Abstract

The discourse on amending Article 7 of the 1945 Constitution to extend the presidential term has surfaced on multiple occasions. The author’s hypothesis asserts that such an amendment is not only challenging but fundamentally unfeasible, as it constitutes an implicit unamendable provision. This article examines this hypothesis using a normative juridical method, which involves analyzing legal norms, principles, and doctrines through a positive legal approach. The study concludes that Article 7 of the 1945 Constitution represents an implicit unamendable provision, as evidenced by its historical context, its interrelation with other constitutional provisions, relevant court decisions, and the procedural framework of the constitutional amendment process.

Abstract

This paper discusses several Constitutional Court decisions concerning the minimum age requirements for presidential and vice-presidential candidates that were issued on the same day. In Constitutional Court Decisions Number 29/PUU-XXI/2023, Number 51/PUU-XXI/2023, and Number 55/PUUXXI/ 2023, the Court consistently rejected all petitions. However, later in the afternoon, through Constitutional Court Decision Number 90/PUU-XXI/2023, the Court changed its stance and partially granted the request. This paper aims to analyze the differences among these decisions and the Constitutional Court’s inconsistency when addressing decisions that substantially challenge the same article. This research employs a normative legal approach using primary, secondary, and tertiary legal materials. The findings of this study indicate discrepancies between the decisions, procedural irregularities, and drastic shifts in the judges’ perspectives. These factors have resulted in the Constitutional Court’s inconsistency in ruling on the issue of the minimum age requirements for the President and Vice President.

Abstract

Putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 mengamanatkan penerapan meaningful participation dalam proses pembentukan undang-undang. Sejalan dengan revisi UU P3, partisipasi publik secara daring atau e-participation mulai diakomodasi bersamaan dengan substansi meaningful participation. Artikel ini mengkaji penerapan e-participation dalam proses legislasi di Indonesia untuk mengoptimalkan partisipasi publik melalui pemanfaatan teknologi informasi dan komunikasi. Tiga rumusan permasalahan yang dibahas dalam artikel ini adalah: (1) bagaimana evaluasi pengaturan dan pelaksanaan e-participation dalam proses legislasi saat ini? (2) bagaimana perbandingan e-participation dalam pembentukan undang-undang di berbagai negara? (3) bagaimana reformulasi e-participation guna mengoptimalkan pemenuhan partisipasi bermakna? Penelitian ini menggunakan metode yuridis normatif dan menemukan empat isu krusial dalam reformulasi e-participation di Indonesia, yaitu: (1) penguatan infrastruktur Sistem Pemerintahan Berbasis Elektronik; (2) unifikasi pengaturan lembaga pembentuk undang-undang yang menyelenggarakan e-participation; (3) akomodasi model citizen initiative dan crowdsourcing; serta (4) pengaturan waktu pelaksanaan e-participation.

Abstract

Dynastic politics, practiced by certain groups of individuals with kinship ties or close relationships, dominate political positions in regional head elections and local government administration processes. This phenomenon persists due to the lack of concrete regulations, thereby normalizing it as a political practice in Indonesia. This study aims to elaborate on the facts surrounding dynastic political practices, examine how such practices undermine the democratic ideals envisioned by the people, and propose prospective regulatory frameworks to address this issue. The research employs a normative juridical method with statutory, historical, and conceptual approaches. The findings reveal that dynastic political practices harm the democratic system and tend to be more formalistic rather than providing a genuine opportunity for the people to elect leaders aligned with their will. To prevent such practices in the future, the government, the legislature, and election organizers must collaborate to formulate concrete regulatory norms in the Regional Head Election Law.
