Jurnal Hukum dan Peradilan (JHP) is published by the Research Center for Law and Judiciary of the Supreme Court of the Republic of Indonesia. JHP aimed to be a peer-reviewed platform and an authoritative source of information on legal and judiciary studies. The scope of JHP is analytical, objective, empirical, and contributive literature on the dynamics and development of legal studies, specifically in Indonesia. JHP welcomes scientific papers on a range of topics from research studies, judicial decisions, theoretical studies, literature reviews, philosophical and critical consultations that are analytical, objective, and systematic. However, from a wide range of topics that researchers can choose from, JHP puts more attention to the papers focusing on the sociology of law, living law, legal philosophy, history of national law, customary law, literature studies, international law, interdisciplinary, and empirical studies. Jurnal Hukum dan Peradilan (JHP) is a media dedicated to judicial personnel, academician, practitioners, and law expertise in actualizing the idea of research, development, and analysis of law and judiciary. Jurnal Hukum dan Peradilan comes out three times a year in March, July, and November.

Abstract

By the promulgation of Law Number 23 of 2014 concerning Regional Government, there has been a shift in the institutional design of the Regional House of Representatives (DPRD in Bahasa Indonesia), especially in the aspects of the legislative function and its authority. There is an affirmation of the understanding of the DPRD as an element of regional government administration. In this context, the House of Representatives (DPR in Bahasa Indonesia) and the President deliberately combine the two types of power functions, the legislative and the executive, into one institution called the DPRD in the local government system in Indonesia. Shifting of institutional design above indicates that Regional Government Law is principally no longer categorizes the DPRD as a legislative agency but instead as an executive institution playing a role in supervising the implementation of Regional Government. Based on this Regulation, the theoretical interpretation of DPRD’s existence is interpreted as an executive institution running the legislative function.

Abstract

Legal decision-making is heavily influenced by cognitive processes like memory and judgment, which are vulnerable to biases such as false autobiographical memories, hindsight bias, and pretrial publicity. These flaws can lead to wrongful convictions, biased negligence assessments, and compromised impartiality, undermining legal fairness. This study examines these cognitive vulnerabilities, analyzing their mechanisms and proposing strategies to reduce their impact. A literature review of empirical research from 2018 to 2023 integrates findings from psychology, neuroscience, and law. The study highlights how these biases affect legal outcomes and suggests practical solutions like simplified judge instructions, structured interrogation protocols, and bias awareness training. The research uses Cognitive Load Theory, aiming to enhance the integrity of legal processes and provide evidence-based recommendations to improve the fairness and accuracy of legal decisions.

Abstract

Law is a set of words that are systematically linking an authoritative text, according to Gustav Radbruch, it should contain three (3) elements, namely fairness, certainty and expediency. The application of the authoritative text in social life was an absolute authority of a judge in resolving a civil case. The judge, in the checking-hearing-deciding a case, not only expected to return the case to the original state (restitutio in integrum) before the advent of the dispute, but should attempt made every effort to not create new disputes or disputes derived from the subject matter examined. Therefore, it becomes very important role of the paradigm for a judge in deciding the case in order to fulfill a sense of justice. Therefore, deciding the case in a precise sense of justice will be a judge most important role. Nowadays, the meaning of "justice" in Civil Procedure Code only limited to the authority of the power of the parties bound by the principle of consensualism and the principle of freedom of contract. Therefore, based on the Law Paradigm (Philosophy) of Pancasila, Judge as an interpreter, in defining and applying the law, legal science must have the ability to deconstruct and reconstruct an authoritative text based paradigm embraced by a nation.Keywords: the principle of consensualism, justice, pancasila, paradigm, civil procedural law

Abstract

In international trade activity, the law exists and becomes one of the important components to ensure the trading activity runs effectively, efficiently, and fair. Gradually, international trade system has started to embed environmental law issue to become its part of the system, and this process has begun since people realized that environment should be protected in order to support the sustainable development process. Currently, environmental law issue becomes an important condition for most of the international trade relations which are being done or will be done by subjects of the international trade. This paper focuses on how environmental law is being synergized within international trade system. Abstract

There were appeal legal effort, cassation and judicial review on Administrative Court. After the Supreme Court Act article 45A paragraph (2) letter c was applied, it was determined that not all administrative settlement dispute can be filled to cassation legal effort. The setting restriction poses legal problems to justice seekers. This article aims to study the solution of cassation rights setting restrictions so that it can be mutual for administrative justice seekers. Based on the analysis that has been done it can be concluded that the regulation on Supreme Court Act article 45A paragraph (2) letter c Act number 5 2014 was not clear in procedures and substantive. Abstract

Act No. 30 Year 2014 on Government Administration (UU AP) instead of administrative law. The concept of public administration (AP) in Article 1.1 is governance in the decision and / or action by the official agency and / or government. When compared with the Dutch Algemene wet Bestuursrecht (AWB), it seems obvious differences. AWB moved from the concept of administrative law (bestuursrecht) while the AP is the starting point of government  dministration. That in AP there are aspects of administrative  law, but the concept of administrative law is confusing. On the basis, the common explanations of AP stating AP Act is a substantive law of the State Administrative Court system becomes a big question mark. AP Act provisions concerning Administrative Court is not based on a clear conceptual approach. On the basis, AP Act concerning Administrative Court is very difficult to apply in judicial practice as well as vague concepts is also contrary to the concepts of administrative law. Abstract

