Abstract

This research aims to analyze the considerations of the Judge inimposing a prison sentence of 9 (nine) months on the Defendant who, due to their negligence in driving a motor vehicle, caused the death of another person, which has corresponded with the actions of the defendant and the facts presented in the trial. The type of research that the author uses is Normative Juridical research (library research), which is research that studies document analysis using various secondary data such as legislation, court decisions, legal theories, and can include the opinions of scholars. This research shows that (1) The judge in imposing a prison sentence of 9 (nine) months on the defendant did not consider the actions of the defendant sufficiently, so the application of the prison sentence of 9 (nine) months was not appropriate considering the actions of the defendant, which were that the defendant saw the victim from a distance of 50 (fifty) meters, but the defendant did not attempt to stop his vehicle, merely trying to change lanes, and the victim also moved to the same lane, making the accident unavoidable. (2) The judge's decision to impose a prison sentence of 9 (nine) months on the defendant was in accordance with the facts presented during the trial which included the Defendant's Testimony, the Indictment by the Public Prosecutor, and the Demands of the Public Prosecutor.

Abstract

This study examines the application of Article 362 jo Article 64 paragraph (1) of the Criminal Code (KUHP) in the Kupang District Court Decision Number 170/Pid.B/2023 against the defendant Sherly Oktaviana Nggeon, who was proven to have committed the crime of repeatedly stealing gold at her workplace, Toko Mas Sahabat. This study aims to assess the accuracy of the application of criminal law norms to concrete facts revealed at the trial and analyze the judge's considerations both from juridical and non-juridical aspects in imposing a verdict. The method used is a normative juridical approach with secondary data sources obtained through literature studies of laws and regulations, doctrines, and court decisions. The results of the study show that although the panel of judges has formally applied Article 362 jo Article 64 paragraph (1) of the Criminal Code by qualifying the defendant's actions as a continuing act (voortgezette handeling), this approach is not entirely appropriate substantively. The act of theft was carried out in different periods, against different objects, and accompanied by the forgery of a memorandum of sale of elements that can legally be qualified as a separate criminal offense based on Article 263 of the Criminal Code. However, in the judge's decision, this act of forgery was not explicitly considered either as an additional charge or as a burden of punishment. This raises the issue of justice, considering that the merging of all acts into one criminal act reduces the weight of criminal responsibility that the defendant should receive, and does not fully reflect the overall dimension of the crime committed. From a non-juridical aspect, the judge considered the defendant's background, good faith to return the damages, and the social and economic conditions of the defendant in imposing a two-year prison sentence. However, this consideration is considered disproportionate when compared to the amount of loss, the consistency of the evil act, and the existence of counterfeiting which contributes to aggravating the character of the crime. Abstract

The authority and role of security guards assist the Police in carrying out security duties in a limited manner. The results of the study show that security guards in carrying out security responsibilities as a partner of the Police in dealing with and limited public order in the city of Kupang such as arresting the perpetrators of iron theft at PT Semen Kupang, Helmet Theft at the Kupang Polytechnic Campus, computer theft at the UKAW Kupang Campus and Oesapa Procurement Office Motorcycle Theft. Obstacles in carrying out duties and authorities as security guards include the authority of security guards which are limited by the law and inadequate facilities and infrastructure. Conclusion on the research Based on the provisions of Law number 2 of 2002 concerning the National Police of the Republic of Indonesia, it gives limited authority 'to security guard members to carry out security in the company environment acting Pre-emptive (fostering, directing), preventive (preventing, counteracting) and as limited law enforcement officers to assist the role of the functions of the National Police in a Repressive, Non-Judicial manner (acting, arresting, handcuffing, conducting initial interrogation) and in carrying out their duties and responsibilities the security guard experiences several obstacles such as the authority of the security guard which is limited by the law when he is in a position to face the perpetrator of the crime of theft who holds a weapon while the security guard officer is not armed because his authority is not like a member of the Police, but if the security guard officer resists it will be suspected that he has committed an unlawful act because of his limited authority and the law and the Facilities and Inadequate infrastructure.

