Abstract

Social learning is a relatively new theory compared to other learning theories. Social Learning is learning through interaction with a community of experts and fellow learners. Communication between participants relies on social networking media such as online discussions, blogging, and text messages. As we know there are a lot of social media that exist today, based on data, there are 6 social media that are most often used by people, especially Indonesia, namely Facebook, Twitter, Google+, LinkedIn, Instagram, and Pinterest. To apply social learning we must pay attention to the features that can be used from each of these social media so that they can support a learning process. Then, determine which social media is suitable for the learning process you want to build. In Social Learning, there are many ways to interact between teachers and students with the presence of educational technology in the digitalization era. Likewise social learning with educational technology can support and be useful in supporting Christian religious education learning.

Abstract

Indonesia is a legal state based on Pancasila with the aim of realizing a safe, prosperous and orderly life order for the nation and state as the legal position of citizens in society is guaranteed. The state is a power organization (political organization) led by a centralized government whose task is to defend the state, maintain public order and prosper all citizens. In its implementation, there are often disputes and disputes between the State Administration Agency and Officials and the citizens of the community. The dispute is resolved through the State Administrative Court. This paper discusses about the proving procedure in state administrative disputes. Because, as it is known that a very important problem in the law of proof is the problem of the burden of proof. The distribution of the burden of proof must be carried out fairly and impartially, because a one-sided distribution of the burden of proof means that a priori the party who accepts the burden that is too heavy falls into the abyss of defeat. Meanwhile, proving or providing evidence is by using certain evidence to provide a level of certainty that is in accordance with reasoning about the existence of the facts (laws) in dispute. It is stipulated in article 100 paragraph (1) of Law N0. 5 of 1986 concerning the State Administrative Court in the form of letters or writings, expert statements, witness statements, confessions of the parties and knowledge of judges.

Abstract

One of the most important agendas of demands for reform and democracy is the establishment of an Indonesian constitutional system based on the notion of people's sovereignty and a rule of law (rechstaat). Therefore, in the context of strengthening the legal system which is expected to be able to bring the Indonesian people to achieve their aspired statehood goals, the amendment to the 1945 Constitution is a strategic step that must be carried out carefully by the Indonesian nation. Talking about the legal system is of course inseparable from the issue of legal politics, because it is legal politics that determines the legal system as desired. Changes in the constitutional system that occurred resulted in changes in the political, cultural and legal systems in Indonesia. Therefore, the younger generation must become agents of change in the life of the state constitutionally by taking part in the dynamics of the constitutionality of the nation and state. To foster a culture of constitutional awareness, it is necessary to understand the basic values and norms which are the material content of the constitution. Thus, the idea of establishing a Constitutional Court is an effort aimed at the correct administration of power and state administration in accordance with the basic law or constitution. The Constitutional Court is one of the state institutions that has the authority to exercise independent judicial power to administer justice, is responsible for managing its own organization, personnel, administration, finances, and can further regulate matters necessary for the smooth implementation of its duties and authorities.

Abstract

The constitutional court is one of the judicial power institutions that has the authority to try cases and also resolve cases from the first level to the last level, in exercising judicial power a decision if it has been issued by the constitutional court then the decision is final and also binding in the sense of the word if a the decision has been issued by the constitutional court, the decision is no longer legal, that's why the law gives four powers to the constitutional court to become one of the institutions that can uphold the law and also justice in Indonesia and the four authorities are: 1) examine the 1945 Constitution 2) decide on a dispute over authority between state institutions whose authority has been granted by the state based on the 1945 Constitution 3) decide on the dissolution of political parties 4) decide on disputes over election results.

Abstract

Setelah diundangkannya Undang-Undang No.5 Tahun 1986 Tentang Pengadilan Tata Usaha Negara, banyak sekali perkembangan-perkembangan yang terjadi dalam pelaksanaan hukum acara tata usaha negara. Sejalan dengan perkembangan-perkembangan tersebut, banyak juga terdapat kesalahpahaman terhadap asas-asas penting hukum acara tata usaha negara. Menggunakan metode penulisan yuridis normatif dan menggunakan pendekatan statuory approach dan conceptual approach tulisan ini berlandaskan pada pendekatan bahan hukum dengan menelaah konsep-konsep, teori-teori, asas-asas hukum, serta peraturan perundang-undangan, dan literalur yang terkait dengan tulisan. Dalam riset, penulis menemukan bahwa asas-asas bisa dikelompokkan menjadi dua buah bagian, yakni mengenai asas-asas formalitas dan mengenai asas-asas penyelesaian pokok sengketa.

