Abstract

This article aims to narrate Surah Al-Kahf through the perspective of Sheikh Abdul Qadir Al-Jailani using William James' theory of mysticism (1902). Many arguments explain that the historical aspects in the Qur'an are only symbolic and some consider them fictional. Through a Sufi exegesis, it takes a deep effort to see the extent to which historical arguments are included in the interpretation. Using a character-based qualitative research method, this article examines the life, thoughts, contributions, and interpretation of the Qur'an by Sheikh Abdul Qadir Al-Jailani by analyzing Surah Al-Kahfi. The findings show that the stories of the Companions of the Cave (Ashab al-Kahf), Satan's refusal to prostrate to Prophet Adam, Prophet Khidr and Prophet Musa, Dhu al-Qarnayn, and Gog and Magog (Ya'juj and Ma'juj) contain mystical elements that are in line with the characteristics of mysticism according to James. Four main characteristics, namey ineffability, noetic quality, immortality, and passivity, are clearly reflected in Al-Jailani's interpretation and tadabbur iqrar (spiritual advice). These results show that Al-Jailani's interpretation of Surah Al-Kahf not only highlights historical aspects but also reveals the spiritual depth and inner meaning of each event.

Abstract

The phenomenon of gift-giving in the digital world, especially on streaming platforms and social media, has grown rapidly with the presence of various donation features and support for content creators. This practice raises questions about the legal and cultural aspects of gifts from an Islamic perspective, especially related to the teachings of fiqh which focus on the relationship between the giver, the recipient, and the benefits contained therein. This paper aims to examine integrative fiqh on digital gift practices, with a case study on the streamer @yb who uses the tajribi (experimental) approach to assess the social and economic impacts of this gift practice in the digital world. This study uses a qualitative approach with direct observation methods of phenomena on social media and analysis of content received by the streamer. The results of the study indicate that the gift practice in streaming @yb has significant social value, creates a relationship between content creators and their audiences, and can affect the personal economic aspects and digital communities and from a contemporary fiqh perspective, this donation practice is generally more inclined towards the tabarru' contract (voluntary grant) because it is given spontaneously without conditions and without any demands for a specific return.

Abstract

Hate speech is a serious problem for religious adherents and a challenge for governments. Its spread is due to the increasingly strong influence of globalization, with open access and the excuse of free speech. Imam al-Ghazali, a prominent medieval scholar, already mentioned the importance of avoiding hate speech with the term as-Syukriyah. The purpose of this study is to determine how the concept of hate speech on social media is viewed from the perspective of Imam al-Ghazali. This study uses library research with a descriptive interpretive qualitative approach, using the Miles and Huberman analysis technique, namely data collection, data reduction, data display, and conclusion and verification. The results of this study show that the concept of hate speech on social media according to Imam al-Ghazali is called as-Syukriyah, which means “insulting or belittling others through words, behavior, or gestures.” This action is haram (forbidden), considered bad character, and the perpetrator is classified as a fasiq farji (immoral person). In the context of positive law, free speech is guaranteed by Article 1 of Law No. 39 of 1999 concerning Human Rights. However, free speech is still limited by ethics, norms, and legal regulations in the ITE Law, which strictly regulates hate speech on social media. In line with Imam al-Ghazali's concept, the principles of Islamic law and positive law state that hate speech violates human values, ethics, and the law, and triggers social conflict. Therefore, synergy between Imam al-Ghazali's religious ethics and the law is necessary to maintain social harmony and stability.

Abstract

This research aims to analyze the function of collective Ijtihad operated by Muslim intellectuals in Indonesia as the driving force for the renewal (tajdid) of Islamic legal thought. Starting from a gap in previous research that tended to focus on legal outcomes (product) rather than the thought process and method (process) of Ijtihad, this study employs an analytical framework that combines Jasser Auda's Contemporary Maqasid al-Shari'ah (as the philosophical framework) and Fazlur Rahman's Double Movement Method (as the methodological framework). The transformation of Ijtihad in Indonesia from individual to collective, represented by major institutions such as the Indonesian Ulema Council (MUI), Nahdlatul Ulama (NU), and Muhammadiyah, demonstrates a diversity of methodologies within a dialectical space between text, school of law tradition, and modern demands. The case study of In Vitro Fertilization (IVF) proves the collective Ijtihad's ability to reach a consensus. The analysis indicates that the cautious stance of these institutions allowing IVF only between a legally married husband and wife without involving a third party is an expression of critical and responsive Muslim intellectuality. Through the lens of the double movement, the mujtahids succeeded in drawing the universal moral goal from the texts prohibiting the confusion of lineage, namely the protection of honor and the clarity of the family line, to be applied to the problem of modern reproductive technology. Philosophically (Maqasid), this process balances the benefit for infertile couples (the right to have offspring) with the obligation to safeguard the universal objectives of Shari'ah, particularly the preservation of progeny (hifz al-nasl) and human dignity. The implications of this Ijtihad finding are reinforced in Indonesia's Positive Law (Law No. 36 of 2009 concerning Health).
