Abstract

The considerations of the Panel of Judges  in the first instance of the courts (High Religious Court of Bengkulu) are: 1) Frequent quarrels and quarrels between  husband and wife are not solely due to the mistakes of the wife, but also because there is no mutual  understanding between  the two parties.  2) The evidence  submitted in the form of photographs and  statements of witnesses is not sufficient to prove the behavior of nusyuz of the wife because it is not equipped with other supporting evidence.3) Criminal acts of corruption committed  by the wife can not be used as the basis of the assessment that the concerned has acted and behave nusyuz, not directly related to the rights and duties between  husband and wife in household affairs. 4) The wife likes to indebted to a third party without the knowledge  of her husband can not necessarily be the legal basis that the concerned has acted nushyuz. Because  there is only one evidence  that explicitly indicates that the concerned has paid off the wife’s debts, while other evidence  shows the wife who has paid off its own debts.  5) The occurrence of separation of residence between  husband and wife is not because the wife has left the place of residence without the applicant’s / appealed permission,  but the separation of the applicant’s / appellate residence has surrendered his wife to his parents  in a kinship and good manner. 6) During the sepa- ration of the house  because of repatriation to the home  of her parents, the wife remains  obedient to the wishes of the applicant/ comparable is to remain  settled in the home  of his parents. 7) The wife as the plaintiff of reconvention is not proven  to act and behave nusyuz as the opinion  of the court of first instance.  So that he remains  legally entitled to get the rights as a devout  wife to the husband. 8) During the separation of the husband’s dwelling only performs  the obligation  as a father to his childre.that is transfer to the savings account of his children.  Second, in terms of the jurisprudence

Abstract

Abstrak : Rumusan masalah penelitian ini yaitu :1) Apa saja regulasi/ hukum positif di Negara Indonesia yang mengatur tentang pengadaan tanah khususnya dalam hal ganti rugi tanam tumbuh? 2) Bagaimana perspektif fiqih siyasah tentang pengadaan tanah khususnya dalam hal ganti rugi tanam tumbuh?. Jenis penelitian ini merupakan penelitian lapangan (field research) dengan metode pengumpulan data secara observasi, wawancara, dan dokumentasi. Lokasi penelitian adalah di Desa Jum'at Kecamatan Talang Empat Kabupaten Bengkulu Tengah. Hasil penelitian yaitu terdapat 13 bidang tanah dari warga terkena proyek pengadaan tanah jalan tol Bengkulu-Taba Penanjung di Desa Jum'at Kecamatan Talang Empat yang uang ganti kerugiannya dititipkan ke pengadilan negeri(konsinyasi). Dari ke-13 bidang tanah tersebut, 3 bidang sertifikatnya masih menjadi agunan di bank.Kata kunci : Pengadaan tanah, Ganti Rugi Tanam Tumbuh, Jalan TolAbstract : The formulation of the research problem is: 1) What are the positive regulations/laws in the State of Indonesia that regulate land acquisition, especially in terms of compensation for planting and growing? 2) What is the fiqh siyasah perspective on land acquisition, especially in terms of compensation for planting and growing?. This type of research is a field research with data collection methods by observation, interviews, and documentation. The research location is in Jum'at Village, Talang Empat District, Central Bengkulu Regency. The results showed that there were 13 plots of land from residents affected by the Bengkulu-Taba Penanjung toll road land acquisition project in Jum'at Village, Talang Empat District whose compensation money was deposited with the district court (consignment). Of the 13 parcels of land, 3 of the certificates are still collateral in the bank.Key words : Land acquisition, Plant Growth Compensation, Toll Road

Abstract

Abstract: Greeting Of ‘Merry Christmas’ By Muslims To Christians In Islamic Perspective. The greeting of ‘Merry Christmas’ is usually pronounced when the Christian welcome the birth of Jesus. In Indonesia, there are still differences of opinion on whether or not allowed for Muslims to say ‘Merry Christmas’ to Christians as a form of respect and tolerance for the Christians. Some ulema are strictly prohibiting to greet Christian by saying ‘Merry Chirstmas’ because this act is a part of religious rituals, and others allow it with certain terms and conditions. To clarify the Islamic legal regarding the greeting of ‘Merry christmas’, this article will explore more deeply through a review of the philosophy of Islamic law. This study is a qualitative research approach. In general there are two approaches that will be used by the researchers, namely: a phenomenological approach and a juridical philosopy approach. In the mean time, the researcher also used the conceptual approach, case approach, as well as comparative approach. The research shows that greeting by saying ‘Merry Christmas’ to Christian is considered as haram li dzatihi (prohibited) because faith related issues. The prohibitation applies as long as not in the state of urgent or special needs.

