Abstract

Family case settlement in the religious court often does not run effectively and efficiently due to some judicial constraints in the level of absolute competence, event law, and material law. This paper seeks to describe some notes related to divorce settlement due to the domestic violence in the religious court. The data was collected through the observation of the trial and the reading of the verdicts on several divorce cases of domestic violence in metro religious court in 2016-2018. The findings suggest that justice for women could only be gained at a formal legal level, while the desired substantive justice has not yet been achieved. The constraints occur in such stages as submission, case handling, and the verdict. The gender perspective of justice case handling and the judges’ courage of the religious court to deliver ultra petitum verdicts are a legal breakthrough in order to realize substantive justice in resolving family conflicts. Abstract

This study was aimed at examining the pattern of community participation in the planning of Islamic education funding, especially in the Taman Pendidikan Al Qur'an (TPQ). This research is important because many Islamic educational institutions had low standard quality and even stopped their activities because of weak education funding, including in the realm of financial planning. Community participation is considered appropriate for strengthening education financing planning as a form of equitable democracy, which means that the community has the right to get quality education and is obliged to provide funds. This research is qualitative descriptive field research with case studies as its approach. Data collection techniques used were observation, interviews, and documentation, while the analysis of this research follows the stages of data reduction, data presentation, and inference. The obtained data shows that the presence of active community participation with cultural religious functional patterns in the planning of Islamic education financing at TPQ in Banyumas Regency, Central Java indicates an increase in awareness and serious attention of the community towards religious education for their children. Therefore, it is time for Islamic education institutions to be able to utilize this momentum as part of efforts to improve the quality of Islamic education through strengthening education funding. Abstract

Western theories tend to view the essence of humans in a way of a blank state (tabula rasa), wherein their development will be affected by environmental factors as the determinant variable. However, there are a few differences in the portrayal of humans if scrutinized from al-Qur’an. With conducting a library study, the present study sought to scrutinize the essence of humans along with the affiliated dimensions according to the Qur’anic perspective. The current study drew a conclusion that humans are composed of physical (with the overall physical power therein), psychological, and spiritual dimensions. Humans were born with their inborn good trait alongside the naturally inherent elements such as soul and the active as well as responsive supports from environments so that the two elements as such will construct humans’ behavior. Even though environments will not entirely construct humans’ behavior as commonly targeted by education, the inborn potencies cannot develop automatically without being simultaneously promoted by good and conducive environments in addition to effective education. The foregoing is due to the responsive trait of humans.

Abstract

This article is a qualitative-descriptive study which employs which concern the existing phenomenon underlying in the translation of Qur'anic verses that are generally interpreted as a means for legitimizing the acts of terrorism by radical Islamists. The integration on the linguistic knowledge of Islamic texts has been studied as a process of incorporating new information into the existing knowledge with an interdisciplinary approach. The importance of language in the multitude of learning and the discipline of science has led to its status as a condition for correct understanding of the Qur'anic messages. This study used Fairclough’s intertextual approach on the potentially abused Qur’anic verses for violence acts in the name of Islam by extremist groups such ISIS. Two patterns of understanding Islamic texts become the spectrum of how the teachings of Islam are fairly understood. Linguistic provides general criticism toward the radicals’ interpretations in understanding the Islamic sources (primarily the Qur’anic verses). Then the study ends up with an argument that the radicalism in many groups in Islam is connected with the reality of Islamic sources which essentially needs to be interpreted in the context of Islamic societies and requires dynamic reading and prospective production on the meanings of a sacred text. Abstract

Youth as religious peacebuilding actors still receive less attention in academic studies and peace praxis. It often makes youth being depicted as victims or as perpetrators of violence in religious conflict. This study specifically seeks to explore the efforts of youth involvement and also to strengthen the capacity of the youth in making religious peacebuilding in Bukittinggi, West Sumatra. By using the action research method, this research found that Bukittinggi is at negative peace, which is still at the level of mere absence of war and saving the seeds of mutual suspicion between interfaith believers. It is undoubtedly because of a lack of interaction and openness between the interfaith believers. As for the strengthening efforts are undertaken through interfaith youth forum, youth for peace workshop, and the initiation of the interfaith youth organization. That various efforts give hope for the future of religious peace in Bukittinggi from negative peace to positive peace. It is because youth offer creative energy and active potential to transform violent conflict and foster active peace. Abstract

Action or morality in principle begins with a deep value in the soul. That deep value becomes a pattern of belief, awareness, and thought. Because that value has become a mindset, taste, and belief, one will easily do positive and negative actions. So, the planting of value becomes a necessity in education. This research will answer how the school's strategy instills religious values, what religious values are instilled, its supporters and inhibitions, and how they result. This type of research is qualitative with a pedagogical approach. Determination of subjects using purposive and Snowball. Data collection with observations, interviews, and documentation. The analysis technique uses Miles and Huberman models. The conclusion is (1) strategies for planting religious values are habituation, teaching the values of goodness, nudity, repentance with istighatsah, and punishment; (2) The religious values instilled are personal and social worship; (3) the less successful factors of planting religious values are less aware learners, teachers have difficulty supervising students, parents are less exemplary, and socio-cultural environments are less supportive. Simultaneously, the success factor is compact managers, adequate facilities and infrastructure, strict school discipline application, passionate teachers, sincere, and professional managers applying the pesantren system.
