Abstract

This study raises the issue of the causes of the reluctance wife filed a divorce against her husband who violate sighat taklik divorce and understanding with their wives taklik divorce in marriage as well as the legal implications of the breach taklik divorce for a marriage. The purpose of this study was to determine the factors causing reluctance wife filed a divorce against her husband who violate sighat taklik divorce and understanding wives District of South Kaur Kaur District with their taklik divorce in marriage as well as to know the legal implications of the breach taklik divorce for a marriage. This study uses empirical juridical law starts from the primary data / basic data is data obtained directly from informants selected are six wives whose husbands abuse sighat  taklik divorce  in the  district South Kaur Kaur regency.  The data  collection techniques used  were  observation, interview  and secondary data collection. When  the data to do the data analysis by descriptive normative. The results showed that the wives of the District Kaur Southern District Kaur assume that sighat taklik divorce in a marriage is only limited pledge of marriage and does  not quite understand that sighat taklik divorce is guaranteed protection of self-wives while factors causing reluctance wife filed a divorce against husband sighat abuse taklik divorce in the district of South Kaur Kaur District is because of shame to the neighbors and the psychological impact  of small children, not understanding the process of the divorce to the religious courts, and embarrassed by the title of a widow who still put it negatively as a widow in society

Abstract

Abstrak : Tujuan penelitian ini adalah untuk mengungkapkan  prosedur perkawinan Anggota Kepolisian Daerah Bengkulu sebelum perkawinan dicatatkan di Kantor Urusan Agama (KUA). Sebelum melangsungkan pernikahan ada beberapa hal  yang harus disiapkan oleh anggota Kepolisian Daerah Bengkulu baik berupa surat surat maupun syarat yang harus dipenuhi. Penelitian ini dilakukan dengan pendekatan deskriptif kualitatif (Library researh) mempergunakan alat pengumpulan data wawancara langsung kepada informan yaitu Anggota  Biro Sumber Daya Manusia  Polda Bengkulu serta di tambah dengan observasi awal  dan dokumentasi lokasi penelitian, kemudian dilanjutkan dengan analisis mempergunakan model analisis Milles dan Hubberman yaitu data reduction, data display, data verification dan conclusion, kemudian dilakukan analisis SWOT untuk mendapatkan faktor-faktor kekuatan dan kelemahannya. Temuan penelitian mengungkapkan bahwa prosedur perkawinan  bagi anggota Kepolisian Daerah  Bengkulu adalah para anggota Polri yang ingin menikah diwajibkan melengkapi berkas persyaratan, yang terdapat pada Peraturan Kepala Kepolisian Republik Indonesia Nomor 9 tahun 2010 tentang tata cara perkawinan,perceraian dan rujuk bagi Pegawai Negeri Pada Kepolisian Negara Republik Indonesia dan Peraturan Kepala Kepolisian Republik Indonesia nomor 6 tahun 2018 tengtang perubahan atas Pertauran Kapolri nomor 9 Tahun 2010. dilihat dari sudut pandang Maṣlaḥah Mursalah  sangat dianjurkan untuk melaksanakan sidang pra nikah yang termasuk di salah satu prosedur perkawinan bagi Anggota Kepolisian Daerah Bengkulu yang akan melangsungkan pernikahan. Diadakannya sidang  pra nikah bagi anggota Kepolisian Daerah Bengkulu akan membuat paham dan mengerti bagi calon pasangan Anggota Kepolsian tersebut akan tugas dan tanggung jawab anggota Kepolisian sebagai pelindung,pengayom dan pelayan masyarakat , Dalam hukum Islam ( Maslahah Mursalah) sidang Pra nikah sangat dianjurkan, dengan adanya sidang pra nikah diharapkan akan tercipta keluarga yang sakinah mawadah dan warohmah bagi Anggota Kepolisian Daerah Bengkulu.Kata kunci : Prosedur Perkawinah, Keluarga Sakinah, Mawaddah, Warohmah. Abstract : The purpose of this study was to reveal the marriage procedures and household construction of sakinah, mawaddah and warahmah for members of the Bengkulu Regional Police according to Islamic family law. This research was conducted with a qualitative descriptive approach (Library research) using data collection tools for direct interviews with informants, namely the Bureau of Human Resources, Civil Servants, members of the National Police and added with observation and documentation of the location of the research, then continued with analysis using the Milles and Hubberman analysis model, namely data reduction. , display data, data verification and conclusion, then do a SWOT analysis to get the strengths and weaknesses. The findings of the study reveal that the procedure for conducting pre-marital hearings for members of the Polda Bengkulu is that members of the National Police who wish to marry are required to complete the required documents, seen from the point of view of Maṣlaursah Mursalah that it is highly recommended to hold a prenuptial procedure trial for members of the National Police, because in terms of Islamic law, pre-marriage guidance has been implemented optimally and quite effectively, in order to support members of the National Police and prospective husband or wife in forming ṡākinaḥ, mawaddaḥ, wa rahmaḥ families. The concept of the sakinah family is to build the foundation of a sakinah family with a strong religion, planning a strong marriage to a sakinah family by getting married in adulthood, managing family conflicts by understanding the perspective of conflict and the principle of problem solving.Keywords: Marriage Procedure, Sakinah Family, Mawaddah, Warohmah.