Abstract

This study discusses the development of bullying prevention policy instruments as an effort to create Child-Friendly Schools in Surabaya City. This study uses a descriptive qualitative method with data collection through observation, interviews, and documentation. Informants in the study from the head of the Middle School student work team of the Surabaya City Education Office, the Head of the Women and Children Protection Division of the Women's Empowerment and Child Protection Office and Population Control and Family Planning of Surabaya City, the violence prevention and response team at SMPN 61 Surabaya, the violence prevention and response team at SMP Islam Shafta Surabaya, the violence prevention and response team at SMP Wijaya Putra Surabaya. Analysis of the development of bullying prevention policy instruments as an effort to create Child-Friendly Schools in Surabaya City uses the Howlett and Ramesh theory with 3 instruments, namely: (1) mandatory instruments (2) voluntary instruments and (3) mixed instruments. According to the Regulation of the Minister of State for Women's Empowerment and Child Protection of the Republic of Indonesia Number 8 of 2014 concerning Child-Friendly School Policies at SMPN 61 Surabaya, SMP Islam Shafta, and SMP Wijaya Putra, 6 indicators have been implemented in creating Child-Friendly Schools. But there is still something lacking. And of the 3 schools, the most complete in implementing Child-Friendly Schools is SMPN 61 Surabaya. So other schools also need to follow the example of SMPN 61 Surabaya.

Abstract

Sustainable development in coastal areas requires collaborative governance involving multiple stakeholders, including government, private sector, and communities. Makassar, as a major coastal city in Eastern Indonesia, faces significant challenges in implementing sustainable development programs in its coastal areas.This study examines the influence of collaborative governance on the success of sustainable development programs in Makassar's coastal areas, with a focus on accountability mechanisms and stakeholder engagement processes.This research employs a mixed-method approach, combining quantitative analysis using Structural Equation Modeling (SEM) and qualitative analysis through in-depth interviews with 150 respondents from government agencies, private sector, NGOs, and local communities. Data were collected from January to October 2024 in four coastal sub-districts of Makassar.The study reveals that collaborative governance significantly influences the success of sustainable development programs (β = 0.687, p < 0.001). Key mediating factors include transparency in resource allocation (β = 0.445, p < 0.01), community participation in decision-making (β = 0.523, p < 0.001), and integrated monitoring systems (β = 0.398, p < 0.05). Effective collaborative governance enhances sustainable development program outcomes through improved accountability, resource efficiency, and stakeholder satisfaction. The findings suggest that formal collaboration frameworks and transparent financial reporting mechanisms are critical success factors.

Abstract

Extension workers have been instrumental in encouraging farmers to adopt new technologies, aiming to improve productivity, income, social status, and climate resilience. This study investigates challenges in technology adoption and its impact on vegetable production, economic and social enhancement, and climate resilience in Svay Rieng province. Data from 302 agricultural cooperative members were analyzed using Pearson’s correlation to examine relationships and linear regression to predict factors influencing farmers' achievements. Results show that internal challenges (labor, capital, technical know-how) significantly influence success, followed by external challenges. Investments in hard technologies (e.g., net houses, drip irrigation) strongly correlated with achievements, while soft technologies (technical knowledge) had a lesser impact. Regression analysis identified internal challenges and adoption of hard technologies as key predictors, explaining 25% of overall performance, including 36%, 29%, and 25% of economic, social, and climate resilience improvements, respectively. For production, only internal challenges and hard technologies were determinants, predicting 30%. Addressing internal challenges and enhancing technology applications are critical to improving vegetable producers' success in the province.

