Abstract

Over time, the buying and selling system that continues to develop can sometimes raise problems that are detrimental to consumers and violate legal corridors. One of them is the practice of diverting consumer’s change into goods. The phenomenon of diverting consumer’s change also occurred at the SRC Enco Store, Cilaja Village, Kramatmulya Sub District, Kuningan Regency. SRC Enco Store is one of today's grocery stores that provides a variety of daily needs for the community. In practice, the seller at the SRC Enco Store transfers the consumer's change into an item. This study aims to find out how the practice of transferring change into goods at the SRC Enco Store, Cilaja Village, Kramatmulya Sub District, Kuningan Regency. In addition, this study also aims to analyze how the practice of transferring change into goods at the SRC Enco Store, Cilaja Village, Kramatmulya Sub District, Kuningan Regency, is viewed from Islamic law and Law No. 8 of 1999. The research method used is a qualitative method. This research includes the type of field research. Data collection techniques used are interviews, observation and documentation. The results of this study are first, the practice of transferring change into an item that occurs at the SRC Enco Store in Cilaja Village, Kramatmulya Sub District, Kuningan Regency is carried out by asking for prior approval from the consumer, and explaining the reasons for transferring change into the item. The practice of transferring change for goods is also carried out on the basis of the principle of consensual or there is the mutual approval of the shop or the buyer. Second, the transfer of change into an item that occurred at the SRC Enco Store in Cilaja Village, Kramatmulya Sub District, Kuningan Regency is in accordance with Islamic Law, because both parties are pleased with each other and neither party feels wronged or harmed by the transfer, and does not conflict and does not cause disputes, and the rights of sellers and buyers are fulfilled. Third, the transfer of change into goods at the SRC Enco Store in Cilaja Village, Kramatmulya Sub District, Kuningan Regency has been in accordance with Law No. 8 of 1999 because the shop does not violate consumer rights and there is no element of violation in the transaction.

Abstract

ملخص البحث يهدف هذا البحث إلى بيان حكم البيع للآلات الإلكترونية الذي يمارسه المدرسون في مدرسة بوابة المستقبل بكاسي والعقود المستعملة فيها. بدأ البحث بدراسة صيغ البيع والعقود المستعملة فيها وهي المرابحة والمرابحة للآمر بالشراء والمساومة نقدا أو تقسيطا ومشروعيتها، ثم تناول حكم البيع للآلات الإلكترونية الذي يمارسه المدرسون مع ذكر الاختلاف في حكمه بين المجيزون لها والمانعون عنها وأدلتهم والقول الراجح عند الباحث وسبب الترجيح. ينهج البحث بمنهج الحوار والمقابلة الشخصية لمعرفة صيغ هذا البيع، والمنهج الاستقرائي لجمع المعلومات المراد دراستها، والمنهج التحليلي والوصفي للتحليل والتوصيف هذه الصيغ والحكم لها. وتوصل إلى أن لبيع للآلات الإلكترونية مثل الحاسوب الآلي والهاتف الذكي الذي يمارسه المدرسون ثلاث صيغ، الواحدة منها مشروعة وهي أن يشتري البائع السلعة لنفسه ويستعمله ثم يبيعه للمشتري نقدا أو نسيئة مساومة أو مرابحة بسعر يومه، والثانية والثالثة منها ممنوعة وهي أن يبيع السلعة تقسيطا لمدة سنة مثلا، بسعره مع الزيادة مقابل الأجل، وهذا ما يسمى ببيع التقسيط المعروف في هذا العصر، والأخرى يبيع البائع السلعة للممول نقدا، ثم يبيع الممول للمشتري تقسيطا لمدة سنة بسعره مع زيادة مقابل الأجل، وهو ما يسمى بالمرابحة للآمر بالشراء المعروفة في هذا اليوم. الكلمات المفتاحية: بيع الآلات الإلكترونية، المساومة، المرابحة، المرابحة للآمر بالشراء، المدرسون.

Abstract

Marriages among religious figures, particularly within the circle of kiai (Islamic scholars), represent a significant phenomenon in Indonesian society. This practice aims to preserve the pesantren lineage or family heritage, while also being regarded as an effort to ensure compatibility or equality (kafa’ah) in social and religious contexts. This study explores the underlying social and religious dynamics of the phenomenon and its impact on social structures. Lineage (nasab) becomes a primary consideration in spouse selection among kyai. The objectives of this research are to examine the phenomenon of marriage among the children of kiai in Indonesia and to analyze it from the perspective of Islamic law, specifically through the lens of the four major schools of fikh. This study employs a qualitative method with a library research approach. Data were collected through documentation derived from books and journal articles. The findings of this study are twofold. First, marriages among the children of kiai in Indonesia are indeed a long-standing tradition within the pesantren elite, passed down from generation to generation and often arranged by parents. The purpose of such marriages is to strengthen religious commitment, social networks, and political ties between pesantren or ulama families. Society views marriage among kiai descendants as a form of propriety or kafa’ah. Although many marriages are arranged from an early age, there is no coercion in the process, as consent and willingness remain essential prerequisites for marriage. Second, from the perspective of Islamic law according to the four schools of fikh, scholars differ in their opinions regarding the legal status of kafa’ah. The Hanafi school considers kafa’ah non-obligatory but important; the Maliki school regards it as recommended (sunnah); the Shafi’i school stipulates kafa’ah as a requirement set by the guardian (wali); and the Hanbali school also deems it a requirement. Therefore, marriage among the children of kiai, according to scholars of the four schools, is permissible as it fulfills the concept of kafa’ah and aligns with Islamic principles.

