Jurnal Hukum dan Peradilan (JHP) is published by the Research Center for Law and Judiciary of the Supreme Court of the Republic of Indonesia. JHP aimed to be a peer-reviewed platform and an authoritative source of information on legal and judiciary studies. The scope of JHP is analytical, objective, empirical, and contributive literature on the dynamics and development of legal studies, specifically in Indonesia. JHP welcomes scientific papers on a range of topics from research studies, judicial decisions, theoretical studies, literature reviews, philosophical and critical consultations that are analytical, objective, and systematic. However, from a wide range of topics that researchers can choose from, JHP puts more attention to the papers focusing on the sociology of law, living law, legal philosophy, history of national law, customary law, literature studies, international law, interdisciplinary, and empirical studies. Abstract

This study aims to trace the contradictions of sentencing arrangements in child sexual abuse crimes in Aceh after the enactment of Qanun No. 6 of 2014 with Law No. 35 of 2014 on Child Protection. The regulation of child sexual abuse punishment in jinayat law in Aceh has different interpretations from other laws and regulations, including Law No. 35 of 2014 on Child Protection. So the essence of the deterrent effect for perpetrators that should be part of the goal of criminalization is not so achieved. In addition, Qanun Jinayat also has the potential for impunity for the government with Article 9 and Article 11 Qanun No. 6 of 2014 on the reasons for justification and forgiving reasons. The method used in this paper is a normative juridical method, using secondary data or library data. The study results showed that in Aceh, there had been a dualism of the legal regulation of child sexual abuse. The provisions of qanun jinayat are still many shortcomings in providing protection and rights for children as victims, so law enforcement tends to choose positive laws. It is recommended that the Aceh government to harmonize the law between jinayat law provisions and positive laws relating to sexual harassment.

Abstract

Indonesia is a unitary state on which national law applies in all the provinces. The national law applied throughout Indonesia regulates civil, criminal, commercial, and other aspects of Indonesian society. However, an exception to the national law application exists in the Province of Nanggroe Aceh Darussalam, especially in the type of sanctions applicable towards the convicts who have committed or violated criminal law in Nanggroe Aceh Darussalam. Nanggroe Aceh Darussalam implements a different criminal law from the national criminal law applicable to other regions in Indonesia. This is due to the issuance of Law No. 11 of 2006 on Aceh Government, which gave the Aceh Province special authority to adopt and practice Islamic law to its people. One form of punishment applied in Nanggroe Aceh Darussalam is the practice of flogging carried out in public (public flogging). This form of sanction has attracted the attention of the UN Special Rapporteur who recommended that the sentence be abolished, due to its practice which is contrary to international conventions that have been ratified by Indonesia. This article will discuss the legalization of public flogging practice in Indonesia following the international conventions on which Indonesia is its member.

Abstract

Revolusi Industri 4.0 telah memberikan pengaruh terhadap pemutusan hubungan kerja dengan alasan efisiensi. Alasan efisiensi Pasal 164 ayat (3) Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan menimbulkan polemik yang berdampak kepada besarnya jumlah pengangguran. Penelitian dilakukan secara normatif yang bertujuan untuk menelaah undang-undang ketenagakerjaan yang belum mampu melindungi hak berkerja di era revolusi industri 4.0. Efisiensi di revolusi industri 4.0 akan mengancam kehidupan pekerja dimasa yang akan datang, dengan tergantikannya tenaga manusia dengan tenaga robot. Hak berkerja yang telah diamanatkan oleh UUD 1945 di dalam Pasal 28A- 28J terancam hilang dengan berkembangnya zaman. Kewajiban konstitusi dari pemerintah untuk menyediakan lapangan pekerjaan bagi pekerja di era revolusi industri 4.0, karena berkerja merupakan hak asasi manusia untuk mempertahankan kehidupannya.

Abstract

The Supreme Court in carrying out the function of judicial power is carried out independently so that it is not possible for intervention from other parties that can affect its function. However, the independence of the Supreme Court has not been fully strung together in accordance with the concept of independence in the exercise of judicial power. This can be seen in the Supreme Court's budget, the amount of which is still determined by the government. This condition will certainly affect its independence, because the budget is a support for the Supreme Court in carrying out the functions of judicial power. In this discussion, the method used is normative juridical. The benefit of this research is that it can become a reference for the Supreme Court to form an independent budget pattern so that it can carry out its functions independently. The conclusion of this study is that the Supreme Court has not been able to carry out its functions independently as outlined in Article 24 paragraph (1) of the 1945 Constitution, so it is necessary to change regulations by aligning the rules so that the Supreme Court can prepare its budget independently.

Abstract

Senyatanya pengaturan tindak pidana kesusilaan yang fokusnya terkait homoseksual (gay dan lesbian) belum sepenuhnya diakomodir dalam KUHP, manakala pelaku dan korbannya adalah orang dewasa. Di kalangan penegak hukum militerpun timbul perdebatan adanya anggapan kekosongan hukum, tatkala oknumnya adalah sesama Prajurit TNI.  Oleh karenanya, menarik untuk dianalisis dasar pertimbangan hakim militer dalam penjatuhan pidana perkara kesusilaan yang terkait homoseksual. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan pendekatan yuridis normatif yang selanjutnya dianalisis secara yuridis kualitatif. Hasil penelitian menyimpulkan berdasarkan putusan tindak pidana kesusilaan yang terkait homoseksual (lesbian dan gay), setalah dilakukan dianalisis telah merujuk pada SEMA sebagai supervisi bagi hakim dalam memutus perkara, dimana selain dibuktikan terbuka melanggar susila juga dikategorikan melanggar perintah dinas.