Abstract

The issue of limited employment access for persons with disabilities is a strategic concern that demands serious attention, particularly in Medan City. Unit Layanan Disabilitas (ULD) under the Department of Manpower of Medan City was established as a government initiative to support persons with disabilities in obtaining equal employment rights. ULD has demonstrated positive initiatives through skills training, coordination with companies, and the placement of workers with disabilities. However, its effectiveness in realizing inclusive employment still faces various internal challenges, such as limited personnel capacity and suboptimal work structure. The research method used in this study is qualitative with a case study approach. Data were collected through interviews, observations, and documentation studies. The data was analyzed qualitatively usingInstitutional Capacity Development indicators proposed by Merilee S. Grindle (1997), which include three dimensions: Human Resource Development, Organizational Strengthening, and Institutional Reform. The results of this study indicate thatthat in the dimension of human resource development, some ULD members have not received adequate training, there are no specialized assistants, and the recruitment process is not yet based on specific competencies. In terms of organizational strengthening, unclear division of tasks, weak internal communication systems, and suboptimal leadership in directing cross-sectoral teamwork were identified. Meanwhile, in the institutional reform dimension, there is still a lack of concrete policy support from the local government. Nevertheless, ULD has successfully facilitated the employment of 42 persons with disabilities in companies that provide inclusive job opportunities to fulfill the 1% employment quota for persons with disabilities

Abstract

This study aims to analyze the implementation of digital fiscal surveillance through the use of tapping boxes in optimizing restaurant tax collection in Ogan Komering Ilir Regency. The research employs a descriptive qualitative approach with data collected through in-depth interviews, observations, and documentation studies. Data were analyzed using the reduction, presentation, and conclusion drawing model proposed by Miles, Huberman, & Saldaña. The findings reveal that the implementation of tapping boxes enhances transparency and accountability in restaurant tax collection by providing real-time transaction data. The devices strengthen taxpayer compliance, particularly in terms of instrumental compliance, as the risk of detection for non-compliance increases significantly. Nevertheless, several challenges remain, including resistance from some restaurant owners, limited internet infrastructure, and the need for regular device maintenance. Overall, tapping boxes hold significant potential for optimizing restaurant tax revenues at the regional level, provided that local governments improve socialization, technical support, and digital infrastructure readiness.

Abstract

School social workers have a strategic role in supporting the welfare of students in Indonesia, especially in dealing with various social, emotional, and psychological issues that can affect academic performance. As a liaison between students, families, schools, and the community, school social workers play a role in providing interventions that aim to create an inclusive, safe, and supportive learning environment. However, the implementation of this role still faces various challenges, such as the limited number of professionals, the lack of support for facilities in schools, and social stigma against the social worker profession. This condition hinders the optimization of student welfare services as a whole. This article aims to explore the role of school social workers in the context of Indonesian education, identify the challenges faced, and examine opportunities for role strengthening through holistic intervention approaches and policy support. The results of the study show that increasing the effectiveness of school social workers can be achieved through the integration of student welfare programs into the curriculum, ongoing training for social workers, and synergy between the government, schools, and local communities. Strong policy support and adequate resource allocation are decisive factors in strengthening the function of school social workers. With the right approach, school social workers have the potential to be agents of change in creating an education system that is more responsive to students' social and emotional needs, as well as encouraging the creation of a healthy and sustainable learning climate.

Abstract

This study examines the effectiveness of integrated marketing communication in the development of community-based ecotourism at Bukit Tungkuwiri, Papua, with the aim of linking channel strategies and governance structures to socioeconomic impacts. A qualitative descriptive method was applied using purposive sampling involving visitors, managers, and local leaders. Data were collected through observation, semi-structured interviews, and documentation, and analyzed through reduction, presentation, and conclusion drawing using source and method triangulation. The results indicate that the orchestration of local government social media and printed materials expanded outreach and enhanced engagement, while community oral communication strengthened trust, identity, and educational experience. The appeal of the landscape, culinary and guide training, and local participation stimulated the economic turnover of stalls and small businesses, with tourist reach extending across provinces. The main constraints include dual authority systems, limited funding and human resources, and the absence of ticketing regulations and service SOPs. The discussion highlights the importance of cross-channel message consistency, brand architecture, and a monitoring–evaluation system linking digital metrics with on-site feedback. The study concludes that strengthening governance and local capacity is key to balancing promotion, conservation, and economic empowerment. The findings offer an operational model that can be replicated in similar rural destinations. Implications include establishing transparent ticket pricing, seasonal content calendars, curated experience packages, and cross-level collaboration among provincial, district, community, and business actors to ensure long-term sustainability.
