Abstract

The image of a standard contract that puts forward the determination of contract terms unilaterally becomes the core of the study of the essence of justice in a standard contract, especially from the perspective of Hindu law. The method used is a type of qualitative research with a statutory and conceptual approach. For data collection techniques using literature studies and documentation with reference to the analysis of the application of Aristotle's theory of justice to the unilateral application of standard contract terms. Based on the results of the analysis, it was found that the standard contract is included in the category of sources of procedural law (Sadacara) in Hinduism which must not conflict with Sruti and Smerti as lex superiorioir. In the context of Smerti, the standard contract is included in the Arthasastra section, especially the Manawa Dharmasastra group, so the provisions in the Manawa Dharmasastra also apply to standard contracts such as the provisions of Article 1338 of the Civil Code which has similar arrangements with Book VIII Sloka 46 Manawa Dharmasastra, while the provisions of Article 1320 of the Civil Code have essence similarity with Book VIII Manawa Dharmasastra Sloka 143 (regarding object/achievement/guarantee), Sloka 163 (regarding legal competence), Sloka 164 (regarding halal causa), and Sloka 165 (regarding agreement). Furthermore, regarding the essence of standard contract justice, it is categorized as equal justice (justitia commutativa) as long as it fulfills the legal certainty aspect, namely it does not conflict with the provisions of public legislation such as the fulfillment of the provisions of Article 1338 and Article 1320 of the Civil Code, as well as Article 18 Paragraph (1, 2,3,4) Law Number 8 of 1999 concerning Consumer Protection.

Abstract

Indonesia, which has entered a phase of development both politically and economically, is currently facing a fairly serious problem, namely the problem of a new model of colonialism. It is not colonization carried out by humans on behalf of the state but carried out by a system that has no owner. This system is known as the capitalist system. The capitalist system has an impact on the behavior of the Indonesian people, especially those related to production goods. This phenomenon is called consumptive behavior, namely the excessive use of production goods or services. In turn, consumptive behavior is transformed into a consumptive lifestyle. In this study, consumptive behavior as a bias of the capitalist system or social pathology is exposed through the eyes of Herbert Marcuse who seriously analyzes modern industrial society. The purpose of writing this article is to reveal a new model of slavery carried out by the capitalist system which has a real impact on the consumptive behavior of Indonesian society. One of the causes is stuttering in determining genuine needs with artificial needs. So that a society that only has a one-dimensional view was born. While the method used is a qualitative method sourced from library data. The purpose of this method is to find a one dimensional man ontological basis which can then be used to reveal the social reality of Indonesian society. So that it can provide solutions to the problems that are being faced. The solution offered by Herbert Marcuse is a new society built by progress-oriented young intellectuals who have a multidimensional view.

Abstract

This article discuss what or who Pancasilaists are in today's context. The focus of attention in the following article is on the question of what is the nature of a Pancasilaist human and how is the existence of a Pancasilaist human being. In the current era of globalization and technological disruption, which is being accelerated by the COVID-19 pandemic, it is important to rethink your identity to Indonesia. Because of course Indonesia is not impermeable to the influence of the dynamics of global developments. The author tries to re-examine who the Pancasila people are and how they exist. The method that the author will use is to use a knife of human concept analysis in the Personalism flow. This paper can offer a new interpretation and perspective on Pancasila and what a Pancasilaist human looks like when viewed from the perspective of Personalism.

Abstract

The younger generation is the next generation of the nation. So, it is not surprising that the nation's expectations for youth are very large. However, the problem is that the younger generation does not have sufficient religious and moral knowledge. In addition, the younger generation must be faced with the digital era which has a greater moral impact. The phenomenon of juvenile delinquency which increases every year is an indication that there is a moral degradation in the nation. Therefore, the government strives to emphasize a character-building-based curriculum. The purpose of this research is to reinforce the foundation of the nation's moral education through the role of religion and philosophy in several aspects; First, the private aspect, namely the family room. Second, the public aspect, namely the education space, is both formal and non-formal. Third, is the social aspect, namely the environment. This research is qualitative research with religion and philosophy as formal objects and character education as material objects. In addition, researchers use methodical elements as research supports; Abstraction analysis as a tool to examine social change and social influence, induction is used to see the phenomena that occur, and heuristics as a method to see the overall supporting factors and inhibiting factors in today's young generation. The result of this research is to reaffirm the foundation of the nation's moral education through the role of religion and philosophy.

Abstract

This writing about the existence of barong and rangda dance performances is based on social life, the people of Tanah Embet Hamlet have a high sense of brotherhood, mutual respect between residents and one another. So there are rarely disputes between residents because between residents there is still a relative relationship. Therefore, research on the performance of Barong and Rangda Dances is considered necessary to know the history, processions, and public perceptions of the performance of Barong and Rangda Dances. From the results of the study, data were obtained that the staging of Barong and Rangda Dances is an ancestral heritage, where before the stage of Barong and Rangda Dance, the hamlet of Tanah Embet was once hit by disease outbreaks and drought stands for. Barong and Rangda Dance staging procession, first, preparation activities for facilities and upakara were carried out, praying together at the Patokan temple, carrying out the staging ceremony, and continued with the performance of Barong and Rangda Dances. After the completion of the storage ceremony at pemaksan temple. The people of Tanah Embet have the same perception of barong and rangda dance performances, but the most important purpose of staging Barong and Rangda dance is to reject bala (disease), beg for welfare, and prosperity.