Abstract

AbstrakUlama sebagai panutan masyarakat telah mengambil peran yang penting ketika terjadi penyebaran covid-19. Hal itu ditandai dengan keluarnya fatwa MUI tentang covid-19. Dengan menggunakan pendekaan sosiologi Ibnu Khaldun dan teknik analisis isi, kajian ini menunjukkan: Pertama, respons Jamaah Tabligh yang selama ini diasosiakan kurang terhadap fatwa MUI dan physcal distancing tidak sepenuhanya benar. Gerakan dakwah Jamaah Tabligh yang berpusat di Masjid juga memerlukan evolusi dalam melakukan perubahan sebelum kemudian memutuskan untuk melakukan physcal distancing dan melaksanakan ibadah di rumah untuk mencegah covid-19. Kedua, kurangnya respons Jamaah Tabligh itu terjadi karena adanya dominasi teks syariat Islam yang banyak mendorong untuk hadir ke Masjid, sehingga walaupun jamaah mereka umumnya berasal dari masyarakat hadarah, tetapi pemikiran keislaman mereka berada dalam masyarakat badawah yang tetap memprioritaskan spiritualitas dan ikatan solidaritas jamaahnya. Ketiga, gerakan Jamaah Tabligh yang memiliki ciri evolutif berpotensi menimbulkan penyebaran covid-19 ketika berada dalam zona merah.

Abstract

Mediation  is a process of problem-solving negotiations, where impartial  parties  work  with disputants to seek mutual  consent. Mediation  is also  known  in Islamic  law  that  equates mediation with  islah  or Al-Sulh, is a process  of dispute resolution in which  the parties  agree  to end  their case  peacefully. The provisions  of mediation in the last Court are regulated in supreme Court Regulation  number 1 of 2016. Regulation  Court are one of the courts  under  the Supreme Court in accordance with the mandate of constitution, therefore it is obligatory to enforce the provisions  of mediation set forth in the Supreme Court Regulation.  In accordance with its authority in terms of solving a particular dispute for Muslims, it means that the Religious Court, besides deriving from the positive law of Indonesia, must  also derive from Islamic law. Likewise with the provisions on the implementation of mediation in the Court, in addition  to following the Supreme Court, in addition  to following the Supreme Court Regulation number 1 year 2016, also follow the provisions of mediation set forth in Islamic Law.  Based on the above  background this research reveal issues,  what is the view of Islamic law in mediation procedures in religious court.

