Abstract

This research examines the implementation of the curator’s role in the bankruptcy process following the Postponement of Debt Payment Obligations (PKPU) based on Law Number 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations. The main objective of this study is to analyze the role, authority, and challenges faced by curators in carrying out their duties in accordance with Indonesia’s positive legal framework. This research employs a normative juridical approach combined with an empirical juridical approach, incorporating a review of legal literature, court rulings, and statutory regulations, as well as interviews with curators and supervising judges in commercial courts. The findings reveal that curators play a central role as administrators and liquidators of bankrupt estates, with the authority to inventory, secure, manage, and liquidate the debtor’s assets to protect creditors’ interests. Pursuant to Law Number 37 of 2004, curators are also responsible for overseeing the bankruptcy process, preparing reports, and ensuring that the distribution of liquidation proceeds is conducted transparently and equitably. However, the implementation of this role often faces obstacles such as limited curator competence and resources, external interference, the complexity of bankruptcy laws, and inadequate judicial supervision. This study emphasizes the importance of legal reform, professional capacity building, and the adoption of digital technology to enhance the effectiveness of Indonesia’s bankruptcy system. A professional, accountable, and integrity-driven curator is essential to achieving the fundamental objectives of bankruptcy law—ensuring fair, efficient, and transparent debt settlement for all parties involved.

Abstract

A land certificate serves as the strongest form of ownership evidence; however, conflicts over physical possession frequently occur, leading to legal uncertainty. This study examines the legal protection afforded to legitimate owners of land certificates whose land is unlawfully possessed by third parties. The 1945 Constitution of the Republic of Indonesia guarantees and protects the rights of Indonesian citizens, including their rights to acquire, own, and enjoy land ownership. The research employs a normative juridical method by analyzing relevant laws and regulations, such as the Basic Agrarian Law Number 5 of 1960 and Government Regulation Number 24 of 1997 concerning Land Registration. The data sources used in this study consist of both primary and secondary materials. The main issues addressed include the form of legal protection available to land certificate holders whose land is unlawfully controlled by third parties, and the legal remedies that may be pursued by the rightful owners to reclaim their rights. The findings indicate that legal protection for land certificate holders can be implemented through both preventive and repressive measures. Preventive protection is achieved through a land registration system that ensures legal certainty, while repressive protection is pursued through dispute resolution mechanisms in court. These mechanisms are expected to safeguard the rights of landowners and ensure the realization of legal certainty in a fair and equitable manner.

Abstract

The pretrial institution serves to regulate the use of coercive measures by authorized organizations during the investigation and prosecution stages. The establishment of this institution is a primary priority aimed at protecting the rights of suspects, particularly in cases involving unlawful arrest or detention, the termination of investigations and prosecutions, and other similar circumstances. However, several weaknesses remain in both the design and implementation of this institution within the judicial system, resulting in insufficient protection of human rights for suspects, despite its regulation under positive law, namely Law Number 8 of 1981. Efforts to safeguard the human rights of suspects during the investigation process constitute the main focus of this study, which examines the legal status of pretrial procedures within Indonesia’s criminal justice system, the challenges in their implementation as a means of protection, the effectiveness of pretrial rulings in this context, and their implications for subsequent investigations.

Abstract

This study is entitled "The Role of the Indonesian Transport Workers Federation (FSPTI) in Defending the Rights of Stevedoring Workers (TKBM) in Padangsidimpuan City". The background of this study is based on the importance of the existence of trade unions as a forum for workers' struggle in protecting and fighting for the normative rights of workers as guaranteed in Law Number 21 of 2000 concerning Workers' Unions/Labor Unions. In practice, many workers still face employment problems due to their weak bargaining position, lack of legal awareness, and low protection from employers. The purpose of this study is to determine and analyze the role of the FSPTI of Padangsidimpuan City in defending the rights of Stevedoring Workers, as well as to assess the effectiveness of the implementation of Law Number 21 of 2000 on the implementation of trade union functions at the regional level. The research method used is empirical juridical, with a qualitative approach that combines primary data through interviews, as well as secondary data through literature reviews of laws and regulations and related legal literature. The research results indicate that the Padangsidimpuan FSPTI plays a strategic role in advancing the interests of TKBM workers through advocacy, legal assistance, and negotiations with employers and local governments. However, the implementation of Law Number 21 of 2000 has not been fully effective due to challenges such as limited resources, low participant participation, and weak enforcement of labor laws. Overall, the FSPTI has made maximum efforts to advocate for the rights of TKBM workers, but further government support and organizational capacity building are needed to further optimize the union's function.

Abstract

The number of housing units with the handover of residential Prasarana, Sarana, dan Utilitas (PSU) by developers in Sidoarjo Regency is inversely proportional. As of 2023, there were 535 housing units, and 25 Surat Keterangan Rencana Kota (SKRK) were issued in 2024, whereas the number of Berita Acara Serah Terima (BAST) for the handover of residential PSU until September 2025 was only 128. However, the handover of residential PSU to the Regional Government is a mandatory obligation for every developer. This research focuses on the implementation of Sidoarjo Regent Regulation Number 53 of 2024 concerning Procedures for the Handover and Utilization of Residential PSU. The purpose of this research is to examine the extent of implementation of this regulation. This study uses a qualitative method with a case study approach. The results show that the implementation of Sidoarjo Regent Regulation Number 53 of 2024 has been running well, with a focus on improving Human Resources and inter-agency communication.

