan ilmiah dengan menggunakan metode normatif-empiris yang mengambil lokasi di 5 daerah yaitu DKI Jakarta, Kabupaten Surakarta, Kabupaten Pekalongan, Kabupaten Wonosobo dan Kabupaten Banyumas (Purwokerto) dan purposive sample meliputi advokat, organisasi advokat, lembaga bantuan hukum, pengadilan negeri dan penerima bantuan hukum. Berdasarkan hasil penelitian terdapat beberapa persoalan-persoalan dalam penerapan pemberian bantuan hukum di masyarakat yang menjadikan pemberian bantuan hukum bagi rakyat miskin menjadi belum efektif, oleh sebab itu, diperlukan suatu optimalisasi pemberian bantuan hukum bagi rakyat miskin yang menjadi suatu gagasan untuk menjawab persoalan tersebut untuk mewujudkan access to law and justice bagi rakyat miskin.Legal Aid is a way to implementing access to law and justice for the poor which is Mandate from the State listed in the constitution. Some regulations concerning legal assistance have been issued by the state through the rule and implementing regulations and also from the Supreme Court through and Constitutional Court by the Supreme Court Regulation or Constitutional Decission. However, in fact the regulation has not been effectively implemented, so that the meaning of access to law and justice becomes refracted. The ineffectiveness of application in the provision of legal assistance in Indonesia is an interesting legal issue to be reviewed deeper to find out the main problems that have caused the ineffectiveness of providing legal assistance in Indonesia which will be sought solutions from ideas that become formulation as the optimization of legal assistance in Indonesia. Legal Issues sought are issues in the application of legal aid provision and Formulation how the application of legal assistance can applied optimally. This article will describe systematically and scientifically using the normative-empirical method that takes place in 5 areas, DKI Jakarta, Surakarta Regency, Pekalongan Regency, Wonosobo Regency and Banyumas Regency (Purwokerto) and purposive sample includes advocate, BAR organization, legal assistance organization, state courts and legal aid recipients. Based on the results of the study there are several problems in the implementation of providing legal aid in the community that makes the provision of legal aid for the poor is not effective, therefore required an optimization of legal aid for the poor who became an idea to answer the problem to realize access to law and justice for the poor.
