The Journal of Islamic and Law Studies is a multi-disciplinary publication dedicated to the scholarly study of all aspects of science and of the Islamic in Indonesia. Particular attention is paid to works dealing with history geography political science economics anthropology sociology law literature religion philosophy international relations environmental and developmental issues as well as ethical questions related to scientific research. Abstract

Abstract: Talking about the meaning of usury, there are several thoughts according to Al Gazali, Ar Razi, Ad Dahlawi, and Al Maududi. Al-Gazāli argues that usury does not address the issue of interest on money loans. He only said that fixing interest on borrowed money means diverting it from its main function, namely as a medium of exchange and as a measure of value. Meanwhile, according to Ar Razi, there are several things that are prohibited in usury. First, because usury means taking the borrower's property unfairly. Second, Allah forbids usury so that people are not lazy to work. Third, because usury will eliminate the goodness contained in borrowing money. Fourth, in general those who lend money (muqriḍ) come from the rich, while those who borrow money (mustaqriḍ) come from the poor. Fifth, the prohibition of usury has been clearly established in the Qur'an and Hadith. According to Ad Dahlawi, transactions that contain elements of usury do not have a spirit of cooperation at all, therefore these transactions are contrary to humanity and detrimental to civilization. Then according to Al Maududi, the problem of usury is clear and practical, capital does not have the right to collect fixed interest, even if the borrower wins or loses. Abstrak: Berbicara mengenai makna riba, ada beberapa pemikiran menurut Al Gazali, Ar Razi, Ad Dahlawi, dan Al Maududi. Al-Gazāli berpendapat bahwa riba tidak membahas masalah bunga pinjaman uang. Ia hanya mengatakan bahwa penetapan bunga terhadap pinjaman uang berarti membelokkannya dari fungsi utamanya, yaitu sebagai alat tukar dan sebagai pengukur nilai. Sedangkan menurut Ar Razi, ada beberapa hal yang dilarang dalam riba, yang Pertama, karena riba berarti mengambil harta si peminjam secara tidak adil. Kedua, Allah mengharamkan riba agar manusia tidak malas bekerja. Ketiga, karena riba akan menghilangkan kebaikan yang terkandung dalam peminjaman uang. Keempat, pada umumnya pihak yang meminjamkan uang (muqriḍ) berasal dari golongan orang kaya, sedangkan pihak yang meminjam uang (mustaqriḍ) berasal dari kalangan orang miskin. Kelima, keharaman riba telah ditetapkan dengan jelas di dalam Alquran dan Hadis. Menurut Ad Dahlawi, transaksi yang mengandung unsur riba, sama sekali tidak memiliki semangat kerjasama, karenanya transaksi tersebut bertentangan dengan kemanusiaan dan merugikan peradaban. Kemudian menurut Al Maududi, masalah riba sudah jelas dan praktis, modal tidak punya hak untuk memungut bunga yang tetap, meskipun peminjam untung atau rugi.

Abstract

Abstrak: Ditetapkannya Undang-Undang No. 21 tahun 2008 tentang Perbankan Syariah semakin memperkokoh eksistensi perbankan syariah di Indonesia yang walaupun oleh beberapa kalangan pembentukan undang-undang tersebut dinilai yang terlambat dalam merespon perkembangan bank syariah yang sudah dimulai sejak tahun 1992. Dalam penelitian ini kajian berpusat pada Undang-undang No.21 tahun 2008 tentang Perbankan Syariah sebagai dasar regulasi operasional perbankan syariah di Indonesia. Setidaknya ada tiga hal yang masih perlu ditinjau secara kritis yakni akad qardh, hubungan hukum antara nasabah dan bank syariah, serta kewenangan penyelesaian sengketa. Penelitian ini merupakan penelitian hukum yang menggunakan pendekatan undang-undang (statute approach) yang berdasarkan pada bahan hukum primer dan sekunder dengan analisis yang bersifat kualitatif. Penelitian ini melihat adanya konsep pembiayaan berdasarkan akad qardh yang belum spesifik dijelaskan, dasar hubungan hukum antara nasabah dan bank syariah, serta kewenangan penyelesaian sengketa yang berpotensi memunculkan pertentangan antara Pengadilan Agama dan Pengadilan Umum.Abstract: Islamic Banking Act No. 21 of 2008 which had been implemented increasingly strengthened its existence in Indonesia, although a cohort of people regarded that the formation was late on responding islamic banking development which had been started since 1992. This research focused on Islamic Banking Act No. 21 of 2008 as basic operational regulation of Islamic banking in Indonesia. Three cases which still should be reviewed critically was akad gardh (loan agreement), linkages of customer and Islamic bank, and dispute resolution authority. This research was law research which used statute approach based on primary and sekunder law material along with qualitative analysis. This research found out that finance concept based on akad gardh have not been explained specifically, basic relation between costumer and Islamic bank, and dispute resolution authority potentially brings up contradiction between religious and general courts