Abstract

Nyāya is one of the Indian philosophical systems belonging to the Astika group. The Nyāya specializes in the exposition of a reasoning methodology or a method used for validation. The validation method in the nyāya philosophical system is called pramana so that the nyāya is very synonymous with the logical system. This study focuses on using a literature study research approach. The results in this study are that there are four principles that need to be carried out in a reasoning or logic in finding a truth, namely, Pratyaksa Pramāna which means a truth obtained through direct observation. Anumāna Pramāna means the truth that is revealed through a process of inference, then Upamāna Pramāna that is revealing the truth through comparison, and finally Sabda Pramāna that is obtaining a truth through witness. The four methods can be used simultaneously to obtain a valid truth.

Abstract

This article is a scientific paper in the field of philosophy. The material object of this article is the phenomenon of fear of missing out (FoMO) after digital social media hegemony in Indonesia. The formal object is the schizoanalysis perspective from Gilles Deleuze. The analysis using philosophical hermeneutic method, it was found that the phenomenon of fear of missing out (FoMO) has a correlation with the development of contemporary culture that is supported by the increase of digital social media users. This phenomenon is a form of anxiety when comparing oneself with what is owned and experienced by others, which then encourages each individual to consume everything that is considered trending to increase their symbolic appreciation of it. From the perspective of schizoanalysis, this phenomenon is a form of epistemological madness. There is disconnection between reality and the orientation of thought that is presented through various symbolic attributes due to the hegemony of digital social media. This condition is considered by Deleuze as the foundation of representative truth that curbs the emergence of change.

Abstract

This study aims to reveal the ontological urgency of philosophy for the academic community in higher education. This research uses qualitative methods by conducting verstehen (understanding the text as a posttranslational datum from primary and secondary sources both verbatim and in thick description), trouble mapping (mapping problem sitting), interpretation (interpreting explicit and implicit messages). The results of the study found first, the existence of philosophy exists in forma and materia. Forma, in the onto-epistemological sense i.e. there is a thought anchored as a dialectical logos. Materia, namely, philosophy of existences as a system in the lex generalist curriculum in the form of a course that contains the history of thought (historical discourse) in tension with schemes, between the flow of various statements and variants of disputation. Second, there is a mental readiness to be in tension (in the debate room in the form of scientific rebuttals) for the academic community, both between lecturers and students, fellow lecturers, and fellow students. Thus, psycho-social takes the form of emotions, and action needs to be postponed (epoche) in debate. Rationality, thus, precedes psychological impulses.

Abstract

The writing of this study is to explain education and character education from the point of view of critical educational philosophy. Education is a process to achieve competence and self-maturation, and character education is currently essential in overcoming moral degradation. However, its implementation still needs to be strengthened, considering that there are still many phenomena of juvenile delinquency in school-age children. So that studies in the critical paradigm are essential to be carried out to put back the position of education and the implementation of character education in the learning process in educational institutions. This study uses qualitative research with a literature study approach; analysis uses a reduction analysis model, data presentation, and verification. The results of the interpretation can be explained that the study of critical philosophy in education seeks to criticize the essence of education and character education that is understood today. Proper education is not only the process that runs in schools, but education runs within the family, school, and community. Character education is a process of internalization, and integration of values, in order to realize students with character and become a guideline for attitudes and behavior, as well as moral awareness to mitigate moral degradation by students, so it must be strengthened not only in the policy context but must be strengthened in its implementation. This study can increase knowledge about the philosophy of critical education and is helpful to be a reference library for relevant studies.

Abstract

Ethics is a very noble attitude that needs to be studied and applied by all human beings regardless of their religion. This study aims to obtain and examine the role of teachers in instilling the value of Hindu Ethical Philosophy. By using descriptive qualitative research methods. Taking location in class XI SMAN 7 Denpasar. With data collection techniques Observation, Interview and Documentation. At SMAN 7 Denpasar in instilling the value of Hindu Ethical Philosophy by 1) the task of Hinduism teachers as planners, namely before carrying out the learning process the teacher makes lesson plans, 2) the task of Hinduism teachers as implementers, namely the role of Hinduism teachers as educators teachers have an important role in providing encouragement, supervision, The role of Hinduism teachers as educators teachers have an important role in encouraging, supervising, coaching and disciplining children so that students become obedient to school rules and norms of life in family and community life, the role of Hinduism teachers as teachers must keep abreast of technological developments, so that what is conveyed to students is the latest things and not outdated, the role of Hinduism teachers as motivators in instilling religious character in students, Hindu religion teachers teach students to always have confidence and enthusiasm to get good grades and always provide encouragement to always study hard so that they can get good grades on every test held by the teacher, the role of Hindu religion teachers as mentors and trainers is expected, because students will know which one is wrong and which one is right, with guidance it is hoped that children's thinking skills will develop and gradually students will be able to have a good mindset based on their own thinking, The role of Hinduism teachers as facilitators in the form of providing facilities and infrastructure when carrying out Yoga practices to support teaching and learning activities carried out to improve students' skills in the field of self-control, and the role of Hinduism 48teachers as directors must be able to listen to students in solving the problems faced, directing students in making a decision and finding their identity. 3) the task of Hinduism teachers as assessors, namely after providing the material taught, the teacher will evaluate the material that has been taught to determine the extent of students' understanding of the material that has been taught.