Abstract

This sociolinguistic study examines patterns of regional language interference in formal Indonesian usage across bilingual areas of Indonesia. Through a mixed-methods approach, this research analyzes oral and written data from 240 participants across three strategic bilingual regions: Javanese-Indonesian, Sundanese-Indonesian, and Batak-Indonesian. Data were collected through structured interviews, ethnographic observations, and corpus analysis of formal documents. Quantitative analysis employed linguistic corpus software to identify frequency patterns and interference distribution, while qualitative analysis applied ethnography of communication approaches to understand social contexts and functions of interference in communicative interactions. Findings reveal systematic interference typologies that vary according to linguistic domains. Phonological interference demonstrates the highest resistance to formal register constraints (78% consistency), with Batak-Indonesian speakers showing the highest interference rates (85%), followed by Javanese-Indonesian (74%), and Sundanese-Indonesian (71%). Lexical interference occurs in 65% of samples with significant variation based on communication domains, where Sundanese-Indonesian shows the highest rates (72%). Morphological interference is found in 52% of cases, particularly in affixation and reduplication systems. Syntactic interference shows the highest sensitivity to situational formality, decreasing from 45% in semi-formal communication to 28% in strict formal contexts. Research implications indicate the need for reorienting language policy from corrective approaches toward recognizing interference productivity. Language policies should develop flexible standards that accommodate regional variations and promote positive attitudes toward multilingualism. In educational contexts, integration of contrastive approaches in Indonesian language learning is required, along with development of instructional materials sensitive to students' linguistic backgrounds, and teacher training on managing productive versus corrective interference.This research contributes to Indonesian sociolinguistics through providing comprehensive empirical databases, developing innovative theoretical frameworks, and replicable methodologies for language contact analysis. Findings confirm that regional language interference in formal Indonesian constitutes a productive phenomenon reflecting Indonesia's multilingual vitality. Approaches that recognize productive aspects of interference while optimizing formal communication effectiveness become key to developing language strategies responsive to contemporary multilingual Indonesian realities.

Abstract

Collaborative governance is a decision-making approach that brings together multiple stakeholders to work toward a shared objective. This study aims to describe the collaborative governance process in poverty alleviation through the Tasik Bageur Program in Tasikmalaya City. Poverty in the city is a multidimensional issue that affects social, economic, and environmental aspects of community life. In response, the Tasikmalaya City Government initiated this program as a collaborative effort involving government institutions, private sector actors, and academic organizations. The program is implemented every Wednesday and is designed to foster cooperation and mutual support in addressing poverty-related needs.Although the program has succeeded in attracting participation from several private and academic actors, this study identifies a major challenge: the number of poor residents remains significantly higher than the number of collaborating partners. This imbalance limits the amount and diversity of assistance provided and reduces the program’s overall effectiveness.This research employs a qualitative descriptive approach, with data collected through observations, interviews, and document analysis. The findings indicate that the collaborative process within the Tasik Bageur Program has not yet reached optimal implementation. Limited understanding and low awareness among private-sector actors hinder broader participation. As a result, the gap between community needs and the available collaborative resources remains substantial.

Abstract

Badan Perencanaan Pembangunan Riset dan Inovasi Daerah Probolinggo City utilizes the Regional Asset Information Sistem (SIASAD) to record and report Regional Property (BMD) in real time. However, there is a discrepancy between the percentage of Regional Government Financial Reports (LKPD) that comply with regulations, which is 100%, and the percentage of BMD data validity, which fluctuates between 86.21% in 2021 and 82.14% in 2024, indicating that the system is not optimal and there is inconsistency in BMD data. This study aims to evaluate the implementation of SIASAD in BMD management at BAPPERIDA Probolinggo City, based on the principles of Good Governance. The research method applied is qualitative with a case study approach involving data collection techniques such as interviews, observations, and document studies. The results of the study reveal that SIASAD supports the application of Good Governance through the principles of participation, consensus orientation, accountability, transparency, responsiveness, effectiveness and efficiency, fairness and inclusiveness, and compliance with the law. From this study, it can be concluded that the implementation of SIASAD contributes significantly to transparent and accountable BMD governance in accordance with the principles of Good Governance, although improvements are still needed in terms of public accessibility.

Abstract

This study aims to analyze the involvement of the Nusantara Nature Conservation Foundation (YKAN) in mangrove management in Berau Regency. This study explains how YKAN, as a broker organization in an advocacy network, encourages the local Forlika community to obtain resources from global partnerships. This study uses a qualitative descriptive method. The research data is sourced from primary data through interviews and uses primary data from relevant literature studies related to the research variables. The results of this study show that there is cooperation between each actor in international relations in managing mangrove areas in Berau Regency. YKAN's partnerships with global and local institutions give YKAN a strategic position in transnational advocacy networks. YKAN functions as a liaison that advocates for the needs of coastal communities at the international level, so that YKAN's role is to represent local communities in cross-actor cooperation in Berau Regency.
