Abstract

The transfer of receivables by cessie between UOB Bank and Mrs. Linda still raises issues related to legal issues and the settlement of the cessie lawsuit. Legal Effects of Transfer of Receivables by Cessie Against Collateral that has been given Mortgage Rights Based on Court Decision No 370/Pdt.G/2019/PN Jkt.Pst and Civil Settlement of Transfer of Cessie Receivables in Court Based on Court Decision No 370/Pdt.G/2019/PN Jkt.Pst. Using normative legal research methods with qualitative analysis by using primary and secondary legal materials conducted using literature studies and through a case approach. The results of the study illustrate that UOB bank as a creditor has the legal power of proof of the legal event of a transfer of receivables in cessie to Chyntia as a third party and also, in this case, UOB bank as a creditor has the power of proof to Mrs. Linda Soetanto as a debtor related to the transfer of receivables. The plaintiff's lawsuit cannot be accepted because the formality of the lawsuit is not perfect, therefore all costs incurred in this case are charged to Mrs. Linda as the plaintiff for Rp. 1,041,000. The settlement regarding the transfer of receivables by cessie is carried out between Cyntia as the new creditor as well as the holder of Mrs. Linda's receivables, so everything regarding the settlement of Mrs. Linda's credit, Cyntia has the right and obligation to execute against the object of collateral belonging to Mrs. Linda.

Abstract

Organizing spatial planning is important to achieve safe, comfortable and sustainable spatial conditions. Regional Government plays a key role in preparing regional spatial plans and controlling space utilization. Monitoring and evaluation is carried out routinely to assess the suitability of space utilization. Evaluation of the Suitability of the Spatial Planning of Tanggamus Regency in 2023 show a level of conformity of 88.71%, in the QUALITY category. The conclusion of the analysis highlights aspects that need to be considered in space management in Tanggamus Regency, providing a basis for policy formulation that maintains consistency in space use and increases conformity with spatial plans.

Abstract

In this digital era, banks must adjust themselves, given the needs of customers who want rapidity and flexibility of banking services so that customers can quickly and safely anytime, anywhere. Almost all commercial banks have digital services, but on the other hand, there are potential risks that will be faced. The problems discussed in this study are the potential risks in digital services and risk management related to the protection of customer rights. The approaches used in this research include statutory and conceptual approaches. The result of this research is that the main risks faced in digital services are operational risk, strategic risk, and reputation risk. So preventive efforts by conducting risk management and ensuring information system security and cyber resilience for Consumer Protection. While repressive protection with a handling mechanism for any questions and / or complaints from consumers. It is emphasized in POJK 22/2023 that banks such as PUJK are required to have and implement a mechanism for handling complaints submitted by consumers. Banks are required to provide consumer complaint services whose scope consists of receiving complaints, handling complaints, and resolving complaints.

Abstract

The development of the Jakarta-Bandung High-Speed Rail Project (KCJB) as a national strategic project experienced delays in completion and cost overruns, was considered not urgent and only oriented to the interests of small groups rather than the wider community and brought losses to the state. In making decisions regarding the Jakarta-Bandung High-Speed Rail Project, the government needs to ensure the implementation of the general principles of good governance. The research methodology used is doctrinal research. The implementation of the Jakarta-Bandung High-Speed Rail Project experienced development setbacks and did not fulfill various principles of Good Governance and has a negative impact on aspects of sustainable development. Existing problems range from procurement, planning, development, and evaluation. This means that the principles of participation, transparency, legal certainty, benefit, accuracy, efficiency, effectiveness, accountability, equality, and inclusiveness are not fully applied to the development of the Jakarta-Bandung High-Speed Rail project as a national strategic project.

Abstract

Environmental Politics advocates for a collaborative approach among government, industry, academics, and civil society to address Indonesia's complex forest and land fire challenges. The government is pivotal in policy initiation and regulation, requiring effective prevention and response strategies. Industry contributes through technological innovation, particularly in fire risk monitoring and mitigation. Academia offers scientific research to build sustainable forest and land management strategies. As supervisors and stakeholders, civil society can actively participate in environmental management. Close collaboration among these sectors is essential, with the government leading coordination efforts, industry providing technology, academia offering scientific insight, and civil society engaging in education and community empowerment. Building community capacity in forest management and environmental monitoring is crucial. This collaborative effort aims to create synergy in tackling forest and land fires, emphasizing sustainable resource management, monitoring illegal activities, and promoting responsible environmental practices. Implementing Environmental Politics in Indonesia highlights a shared commitment to environmental sustainability and national sovereignty amidst globalization and climate change.