Abstract

AbstrakRealitas bahwa Indonesia adalah negara hukum sekaligus negara dengan jumlah penduduk muslim terbesar di dunia, seringkali memunculkan upaya untuk “mengislamkan” hukum di Indonesia yang memicu pertentangan dan perdebatan antara konsep negara Islam dengan negara bangsa. Penelitian ini merupakan penelitian normatif yang bertujuan untuk mengetahui apakah sistem hukum dan bentuk negara Indonesia sudah sesuai dengan konsep negara syariah dari Arskal Salim yang ditulis dalam bukunya yang berjudul Challenging the Secular State: The Islamization of Law in Modern Indonesia. Hasil penelitian ini menunjukkan bahwa sistem hukum di Indonesia tergolong syariah, namun desonansi harus dihindari dengan benar-benar membedakan antara syariah (nizamul ilahiyyat), fiqih (nizamul insaniyyat), serta aspek keadilan dan aspek legitimasi dari suatu peraturan. Konsep politik negara syariah yang terdiri dari ummah (komunitas), khalifah (umara), dan syariah (ulama) telah dipenuhi oleh Indonesia. Di mana di indonesia, antara agama dan negara dipisahkan namun tetap saling berhubungan, di mana Indonesia yang terdiri dari beragam suku dan agama (ummah) dipimpin oleh presiden (khalifah/umara) sebagai pemegang pemerintahan dan MUI/Majelis Ulama Indonesia (ulama)  mengurusi masalah agama.

Abstract

AbstractThis research was compiled based on the existence of asymmetry between the implementation of the functions of the Village Consultative Body in Cukan Lipai Village as stated in Law Number 6 of 2014 with fact in the field. This is because the government in the village is filled with people recruited by the village head from the relatives and the success team during the village head election without strict selection and consideration. The purpose of this study was to determine the performance of the implementation of the function of the Village Consultative Body in Cukan Lipai Village in realizing a village apparatus that was clean from corruption, collusion and nepotism and obstacles to its implementation.This research is an empirical legal research that is descriptive qualitative and located in Cukan Lipai Village, Batang Alai Selatan District, Hulu Sungai Tengah Regency. The results showed that the performance of the implementation of the functions of the Village Consultative Body was still not effective due to a lack of understanding of the functions of the Village Consultative Body. The village head and village apparatus take many roles in the policies issued by the Village Consultative Body. So that the presence of the Village Consultative Body as the supervisor of the performance of the village head which is expected to play a role in realizing a village apparatus that is free from corruption, collusion and nepotism is nil. Keywords: Function, Village Consultative Body, Village Apparatus, Corruption Collusion and Nepotism.

Abstract

Kertas ini mengkaji sumbangan Prof. Ahmad Ibrahim dalam usahanya merangka dan menjayakan gagasan Islamisasi undang-undang di Malaysia. Beliau telah membangunkan kerangka perundangan Islam yang bernafaskan prinsip hukum dan syariat yang dilakarkannya bagi menggantikan undang-undang sivil yang diwarisi dari penjajah. Menurutnya pindaan terhadap undang-undang sivil harus diusahakan dengan bijaksana dan berperingkat. Beliau berhujah bahawa undang-undang Islam telah diterima dan dilaksanakan dalam Kanun Melaka, Terengganu dan Kedah dan dipertahankan sejak Islam masuk ke rantau ini sebelum dihapuskan oleh penjajah. Undang-undang syariah menurutnya lebih baik dan telah memperlihatkan kecemerlangan dalam penerapannya di negara-negara Islam dalam mengurangkan kadar jenayah. Kertas ini akan mengkaji secara terperinci kaedah yang diusulkannya bagi menerap dan mengaplikasi undang-undang Islam seperti yang dicerakin dan dibincangkan dalam karya-karyanya.

Abstract

Determining the Qibla direction is a very important thing in Islamic teachings, because one of the conditions for the validity of prayer is facing the Qibla. For those who are around Mecca, facing the Qibla is not a problem because they can directly see the Temple of Allah or the Masjid al-Haram, but for those who are far from Mecca, determining the direction of the Qibla is sometimes quite a complicated issue, because special knowledge is needed to that. For this reason, experts then try to make a compass that can be used as a tool to determine the direction of the Qibla, including the Mecca compass and the user guide containing Qibla data from major countries around the world, including Indonesia and several other major cities. This paper attempts to provide a concrete description of the accuracy of using the Mecca compass in determining the Qibla direction of major cities in Indonesia. Penentuan arah kiblat merupakan suatu hal yang sangat penting dalam ajaran Islam, karena di antara salah satu syarat sahnya shalat adalah menghadap kiblat. Bagi yang berada di sekitar Mekkah, menghadap kiblat tidaklah menjadi masalah karena mereka secara langsung dapat melihat Bait Allah atau Mesjid al-Haram, namun bagi mereka yang jauh dari Mekkah, penentuan arah kiblat ini terkadang menjadi persoalan yang cukup rumit, karena diperlukan ilmu khusus untuk itu. Untuk itu para ahli  kemudian berusaha membuat kompas yang dapat dijadikan sebagai alat untuk menentukan arah kiblat, di ataranya adalah kompas Mekkah berikut buku petunjuk yang memuat data kiblat negara-negara besar di seluruh dunia termasuk Indonesia dan beberapa kota-kota besar lainnya.Tulisan ini berusaha memberikan gambaran secara konkrit keakuratan penggunaan kompas Mekkah dalam menentukan arah kiblat kota-kota besar di Indonesia.

