Abstract

Business actors use digital media in various forms to support market expansion. Various information related to production methods and marketing methods through digital media is no longer in line with the legal concept of trade secret protection in Indonesia. It seems that business actors have no worries about a decrease in economic value when the production methods used are disseminated using social media. This study aims to analyze the implementation of trade secret law as intellectual property rights in the digital era. This normative research uses qualitative methods and a phenomenological approach. Data was collected through literature study, observation, and interviews. The results of the study show that the implementation of trade secret legal protection is private or individualistic. If a business actor disseminates trade secret information, the information will no longer be the object of a trade secret and will not receive legal protection as stipulated in Law No.30/2000.

Abstract

Intellectual Property Rights are the result of an individual's thoughts which can be in the form of ideas, thoughts, or ideas by expressing them in a form of invention in works of art, literature, or in the field of science that have economic value. One of the Intellectual Property Rights is Copyright. Authors have Moral Rights and Economic Rights, so licenses and royalty payments are required for the commercial use of copyrighted works. This research has formulated the problem of how the rules regarding Copyright, especially regarding songs and/or music in Indonesia, and what legal remedies can be taken for violations of performing songs without permission. The research method in this study used descriptive-analytical research with normative juridical methods. Copyright is regulated in Law Number 28 of 2014 concerning Copyright. Commercial use of copyright works without permission will be subject to sanctions as stipulated in Article 113 paragraph (2) of Law no. 28 of 2014, namely imprisonment for a maximum of 3 (three) years and/or a maximum fine of Rp. 500,000,000.- (five hundred million rupiah).

Abstract

TikTok, a smartphone-based application based on sharing media that provides freedom for users to insert the desired song and sound effects into a short video which will then be ready to be announced and/or uploaded. 1 With the entertainment and comedy genres, TikTok makes teenagers the most dominant demographic even though TikTok's target audience consists of pre-teens to the elderly. Besides that, the consumerist mindset of teenagers makes the demographic perspective of this application user give the impression that the legality element in this application is insignificant and even seems trivial. In this study, the legal aspect in question is copyright. This study carries the formulation of the problem in the form of: 1) What is the legal protection for the original creator of audio and/or video that has been sampled?; 2) What are the provisions governing certainty regarding whether or not a snippet is used by a TikTok application user based on statutory regulations? This research is a normative legal research that uses primary, secondary, and tertiary data sources as a complement or explanation if necessary. The approach used in this study is a statutory approach and a conceptual approach. The results of the research can be concluded: The reasons for the importance of implementing and enforcing fair use in media sharing-based social media applications such as TikTok are: 1) The high potential for copyright infringement occurs because there is no oversight of UserGenerated Content uploaded by users; 2) There is no information that serves as an explanation regarding the use of copyrighted works in applications that can support the certainty of fair use terms; 3) The lack of action to enforce existing provisions in UUHC by the competent authorities has become a catalyst for copyright infringement.

Abstract

This study analyse the role of Intellectual Property Rights to develop cultural expression “Pacu Jalur” from Riau province. It aims to find out  how the current legal system protect and utilize communal rights so that it can be preserved. Normative research is applied as the methodology where secondary data such as laws, regulations, and relevant study are present. Analysis are done through quantitative and qualitative description. This study obtained that Pacu Jalur is part of Communal Rights that have to be protected and developed to be an identity of Taluk Kuantan Regency in Riau Province. Such right are not fully implemented and it is advised to be improved so that economic benefit could be realized.

Abstract

This study analyzes the legal protection of the Angguk dance for commercial purposes and provides an overview of intellectual property rights and traditional cultural expressions. Furthermore, the author also mentions the legal protection of the Angguk dance as a traditional culture and legal protection at the national level. Next, we analyze the concept of profit sharing. This study provides practical and academic guidance in a scientific field, namely legal research, for those who are interested in advancing the legal protection of the Angguk dance as a traditional culture from the perspective of commercial interests and the subject of analysis. You are expected to provide feedback in a timely manner. of profit sharing. The research method used in this study is a normative library research method, namely research on legal norms contained in statutory regulations. The author analyzes the legal protection of the Angguk Dance as a traditional culture based on Article 38 of Law Number 28 of 2014.