Abstract

Jenis penelitian ini adalah penelitian lapangan (field research). Tekhnik pengumpulan data menggunakan Metode Wawancara (Interview) dan Metode Dokumentasi. Hasil kesimpulan menyatakan bahwa 1) Pelaksanaan uang hantaran di Kabupaten Way Kanan Lampung, uang hantaran ditetapkan pada waktu manjau atau minimal satu bulan sebelum pesta pernikahan, karena uang tersebut nantinya akan dibelikan perabot rumah tangga oleh pihak calon isteri dan merupakan biaya tambahan dalam melangsungkan berbagai prosesi pernikahan, salah satunya yaitu prosesi ningkukan. Sedangkan ningkukan dilaksanakan setelah acara manjau atau biasa disebut dengan acara bujang gadis (muli meranai). 2) Tinjauan hukum Islam terhadap pelaksanaan uang hantaran dan Ningkukan hukumnya boleh jika tidak ada pertentangan dari ciri-ciri pelaksanaanya dengan syarat-syarat ‘Urf Shahih. Namun apabila praktek uang hantaran telah menyebabkan mudharat seperti penundaan perkawinan, maka ia  berubah menjadi ‘Urf Fasid. Berbeda dengan ningkukan apabila dilakukan sesuai dengan aturan adatnya yang melarang laki-laki dan perempuan bercampur dalam satu tempat tanpa pembatas, maka boleh dilakukan. Namun pada masa sekarang, ningkukan dilakukan dengan menari, melempar selendang dan bertukar surat antara laki-laki dan perempuan dalam satu tempat, hal ini bertentangan dengan Firman Allah Al-quran surat An-Nur ayat 30-31 yakni anjuran menjaga pandangan, memelihara kemaluan dan menutup aurat.

Abstract

The study concluded that: first, the policy taken by the head  of the KUA Kecamatan Ratu  Samban suscatin services was related  to schedule  the execution of suscatin,  providing  a free service to any  of the participants suscatin,  implement  the suscatin for 2 hours with priority material pertaining  to marriage  and households only. Second, the implementation of suscatin in KUA Kecamatan Ratu   Samban held as much  as 2 times in a week, namely  on Thursday. Participants who follow suscatin at KUA Kecamatan Ratu  Samban average each  week 2 – 3 couples  or 8 – 12 pairs per month. The material  provided among others the procedures for marriage, wedding,  Fiqh rules on marriage  and the family, the rights and obligations of husband and wife and family concepts  of sakinah  is given by using the method of lecture and question and answer.  The bride gives a varied response associated with the Government’s policy to hold suscatin to every bride. Third, the evaluation of the implementation of the suscatin  in the Subdistrict  of Ratu   Samban KUA is already  well underway in accordance with the tasks and  functions primarily in the service of marriage  guidance to society. Implementation of the suscatin Sub-district office KUA Ratu  Samban quite effective and successful in adding  to the knowledge  and insight of the bride that will foster household. Suscatin be a posi- tive effort in provide  knowledge  to the prospective bride and  groom.  This is an attempt  to prevent  early on things which can disrupt home  life in order not to divorce occurs

