Abstract

Cloud computing is a computing service model that relies on easily accessible resources due to its flexibility, elasticity, ability to perform on-demand services, and low management effort. While offering various advantages, it poses risks to users' personal data, such as access to such data by a public authority in the absence of a legal framework to limit such access. The research employs juridical normative methods. The study shows that companies are responsible for ensuring the security of personal data under their control and preventing unauthorized access by third parties, including public authorities. This research aims to bridge the gap between the need for personal data protection and the growing cloud computing business, as well as the regulatory vacuum, and theoretically contribute to the development of theories on personal data protection through a legislative and comparative law approach.

Abstract

Artikel ini hendak mengkritisi pendasaran dalam konstitusionalisasi hak-hak asasi manusia ke Bab XA UUD 1945 berlandaskan pada konsep HAM sebagai natural rights, khususnya menurut pemikiran John Locke (Lockean Natural Rights). Prinsip dari pemikiran Locke adalah rights first – government second dengan pengertian intrinsik bahwa pemerintah tidak dapat menciptakan HAM, tetapi hanya dapat mengakui keberadaannya yang telah ada sebelumnya. Artikel ini mengelaborasi prinsip tersebut dalam menanggapi Perubahan Kedua UUD 1945 yang akhirnya melahirkan Bab XA. Terhadap isu tersebut, dipertahankan tesis bahwa Bab XA UUD 1945 dapat ditiadakan karena HAM adalah natural rights, sehingga tidak perlu dituangkan ke dalam konstitusi jika alasannya hanyalah untuk melindungi HAM (karena ada dalam konstitusi). Dengan tesis tersebut, penulis menolak pendasaran konstitusionalisasi HAM dari Penyusun Perubahan UUD 1945 yang menggunakan kerangka berpikir positivis dengan pengertian tersirat bahwa konstitusionalisasi bersifat konstitutif. Diajukan pendasaran konstitusionalisasi HAM yang berbeda dengan Penyusun Perubahan, dalam hal ini pendasaran menurut pemikiran Lockean Natural Rights.

Abstract

This article examines Indonesia’s legal policies toward stateless individuals from the perspectives of human rights and constitutional law. The main issue addressed is whether Indonesia’s Citizenship Law aligns with human rights principles in providing adequate protection for this vulnerable group. Stateless individuals often lose access to fundamental rights, including education, healthcare, and employment. Through an analysis of international legal instruments, the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945), which guarantees every person’s right to citizenship and related national legislation, this study identifies a gap between the normative legal framework and its practical implementation. Although the Constitution formally safeguards the right to citizenship, various factors such as bureaucratic complexity, limited public understanding of naturalization procedures, and discrimination against minority groups remain significant barriers. Academically, this article contributes to the international discourse on the implementation of non-discrimination principles and the right to citizenship by emphasizing the need to harmonize national law with international legal standards to ensure adequate protection for stateless individuals in Indonesia.
