Abstract

Penelitian ini memiliki tujuan untuk mengetahui dinamika penegakan hukum di Indonesia serta arah pembaharuan berdasarkan sosiologi hukum. Penelitian ini merupakan penelitian hukum normatif yaitu penelitian kepustakaan atau data sekunder. Adapun pendekatan yang digunakan adalah pendekatan konseptual penegakan hukum yang ditinjau dari sosiologi hukum. Penegakan hukum di Indonesia masih menghadapi persoalan struktural, kultural, dan moral yang menghambat terwujudnya keadilan substantif. Hukum sering dipraktikkan sebagai instrumen kekuasaan, bukan sarana keadilan sosial. Penelitian ini meninjau dinamika tersebut melalui perspektif sosiologi hukum dengan menyoroti ketimpangan struktur kelembagaan, lemahnya budaya hukum masyarakat, dan krisis integritas aparat penegak hukum. Kebaruannya terletak pada pendekatan integratif yang menggabungkan teori responsive law, konsep living law, dan gagasan hukum progresif sebagai paradigma pembaruan hukum di Indonesia. Pendekatan ini menempatkan hukum sebagai mekanisme moral dan sosial yang hidup dalam kesadaran masyarakat, bukan sekadar teks normatif. Pembaruan hukum diarahkan pada penguatan kelembagaan independen, revitalisasi budaya hukum, serta restorasi moralitas aparat guna membangun sistem hukum yang responsif, humanis, dan berkeadilan.

Abstract

This study aims to develop and evaluate a prediction model for the movement of the Composite Stock Price Index (JCI) using the Long Short-Term Memory (LSTM) method as one of the effective deep learning approaches in capturing nonlinear time series patterns. This study tested three model approaches, namely the Univariate model which only uses historical JCI data, the Multivariate All Feature model which integrates all external variables, and the Multivariate Selected Feature model which uses selected external variables. External variables considered include world gold prices, world oil prices, rupiah exchange rates against the United States dollar, and international stock indices that affect the Indonesian capital market. The model performance evaluation was carried out using the Mean Absolute Percentage Error (MAPE), Root Mean Square Error (RMSE), and Mean Absolute Error (MAE) indicators. The results showed that the Multivariate All Feature model provided the best performance with a MAPE value of 0.76, an RMSE of 66.72, and an MAE of 51.58, which was consistently lower than the other two models. Significance tests using ANOVA and Tukey HSD confirmed significant performance differences between models. These findings indicate that the integration of external variables is able to significantly increase the accuracy of JCI predictions. This research is expected to be a reference for investors, capital market analysts, and researchers in the development of artificial intelligence-based decision support systems in the Indonesian stock market.

Abstract

This paper is a continuation of the previous research theme concerning the relations between religions and democracy in America; however, the focus has shifted to the German setting. The concept of democracy, which notably originated in the West, embodies a distinctive weltanschauung whereby its implementation can adapt to the society in which it exists, including the culture and political systems that the state follows; this adaptation may differ from one country to another. The specific purpose of this paper is to explore how religious textuality manifests within German society and to examine the current relations between religions and democracy. The research materials for this study are exclusively drawn from the perspectives of Indonesian citizens currently residing in various regions of Germany. This paper employs an interview method and distributes questionnaires containing 18 questions among seven Indonesian citizens living in both Western and Eastern Germany. The findings presented here reveal how the dynamics among Christianity’s Catholic and Protestant adherents have evolved and how these dynamics presently relate to democracy in the country.

Abstract

The rapidly growing business environment has intensified competition among companies, compelling business actors to expand their operations strategically and accurately. Such expansion requires companies to strengthen their financial resources. However, business growth is often not aligned with proper financial management, leading to instability and imbalance within corporate finances. As a result, many businesses face various challenges, including the risk of bankruptcy, which ultimately forces companies to obtain financial support from banks to sustain their operations. Banks thus become a primary funding solution, with companies securing credit by pledging or mortgaging their assets. This study examines this relationship in the context of corporate bankruptcy and concludes that banks, as creditors, require strong legal protection and certainty regarding the credit they extend, as well as alignment in the implementation of relevant legal provisions. The research employs a normative–empirical legal method, combining statutory analysis, literature review, and interviews with credible sources from banking institutions and companies. The objective is to identify the form of legal protection available to creditors and explore the steps that can be taken by creditors concerning Mortgage Rights when debtors are declared bankrupt. The analysis refers to the interaction and relevance between Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations and Law No. 4 of 1996 on Mortgage Rights over Land and Objects Related to Land in the execution of collateral. The study highlights the importance of harmonizing and synergizing statutory regulations to ensure effective handling of corporate bankruptcy cases. Abstract

