Abstract

A democratic state is characterized by the sovereignty of the people, where the highest power lies with the citizens. One manifestation of this sovereignty is the role of representative bodies in the legislative process. This study examines the role of the Indonesian House of Representatives and the Representatives in Uruguay in the law-making process, and evaluates their legislative performance. The research employs normative legal methodology, with descriptive writing, and uses secondary data. The result and Conclusions are drawn using deductive logic. The study finds that the Indonesian House of Representatives has a national legislative program that includes draft laws, while the Representatives in Uruguay do not have such a program. In Indonesia, 24 out of 247 draft laws in the 2020-2024 period were successfully enacted, whereas in Uruguay, 412 draft laws were passed into law during the same period.

Abstract

The Public Prosecutor is responsible for prosecuting, beginning with the reading of the indictment. However, in practice, some indictments do not meet the requirements set out in the Indonesian Criminal Procedure Code (KUHAP), as seen in Decision Number 813/PID.B/2023/PN.SBY. The research questions are how the indictment for the crime of assault was applied in decision number 813/PID.B/2023/PN.SBY and what are the legal consequences of an inaccurate indictment by the Public Prosecutor in this case, according to KUHAP. This research uses a normative juridical method with a descriptive-analytical approach, relying on secondary data and primary legal materials analyzed qualitatively. The conclusions drawn are that the indictment in Decision Number 813/PID.B/2023/PN.SBY is a cumulative-alternative combination but fails to meet the material requirements of KUHAP. The Public Prosecutor’s negligence in repeating the same article within the indictment reflects a lack of diligence, resulting in a vague indictment that contradicts the principles of criminal procedure law. Such an indictment opens the door for the defense counsel to file an exception, potentially leading to the judge rejecting the indictment and the case being dismissed by law

Abstract

Decision No. 254/Pid.Sus/2023/Pn.Mks, which examined and adjudicated a case of sexual assault and intercourse, was based solely on Testimonium de auditu. The issue is to what extent the available evidence supports Decision No. 254/Pid.Sus/2023/PN.Mks in declaring the defendant not proven legally and convincingly guilty according to the applicable legal standards. The research method used involves secondary data and is structured using normative descriptive research techniques. The discussion and conclusion are that Asdar Muhammad should be charged with sexual assault and intercourse based on written evidence, witness statements, and testimony from a minor victim, according to the analysis conducted (Case No. 254/Pid.Sus/2023/PN.Mks). The importance of witness testimony compared to what is seen, heard, or experienced determines the severity of a case, based on Constitutional Court Decision No. 65/PUU-VIII/2010. However, Asdar Muhammad should have been found guilty of committing sexual assault or intercourse, rather than being declared not guilty, as stated in Constitutional Court Decision No. 65/PUU-VII/2010.

Abstract

Indonesia regulates its criminal proof system in the Indonesian Criminal Procedure Code, while China governs its proof system under the Criminal Procedure Law of the People's Republic of China. Although both Indonesia and China follow a Civil Law system, there are similarities and differences in their criminal proof systems. This study employs a normative legal research approach with a descriptive-analytical nature, utilizing secondary data analyzed qualitatively and drawing deductive conclusions. The research findings indicate that the similarity between the criminal proof systems of Indonesia and China lies in the presence of proof hearings during the trial process in both countries. The difference is found in the types of evidence admissible in court: Indonesia recognizes five types of evidence, whereas China acknowledges seven types.

Abstract

This study evaluates the inconsistencies in the decisions of the Constitutional Court (MK) regarding the judicial review of laws, specifically concerning the decision MK No. 29-51-55-90/PUU-XXI/2023. The aim of this study is to understand the reasons behind the differing positions of the MK when reviewing the same article, namely Article 169 letter q of Law No. 7 of 2017 on General Elections. The method used is normative legal research with a descriptive nature, utilizing secondary data as the source. Data collection is conducted through literature study, data analysis is qualitative, and conclusions are drawn using the deductive method. The research findings reveal inconsistencies in the MK's decisions. In Decision No. 90/PUU-XXI/2023, the MK added a new norm by establishing alternative requirements for Article 169 letter q of Law No. 7 of 2017. In contrast, in Decision No. 29-51-55/PUU-XXI/2023, the request to review the same article was rejected on the grounds that the regulation of the minimum age is an open legal policy of the lawmakers and does not violate the 1945 Constitution. This inconsistency raises questions about the integrity of the MK and reduces public trust in the institution. The study recommends that the MK maintain consistency in judicial review decisions to preserve its authority and public trust.

