Abstract

Abstract: Customary law is an unwritten law that is recognized in the 1945 Constitution. One of the indigenous peoples in Indonesia who still practice their customary law is the indigenous Malay community, especially in the city of Pekanbaru. The law of marriage for the Malay customary community must be carried out in stages and irrationally in accordance with the stages of the implementation of marriage and Malay teachings with Islamic nuances, especially in marriages between people with the title of King and people who do not have the title of King that occur among the Malay community which will also affect the children, assets, and the position of husband and wife. The main problem in this research is how the implementation of traditional Malay marriages between those with the title of King and those who do not have the title of King in Pekanbaru, and what are the legal consequences for the occurrence of marriages between those with the title of King and those who do not have the title of King for children, assets, and the position of husband and wife in the indigenous Malay community in Pekanbaru.The method used in this study when viewed from its kind is using observational research methods using survey methods. From the results of the research it is known that currently there are still many children from parents from among people with titles of Kings or nobles in Pekanbaru who carry out marriage customs, but many of these traditional marriage processions have been abandoned and keep up with the times which of course are no longer appropriate. with the authenticity of the marriage customs of the Malay community. Keywords: Marriage, Custom, Original, Titled King. Abstrak: Hukum adat merupakan hukum tidak tertulis yang diakui dalam Undang-undang Dasar 1945. Salah satu masyarakat adat di Indonesia yang masih menjalankan hukum adatnya adalah masyarakat adat Melayu terkhususnya di Kota Pekanbaru. Hukum nikah kawin bagi masyarakat adat Melayu harus dilaksanakan secara bertahap dan irasional sesuai dengan tahapan pelaksanan kawin kawin dan tunjuk ajar Melayu yang bernuansa Islam, terutama dalam perkawinan antara orang bergelar Raja dengan orang yang tidak bergelar Raja yang terjadi dikalangan masyarakat Melayu yang juga akan berpengaruh pada anak, harta, dan kedudukan suami istri.Permasalahan pokok dalam penelitian ini ialah bagaimana pelaksanaan perkawinan adat asli masyarakat Melayu antara bergelar Raja dengan tidak bergelar Raja di Pekanbaru, serta bagaimana akibat hukum terhadap terjadinya perkawinan antara yang bergelar Raja dengan tidak bergelar Raja terhadap anak, harta, dan kedudukan suami istri pada masyarakat adat asli Melayu di Pekanbaru.Metode yang digunakan dalam penelitian ini jika dilihat dari jenisnya yaitu menggunakan metode observasional researchdengan menggunakan cara survey. Dari hasil penelitian diketahui bahwa saat ini masih banyak anak dari para orangtua dari kalangan orang bergelar Raja atau bangsawan di Pekanbaru yang melangsungkan adat nikah kawin namun beberapa dari prosesi adat nikah kawin tersebut sudah banyak yang ditinggalkan dan mengkuti perkembangan zaman yang tentu saja sudah tidak sesuai lagi dengan keaslian adat nikah kawin masyarakat Melayu. Abstract

Abstract The problem of land ownership in Indonesia in general and in the Kesumbo Ampai Village area has complex problems. Among them, the government takes over land from the people, to be developed in accordance with the plans that have been set to continue economic modernization or the creation of oil palm fields for investors, both inside and outside the State. This land problem shows a conflict of interest between the government, which sees land as capital for national development, and local residents who see land as a source of income. Based on the above problems, the formulation of the problem is how is the legal review of the existence of customary land in the Sakai Tribe Village based on the UUPA. The research method uses observation research. The result of the research is that the existence of the Sakai tribe community has been based on the conditions of existence determined by law so that the Sakai tribe is still truly a customary law community, as well as the land or land on which they live is land belonging to their ancestors for generations which is still jointly owned, which in terms of management and control and use of the land still follows the rules of customary law that apply in their environment, supervised by the customary leader they have.

Abstract

Abstract Same-tribal marriages are common nowadays, because men and women love each other. However, this research focuses on the customary sanctions for same-ethnic marriages carried out by the Petalangan Malay indigenous people. Same-tribal marriage in Islam has no rules, but in customary law, same-tribal marriage will result in the consequences of customary law that applies in the Petalangan Malay indigenous people. Based on the background of the problem, the formulation of the problem raised is, what is the history of the Prohibition of Same-ethnic Marriage in the Petalangan Malay Indigenous Community in the Perbatinan Bunut Region. The research method is sociological law which is research that goes directly to the field. This research was conducted in the Balam Merah Spiritual Area, Pelalawan Regency. From this research, it is known that historically the prohibition on same-ethnic marriages for ninik mamak testifies that one person or one ethnic group is brother and sister. Therefore, if a person or group of people is prohibited from marrying, the prohibition is highly trusted and if it is carried out, bad things will happen to the couple and they are afraid of sanctions

Abstract Purpose from research this is for knowing the view of Islamic Law on Sanctions given to the Malay Customary Society Adventurers who do Marriage A tribe. Method research used is ethod research A sociologist who is plunged research directly to field. Research this done in Perbatinan Region Balam Merah District Opponent. In the Qur'an and Hadith no found about obligations or forbid marriage a tribe Customs that exist in the tribe Malay about ban married a tribe this grounded above existing confidence regularly down hereditary from generation generation. Though customs Malay Adventure forbid marriage a tribe, however marriage the said no ever canceled and fixed considered valid marriage that has been done one quarter said. This indicate marriage a tribe not including illegal category. Because if a marriage banned then marriage the said should cancelled. Abstract

Abstract The district head has delegated authority, which is the delegation of authority from the regent/mayor. The delegation of authority includes aspects of service to the community which include: licensing, recommendations, coordination, guidance, supervision, facilitation, determination, implementation and other powers that are delegated including the social welfare of the people in their area. This research examines the optimization of the role of sub-district heads in empowering Malay communities, especially those in the Bina Widya sub-district, Pekanbaru City. This study uses a sociological juridical method approach with the aim of knowing how the sub-district head plays a role in community empowerment at research locations that have been determined and reviewed with existing laws and regulations. The results showed that the role of the sub-district head in community empowerment, especially in the field of social welfare, was still not optimal. This was evident from the uneven distribution of social assistance funds to people in need in the BinaWidya sub-district area.

Abstract

This study aims to describe the content of local wisdom in traditional expressions to reveal the characteristics of the Malay community of Jambi. The data include traditional expressions that include phrases in the form of seloko, petitih proverbs, figurative language, and proverbs. The research method uses the method of listening, note -taking and recording techniques. Data analysis using independent techniques Based on the results of the study, it was concluded that the traditional Malay expressions of Jambi, obtained either in the form of proverbs, sayings, and parables. The Malay community of Jambi in general is not open in speaking, so they use allusions to convey the message in the speech. Some of the characters of the Jambi Malay society in the traditional are heavy, religious, honest, polite, polite, wise, open, diligent, mutual aid, loyal, empathetic, humble, obedient, friendly, knightly, unyielding, democracy, tolerance, pluralism, fair, responsibility. Jambi Malay traditional expressions have a function in social life in the community. The function is as a means of community education, advice, and cultural treasures of the oral tradition