Abstract

Abstrak : Di dalam hukum Islam hubungan antara pendaftaran Tanah Sistematis Lengkap dan maqasyid Alsyariah adalah melalui pendaftaran tanah, hak-hak warga negara untuk melindungi bendanya berupa tanah dapat terwujud dan itu juga merupakan tujuan dari maqasyid Al-Syariah yang hendak dicapai. Dijelaskan di dalam tulisan ini, bagaimana pelaksanaan PTSL, bagaimana kepastian hukum kepemilikan hak atas tanah dalam PTSL, dan bagaimana Perspektif hukum islam terhadap Pelaksanaan PTSL dan kepemilikan hak atas tanah. Guna mempercepat proses pendaftaran tanah di Indonesia, dikeluarkanlah terobosan baru yaitu Pendaftaran Tanah Sitematis Lengkap atau yang disingkat PTSLyang diatur melalui ketentuan Peraturan Menteri Agraria Nomor 6 Tahun 2018 tentang Pendaftaran Tanah Sistematis Lengkap. Terkait kepastian hukum, hal-hal yang perlu diperhatikan dalam pendaftaran tanah yaitu, asas publisitas,  pemasangan tanda batas dan penerapan asas Contradicture Delimitasi atau kehadiran pemilik dan saksi berbatasan. Hubungan hukum islam dan pendaftaran tanah merupakan sebuah bentuk tanggungjawab pemerintah dalam menjalankan amanat Undang-undang Pokok Agraria. Penelitian ini merupakan penelitian kualitatif-empiris dengan cara field research atau observasi dan dilakukan dengan wawancara.Kata kunci :Pendaftaran Tanah Sistematis Lengkap, Maqasyid Al-syari’ah Abstract : In Islamic law, the relationship between Complete Systematic Land Registration and Maqasyid Al-Sharia is through land registration, the rights of citizens to protect their objects in the form of land can be realized and that is also the goal of Maqasyid Al-Shariah to be achieved. It is described in this paper, how is the implementation of PTSL, how is the legal certainty of ownership of land rights in PTSL, and how is the Islamic legal perspective on the implementation of PTSL and ownership of land rights. In order to speed up the land registration process in Indonesia, a new breakthrough was issued, namely the Complete Systematic Land Registration or abbreviated as PTSL which is regulated through the provisions of the Minister of Agrarian Regulation Number 6 of 2018 concerning Complete Systematic Land Registration. Regarding legal certainty, things that need to be considered in land registration are the principle of publicity, installation of boundary signs and the application of the principle of Contradicture Delimitation or the presence of the owner and witnesses bordering. The relationship between Islamic law and land registration is a form of government responsibility in carrying out the mandate of the Basic Agrarian Law. This research is a qualitative-empirical research by means of field research or observation and conducted by interview.Keywords: Complete Systematic Land Registration, Maqasyid Al-syari'ah

Abstract

Keadilan  harus  ditegakkan. Tujuan  hukum  sejatinya  adalah untuk  mewujudkan keadilan,  kepastian hukum  dan kemanfaatan. Karena hukum  lahir dari ketentuan yang hidup  dalam  masyarakat, maka hukum  harus terus dibedah dan digali melalui upaya-upaya terobosan hukum  untuk  menggapai kemaslahatan demi tegaknya  keadilan.  Bagi hakim,  yang menjadi dilema  terkadang adalah pertentangan antara sisi keadilan  dan  sisi kepastian hukum.  Hakim  melalui  penerapan penemuan hukum,  berupaya mengedepankan keadilan  dengan memutuskan suatu  perkara  menyelisihi  dari apa  yang  telah  ditentukan undang-undang. Penelitian ini bertujuan untuk mengetahui dan  menjelaskan mengenai penemuan hukum  oleh hakim dalam kewenangannya untuk  memutus suatu  perkara  di luar dari  apa  yang  telah  ditentukan oleh  undang-undang. Masalah  yang dianalisis  adalah mengenai penerapan contra  legem  dalam  putusan kasasi  Mahkamah agung  yang  memberikan hak  waris melalui wasiat  wajibah  pada ahli waris non  muslim dan  pemberian hak hadhanah untuk  ayah.  Penelitian ini menggunakan metode penelitian  kualitatif dengan pendekatan yuridis normative. Hasil penelitian  menunjukkan bahwa  putusan hakim yang bersifat contra  legem  sejatinya  adalah upaya hakim  melalui  penemuan hukum  untuk   mengkontekstualisasikan  hukum  itu sendiri demi mewujudkan keadilan.