Abstract

The analysis examines the criminal sanctions applied to a military officer convicted of rape in Decision No. 35-K/PM III-17/AD/II/2022. Under Article 285 of the Criminal Code, rape is a severe crime, and military personnel may face sanctions under the Criminal Code if their actions are not specifically addressed by military law. The research addresses two main issues: 1) Whether the criminal sanctions in this decision are consistent with Article 285, and 2) How criminal sanctions should be aggravated for a military officer found guilty of rape in this case. This normative juridical research, using descriptive analysis, concludes that the sanctions in Decision No. 35-K/PM III-17/AD/II/2022 do not align with Article 285. The judge should have imposed harsher penalties, taking into account the severity of the offense. The aggravation of criminal sanctions should have been guided by Article 52 of the Criminal Code, allowing for an increase of one-third of the original penalty.

Abstract

The right of review is the right of the perpetrator, in contrast to ordinary legal remedies whose application is enshrined in Article 268 paragraph (3) of the Criminal Code. However, in SEMA Number 7 of 2014, a review can be submitted on the grounds that there is a conflict between the decisions. Through Decision 467 Pk/Pid.Sus/2021, the panel of judges decided that the application was unacceptable. From the description above, the author intends to analyze two main issues to be examined, namely whether the decision is in accordance with the Criminal Procedure Code, and whether the reason for the decision is not acceptable to the application. In this paper, the author conducts a descriptive analysis method. Based on the discussion presented in this paper, it is concluded that the decision is not in line with Article 79 of Law Number 14 of 1985 concerning the Supreme Court, using the reason that there is no contradiction submitted as evidences as required in SEMA Number 7 of 2014

Abstract

Differing views on sovereignty and intervention gave birth to the Responsibility to Protect (R2P) principle which emphasizes the responsibility of states to protect their people from war crimes, crimes against humanity, and ethnic cleansing. The armed conflict in Sudan showed violations of the R2P principle that caused thousands of casualties and sexual violence. The problem of this article is the status of the R2P principle in international law and whether the UN Security Council resolution implementing R2P can be a precedent for applying the R2P principle in Sudan. This article is normative juridical research, descriptive-analytical in nature, using secondary data, qualitative data processing, and deductive conclusions are drawn. The results show that the position of the R2P principle is internationally recognized in various UN documents and resolutions and the UN Security Council has not applied the R2P principle in the case of Sudan.

Abstract

The safety guarantee of the right to life for prisoners in correctional institutions (“lapas”) is often neglected, even though it is the responsibility of the state.  One of the cases that occurred was the alleged negligence of government officials in the management of facilities and infrastructure in prison, such as the fire that occurred in Correctional Institutions Class 1 Tangerang on September 8, 2021. The problems of this article are:  whether there is a violation of human rights in the case of fire in Correctional Institutions Class 1 Tangerang? This article is a normative legal research, descriptive in nature, using secondary data, and deductive inference. The Result and conclusion obtained is that there was a violation of human rights due to the negligence of several prison officers which then caused a fire and resulted in casualties. Related to the case, four prison officers were charged under Articles 359 and 188 of the Criminal Code with a prison sentence of up to five years. Improvement and revitalization of prisons are also needed so that the safety of prisoners in prison can be better guaranteed.

Abstract

The occurrence of disputes over the use of the "Bensu" trademark made PT Ayam Geprek Benny Sujono as the First to File holder of the "Bensu" trademark suddenly removed unilaterally by the Directorate General of Intellectual Property from the IP Database. This journal examines the regulation of the removal of registered trademarks in the case of the loss of the trademark "I Am Geprek Bensu" by the DJKI from the Database based on Law No.20/2016 Trademark Law and Geographical Indications and its impact. The results showed that the Decree of DJKI which removed the registered mark "I Am Geprek Bensu" owned by Benny Sujono from the Database through a Decree on behalf of the Minister (HKI-KI.06.07-11) caused inconsistency with the MIG Law, as well as contrary to Decision No.57/Pdt.SusMerek/2019/PN Niaga Jkt.Pst and Decision No.575/Pdt.SusHKI/Merek/2020/PN Niaga Jkt.Pst. Also, the impact of the abolition of the "I Am Geprek Bensu" trademark is very detrimental both materially and immaterially to PT. Ayam Geprek Benny Sujono with the loss of exclusive rights to the trademark and creates confusion and uncertainty in the community towards the steps taken by the Government.
