Abstract

Justice is essentially an ethical concept, a moral concept. As a moral concept, justice aims to seek improvement for everyone. To work for the good for everyone, the interests of each person need to be cared for without giving birth to gold or bringing someone else's eyes. Justice has meaning as the fulfillment of the rights of every person to be respected and cared for by each of the same degrees, both in preserving, advancing and enjoying their lives.Justice, not just a value that only exists, and is owned by someone. But, it must be realized in real life in relation to others. The religion which contains the teachings of the truth of the highest and absolute values teaches its adherents to do justice, act fairly, be fair, and act fairly in making decisions, and in all areas of their lives. In fact, injustice still happens everywhere. This happened, because none of the reasoning was functioning properly, and the bluntness of one's conscience which included the cause of the injustice.Keyword: Justice, Religion, Moral Philosophy

Abstract

Talak merupakan suatu ungkapan yang amat dibenci oleh Allah SWT,meskipun halal. Konsekuensi dari ungkapan talak tersebut ialah terputusnyahubungan perkawinan suami-istri. Dikarenakan akibat yang ditimbulkan daritalak sangat fatal bagi kehidupan pernikahan seseorang, maka munculproblematika di tengah masyarakat muslim. Sebagian kalangan yangberpedoman pada konsep fiqh menyebut bahwa talak sudah jatuh, manakalasang suami mengucapkan perkataan yang mengarah pada talak, meskipuntanpa saksi. Sementara sebagian yang lain yang berpegang pada hukumpositif di Indonesia menyatakan talak tidak akan dapat terealisasi sebelumada putusan pengadilan yang menyatakan sahnya perceraian suami-istri.Kata Kunci: Talak, Fiqh, dan Hukum Positif

Abstract

According to Michael Williams, there are five theoretical formulations of truth: Correspondence Truth, Coherence Truth, Pragmatic Truth, Performative Truth, and Propositional Truth. In the history of Western philosophy, actual knowledge corresponds to reality, while in Eastern philosophy, proper knowledge is the knowledge that saves. There are three Institutes of Truth, namely: Science, Philosophy, and Religion, all of which have points of similarity on the one hand and issues of difference on the other. The topics of similarity include: Neither Science nor Philosophy nor Religion aim at least the same thing: Truth. With their respective characteristics, Science, philosophy, and Religion seek the truth about nature and include humans and God. The points of difference, including Both Science and Philosophy, both result from the same source, namely human reason, while Religion comes from divine revelation. Both Science and Philosophy begin with an attitude of doubt or disbelief. Religion begins with an attitude of trust and faith. Both the truth of Science, and the fact of Philosophy, are relative (relative). At the same time, the reality of Religion is absolute (absolute) because Religion is a revelation sent down by the One Who is True, Absolute, and Perfect.

Abstract

This research discusses the effect of third party funds (DPK), capital adequacy ratio (CAR), non-preponing financing (NPF) and returns on assets (ROA) on Murābaḥah financing in banking, given the important role of banking in the wheels of the economy, one of which is as an institution. intermediation whose task is to collect funds from the public and channel them back in the form of credit. This study aims to determine the factors that affect the distribution of Murābaḥah Financing at Bank Syariah Mandiri and to determine the extent of the relationship between Third Party Funds (DPK), Capital Adequacy Ratio (CAR), Non-Performing Finance (NPF), and Return On Assets (ROA) towards Murābaḥah Financing at Bank Syariah Mandiri in 2016-2019. The sample used in this study was the 2016-2019 Bank Syariah Mandiri Quarterly Financial Report using the purposive sampling method. The type of data used is secondary data obtained from published financial reports and downloaded through the official website of Bank Syariah Mandiri. The analytical method used is multiple regression with a significance level of 5%. The results of the analysis show that partially only DPK and NPF have a significant positive effect on Murābahah Financing, while CAR and ROA do not affect Murābaḥah Financing. Simultaneously, the variables of DPK, CAR, NPF, and ROA have a significant effect on Murābaḥah Financing. This is evidenced by the sig-F value of 0.002 which is smaller than the 5% significance.

Abstract

The issue of human rights enforcement has always been an interesting spotlight in the public, including in Indonesia. This is because the existence of human rights is always attached to every human being. Besides that, guarantee and protection of human rights is also one of the benchmarks for the nation and state progress. The presence of this research is also inseparable from the efforts to answer various problems of human rights enforcement in Indonesia, which have so far been considered badly by Human Rights Watch (HRW) in the 2020 word report, especially for vulnerable groups. Therefore, this research not only presents a detailed description of the theoretical aspects of human rights itself, but also describes in detail the important instruments for human rights enforcement, various problems in enforcing human rights in Indonesia, as well as some important solutions that needs to be implemented immediately in the practice of human rights enforcement so that the manifestation of substantive truth and justice is truly felt by all levels of Indonesian society.Keywords: Human Rights Enforcement, Human Rights Problems, Human Rights Enforcement Solutions

