Abstract

This research aims to study and explore the phenomenon of corruption in local government and strategic efforts to prevent it from realizing good local governance. This type of research is socio-legal research with a statutory and conceptual approach and is presented in descriptive-qualitative form. The results of the study show that the factors that cause corruption in the regions are high political costs of regional elections, Regional heads' intervention in the planning of the Regional Expenditure Budget (APBD), regional heads intervene in the management of the APBD, regional heads participate in determining the implementation of permits, regional heads determine the procurement of goods and services, and regional heads buy and sell positions. The strategies to prevent corruption in the regions include reducing the political costs of direct elections, prevention through strengthening internal government supervision, prevention through the performance accountability system of government agencies, prevention through LHKPN reporting and transfer of officials' wealth to the state, and prevention of corruption favoritism.

Abstract

Abstract This paper aims to discuss the position of the Constitutional Court of the Republic of Indonesia in political judicialization. Judicialization of politics has become a critical issue because there is an intense debate on the choice of judicial restraint or judicial activism, particularly concerning its implications for the general election process. On this issue, this paper provides an alternative view related to the position of judicial restraint or judicial activism in a contextual manner, which departs from the limitation of the formation of General Election regulations that political judicialization must fill the legal vacuum caused by the finality of the General Election law which depends on delegated regulations. In adjudicating, the Constitutional Court of the Republic of Indonesia must perform policy calculations to determine how to correct the norms of the annulled General Election law.

Abstract

This article aims to discuss the issue of the appropriate form of legal product for regulating government procurement of goods/services. The existing legal product is the Presidential Regulation, in this case, Presidential Regulation Number 16 of 2018. Considering the material content covered by the Presidential Regulation, this article proposes that regulating government procurement of goods/services should be an Act because there is no explicit delegation from the Act that orders government procurement of goods/services to be regulated by Presidential Regulation. Presidential Regulation Number 16 of 2018 uses an implicit delegation technique that is strengthened by the function of the Presidential Regulation as a legal instrument in exercising the executive power of the President, according to Act Number 12 of 2011. Such an approach is inappropriate because implicit delegation is not law. Furthermore, the Presidential Regulation also contains material content in the form of sanctions. Therefore, the ideal form of legal product for regulating government procurement of goods/services is an Act.

Abstract

Target nasional tahun 2024 Indonesia terbebas dari BABS atau dengan status ODF. Sanitasi sehat dan aman akan meningkatkan kesehatan dan kesejahteraan masyarakat. Tingkat ekonomi dan pendidikan yang rendah menjadikan perubahan kebiasaan BABS menuju ODF bukanlah hal yang mudah. Atas dasar Perda Surabaya No. No. 2 Tahun 2014 tentang Penyelenggaraan Ketertiban Umum dan Ketentraman Masyarakat, maka tahun 2023 Surabaya telah mampu mencapai target 100%. Oleh karen itu dalam penelitian ini akan menganalisis kebijakan Surabaya dalam mendukung target ODF 100% serta strategi Surabaya agar dapat mempertahankan status ODF saat ini. Dengan menggunkan metode sosio legal dapat disimpulkan bahwa Surabaya telah menerbitkan Peraturan Walikota untuk melakukan percepatan pembangunan jamban dengan mengabaikan syarat legalitas kepemilikan lahan. Sedangkan strategi dalam mempertahankan status ODF adalah dengan adanya kebijakan dan aplikasi sedot tinja dengan biaya yang murah serta keterlibatan aktif masyarakat untuk tetap melakukan kebiasaan baik dalam hal sanitasi berkelanjutan.

Abstract

This article presents a comparative constitutional law study of the President's executive power. The article confidently interprets the President's executive power based on the 1945 Constitution. It does so by referring to the unitary executive theory developed in the United States by unitarians based on the Constitution of the United States. Unitary executive means that the President, as Chief Executive, holds all executive power. The study's central point is presidentialism, a system of government shared by the United States and Indonesia. This article has two purposes. First, it corrects the foundational flaw of the unitary executive theory developed by unitarians because they do not specifically claim presidentialism as the underlying principle of their theory. Second, it makes the unitary executive theory applicable to Indonesia.

Abstract

Wira wiri Suroboyo merupakan salah satu alat transportasi umum yang beroperasi di Kota Surabaya. Pemerintah Kota Surabaya melalui Dinas Perhubungan Kota Surabaya menjadi bagian dalam sistem operasional wira wiri Suroboyo. Isu hukum yang diangkat pada topik ini adalah perlindungan hukum bagi penumpang feeder yang mengalami kerugian. Metode penelitian yang digunakan untuk menjawab isu ini adalah dengan menggunakan penelitian hukum dengan pendekatan statute approach dan conceptual approach yaitu metode yang berdasarkan peraturan perundang-undangan dan konsep hukum yang telah ada di masyarakat.. Sebagai alat angkutan darat, tentu penumpang memiliki risiko kerugian seperti kecelakaan atau kehilangan barang. Wira wiri Suroboyo berbeda dengan alat transportasi umum lainnya, terutama dalam perlindungan hukum bagi penumpangnya. Pemkot Surabaya memiliki peran penting dalam memberikan perlindungan hukum bagi penumpang feeder. Perlindungan hukum yang dilakukan oleh angkutan umum Wira Wiri Suroboyo wajib dilaksanakan sesuai dengan Peraturan Walikota dan peraturan perundang-undangan yang sesuai pada bidang angkutan jalan.

Abstract

Abstract Environmental protection instruments in Law Number 32 of 2009 concerning Environmental Protection and Management (UUPPLH) are divided into preventive and repressive. One of the preventive instruments in UUPPLH is an economic instrument. Environmentally friendly labels (ekolabels) are one part of the monetary instrument. The arrangement of ecologically friendly labels is needed to support sustainable consumption and production policies. However, there are still several problems with arranging environmentally friendly labels, one of which is the practice of greenwashing. This study focuses on the issue of whether the arrangement of ecologically friendly labels follows the direction of sustainable consumption and production policies and whether their implementation can reduce greenwashing activities. The method used in this study is normative juridical, which is carried out through a literature study using primary and secondary legal materials. The study's results indicate that the arrangement of voluntary environmentally friendly labels is still insufficient to reduce greenwashing practices, so sustainable consumption and production goals have not been optimally achieved.

Abstract

The repositioning of victims within a more just criminal justice system has been advanced through the implementation of restorative justice, provided that victims give their consent. This article explores the historical development of restorative justice in Indonesia and examines its relevance to criminal acts resulting in death. Using a statutory and conceptual approach, the study finds that restorative justice was first introduced in 2012 as a mechanism to protect children in conflict with the law. Over time, its scope has broadened, including limited application to fatal offenses—specifically negligent deprivation of liberty leading to death (Article 334 of the Indonesian Penal Code) and negligent acts causing death (Article 359). Historically, the adoption of restorative justice in Indonesia centered on the protection of offenders, particularly juveniles, rather than addressing the rights or recovery of victims. Its application in fatal cases raises a conceptual issue, as death represents an irreversible harm that contradicts the restorative aim of repairing the damage done. Therefore, this article suggests the need for a unified legal framework governing restorative justice in Indonesia, with its role in cases involving death limited solely to a basis for sentence mitigation, rather than complete restoration.
