Abstract

Amid globalization and evolving educational paradigms, innovative learning models integrating Islamic values are increasingly essential, particularly in Islamic Religious Education (PAI). This study aims to: (1) examine Project-Based Learning (PjBL) characteristics from an Islamic perspective, (2) analyze PjBL syntax regarding Islamic education principles, and (3) formulate implementation strategies in PAI. Employing a qualitative library research method, the study analyzes books, scientific articles, journals, and previous research. Results indicate that PjBL aligns closely with Islamic educational values by engaging students actively, encouraging collaboration, fostering deliberation, promoting responsibility (amanah), and producing beneficial work as good deeds. These elements reflect the Islamic tradition's balance among knowledge mastery, practical application, and spiritual formation. Furthermore, every PjBL syntax stage—from planning and execution to evaluation—mirrors Islamic educational principles. Applying PjBL enhances academic achievement while strengthening character, social attitudes, and spiritual values, offering an effective, meaningful, and relevant alternative for modern education's challenges. These findings provide valuable insights for educators and policymakers developing innovative, value-based PAI curricula.

Abstract

This research is motivated by the hegemony of Western materialistic positivist epistemology, which reduces science to the empirical realm, triggers an epistemological crisis, and delegitimizes metaphysical truths. The study addresses how Shaykh M. Said Ramadhan Al-Buti’s Islamic epistemology critiques materialistic positivism and evaluates its methodology as an effective antithesis. The objectives are to analyze Al-Buti’s manhaj ilmi, evaluate his critique of positivism, assess its methodological effectiveness, and outline its implications for contemporary Islamic theology in counteracting atheism. The framework relies on Al-Buti’s integrative epistemology, synergizing the senses (al-hiss), reason (al-’aql), and valid news (al-khabar al-sadiq) to achieve certainty (al-yaqin). Employing a qualitative literature study with philosophical-epistemological, historical-sociological, and dialectical-critical approaches, the primary data source is the Preamble of Kubra al-Yaqiniyyat al-Kawniyyah, supported by secondary literature on science philosophy. Data collected via critical reading and proposition extraction were analyzed using descriptive-analytical, comparative, and dialectical-critical methods. Results demonstrate that Al-Buti’s manhaj ilmi rejects the reason-revelation dichotomy by establishing proportional standards of proof based on the object’s nature (empirical for physical matter; analytical-transmissive for metaphysics). His critique successfully falsifies positivism by exposing internal contradictions within its verification principles and taxonomic reductions. Critical reflection reveals that despite suspending qiyas mantiqi, Al-Buti’s methodology remains a highly effective counter to modern positivism. Its implications offer a philosophical resolution refuting scientism and establishing a sound argumentative foundation for faith education. In conclusion, Islamic theology possesses an independent, objective scientific methodology that dismantles Western positivism's monopoly on truth while restoring the authority of revelation and reason.

Abstract

This study reconstructs the constitutional boundaries of law enforcement discretion in Indonesia to balance national security, civilian supremacy, and citizens' constitutional rights. Employing a normative-juridical method alongside statutory and conceptual approaches, the study analyzes the 1945 Constitution, Law No. 2 of 2002 on the Indonesian National Police, Law No. 30 of 2014 on Government Administration, relevant court rulings, and contemporary legal doctrine. The findings reveal normative ambiguities within sectoral regulations that create accountability gaps and open opportunities for the abuse of authority. To address these weaknesses, the study proposes the "Constitutionalization of Operational Discretion"—a framework that subjects discretion to the rule of law, the General Principles of Good Governance (AAUPB), proportionality tests, judicial oversight, standardized rules of engagement, post-action digital reporting, independent supervision, state liability, and financial recovery mechanisms targeting officials who abuse their authority. This framework contributes to the development of constitutional and administrative law by establishing enforceable standards for individual operational conduct and fostering democratic, transparent, proportionate, and human rights-oriented security sector governance.

Abstract

The rapid development of information and communication technology has brought significant changes to the provision of healthcare services, particularly through the use of telemedicine. In Indonesia, telemedicine plays a strategic role in improving access to healthcare services in geographically dispersed areas. Along with this development, the use of artificial intelligence-based medical algorithms is increasingly widespread in the diagnosis process, clinical decision-making, and treatment recommendations. While offering efficiency and innovation, the use of these algorithms also raises new legal challenges, particularly regarding liability for algorithmic errors that can harm patient safety. This study aims to analyze legal liability for algorithmic errors in telemedicine services through a normative legal research approach, focusing on identifying potential regulatory gaps in Indonesia. The research methods used include statutory, conceptual, and case studies. The analysis was conducted on relevant laws and regulations in the fields of health, consumer protection, and personal data protection, and was supported by a doctrinal review and comparison with the legal framework for telemedicine in Malaysia. The results indicate that the Indonesian legal system does not explicitly regulate liability for medical algorithm errors, so the determination of liability still relies on general principles of health law and civil law. This regulatory gap creates legal uncertainty, particularly when errors stem from algorithm design flaws, training data bias, or system failures beyond the reasonable control of medical personnel. Therefore, this study proposes the implementation of a shared liability model between physicians, telemedicine platform providers, and algorithm developers, based on the roles and causal contributions of each party. This model is considered fairer, more proportional, and able to strengthen legal protection for patients in Indonesia's AI-based telemedicine ecosystem.