Abstract

Abstrak: Keluarga merupakan cikal bakal pembentukan karakter yang paling mendasar. Sikap mendidik anak dalam sebuah keluarga sangat berpengaruh pada kehidupan selanjutnya. Oleh karena itu, keluarga harus siap dan mampu menghadapi tantangan zaman. Revolusi industri 4.0 memiliki pengaruh yang besar bagi keluarga. Tantangan dan godaan yang dengan mudahnya menyusup ke dalam kehidupan keluarga melalui teknologi, komunikasi, dan informasi. Serta derasnya materialisme membawa perubahan besar dalam pola hidup dan sikap perilaku sehari-hari. Oleh karena itu, perlu dilakukan penelitian guna menjawab tantangan yang terjadi di lingkungan keluarga. Tulisan ini merupakan hasil penelitian kualitatif dari berbagai sumber data (karya): buku, jurnal, dan artikel yang membahas tentang keluarga dalam menghadapi era revolusi industri 4.0. Dari penelitian ini menghasilkan dampak dan berbagai macam penawaran yang dapat digunakan dalam menyikapi revolusi industri 4.0 khususnya di sektor keluarga. Dampak yang terjadi akibat revolusi industri 4.0 di bidang hukum keluarga antara lain: konsentrasi anggota keluarga yang terfokus pada mencari kesenangan, kurangnya perhatian orang tua, kecenderungan untuk menggunakan gadget secara berlebihan, putusnya seluruh sistem keluarga, kehidupan materialistis. Untuk merespon dampak tersebut, ada beberapa tawaran yang dinilai mampu menjawab era revolusi industri 4.0 antara lain: menumbuhkan saling pengertian, mengaktualisasikan peran, memberikan penghargaan, komunikasi yang positif dan efektif, menanamkan sikap disiplin positif dan membangun kualitas. generasi.Kata kunci: Keluarga, Revolusi Industri 4.0, Ketahanan Keluarga. Abstract: Family is the forerunner of the most basic character formation. The attitude of educating children in a family is very influential on the next life. Therefore, families must be ready and able to face the challenges of the times. The industrial revolution 4.0 has a great influence on families. Challenges and temptations that easily infiltrate family life through technology, communication, and information. As well as the torrent of materialism brought major changes in patterns of life and attitudes of daily behavior. Therefore, it is necessary to conduct research in order to answer the challenges that occur in the family environment. This paper is the result of qualitative research from various data sources (works): books, journals, and articles that discuss families in facing the era of the industrial revolution 4.0. From this research, it produces impacts and various kinds of offers that can be used in responding to the industrial revolution 4.0, especially in the family sector. The impacts that occur due to the industrial revolution 4.0 in the field of family law include: concentration of family members focused on seeking pleasure, lack of parental attention, tendency to use gadgets excessively, breaking up of the whole family system, materialistic life. To respond to this impact, there are several offers that are considered capable of responding to the era of the industrial revolution 4.0 including: fostering mutual understanding, actualizing roles, presenting awards, positive and effective communication, instilling a positive discipline attitude and building a quality generation.Keywords: Family, Industrial Revolution 4.0, Family Resilience.

Abstract: Decision On The Case Study Ofhadhanah Viewed From The Law On The Protection Of Children. Fiqh scholars agree that the laws of caring for and educating children is mandatory, because if it is not cared for and well educated, will reflect badly on themselves, can even lead to losing their lives. In the case ofhadhanah decision No.34 / Pdt.G / 2014 / PA.Crp and No. 16 / Pdt.G / 2015 / PA.Crp hadhanah has granted to the mother, but the basic of its legal consideration is vary. These Differences will be recorded, analyzed philosophically and normatively. This paper will examine how the consideration of judges in deciding cases ofhadhanah No. 34 / Pdt.G / 2014 / PA.Crp and No. 16 / Pdt.G / 2015 / PA.Crp terms of Act No. 23 of 2002 on Protection of Children and legal settings. This research is a normative legal research with qualitative methods in the form of literature studies. The approach used in this study isstatute approach and case approach. Data were analyzed using comparative analysis. The results of this study indicate that in case the decision ofhadhanah No. 34 / Pdt.G / 2014 / PA.Crp and case No. 16 / Pdt.G / 2015 / PA.Crp, judges tend to pay less attention to consideration of the regulations to the Act No. 23 of 2003 on Protection of Children Jo No. 35 of 2014 regarding Child Protection. Legal arrangements in the settlement of hadhanah isverzet, appeal, and need to be applied mediation and dwangson that the defendant is willing to fulfill his promise.