Under art 24A(1) of the Constitution, the Supreme Court is granted the power to review legal instruments below laws (undang-undang). This means that an applicant could seek judicial review of regulations other than Acts of Parliament (Undang-Undang) with a request to strike it out because, for example, it contravenes national laws. This would provide the courts with an opportunity to review the legitimacy of the regulation and determine whether it is ultra vires, or beyond power. The Supreme Court has the power to cancel a regulation if it is found to be in conflict with a higher law. This article analyses the judicial review in the Supreme Court. It begins by highlighting the origins and formation of judicial review before the regulation promulgation of the Supreme Court (PERMA) No. 1/1993, and then examines several aspects of procedural law in the current Supreme Court Regulation in No. 1/2011. Abstract

Doctrinal research asks what the law is on a particular issue. It is concerned with analysis of the legal doctr ine a nd how i t ha s been developed a nd a ppl ied. This type of r esea r ch is a lso known a s pur e theoretical research. It consists of either a simple research directed at finding a specific statement of the law or a more complex and in depth analysis of legal reasoning. Non-doctrinal research, also known as socio-legal research is a legal research that employs methods ta ken fr om other discipl ines to gener a te empir ica l da ta to a nswer r esea r ch quest ions. It ca n be a problem, policy or law reform based. Nondoctrinal legal research can be qualitative or quantitative. Doctrinal and nondoctrinal research could be part of a large scale project. Non-doctrinal approach allows the researcher to perform inter disciplinary research where he analyses law from the perspective of other sciences and employs these sciences in the formulation of the law. Abstract

Kewenangan Peradilan Agama banyak bersentuhan langsung dengan kepentingan perempuan dan anak, terutama dalam perkara perceraian dan pengasuhan anak. Peradilan Agama berwenang mengadili sengketa di bidang hukum keluarga dan hukum ekonomi Syariah. Perkara-perkara yang termasuk dalam hukum keluarga seperti perceraian, gugatan nafkah, hak asuh anak, nafkah anak, dan perkara-perkara yang merupakan akibat perceraian, banyak bersentuhan dengan hak-hak perempuan dan anak. Dalam penegakan hukum terkait hak-hak perempuan dan anak, Mahkamah Agung telah mengesahkan Peraturan Mahkamah Agung Nomor 3 Tahun 2017 yang menekankan lembaga peradilan lebih memerhatikan aspek perlindungan hak-hak perempuan dan anak dalam memutus perkara. Penelitian ini merupakan penelitian normatif, dengan menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach).  Hasil penelitian menunjukkan bahwa Peradilan Agama, dalam hal ini telah mengambil peran dalam melindungi hak perempuan dan anak melalui beberapa regulasi dan putusan perkara. Peradilan Agama berupaya memaksimalkan pelaksanaan putusan dengan mengimplementasikan kaidah-kaidah hukum yang responsif sebagaimana dikehendaki dalam Peraturan Mahkamah Agung Nomor 3 Tahun 2017 sehingga putusan tersebut dapat dieksekusi dengan baik. Selain itu, perlu adanya sinergitas lintas instansi agar upaya melindungi hak-hak kaum perempuan dan anak dapat terwujud secara lebih signifikan.The authority of Indonesia’s Religious Court has direct relation to women and children interest, especially in divorce and childcare cases. Religious court has the authority in adjudicating cases of family law and Islamic economy law. Divorce, livelihood, child custody, child allowances, and cases related to the direct consequences of divorce have significant matter to the women and children rights. In case of enforcing law that concern to the protection of women and children rights, Indonesia Supreme Court has enacted Peraturan Mahkamah Agung Nomor 3 Tahun 2017 that insist judicial institution to emphasize the protection of those rights in adjudication processes. The Religious Courts have taken a role in protecting the rights of women and children through several regulations and case decisions. This research is a normative study, using a statute approach and a conceptual approach. The results of the study indicate that the Religious Courts has a shot to implement comprehensively legal norms in Perma Nomor 3 Tahun 2017 as of the court decision more executable. Moreover, it is an urgent demand to hold an inter-institutions cooperation to raise the effectiveness of securing women and children rights.

Abstract

Contempt of ruler or public body are criminal offence which stipulated in article 207 and 208 Penal Code of Indonesia. In practice, there is legal uncertainty because substantially contradict to Constitutional Court Decision No.013-022/PUU-IV/2006 about contempt of President/ Vice President and No. 6/PUU-V/2007 about contempt of Indonesia Government. This paper wants to found criminal legal policy and constitutionality on contempt of ruler or public body. The research method used is juridical normative with regulation, doctrinal, and decision approaches. The result of study shows changes of criminal law policy on contempt of ruler or public body based on comparison of current Penal Code and future Penal Code Draft with changes elements of formulation: (1) suspect; (2) intention; (3) victim; (4) sanction; (5) impact of action, the norms also transform from general offence to complaint offense. Next, analysis to Constitutional Court decisions about contempt of President/Vice President and Indonesia Government which declared null and void, found related legal reasoning: First, violate freedom of expression; Second, violate right to get information; Third, causing legal uncertainty; Fourth, no longer suitable with society development; Fifth, changes in norms on Criminal Code Draft; Sixth; follow previous decision; Seventh, against universal value in international law. Then, the constitutional interpretation methods used in the decisions are: (1) Ethical Interpretation; (2) Historical Interpretation; (3) Futuristic Interpretation; (4) Doctrinal Interpretation. Therefore, according on similar legal reasoning and constitutional interpretation, article 207 and 208 Penal Code also supposed to be stated unconstitutional.