Abstract

Law enforcement that often miseries and hurts the sense of community justice encourages one of the jurists, Satjipto Rahardjo expresses his idea about the need to involve conscience and morals in punishment. This way of punishment is then referred to as progressive law enforcement. Progressive law is a scientific endeavor that criticizes conventional punishment mechanisms; namely punish by putting forward the legal-formal truth, which is the cause of law enforcement in this country cannot give happiness to the seekers of justice. The progressive legal orientation is how to ground the truth (substantive justice), based on the premise that law is for man, not on the contrary. In addition, progressive legal notion holds that the truth of the law is not always judged from the application of laws formulated in the law, but the extent to which the law responds to developments in society. To that end, when the law is stuck in answering the community's problem, then here is the need to make a breakthrough (rule breaking). This shows that progressive law enforcement is an effort / process that always seeks truth and justice.Keywords: Law Enforcement, Progressive Law, Substantive Justice

Abstract

The determination of the wedding day by using primbon happened  in Karanggeger’s society is a Tradition that has been inherited by the ancestors, as in Islam this tradition certainly contradicts with Islamic Shari'a, where as the majority of the Karanggeger people are Muslim, but the tradition is still carried out as a habit that has been handed down for generations by the society, to determine the law from that tradition by using Istihsan, where Istihsan assesses an event based on whether or not there are benefits in it.How to find out the process of determining the marriage contract day in Karanggeger village by using Primbon and how the Istihsan study of the determination of marriage contract by using the primbon. This research used some methods those are Phenomenology, Observation, Interview, and Documentation. The data obtained is then processed with a qualitative approach.The results of the study were that Karanggeger people came to the local religious figures who understood the Primbon problem then determine a good wedding day, every thing that was done and considered something good was worthy of being called Istihsan, as well as legal exclusion from general shari'ah principles, based on habits applicable.

Abstract

Sebagaimana firman Allah dalam QS, Ad-Dzariyah : 56 bahwa menciptaan jin dan manusia tidak lain agar mereka menyembah kepada-Nya, oleh karena Ibadah merupakan urusan makhluq dan khaliq maka ia menjadi urusan pribadi tanpa ada keterkaitan dengan siapapun, akan tetapi karena ibadah membutuhkan sarana dalam pelaksanaannya, maka secara tidak langsung mereka membutuhkan orang lain untuk kesempurnaan ibadahnya. Untuk menghindari perbedaan dalam penyediaan sarana tersebut maka peran pemerintah sangat dibutuhkan agar pelaksanaan ibadah dapat berjalan dengan khidmah. Akan manusia tetaplah manusia, dimana kepuasan terhadap pelayanan Negara tidak sama, sehingga tidak jarang sebagian dari umat manusia khususnya di Indonesia menyediakan pelanan dalam ibadahnya dilakukan sendiri atau kelompok, contoh paling nyata adalah penetapan awal puasa ramadlan, di Negara ini sering sekali terjadi perbedaan dalam penetapan awal dan akhir ramadlan, hal ini terjadi karena sebagian dari mereka telah memiliki sarana sendiri dalam penetapannya. Kata Kunci: Ibadah, Sarana, dan Pemerintah

Abstract

This research discusses the practice of muḍārabah at Bank Muamalat, Wonosobo Sub-Branch Office, a form of business collaboration using a muḍārabah contract and in the process the business fails so that it suffers losses caused not by the negligence of the fund manager (muḍārib) so the fund manager must bear all the losses. Where it should be in the syari'ah concept that if you collaborate using the muḍārabah agreement, if the business fails in the process, the loss is fully borne by the owner of the capital (ṣāḥibul māl). Discussion of the theory and practice in the muḍārabah contract according to Islamic law is very important. This study aims to determine the law regarding the practice of muḍārabah financing at the Bank Muamalat Wonosobo Branch Office, whether it is legal or not legally '. The approach used uses a normative approach with the object of the muḍārabah contract practice at the Bank Muamalat Wonosobo Branch Office which is adjusted to the perspective of Islamic law. After conducting an analysis with adjustments between Islamic Law and collaboration products with the muḍārabah agreement implemented by the Bank Muamalat Wonosobo Branch Office, it resulted in a conclusion that the practice of the muḍārabah contract was not in accordance with Islamic Law (syara ').

Abstract

Keragaman agama, etnis, dan budaya, merupakan modal social yang memiliki daya dukung positif bagi kurukunan umat beragama, tetapi sekaligus juga bisa berpotensi menimbulkan konflik yang justru akan menghambat bagi terwujudnya kerukunan itu sendiri. Oleh karena itu, dalam kehidupan keseharian dalam masyarakat yang majemuk dan multi-etnik, bisa terjalin keharmonisan di satu sisi, sementara disisi yang lain juga bisa terjadi pertentangan dan konflik. Namun demikian, dalam  kehidupan masyarakat (khususnya pada masyarakat tertentu) telah memiliki sejumlah instrument dan mekanisme peredam konflik tersendiri, salah satunya melalui mekanisme kearifan local (local wisdom).