Abstract

Rapidly developing technological developments affectalmost all human affairs, including business matters. Thedevelopment of this technology has led to the concept of certifyingcertificates through electronics, namely cyber notaries. Basically anotary plays a role in guaranteeing legal certainty in the civilrelations of the parties in the engagement relationship. With theterm cyber notary, notaries are faced with the ability to utilizetechnology in carrying out their notary duties. Cyber notary has abasic function as certification and authentication in electronictransactions. However, there are several dilemmas in this cybernotary, namely regarding legal certainty and knowledge of thenotary himself. In the city of Banjarmasin, business development isalso very fast, so it is important to have research on theimplementation of cyber notaries in the city of Banjarmasin. Thisstudy uses empirical legal research or also called non-doctrinal.Subjects in this study, namely notaries who are in the city ofBanjarmasin with the classification of having carried out theirduties for a minimum of five years of office. The purpose of thisresearch is to find out the perspective of a Banjarmasin city notaryregarding the urgency, readiness, and constraints in implementingcyber notary. It can be concluded that the notary perspective of thecity of Banjarmasin on the urgency of implementing cyber notarydepends on the understanding of the notary himself, not allnotaries of the city of Banjarmasin have known the concept of cybernotary. Notaries in Banjarmasin City are also not ready and areworried about several obstacles in implementing cyber notaries,such as legal certainty

Abstract

This paper has a background in the case of the existenceof the DEPO 04 SAHATI landfill which was built around theeducational facilities of SMP Negeri 3 Sampit, thus disrupting theteaching and learning activities carried out by teachers andstudents due to the odor generated from the temporary shelter. Themethod used is descriptive qualitative field research by conductinginterviews with the clerics of Sampit City. The results obtainedfrom this research are related to the legal determination of theexistence of Temporary Shelters around the SMPN 3 Sampit schooland the need for more intensive management from managers andpublic awareness of the importance of managing waste to minimizethe risks that can interfere with teaching and learning activities.

Abstract

This research is motivated by the many violationscommitted by electricity service users or electricity customerswhich are often referred to as unlawful use of electric current.Consumers who object if their rights are not fulfilled submit alawsuit to BPSK (Consumer Dispute Resolution Agency).Consumers always have their complaints rejected regardingviolations of P2TL (Issuance of Electrical Inspections) because PLNalways makes excuses and takes refuge in PT Directors'Regulations. PLN and as long as the resolution method chosen ismediation, which is essentially an agreement between the parties,the BPSK panel cannot impose sanctions on PLN or grant consumercomplaints. Consumer protection is any effort that ensures legalcertainty to provide protection to consumers. There are 8 (Eight)cases related to consumer and PT problems. PLN (Persero) BPSKBanjarmasin City, one of the authors took a case regardingconsumer problems and PT. BPSK PLN (Persero) Case Number:18/PN BPSK.BJM/VIII/2022. This research aims to find out howthe dispute resolution process works and how legal protection is forconsumers in resolving disputes between consumers and PT. PLN(Persero) at BPSK Banjarmasin City. This type of research usesempirical law and uses a case study approach. The data obtainedwas collected using interview and documentation techniques. Thecollected data was then processed and analyzed using qualitativedescriptive methods. Based on the results of this research, in theprocess of resolving BPSK case Number: 18/PNBPSK.BJM/VIII/2022, the parties agreed to choose disputeresolution through mediation. According to the author's analysis,the resolution of mediation according to BPSK and according toIslam based on explanations is in harmony in its resolution. bothuse a peace agreement between the parties without forcing orpressuring the parties. According to the author's analysis, theprotection carried out by BPSK has implemented the theory of legalprotection as appropriate for consumers, starting from their rightsin receiving complaints to determining the results of disputeresolution.

Abstract

Postgenderism is an idea that seeks to eliminate gender inhumans with the help of technology. The birth of this idea is ofcourse a concern, especially in the Islamic religion. This articleexamines the position of postgenderism in the Islamic genderperspective and postgenderism in the view of maqasid sharia.Through Islamic Studies research methods, it was concluded thatpostgenderism violates the gender provisions in Islam, wherehumans are created as male and female, and is also different fromthe concept of khuntsa or double sex. Based on a review of maqasidsharia, postgenderism is contrary to the main principles in Islam,namely hifz ad-din (maintaining religion), hifz an-nafs (maintainingself/soul), and hifz an-nasl (maintaining offspring), as well ashifzul mal. This idea of postgenderism erodes faith in the verses ofthe Koran which emphasize gender differences as God's will. Inaddition, gender modification using technology has the potential tocause birth defects in babies, which is contrary to the principle ofmaintaining personal health and safety. Postgenderism aims atpersonal pleasure without considering the preservation of humansand offspring, contrary to the aim of preserving offspring andmaintaining the human population on earth.