Abstract

This study aims to identify legal sanction against illegal lending providers in Indonesia and examine legal protection for users of illegal online loan services. The research method used is a normative legal approach with a focus on analysis of applicable laws and regulations. Indonesia has a number of legal sanctions that have been imposed on illegal loan organisers, including suspensions of operations, administrative sanctions, and even criminal penalties under the Law and OJK Regulations. These measures aim to protect the public from illegal practices that can harm them financially and socially. On the user side, legal protection is regulated by POJK 77/2016 and the Consumer Protection Law, which provides consumer protection facilities such as complaint services and legal defence. Even though there are regulations that have been implemented, illegal loan services remain a problem because they offer loans without official permission, take advantages of people’s lack of financial literacy, and create the risk of uncontrolled lending. The importance of understanding and complying with the rules and laws that apply in lending services is the key to avoiding legal risks and financial problems

Abstract

This study highlights the urgency of enhancing public accessibility through the implementation of E-Government in Bima District. The research employed a descriptive method with a qualitative approach. The findings indicate that in the context of digital transformation, E-Government becomes a key to improving public access to government services in Bima District, Indonesia. Despite offering significant potential in enhancing efficiency, transparency, and affordability of public services, the implementation of E-Government faces several challenges. Uneven technology infrastructure, low digital literacy, and the lack of trained human resources are among the obstacles that need to be overcome. This study underscores the urgency of enhancing public accessibility through E-Government in Bima District. With a focus on social inclusion, democratic participation, economic aspects, and data security, efforts to address infrastructure constraints, digital literacy, and human resource availability become crucial. Through strategic measures such as technology infrastructure development, enhancement of digital literacy, and inter-agency government coordination, Bima District can achieve significant improvements in public accessibility, increase efficiency in public service, and strengthen community participation in the development process and decision-making

Abstract

The study aims to explore strategies to enhance public administration capacity at Tadulako University, using a qualitative approach through case studies. This research mainly focuses on understanding how the applied strategies can improve administrative processes and provide better services to students and staff. Researchers collect data by conducting in-depth interviews, live observations, and document analysis with administrative staff, students, and faculty. Researchers conduct thematic analysis to identify key themes and comprehend the effectiveness and impact of implemented strategies. Research results show that integrating information technology, staff training, and revising bureaucratic processes are critical factors in improving the efficiency and quality of administrative services. Data triangulation reinforces these findings, ensuring the validity and reliability of the results. The research provides insights into best organizational practices and offers valuable recommendations for other higher education institutions facing similar challenges. These implications extend beyond operational improvements to enhancing student education experiences, illustrating the connection between effective administration and academic success in higher education institutions.

Abstract

In terms of addressing Piercing the Corporate Veil, it’s a law principle that relates to Limited Liability Companies. One of Limited Liability Companies characteristics is a capability to  disregard limited liability for the company’s organs, allowing the organs to be personally liable for wrongful acts that harm the company and other. Knowing this concept is important due to the dynamism of business law and investment law, where the company’s organs often engage in actions solely for personal benefit. This is intriguing due to company’s organs cannot be held personally accountable for corporate actions since the company and it’s organs are separate legal entities. Through normative legal research and a legal and conceptual approach, namely the doctrine of Piercing the Corporate Veil, it’s application to the company’s in investment law will be discussed

Abstract

This research expands the study of women's political strategies in local democracy which is the focus of research in Letneo Village, TTU Regency. This research uses Peter Schoder's theory of political strategy as a knife in analyzing the social facts that occur. The method used is descriptive qualitative with the technique for determining informants being purposive sampling and data collection techniques in the form of documentation, interviews and observation and data triangulation. The results found in achieving victory Mariana Tahu used the maloe mamat and ume hana strategies as defensive and offensive strategies. This research also expands studies on political strategy theory that strategies using local culture are still relevant in Indonesia amidst the rise of strategies using social media and money politics, especially in villages that still adhere to local culture. A strategy that is quite relevant to apply in areas where patriarchal culture is very strong is to use local culture which is adopted with a very subtle approach so as to get support from men. Based on this research, there are suggestions for women to instill a courageous and ethical mentality to fight in the election space so that they can become a channel for aspirations that represent women's interests.