Abstract

Abstrak:  Tujuan tulisan ini adalah untuk menjawab persoalan terhadap musibah yang menimpa dunia pada umumnya, khususnya Indonesia dengan adanya pandemi  covid 19. Pandangan Islam menyatakan bahwa menjaga kebersihan agar tidak terserang penyakit adalah upaya terbaik. Banyak ayat dan hadis menganjurkan agar memperhatikan kebersihan, baik secara khusus atau yang terkait langsung dengan syarat sahnya ibadah. Penelitian ini menggunakan metode kualitatif dengan pendekatan library research. Instrument penelitian ini adalah hadis, al-quran, kitab-kitab fikih. Menurut kedokteran, cara yang paling baik untuk mengobati penyakit berjangkit dan penyakit-penyakit lainnya adalah adalah dengan cara menjaga kebersihan. Menjaga kebersihan adalah suatu langkah untuk mengantisipasi diri dari terkena penyakit  termasuk pandemi covid 2019. Sesungguhnya antisipasi lebih baik dari mengobati.Kata kunci: Fiqh, Covid 19, KebersihanAbstract:The purpose of this paper was to answer the problem of the disaster came to the world in general, especially Indonesia with the covid pandemic 19, in line with that view according to Islamic perspective that maintaining cleanliness is the best effort so we will not be attacked by disease. Many verses and traditions suggest paying attention to cleanliness, either specifically or directly related to the legal requirements for worship. This study uses a qualitative method with a library research approach. The instrument of this research was Hadith, Al-Qur'an, Fiqh Books. According to medicine, the best way to treat infectious diseases and other diseases was to maintain cleanliness. The health solution to overcome cobid 19 was to keep cleanliness. Maintaining cleanliness was a step to anticipate from getting sick, including the covid pandemic 2019. Indeed, anticipation is better than cure.Keywords: Fiqh, Covid 19, Cleaness

Abstract

Tujuan penelitian ini adalah untuk menjelaskan dan menganalisa pandangan fiqh klasik terhadap usia minimal kawin, landasan filosofis penentuan batas usia minimal kawin dalam Undang-Undang Perkawinan Nomor 1 Tahun 1974, serta analisis tinjauan maqȃshid asy-syarî’ah terhadap pembatasan usia minimal kawin menurut Undang-Undang Perkawinan. Jenis penelitian adalah studi pustaka. Pendekatan penelitian yang digunakan adalah pendekatan kualitatif. Teknik pengumpulan data yang peneliti lakukan adalah teknik kepustakaan. Hasil penelitian adalah bahwa dalam fiqh klasik tidak ditentukan secara jelas dan tegas mengenai batas usia minimal. Begitu pula dengan penafsiran kriteria dewasa menurut undang-undang. Landasan filosofis penentuan batas usia minimal kawin yang terdapat dalam Undang-Undang Perkawinan Nomor 1 Tahun 1974 memiliki latar belakang yang panjang dan dipengaruhi oleh unsur (tuntutan) seperti sosialpolitik, budaya, ekonomi dan agama. Sedangkan analisis tinjauan maqȃshid alsyarî’ah terhadap pembatasan usia minimal kawin menurut undang-undang perkawinan dari sudut pandang kulliyat al-khamsah (lima prinsip umum) Maqȃshid Al-Syarî’ah pembatasan usia minimal kawin terkait dengan memelihara agama, jiwa, dan keturunan. Dalam memelihara agama, menikah adalah salah satu bentuk menegakkan syiar-syiar Islam. Dalam hal memelihara jiwa, maka sejalan dengan prinsip yang diletakkan UU Perkawinan. Serta dalam hal memelihara keturunan maka, Islam mengaturnya dengan cara mensyariatkan pernikahan dan mengharamkan zina.

Abstract

After the issuance of the decision of the Constitutional Court Number  46/PUU-VIII/2010, Article 43 of Law Number  1Year 1974 concerning Marriage which originally stated that the married child has only a civil relationship with his mother and his mother’s  family, has blood  relation  including  civil relationship with father his biological and his father’s family although there  must  be recognition or can  be proven  on the basis  of science and  technology and/or  other  evidence. The decision of the Constitutional Court can  be seen from two sides,  namely  the protection of the rights of the married child, and  the conformity  of the  understanding of the  child outside of marriage according to Islamic  law, because according to Islamic law the  child outside marriage should  not at all have  a nasab relationship with his biological  father.  Based  on the  above background, this research reveals  two issues,  firstly how the legal power  of the Constitutional Court decision regarding the outsider marriage perspective of Law Number  35 year 2014 on Child Protection. Second, what is the conformity between the Constitutional Court decision No. 46/PUU-VIII/2010 concerning the married child against the provision of an outsider from the perspective of Islamic law. This type of research is normative juridical research or library research which  is then described descriptively.  The results of this study conclude that the legal force of the Constitutional Court decision is binding (final and binding).  Recognition  of the rights of children  outside marriage shall be exercised by all parties  concerned, in accordance with Article 59 paragraph 2 letter o Law No. 35 of 2014 on Child Protection, that every child has the right to survival, growth and development and is entitled to protection from violence and discrimination, including special protection to children  who are victims of stigmatization from labeling related to the condition of their parents. Meanwhile,  if you look at the provisions in Islamic law, the decision of this Constitutional Court should be adjusted to the understanding of children  outside marriage in Islamic law, because the Constitutional Court decision is a law made man,  while Islamic law is a law that comes from Allah SWT. It is also important to revise Article 2 paragraph (2) on the provision of marriage registration as a legal marriage requirement to be only an administrative requirement. “Outer Child Marriage, Constitutional Court and Islamic Law”.