Abstract

Presidential Threshold (PT) adalah sebuah sistem yang ditetapkan oleh lembaga legislatif Republik Indonesia yang pertama kali diterapkan pada pemilihan presiden pada tahun 2004. Meskipun PT telah disahkan oleh negara sebagai sebuah sistem dan produk hukum, serta dibenarkan oleh Keputusan Mahkamah Konstitusi, bukan berarti PT merupakan produk final. Sebagai sistem yang dibuat oleh manusia, PT harus juga dapat didekonstruksi dan dinamis, yang dimana ketika suatu saat seperti pemilu 2019 beberapa tahun lalu hal tersebut dapat dirubah. Oleh karena itu, relevansi PT dengan Pilkada serentak harus dipikirkan kembali. Dalam artikel ini, penulis akan membahas dua hal, pertama, sejarah awal mula PT diterapkan serta keterkaitannya dengan pemilu setelah adanya PT. Kedua, bagaiamana pengaruh PT terhadap pemilu yang akan mendatang dimasa depan setelah revisi-revisi yang terjadi atas PT. Metode penelitian yang digunakan dalam penelitian ini adalah jenis penelitian hukum normatif, dikaji dengan menggunakan dua pendekatan hukum yaitu konseptual dan komparatif. Sumber data yang digunakan adalah primer dan sekunder. Beberapa kesimpulan diambil dari penelitian ini. Pertama, sejarah PT yang bermula sebagai konsep kemajuan negara dalam menyeleggarakan pemilihan umum yang dilakukan oleh rakyat, menjadi produk hukum yang dapat disalahgunakan kedepannya. Kedua, pelaksanaan PT menempatkan mengesampingkan nilai-nilai fundamental konstitusi, karena regulator dengan mudah mengabaikan perjalanan panjang yang berdarah demokrasi, dan telah menyebabkan pemilihan umum yang tidak adil dan tidak kompetitif sebab keterbatasan yang diberlakukan secara pasif/tidak dapat dirasakan secara langsung. Solusi untuk masalah yang penulis coba usulkan adalah bahwa ambang batas harus dipertimbangkan, baik dihilangkan maupun diberikan kelunakan terhadap batasannya. Namun penulis merekomendasikan konsep tersebut "dihilangkan" berarti bahwa ambang batas tersebut harus dihapus secara total dan tidak terdapat batasan di kursi-kursi legislatif kemudian hari.

Abstract

This study is based on the Constitutional Court Decision No. 95/PUU-XII/2014 which states that it accepts the conditional constitutionality of Article 50(3)(e) and (i) of Forestry Law No. 41 of 1999. when the article is declared constitutional to the extent that it is understood by all people, and it is prohibited to cut trees or harvest or collect forest products in the forest without the right or permission from the authorized agency, except for people who have lived in the forest for generations and not for commercial purposes and livestock grazing in officially designated forest areas, except for people who have lived in the forest for generations and not for commercial purposes. Although the Constitutional Court only accepted the wording of the paragraph, rejected the wording of several other paragraphs of the law and deemed the paragraph of Law No. 18 of 2013 on the Prevention and Elimination of Deforestation unacceptable, the Constitutional Court affirmed the existence of customary law communities inhabiting forest areas. The Federal Constitutional Court held that people who have a very strong relationship with the forest should be exempted from criminal provisions.

Abstract

This research aims to determine the implementation of the provisional authority mandated to the Constitutional Court in resolving election results disputes and this research also aims to determine the impact and effectiveness of the implementation of the election settlement regulations regarding the provision of vote difference thresholds. This study used the library research research method in collaboration with observation or observation methods. The number of cases registered with the Constitutional Court was 53 cases, while only 7 cases passed and advanced to the trial process. The results of the study show that the administration is systematically structured and is still the main argument by the litigants for the sake of overriding the threshold provisions. The implementation of the authority of the Constitutional Court in resolving disputes follows substantial justice while remaining obedient to the constitution, as well as an effort to protect citizens' constitutional rights. However, on the other hand, the element of legal certainty in carrying out the mandate of the Pilkada law for the disputing parties was not fully fulfilled.

Abstract

The State Administrative Court is an application whose formation is intended as a special court to assess, decide and resolve state administrative disputes. One of the features of the administration of this judiciary compared to other courts is the examination of each claim by the Chief Justice before the case is forwarded to the Panel of Judges. The lawsuit for examination by the Chief Justice is called the dismissal process or dismissal procedure. Even though there are juridical and implementation constraints, this does not mean that the process for dismissal and preparation for dismissal cannot be carried out through an electronic hearing. Then, this instrument which is still relevant is applied. The authority of the Chief Justice of the dismissal procedure has increased the authorities for justice and the length of the road to fight for justice so that the existence of the State Administrative Court as an institution that indirectly exercises judicial control will be maximized. With this, the government will feel that it is continuously being watched by its people, as well as the willingness to make corrections or legal resistance to decisions by the TUN Agency or Officials that are considered detrimental to society.

Abstract

Putusan Pengadilan Tata Usaha Negara yang dapat dilaksanakan adalah putusan yang telah mempunyai kekuatan hukum tetap, yaitu suatu putusan yang tak dapat diubah lagi melalui suatu upaya hukum (Pasal 115 UPTUN). Dalam pelaksanaan putusan Peradilan Tata Usaha Negara tidak dimungkinkan adanya upaya paksa dengan menggunakan aparat keamanan, seperti halnya dalam pelaksanaan putusan Peradilan Pidana dan Peradilan Perdata. Tetapi istimewanya dalam pelaksanaan putusan Peradilan Tata Usaha Negara dimungkinkan campur tangan Presiden sebagai Kepala Pemerintahan yang bertanggung jawab dalam pembinaan aparatur pemerintahan juga bertanggung jawab agar setiap aparatur pemerintahan dapat mentaati semua peraturan perundang-undangan yang berlaku termasuk mentaati Putusan Pengadilan sesuai dengan prinsip Negara hukum yang kita anut. Campur tangan presiden diperlukan karena yang bersangkutan adalah orang atau badan hukum Perdata dengan Badan atau Pejabat Tata Usaha Negara dan yang dapat digugat di Pengadilan di lingkungan Peradilan Tata Usaha Negara adalah Badan atau Pejabat Tata Usaha Negara yang dapat mengeluarkan suatu putusan Tata Usaha Negara.