Abstract

This study aims to analyze the juridical implications of abolishing mandatory health budget allocation under Law Number 17 of 2023 on the protection of the right to health and legal certainty of the National Health Insurance system. The research focuses on the paradigm shift from mandatory spending to performance-based budgeting and its impact on the role of the state as the guarantor of the right to health. Key concepts employed in this study include the right to health as a constitutional right, legal certainty, the rule of law, distributive justice, and performance-based budgeting. This research adopts a normative juridical method using statutory, conceptual, and analytical approaches. The scope of the study covers constitutional guarantees of health rights, national health regulations, and the financing framework of the National Health Insurance program. The findings reveal that the removal of mandatory health budget allocation weakens legal certainty in health financing and increases the risk of regional disparities in health service provision. While performance-based budgeting may enhance efficiency and flexibility, the absence of normative safeguards potentially undermines the protection of health rights as fundamental rights. The main challenge identified is the lack of detailed implementing regulations establishing minimum financing standards and effective oversight mechanisms. This study recommends the formulation of implementing regulations that establish legally binding yet adaptive minimum health financing standards, accompanied by strengthened budgetary oversight mechanisms. This research contributes to health law and constitutional law scholarship by advancing a rights-based perspective on health budget reform and offering a normative framework to balance fiscal efficiency with the protection of constitutional rights.

Abstract

Nurses working in primary healthcare facilities face a high risk of occupational accidents and occupational diseases. These risks not only impact the nurses' physical and mental health but can also affect their professional responsibilities and legal standing. In this context, occupational health and safety (OHS) programs play a strategic role, not merely as a technical effort to control workplace hazards but also as an instrument of legal protection for nursing staff in carrying out their duties. This study aims to assess the effectiveness of the OHS program implementation as a form of legal protection for nurses at the Tanjung Enim Community Health Center, referring to Minister of Health Regulation Number 52 of 2018. The method used is a normative-empirical legal approach, which combines analysis of statutory provisions with empirical findings in the field. Empirical data were obtained through documentation studies and in-depth interviews with three nurses and the Head of the Community Health Center. The research analysis is based on the theory of legal effectiveness and legal protection theory to assess the conformity between norms and practices. The research results indicate that preventive legal protection measures are available, including the provision of personal protective equipment (PPE), the implementation of standard operating procedures (SOPs), the implementation of occupational health and safety (K3) training, and regular health checks. However, their implementation has not been consistent and optimal. Meanwhile, repressive legal protection measures have been regulated, but the reporting and documentation mechanisms for work-related incidents still lack clear and systematic standards. Therefore, the implementation of the K3 program at the Tanjung Enim Community Health Center is considered ineffective in ensuring legal certainty and providing a sense of security for nurses in carrying out their profession.

Abstract

This research is based on the urgent role of the principal as a learning leader who has a strategic responsibility in improving teacher professionalism through planned and continuous academic supervision. This study aims to analyze the quality management of academic supervision implemented by the principal in an effort to improve teacher performance at SDN Rancabango and SDN Rancaekek 06, Bandung Regency. In practice, academic supervision is often understood only as an assessment activity, so its function as a coaching and development tool has not been optimally utilized to encourage teacher performance improvement. The research used a qualitative approach with a case study design. Data were obtained through in-depth interviews, field observations, and document reviews involving the principal, teachers, and relevant stakeholders. Data analysis was conducted descriptively with an inductive approach that emphasized four main aspects of supervision management: planning, implementation, evaluation, and follow-up. The findings indicate that supervision planning has been designed through program development, goal formulation, and the use of relevant instruments. Supervision implementation includes learning observations, providing feedback, and professional development, although its implementation is not yet fully optimal. Evaluation is able to identify teacher strengths and weaknesses, but is not supported by systematic and continuous follow-up. Key obstacles include time constraints, inadequate supervisory competency of principals, and a lack of supporting facilities. Improvements are being made through capacity building of principals, refinement of supervision programs, and strengthening collaboration. Overall, academic supervision quality management plays a crucial role in improving teacher performance, but requires consistency and reinforcement in the follow-up phase to significantly impact learning quality.