Abstract

The West Java Child Special Penitentiary (LPKA) noted that in 2020 there were 241 juvenile detainees and 429 juvenile prisoners. Criminal behaviour in children is related to low social control such as attachment, responsibility, involvement, and the belief that the higher the social control, the lower the possibility of a child violating the law. The main issue in the settlement of juvenile criminal cases is the criminal justice system that does not take sides with children because the handling in this system has not implemented a restorative justice policy. Children who commit crimes ideally need to be returned to their original condition, not just punished for their actions. In fact, data on juvenile detainees and juvenile prisoners show an indication of suboptimal restorative justice policies. The purpose of this study was to determine the role of social control over children as perpetrators of criminal acts and to determine the policy of restorative justice in the process of resolving cases. This research is a descriptive study, using qualitative data analysis techniques with normative and empirical juridical approaches. The research subjects were 22 juvenile prisoners and detainees in one of the Penitentiaries of the West Java region. The results of the study indicate that social control plays a role in children as perpetrators of criminal acts, as well as the settlement of child criminal cases based on restorative justice policies, is not optimal. There are many diversion failures and a fairly high percentage of prison sentences that should be a last resort. There is also a large public stigma against the statement that children who violate the law should be imprisoned. On the other hand, trauma due to the examination process, prison life, and stereotypes as ex-convicts will greatly affect the psychological function of children. This can lead to low self-confidence, feeling worthless, and becoming the cause of recidivists because they feel unforgivable even though they have served their sentence.

Abstract

As an intermediary institution that functions to mobilise public funds, the bank has the potential to experience failure or fraud, which can cause ad decline in the bank's soundness (through CAMEL; Capital, Assets, Management, Earnings, and Liquidity). The Deposit Insurance Corporation was formed to guarantee limited deposit funds (limited guarantee) as a substitute for a blanket guarantee. LPS also has an active role in maintaining the stability of the banking system by its authority where after the OJK declares a failed bank, the banks are handed over to LPS, for non-systemic failed banks, a settlement is carried out by a rescue (at the expense of the shareholders) and not perform a rescue (liquidate the failed bank). If the bank failed to have a systemic impact, the IDIC (LPS) would take care of the Systemic Failed Bank, placing a temporary capital placement (PMS) to make it sound and resale it within 3 years. The issue is: How does failing bank restructuring meets the principle of benefit by the Indonesia Deposit Insurance Corporation? The type of this research is juridical-normative research and legal materials traceability technique using qualitative analytical. This research approach uses the statute approach, conceptual approach, and historical approach. The conclusion of this paper is Resolution Bank or restructuring of the failed bank by LPS that meets the beneficiary principle must carry out the following the four (4) categories of Commercial Banks based on Business Activities (BUKU), where for categories 3 and 4, a long period of restructuring is required because the bank has many derivative products.

Abstract

In relation to fulfilling their daily needs, the position and existence of consumers in a dominant society are under businessmen. This has caused the potential loss of customers due to the actions of businessmen. It is not unusual for businessmen to exploit consumers for their interests and advantages without thinking and often neglecting the rights of consumers. This has given rise to disputes between consumers and businessmen that need to be resolved thoroughly and fairly, with legal certainty. The Act No. 8 of 1999 concerning consumer protection has regulated the resolution of consumer disputes which can be carried out outside the court through the Consumer Dispute Settlement Agency (BPSK). The existence of BPSK as a consumer dispute resolution institution does not seem to provide maximum protection to consumers because there are many problems, including the process and procedures for resolving disputes at BPSK. Based on the results of the research and analysis carried out, it is concluded that the resolution of consumer disputes through BPSK in terms of time is relatively faster because it has to be decided within a maximum of 21 working days compared to resolving consumer disputes through general courts which take years. But on the other hand, many problems exist related to the existence of BPSK as a consumer dispute resolution institution, including in the institutional sector, BPSK human resources, inconsistent laws, and so on.

Abstract

The growth of technology has increased the buying and selling of commodities virtually. However, the lack of physical stores makes it impossible for potential buyers to evaluate the quality of their commodities or facilities. This in turn encourages the emergence of virtual shopping scams by perpetrators. This paper mainly tries to evaluate the extent of online shopping fraud in Online Store Fraud Crimes in Indonesia by using a normative juridical approach, which uses secondary data. Fraud in cybercrime requires the victim to develop a statement of the actuality of the crime to police officers. The report must be accompanied by primary evidence in electrical information or methods of publication of electronic information and data. From there, to verify the actuality of a particular type of fraud, an investigation is carried out. The procedural law related to the ITE Law in Indonesia is regulated in article 42 which states that investigations into cybercrimes are carried out against the criminal procedure provisions in the ITE Law. Finally the essay finds that the Criminal Code of virtual fraud is regulated on Electronic Data and Transactions in Law number 19 of 2016.

Abstract

The Law Number 11 of 2020 concerning Job Creation amended 79 laws, including Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. Far from being comprehensive, the Job Creation Law amended the system of law enforcement regarding business competition that had been in place for over twenty years. With a normative method, this research aims to discuss the legal implications of the effectuation of the Job Creation Law regarding the enforcement of the law concerning business competition. This research reveals that Law 11/2020 could lead to a better legal certainty and adequacy of law enforcement concerning business competition in Indonesia in the time to come.