Abstract

The healthcare sector is being impacted by information technology advancements in four key ways: first, a wide range of tasks that were previously performed manually can now be performed by computers; second, some tasks can be outsourced to other countries using affordable communications technology; third, longitudinal and societal healthcare data can now be analysed in acceptable amounts of time; and fourth, the best medical expertise can sometimes be made available. The healthcare industry will increasingly employ a portfolio approach made up of three closely coordinated components that are seamlessly integrated together: healthcare tasks performed by humans on-site; healthcare tasks performed by humans off-site, including tasks performed in other countries; and healthcare tasks performed by computers without direct human involvement. The three-pronged healthcare services paradigm is discussed in this essay along with relevant legal and intellectual property issues.

Abstract

Penelitian ini membahas mengenai persamaan dan perbedaan perlindungan hukum merek terkenal antara Indonesia dan Spanyol dan faktor yang menjadi penyebab perbedaan perlindungan merek terkenal di Indonesia dan Spanyol.. Penelitian ini menggunakan metode penelitian hukum normatif. Hasil pembahasan dari penelitian terdapat beberapa persamaan antara Undang-Undang Nasional Merek Indonesia dengan Undang-undang Merek Spanyol, seperti pengaturan mengenai pengertian merek, pertama mengajukan, dan ganti rugi dalam gugatan perdata. Politik hukum, sistem hukum, dan budaya hukum menjadi faktor penyebab perbedaan perlindungan hukum Indonesia dan Spanyol.

Abstract

Hak cipta di Indonesia diatur dalam Undang-Undang Republik Indonesia No. 28 Tahun 2014 tentang hak cipta yang dikeluarkan pada tanggal 16 oktober 2014. Hak Cipta dapat dimiliki oleh setiap orang yang ciptaannya telah tercatat di Direktorat Jenderal Kekayaan Intelektual (DJKI). Salah satu contoh di bidang kesenian adalah grup (artis) beserta karyanya yang telah tercatat dalam HAKI (Hak Atas Kekayaan Intelektual). Penelitian ini menggunakan jenis penelitian normative, yaitu dengan penelitian terhadap sistematik hukum yang dilakukan dengan pendekatan perundang-undangan tertentu ataupun tercatat. Menurut Undang-Undang Nomor 28 Tahun 2014 tindakan yang dilakukan oleh Warkopi beserta manejemennya termasuk dalam bentuk pelanggaran Hak Cipta. Hal ini dibuktikan dengan adanya perbuatan dari pihak Warkopi yang merugikan pihak Warkop DKI. Upaya penyelesaian kasus antara Warkop DKI dengan Warkopi ini diakhiri secara kekeluargaan.

Abstract

Internet Memes merupakan salah satu media yang populer digunakan masyarakat dalam era bermedia sosial untuk berbagai macam tujuan, mulai dari pengiklanan, penginformasian, edukasi, hingga politik. Dalam penggunaanya, internet memes sering menggunakan ciptaan lain yang dilindungi hak cipta. Penelitian ini bertujuan untuk mengetahui terkait adanya pelanggaran hak cipta terhadap internet memes. Hasil dari penelitian ini menunjukkan bahwa di Indonesia, terdapat kesulitan terkait dengan penggolongan internet memes sebagai hak cipta berdasarkan Undang-Undang No. 28 Tahun 2014 tentang Hak Cipta. Namun, internet memes juga tidak dapat digolongkan sebagai pelanggaran hak cipta karena diakuinya doktrin fair use yang termaktub dalam Pasal 26,43, dan 46 Undang-Undang No. 28 Tahun 2014 tentang Hak Cipta. Penelitian ini juga meninjau doktrin fair use yang berlaku di Amerika Serikat dan Singapura serta membandingkannya dengan doktrin fair use yang berlaku di Indonesia. Dari hasil perbandingan tersebut, Indonesia belum mengatur mengenai faktor-faktor untuk menentukan apakah suatu ciptaan dapat dianggap sebagai fair use atau tidak sebagaimana diatur oleh diberlakukan di Amerika Serikat dan Singapura.

Abstract

This study underscores the need to reevaluate traditional IP paradigms and explore alternative models that strike a better balance between the resultant social costs and benefits. These alternatives encompass a range of strategies, including copyleft principles, trade secrets, etc., each offering unique pathways to mitigate social costs while preserving incentives for creativity. This research contributes valuable insights to the ongoing discourse on reshaping IP frameworks to create a more harmonious and sustainable environment that nurtures innovation and creativity while minimizing unintended societal repercussions.