This article traces the evolution of pharmaceutical patent regimes in India and Indonesia through a jurisprudential and philosophical lens, positioning justice, certainty, and protection as the three normative pillars of evaluation. The theoretical framework draws on John Rawls’s theory of distributive justice, Satjipto Rahardjo’s concept of progressive law, and Barry Mitnick’s theory of the political economy of regulation. Historical analysis reveals two epistemologically distinct trajectories. Since 1970, India has developed a legal system that balances exclusive rights and public welfare through substantive mechanisms such as Section 3(d), compulsory licensing, and drug price control under the National Pharmaceutical Pricing Authority (NPPA). Indonesia, by contrast, initially adopted a TRIPS-compliant positivist approach and began transitioning only in 2024 toward a more reflective and justice-oriented patent regime through the enactment of Law No. 65/2024 on Patents. The study argues that the fairness of a patent system should not be measured by its capacity to create monopolies of knowledge but by its effectiveness in distributing the benefits of technology to those most in need. It concludes with the formulation of a Balanced Patent Justice Framework (BPJF) a normative model integrating Rawlsian fairness, Satjiptian humanism, and Mitnickian institutional design to construct a pharmaceutical patent regime that is not only efficient but also morally sustainable.

Abstract

Putusan Kasasi No. 5009 K/Pid.Sus/2025 mendeskripsikan pelaku yang melakukan tindak pidana korupsi juga terlibat dalam tindak pidana pencucian uang (follow up crime), dengan cara menjadi koordinator beberapa perusahaan boneka atau cangkang ilegal. Pada umumnya korporasi boneka yang sudah diolah menjadi sarana pencucian uang tidak memiliki kegiatan operasional yang nyata seperti memiliki karyawan atau kantor, dilakukan oleh aktor diluar akta perusahaan namun mempunyai otoritas untuk mengendalikan transaksi keuangan perusahaan dengan menunjuk dan mengatur pengurus korporasi sesuai dengan arahannya. Pelaku adalah Directing Mind yang merupakan Penerima Manfaat (Beneficial Owner) terbesar dari dana yang dikelola korporasi. Pada kasus PT Timah Tbk, terdakwa Harvey Moeis mendapatkan keuntungan dan memperkaya diri sendiri dengan menyamarkan, menyembunyikan dan mentransfer uang hasil kejahatan asal (predicate crime) yaitu korupsi, dalam bentuk Corporate Social Responsibility yang melanggar ketentuan Undang-Undang No. 8 Tahun 2010 tentang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang. Pemerintah telah melakukan berbagai upaya pencegahan dan pengawasan terkait keterlibatan Penerima Manfaat dengan mengeluarkan beberapa peraturan perundang-undangan dalam rangka pencegahan dan pemberantasan tindak pidana pencucian uang namun pada praktiknya belum efektif ketika para pejabat pemerintah masih menerima suap, kurangnya kolaborasi dalam pelaporan antar instansi, tidak bertindak tegas untuk menutup korporasi yang merupakan cangkang ilegal. Kejahatan korporasi semakin meningkat karena sanksi dalam pemidanaan belum memberikan efek jera kepada pelaku.