Abstract

Emergency Package is a service from Indosat Ooredoo Hutchison (including Tri) for prepaid users in the form of credit or quota paid during the next top-up, either all at once or in installments. This service is not a subscription. Tri users must first activate to purchase emergency quota through the Bima+ application. This service is subject to an administration fee and the quota is only valid for certain applications such as YouTube and Netflix, unlike regular quota. This study aims to determine the mechanism of emergency quota loan, legal status and relevance to Islamic Law. The author uses a qualitative research method by combining field research through interviews and library research from books and journals. Data collection techniques include literature studies, interviews, and documentation. As for the results of research: 1) The results show two problems in the Tri emergency quota mechanism through the Bima+ application. First, there is an additional fee so that the price of the emergency quota is more expensive than the regular quota. Second, the emergency quota is only valid for certain applications without the user's knowledge, creating ambiguity in the contract; 2) A review of Islamic law on the emergency quota loan mechanism on the Tri provider shows that the contract is closer to bai' bitsamanin muajjal (sale and purchase with deferred payment) than qardh (loan), because the customer receives the benefit first and pays later. The additional fee in this service has the potential to contain elements of riba nasi'ah, namely additional costs due to delayed payment, but is still considered valid because it meets the pillars and conditions of the sale and purchase. However, limiting the use of the quota to only certain applications without detailed explanation creates an element of gharar (ambiguity). Therefore, this mechanism is not fully in accordance with sharia principles because it leads to a fasid sale and purchase, namely a transaction that is valid according to the contract but contains defects in its conditions or pillars according to Islamic law.

Abstract

Marriage annulment, or fasakh, is the termination or dissolution of a marital relationship between husband and wife caused by the non-fulfillment of the pillars and conditions of marriage, or the discovery of certain circumstances after the marriage has taken place which renders the marriage invalid. This study aims to examine the judge’s decision and to analyze the perspective of Islamic law regarding the annulment of marriage due to the wife being pregnant with a child not from her husband (case study of Decision Number 1478/Pdt.G/2022/PA.Kng). The research method employed is a qualitative approach with the type of field research. Data collection techniques used in this study include interviews and documentation. The interview was conducted with the Religious Court Judge of Kuningan who handled the annulment case in Decision Number 1478/Pdt.G/2022/PA.Kng. The findings of this research show, first, that the petition was granted by the judge and the marriage between the petitioner and the respondent was annulled; therefore, the marriage certificate issued by the Office of Religious Affairs no longer holds legal validity, and the judge imposed court costs on the petitioner. Second, the judge’s decision to annul the marriage is in accordance with the provisions of Islamic law, as it was based on considerations of fraud and misunderstanding within the marriage, which are among the factors that justify fasakh or marriage annulment. Moreover, the marriage of a pregnant woman to a man other than the one who impregnated her is not permissible, as only the man responsible for the pregnancy has the right to marry her. This is in line with Article 53 of the Compilation of Islamic Law and the Qur’an, Surah An-Nur verse 3. As a consequence of the annulment decision, the marriage certificate registered at the Office of Religious Affairs is deemed legally invalid, as the marital relationship has been dissolved, thereby restoring both parties to their original status as unmarried.

Abstract

Public transportation plays an important role in supporting the mobility of society, especially in areas where not all residents own private vehicles. One common policy implemented by public transportation providers is the fare differentiation between general passengers and students. This study focuses on P.O Elf Bayem AKDP Kuningan - Cirebon, which applies different fares based on passenger categories. The main issues examined are how this fare differentiation is implemented and how Islamic law views such a practice. The purpose of this research is to understand the implementation of fare differences between general passengers and students, and to analyze this practice based on the principles of Islamic law, particularly the ijarah contract. This study employs a qualitative method with a field research approach. Data collection techniques include interviews with operators, drivers, and service users, supported by relevant documentation. The findings reveal that the practice of fare differentiation at P.O Elf Bayem AKDP Kuningan - Cirebon aligns with the principles of ijarah in Islamic law. Especially ijarah 'ala al-a'maal ijaarah. This practice fulfills three important elements: first, there is transparency of rates in accordance with Al-Ahzab verse 70; second, an agreement based on mutual consent (antaraḍhin) as in An-Nisa verse 29; and third, there is no element of injustice, as emphasized in the Hadith of Abu Dawud, No. 3451. Therefore, this practice can be considered legitimate and in accordance with the values of muamalah in Islamic law.

Abstract

The practice of using a wadi’ah (safekeeping) contract for parking motor vehicles is common in various places, including at Indomaret Fresh Bandorasa Wetan. However, it remains unclear whether the implementation of this wadi’ah contract complies with its pillars (rukun) and conditions as stipulated in Islamic law. This study aims to examine the implementation of the wadi’ah contract in the parking area of Indomaret Fresh Bandorasa Wetan and to assess its conformity with Islamic legal principles. This study used a field research strategy with an emphasis on qualitative data. Observation, interviews, and written records were the means of data collection. The findings reveal that the practice of wadi’ah at the Indomaret Fresh Bandorasa Wetan parking area involves customers entrusting their vehicles to a parking attendant. Initially, there were no attendants, but due to an increase in the number of customers, a parking attendant was later assigned. From an Islamic legal perspective, the wadi’ah contract practice in this setting does not yet fulfill the necessary pillars and conditions. One notable issue is that service users (mudi’) do not receive a parking ticket from the attendant, which is a requirement for clarity and accountability. Additionally, if the item entrusted is one that can be properly safeguarded, any loss of the item obligates compensation.
