Abstract

TikTok is one of the most popular social networking applications and music video platforms in the world. TikTok also uses a lot of songs or music from various creators, this creates legal problems, especially in the field of copyright for song or music creators, namely the distribution of copyright- related products without permission/licence. So that it violates the rights related to copyright and the economic rights of the creator. This study uses a juridical-normative legal research method which is a legal research that is literature writing in the form of books, journals, and regulations that have a correlation to the discussion of problems, and with a legal approach and uses a conceptual approach by examining the doctrine of experts related to the legal issues under study. The application's liability to the copyright holder of the song or music is in the form of compensation or termination of the distribution or reproduction of related products whose copyright is violated. The protection given to song or music copyright holders is criminally and civilly against copyright law violations in accordance with Law Number 28 of 2014 concerning Copyright.

Abstract

The development of technology nowadays seems to reach all aspects of life, includes the realm of art, especially digital illustration. However, these developments were not followed by regulatory developments so that there was a legal vacuum in them. This study is intended to analyze the legal vacuum of limiting an act that can be categorized as piracy and legal protection for the creator of the piracy of digital illustrations which are  tokenized in the form of NFT using doctrinal research methods. Based on the results of the study, it is concluded that the Standard of Copyright Ability and substantial similarity can be used as criteria for piracy of digital illustrations. There are still vacancies in the regulations regarding the limitations of piracy of a work and the provisions governing NFT. The copyright protection system for digital illustrations in the current regulations consists of preventive and repressive protection. Due to this legal vacuum, it is hoped that regulation about NFT and fine art can be added, and awareness of all parties can be made to avoid infringement of other people's copyrights.

Abstract

Law No. 28 of 2014 regulates copyright but there are still many copyright violations in the TikTok application, therefore there is still a need for copyright protection. Copyright protection is needed to prevent copyright disputes. This study examines the legal protection for music and song creators for unauthorized re-arrangements by TikTok application users and the responsibility of the perpetrators of unauthorized re-arrangements of the owner's copyright. This research is a normative research using the approach of legislation, cases, and concepts. The data analysis used is examining library materials such as books, journals, laws, scientific articles related to these legal issues. This study shows that preventive protection of creators' copyrights is less than optimal, because the legal protection and supervision provided by the government are not supported by the TikTok application, which is less assertive in regulating copyright violations in the form of musical arrangements, even the TikTok application tends to let go of copyright violations in the form of re-arranging music. Therefore, the responsibility for arranging without permission is not carried out optimally.

Abstract

The growth of e-commerce transactions in Indonesia reached 533 trillion Rupiah in 2023, reflecting a significant transformation in the national business landscape. This increase opens new opportunities for companies to expand their markets but also presents challenges related to business competition and intellectual property rights protection. Trademarks, as valuable assets representing the reputation and quality of products, require effective protection to build consumer trust and maintain brand integrity. This protection becomes increasingly crucial in the digital era due to the rising cases of trademark infringements, including unauthorized use and counterfeiting. This study highlights the importance of adaptive legislation and the role of technology in detecting counterfeit products in e-commerce. By employing normative juridical methods, this research analyzes the effectiveness of regulations and practices in trademark protection in Indonesia, comparing them with best practices in other countries. The study also evaluates the impact of trademark protection on human rights, emphasizing that the right to a trademark is part of intellectual property rights that protect the economic and social interests of trademark owners. E-commerce platforms play a crucial role in protecting trademarks by implementing internal policies, reporting mechanisms, and cooperation with relevant authorities. Despite progress, challenges remain, particularly in monitoring the large volume of products and addressing increasingly sophisticated infringement methods. Effective trademark protection not only enhances consumer trust but also fosters innovation and digital economic growth. This research provides recommendations to improve collaboration between the government, e-commerce platforms, and trademark owners in protecting intellectual property rights in Indonesia.

Abstract

This paper explores the balance between intellectual property protection and its release for sustainability purposes within the Indonesian legal framework. While intellectual property rights incentivize innovation by granting creators exclusivity, they can also hinder the accessibility of technologies essential for achieving sustainability goals, particularly in resource-constrained regions. The study mentions global examples, including open-source initiatives by Tesla and Toyota, and examines their implications for fostering innovation and promoting equitable access to sustainable technologies. Drawing from Indonesian laws on intellectual property and international frameworks, the paper investigates the extent to which Indonesia's legal regime accommodates intellectual property release mechanisms like compulsory licensing, patent pools, and creative commons. Using a normative legal research method, this study identifies the gaps and opportunities in Indonesia's intellectual property regime. It emphasizes the critical role of stakeholders such as corporations, the government, and international organizations in matching intellectual property protection strategies with sustainability objectives. Companies as intellectual property owners are urged to adopt sustainability-oriented approaches that integrate intellectual property release while safeguarding their commercial interests. Governments are encouraged to implement supportive policies, including incentives and regulations, to promote technology sharing. Furthermore, global entities like WIPO are called upon to foster international frameworks that prioritize sustainable development. Ultimately, this paper advocates for a collaborative, multi-stakeholder approach to ensure intellectual property systems advance innovation while addressing urgent environmental and social challenges.

Abstract

Vision+ (PT MNC OTT) becomes one of the live-streaming-subscription platform or the Over-The-Top subscription platform that has been receiving agreement/ license from FIFA through AFC to broadcast contents of Round 3 of 2026 World Cup Qualification Asia Zone. Vision+ is also a subscription broadcasting enterprise, so everyone who wants to use the platform and watch the contents has to create personal account and pay subscription fee. Sometimes, the platform is used by its user to make a profit (commercialization). For example, the café owner uses the personal account to broadcast the content of sport event to public. That case is our concern or object in this research. The aim of this research is to know the legal perspective of commercialization of the use of the live-streaming-platform personal account. This researchis normative legal research using statute and conceptual approaches. The result of this research is the café owner breaks the provisions of Law Number 28 of 2014 concerning Copyrights, Article 9 Paragraph (1) letter g, because the café owner broadcasts or announces the audio-visual content (economic right) without permission or license from copyrights holder which is Vision+.