Abstract

Online reviews are becoming increasingly important for assessing tourist satisfaction, and although aspect-based sentiment analysis (ABSA) can offer in-depth insights, its use in the ASEAN tourism sector is still largely unexamined. Problem: This gap highlights a significant research issue, as there is insufficient knowledge re-garding the present condition, obstacles, and particular possibilities for applying advanced sentiment analysis methods in this distinctive, multicultural area . Objectives: The main aim of this study is to methodically identify worldwide research trends, highlight gaps, and describe the challenges of utilizing ABSA in the tour-ism industry, concentrating on their effects on ASEAN . Methods Used: To accomplish this, a systematic literature review (SLR) was performed on 61 chosen articles following the PRISMA methodology. Re-sults: The findings indicate a notable research gap marked by a narrow emphasis on the ASEAN region and the application of less sophisticated methods in current studies; the main challenges recognized include the varie-ty of languages, cultural differences, and a lack of datasets in local languages . Conclusion & Solution Offered: This organized review of literature concludes by providing suggestions for a plan-based approach that allows the region to use online reviews to improve its tourism competitiveness, emphasizing the necessity of creating local data resources, encouraging cooperation among different fields, and using data-driven tools to support small businesses .

Abstract

The implementation of Electronic Medical Record (EMR) faces challenges regarding patient information privacy, making it essential to assess the maturity level of its security. This study aimed to conduct an EMR security assessment to evaluate current conditions against those expected to meet the ISO 27002:2022 standard. This qualitative research employed a case study design. Data were analyzed using the System Security Engineering–Capability Maturity Model (SSE-CMM) method and gap analysis. The assessment revealed that the current EMR security level is at the initial/ad hoc stage (level 1), with an average score of 1.06 and a gap of 1.94 from the target defined process level (level 3). Thus, EMR security remains in its early stages, necessitating improvements in formally documented policies and security procedures, which have yet to be implemented.

Abstract

Acute liver failure is a rare but catastrophic complication in nasal-type NK/T-cell lymphoma, typically occurring in terminal stages and associated with mortality rates nearing 94%. This report describes a 53-year-old male with NKTCL who developed ALF after his third cycle of Gemox chemotherapy, presenting with severe right upper quadrant pain, rapid jaundice, and diffuse bruising. Laboratory findings showed marked hepatic injury with extreme transaminitis, hyperbilirubinemia, hypoalbuminemia, and thrombocytopenia, while ultrasound revealed hepatomegaly and multiple complex masses consistent with extensive malignant hepatic infiltration. The ALF was determined to result from a dual mechanism: direct lymphoma infiltration combined with chemotherapy-induced hepatotoxicity, creating a synergistic injury that overwhelmed hepatic function. Despite aggressive supportive care, the patient deteriorated rapidly and died shortly after the onset of liver failure. This case underscores the highly aggressive course of NKTCL complicated by hepatic involvement and highlights the need for strict liver function monitoring during systemic therapy, as transplantation is generally contraindicated and therapeutic options remain extremely limited

Abstract

Indonesia menghadapi tantangan serius penyalahgunaan dan peredaran gelap narkotika yang kian meluas ke wilayah pedesaan. Policy paper ini bertujuan menganalisis efektivitas pelaksanaan Program Pencegahan dan Pemberantasan Penyalahgunaan dan Peredaran Gelap Narkotika (P4GN) di tingkat desa serta merumuskan strategi integratif untuk pengarusutamaannya. Kajian ini menggunakan pendekatan kualitatif deskriptif melalui studi literatur, telaah regulasi, dan analisis data sekunder dari BNN, UNODC, serta Kemendesa PDTT. Analisis diperkuat dengan Problem Tree Analysis dan metode USG (Urgency, Seriousness, Growth) untuk menentukan prioritas masalah. Hasil analisis mengidentifikasi tiga persoalan utama: (1) regulasi dan koordinasi yang belum terpadu, (2) kapasitas aparatur desa yang terbatas, dan (3) rendahnya pemanfaatan dana desa untuk P4GN---hanya 1,92% desa yang mengalokasikannya pada tahun 2024. Kondisi ini menyebabkan desa belum berfungsi optimal sebagai garda terdepan pencegahan narkoba berbasis komunitas. Disimpulkan bahwa efektivitas P4GN di desa memerlukan kebijakan yang operasional, kolaboratif, dan berkelanjutan dengan dukungan lintas sektor. Penguatan tata kelola desa, peningkatan kapasitas aparatur, serta optimalisasi sumber daya menjadi kunci transformasi desa dari wilayah rentan menjadi benteng ketahanan masyarakat terhadap narkotika.