Abstract

Abstrak: Pandemi Covid-19 berdampak pada penurunan aktivitas ekonomi, sehingga menyebabkan perusahaan mengalami kerugian. Untuk menjaga kelangsungan usaha, perusahaan melakukan pemotongan upah pekerja sepihak, yang mana melanggar hak pekerja dan merugikan pekerja. Oleh karena itu, penelitian ini ditujukan untuk mengetahui tindakan hukum terhadap perusahaan yang memotong upah sepihak karena terdampak Covid-19 dan mengetahui perlindungan hukum bagi pekerja yang terdampak. Metode penelitian yang digunakan adalah yuridis normatif, yaitu menggunakan sumber data yang didasarkan pada sumber hukum positif. Berdasarkan penelitian, pemotongan upah sepihak karena Covid-19 tidak berdasarkan hukum dan menimbulkan perselisihan hak. Belum ada tindakan hukum yang pasti pada perusahaan, namun pekerja dapat melaporkan perusahaan pada dinas ketenagakerjaan setempat jika dipotong sepihak upahnya. Untuk melindungi upah pekerja, dikeluarkan Kepmenaker No. 104 Tahun 2021, dimana upah pekerja yang WFO, WFH ataupun yang dirumahkan tetap dibayarkan. Jika ternyata perusahaan tidak mampu membayar, dapat dilakukan perubahan besaran upah berdasarkan kesepakatan dengan pekerja.Kata Kunci: Pemotongan Upah, Covid-19, Ketenagakerjaan Abstract: The COVID-19 pandemic has resulted in a decline in economic activity, causing companies to suffer losses. To maintain business continuity, the company conducts unilateral wage deductions for workers, which violates workers' rights and harms workers. Therefore, this study is intended to find legal actions against companies that cut wages unilaterally because they are affected by COVID-19 and to find legal protection for affected workers. The research method used is normative juridical, namely using data sources based on positive legal sources. Based on research, unilateral wage cuts due to COVID-19 are not based on the law and cause rights disputes. There has been no definite legal action against the company, but workers can report the company to the local manpower office if their wages are cut unilaterally. To protect workers' wages, the Decree of the Minister of Manpower No. 104 of 2021, where wages for workers who are WFO, WFH or laid off are still paid. If it turns out that the company is unable to pay, changes in the amount of wages can be made based on an agreement with the workers.Keywords: Wage Deduction, COVID-19, Employment.

Abstract

Hasil penelitian (1) pola kepemimpinan dalam rumah tangga yang semua pasangan sepakat bahwa suami adalah pemimpin rumah tangga,(2) pola pemenuhan nafkah yang di pahami oleh keempat responden kedalam tiga bentuk, yakni pemenuhan nafkah sepenuhnya tanggung jawab suami, pemenuhan nafkah menjadi tanggung jawab bersama, pemenuhan tnafkah bukanlah kewajiban suami,(3) pola pengambilan keputusan dalam rumah tanggga yang terbagi menjadi dua hasil, yang pertama hasil musyawarah kedua pasangan, dan yang kedua, adanya dominasi salah satu pihak,(4) pola pelaksanaan kegiatan sehari-hari yang terbagi menjadi dua jenis, yakni semua pekerjaan dikerjakan bersama-sama dan adanya pembedaan peran dalam pengerjaan kegiatan tertentu,(5) pola pemeliharaan dan perlindungan yang semua pasangan sepakat bahwa perlindungan dan pemeliharaan hanyamereka sandarkan pada Allah SWT. Berdasarkan hasil penelitian, diperoleh analisis pola kepemimpinan jama’ah tabligh yang diberikan kepada suami adalah sesuai syari’at Islam, meskipun ada beberapa pasangan yang menganggap kepemimpinan diberikan kepada suami itu adalah bersifat simbolik. Kesimpulan dari peranan suami sebagai kepala rumah tangga adalah tetap, sedangkan istri sebagai ibu rumah tangga mengalami pergeseran karena meningkat peran diwilayah publik. Dan mengenai hak dan kewajiban suami istrri tergantung dari kesepakatan keduanya dengan melihat kondisi kesehariannya.

Abstract

Husband’s i’radh In Islamic And Positive Law Perspective, i’radh is the husband who turns away, husband’s i’radh is the beginning  of the cause  of the emergence of nusyuz. In the positive law of Law No. 1 of 1974  concerning Marriage and compilation of Islamic Law does  not  mention  the  problem  of the  husband’s husband explicitly. However,  according  to the author, a husband can be considered as an iadrad  if inside him contains  the elements  of the husband who violate taklik talak. differences and similarities in the views of husbands in the perspective of Islamic law and positive law, among  others.  In Islamic law, it is explicitly mentioned that i’radh in positive law does not explicitly mention  i’radh or nusyuz husband. In Islamic law and positive law both use the path of peace, but when the peace  that is done  is unsuccessful,  the wife can file a divorce. So that this husband could be the cause  of the wife’s divorce  case against  the husband when  he was already  in the behavior, while when he was still within the boundary he could not be the reason  for the divorce