Abstract

The rise of trade dress imitation cases involving well-known trademarks in Indonesia reveals a regulatory gap that potentially harms legitimate businesses and misleads consumers. This article explores the urgency of regulating trade dress within the framework of intellectual property protection, particularly for well-known trademarks that are frequently targeted by visual imitation. Using a normative approach and analyzing Supreme Court Decision No. 402 K/Pdt.Sus/2011, this research highlights the shortcomings of Indonesia’s legal instruments in providing comprehensive protection for non-verbal visual identities, which play a vital role in brand differentiation and reputation. The study also compares Indonesia’s approach with international standards and identifies the need for regulatory harmonization to close legal loopholes exploited for unfair competition. The findings recommend that the concept of trade dress should be explicitly recognized and regulated in Indonesian law to strengthen legal certainty, protect consumers, and uphold fair business competition.

Abstract

Digital platforms become a place to enjoy copyrighted digital content that is widely distributed in cyberspace, and cyberspace becomes a digital space that connects various digital platforms through the Internet network. Copyright as a legal instrument to protect any copyrighted material. Cinematography, which is also known as video, is a material object protected by copyright. The primary research focus is resolving video copyright infringement on digital platforms and determined measures for video copyright infringement on digital platforms. This research uses a normative method with a juridical approach. The results of this study understand the concept of copyright infringement of video content on digital platforms based on Indonesian copyright law and design anticipatory measures in form of proactive action of creators and utilization copyright service features in digital platform, then enforcement measures for copyright infringement of video in digital platform by takedown content, report to authorized institutions and utilize online dispute resolution, as an initial measures before taking a legal remedy under copyright law.

Abstract

The fairly active invention discovery activity in Indonesia for a period of almost three decades requires a mechanism that allows patents to be utilized optimally, not only by their owners but also by other parties through commercialization channels such as the provision of an intellectual property marketplace system. This system supports collaboration between inventors and patent holders which is very important to ensure that the economic potential of patents can be fully realized. The research was conducted using a normative legal approach using secondary data. The data collection technique was carried out using a literature study that was analyzed qualitatively. Legal protection is important in the Intellectual Property commercialization ecosystem to accommodate and legitimize the existence of an intellectual property marketplace. Several regulations such as PP No. 24/2022, the Patent Law, and the ITE Law are the basis for the intellectual property marketplace. Infrastructure development in patent commercialization will help bridge the gap between the creation and commercialization of intellectual property rights, so various components of development in patent commercialization need to be realized such as an intellectual property valuation system, contract standardization, and an inventory of intellectual property rights.

Abstract

The installation process of Fonts differs from the installation process of software such as operating system and application programs. Software installation requires a verification phase based on codes, whereas Fonts do not. This is why software usage can be tracked, while Font usage cannot. As a result, Font creators are unable to monitor/ track whether their Fonts are being used in accordance with the license terms or not. This situation creates a potential loss for Font creators because the economic rights granted to licensees become unlimited. The aim of this research is to gain a conceptual or a philosophical understanding of the protection of the creator’s economic rights over Font on digital platforms based on the Incentive Theory. This is a normative legal study using a conceptual and statutory approach. The results of this research indicate that Font are protected creations which classified as compilations of data that can be read by computer programs, and thus their creators have the economic rights over them. Incentive Theory provides the fundamental principle or concept for protecting the economic rights of Font creators in Indonesia, in order to appreciate their creative efforts, encourage the emergence of other economically valuable works, and ensure a decent livelihood. The protection of the economic rights needs to be facilitated by the Government. Keywords : Font, Compilations of Data, Economic Right, Protection Abstrak. Proses instalasi Font berbeda dengan software sistem operasi maupun program aplikasi. Proses instalasi software membutuhkan tahap verifikasi berbasis kode, sedangkan Font tidak. Hal itu yang menyebabkan software dapat dilacak penggunaannya, sedangkan Font tidak bisa. Dampaknya, kreator Font tidak bisa melacak penggunaan Font apakah sesuai dengan ketentuan dalam lisensi atau sebaliknya. Keadaan seperti itu menimbulkan potensi kerugian bagi kreator Font karena pemakaian hak ekonomi oleh penerima lisensi menjadi tidak terbatas. Tujuan dari penelitian ini yakni mendapat pemahaman konseptual terhadap perlindungan hak ekonomi Pencipta atas karya Font di platform digitalberdasarkan Teori Insentif. Penelitian ini merupakan penelitian normatif dengan pendekatan konseptual dan perundang-undangan. Hasil dari penelitian ini adalah Font merupakan ciptaan yang dilindungi yang mana digolongkan sebagai kompilasi data yang dapat dibaca program komputer sehingga penciptanya mempunyai hak ekonomi atas ciptaan tersebut. Teori insentif memberikan prinsip/ konsep dasar perlindungan hak ekonomi kreator Font di Indonesia guna menghargai upaya kreatifnya, mendorong lahirnya karya bernilai ekonomi lain, dan menciptakan penghidupan yang layak. Perlindungan hak ekonomi perlu difasilitasi oleh Pemerintah. Kata Kunci : Font, Kompilasi Data, Hak Ekonomi, Perlindungan