Abstract

Abstrak: Penelitian ini diadakan di Kota Arga Makmur dengan mengangkat permasalahan apa penyebab muncul anak jalanan di kota Arga Makmur dan bagaimana tinjauan hukum keluarga Islam terhadap layanan Pemerintah Daerah Bengkulu Utara terhadap anak jalanan di Kota Arga Makmur. Untuk menjawab permasalahan tersebut, jenis penelitian yang yuridis empiris. Data didapat melalui informan anak jalanan dan dinas sosial dengan mengunakan metode pengamatan, wawancara mendalam dan pengumpulan data sekunder, kemudian setelah data didapat dilakukan rekotruksi bahan dengan dianalisis secara yuridis kualitatif dengan metode deduktif dan induktif. Dari hasil penelitian menunjukan bahwa 1) penyebab munculnya anak jalanan di kota Arga Makmur disebabkan karena faktor ekonomi, faktor kemauan sendiri (kemandirian), dan faktor budaya (kebiasaan), faktor orang tua. 2) Islam telah memberikan petunjuk kepada umatnya untuk memberikan perlindungan terhadap anak-anaknya. Islam tidak pernah menyebutkan dan menyinggung tentang perbedaan gender dan jenis kelamin dari seorang anak. Maksudnya, semua anak mendapatkan porsi dan hak yang sama untuk dilindungi demi perkembangan dan pertumbuhan anak secara wajar, baik dari segi fisik maupun mental dan sosialnya, hal ini sejalan apa yang dilakukan oleh Pemerintah Bengkulu Utara dalam memberikan pemeliharaan dan perlindungan terhadap anak jalanan agar dapat terpenuhi segala kebutuhan hidupnya dengan cara yang telah terprogram, dengan cara; a) Melakukan pembinaan, b) melakukan kegiatan rehabilitasi sosial yang dilaksanakan oleh dinas sosial yang bekerja sama dengan lembaga-lembaga pusat rehabilitasi untuk anak jalanan, gelandangan, pengemis, dan pengamen dilakukan dalam kurung waktu tertentu, c) melaksanakan proses penguatan keluarga yang dilakukan secara terencana dan terarah melalui kegiatan bimbingan dan pelatihan keterampilan, d) melaksanakan bimbingan lanjutan untuk memonitoring dan evaluasi hasil kinerja secara terencana dan berkesinambungan, e) dibutuhkan peran serta masyarakat dalam memberi perlindungan hukuk kepada anak jalanan.Kata Kunci: Perlindungan Hukum, Anak Jalanan Abstract : This research was conducted in the City of Arga Makmur by raising the problem of what causes the emergence of street children in the city of Arga Makmur and how the Islamic family law review of the services of the North Bengkulu Regional Government for street children in the City of Arga Makmur. To answer this problem, the type of research is juridical empirical. Data obtained through street children informants and social services using the method of observation, in-depth interviews and secondary data collection, then after the data is obtained, material reconstruction is carried out by being analyzed in qualitative juridical ways with deductive and inductive methods. The results showed that 1) the cause of the emergence of street children in the city of Arga Makmur was due to economic factors, self-will (independence), cultural factors (habits), parents' factors. 2) In Islam street children are known as laqit, the North Bengkulu Government has provided maintenance and protection for street children so that all their daily needs can be fulfilled in a programmed manner, namely; a) Conducting coaching, b) providing further coaching by continuing to patrol in public places in the City of Arga Makmur, especially places where there are indeed many street children, c) carrying out social rehabilitation activities, d) carrying out the process of strengthening the family which is carried out in a planned and directed through guidance and skills training activities, e) carry out further guidance to monitor and evaluate performance results in a planned and continuous manner, f) community participation is needed so as not to give money to street children.Keywords: Legal Protection, Street Children