Abstract

The digital transformation in education has brought significant changes to students' learning environments, including the emergence of various new risks such as cyberbullying, exposure to negative content, and misuse of digital technology. These conditions require educational units to develop school environments that are not only physically and socially safe, but also safe in the digital space through the implementation of the Child-Friendly School (SRA) concept. The success of SRA implementation is greatly influenced by the effectiveness of the principal's management in managing various programs related to the protection and fulfillment of children's rights in the school environment. This study aims to analyze the effectiveness of principal management in realizing SRA in the digital era in elementary schools in Purwakarta Regency. The study used a qualitative approach with descriptive methods. Data collection was carried out through in-depth interviews, observations, and documentation studies with principals, teachers, students, and other related parties. Data analysis was carried out using the Miles and Huberman interactive analysis model, which includes data reduction, data presentation, and drawing conclusions. The results of the study indicate that the implementation of the SRA program at SD Negeri 1 Pondokbungur and SD Negeri 2 Sindangkasih has been carried out through the application of management functions including planning, organizing, implementing, and monitoring as stated in the POAC concept proposed by George R. Terry. During the planning stage, schools develop various programs, including anti-bullying activities, digital literacy, and fostering a positive school culture. The organizational stage involves the formation of a SRA team involving the principal, teachers, and other school members. Program implementation is realized through various character-building activities, child protection outreach, and the wise use of digital technology. Program oversight is carried out through regular monitoring and evaluation by the principal and the SRA team. Program implementation still faces several obstacles, including limited understanding of the comprehensive SRA concept among some teachers, limited supporting infrastructure, and suboptimal parental involvement in supporting school programs. Efforts to overcome these obstacles include increasing program outreach, strengthening coordination among school members, and developing a collaborative culture to create a safe and child-friendly educational environment in the digital era.

Abstract

This research is based on the urgency of the principal's role as a strategic leader in encouraging improved teacher performance amidst increasingly high demands for quality education. Transformational leadership is considered an appropriate approach because it is oriented towards positive changes in teacher attitudes, motivation, and performance on an ongoing basis. However, in practice, there is still a gap between the ideal concept of transformational leadership and its implementation in the school environment. This study aims to examine the application of transformational leadership by principals in an effort to improve teacher performance, which includes the dimensions of idealized influence, inspirational motivation, intellectual stimulation, and individualized consideration. Furthermore, this study also identifies various obstacles that arise and the solutions implemented to overcome them. The study used a qualitative approach with descriptive methods in two elementary schools with different characteristics as multi-site research locations. Data were collected through observation, in-depth interviews, and documentation studies to obtain a comprehensive picture. The results show that principals apply transformational leadership contextually by maximizing its four dimensions, resulting in improved teacher performance and the formation of a conducive and collaborative work culture. However, its implementation still faces several obstacles, such as limited understanding of the concept of transformational leadership, high administrative burdens, varying levels of teacher motivation, and limited supporting facilities. To overcome these challenges, principals implement adaptive strategies through strengthening leadership competencies, effective time management, developing a culture of collaboration, and optimizing available resources. Thus, adaptive and contextual transformational leadership has been shown to contribute significantly to improving teacher performance.

Abstract

Midwives, as health workers, play a crucial role in the provision of maternal and child health services, particularly at Community Health Centers (Puskesmas) as primary healthcare facilities. In their practice, midwives often face potential legal risks, particularly when medical procedures are deemed to exceed their authority or cause harm to patients. This situation places legal protection as a crucial aspect in ensuring professional safety while maintaining the quality of healthcare services. This study aims to analyze the forms of legal protection for midwives in the implementation of medical procedures at the Tanjung Enim Community Health Center and to examine the legal responsibilities that may arise in the event of errors or negligence in the service. The research method used is a mixed approach: normative legal research by examining laws and regulations related to midwifery practice and healthcare services, and empirical research through in-depth interviews with two midwives and the Head of the Tanjung Enim Community Health Center. The data obtained were analyzed to assess the conformity between normative provisions and field practice. The results indicate that preventive legal protection is available through the implementation of Standard Operating Procedures (SOPs), competency improvement training, regulation of authority by the Indonesian Health Workforce Council, and the implementation of informed consent before medical procedures. In addition, repressive protection is also available in the form of administrative clarification mechanisms and assistance from Community Health Centers (Puskesmas) and the Health Office in the event of a complaint. However, midwives' understanding of the legal aspects remains limited, and medical documentation is suboptimal, creating a gap between regulation and implementation. Therefore, strengthening legal literacy, improving the quality of medical records, and developing more comprehensive legal assistance guidelines are needed to ensure legal certainty and the safety of the midwifery profession.
