Abstract

Constitutionalism places the constitution as the supreme law that binds all state administrators, with the Constitutional Court (MK) as the guardian of the constitution through final and binding judicial review decisions. However, serious challenges have emerged regarding ethical violations by constitutional judges, such as in Decision No. 90/PUU-XXI/2023, which raises questions about the legitimacy and validity of the decision. This study employs a normative legal method with a doctrinal approach to analyze the applicability and impact of ethical rulings on MK decisions and compares them with ethical oversight and decision correction practices within the Supreme Court (MA). The findings indicate that ethical violations by MK judges only result in personal sanctions without invalidating the substance of the decision, while in the MA, although there is a mechanism for reviewing decisions related to ethical violations, its implementation is highly limited. This study recommends strengthening ethical oversight mechanisms that are more integrated with substantive review of decisions and developing an internal accountability system to maintain the integrity and legitimacy of the judicial institution without compromising legal certainty.

Abstract

The COVID-19 pandemic has been one of the most challenging phases for all countries affected by it, including Indonesia. The impacts of the COVID-19 pandemic are not limited to the health sector but also extend to other areas such as the economy and society. Given the various impacts of COVID-19 felt by the community, new rules regarding new norms or what is often referred to as the “new normal” have begun to be implemented in various regions. Therefore, law enforcement during the COVID-19 pandemic does not only involve policymakers at the central government level but also requires the involvement of policymakers representing each region to ensure that the aspirations of the community are heard. This is because the impacts of the COVID-19 pandemic felt directly by the community in each region will inevitably vary, so the regulations needed by the community must be able to adapt to the needs at that time. In this regard, the role of the Regional Representative Council (DPD) as a regional representation becomes crucial in conveying the aspirations of the community to ensure that law enforcement aligns with the needs of various regions.

Abstract

Partisipasi perempuan dalam politik merupakan salah satu indikator penting dalam menilai kualitas demokrasi suatu negara. Representasi yang setara antara laki-laki dan perempuan, khususnya dalam partai politik dan badan legislatif, tidak hanya menjadi wujud dari keadilan gender, tetapi juga menjadi sarana untuk memperkaya pengambilan kebijakan yang dapat dinilai inklusif dan responsif terhadap kebutuhan seluruh warga negara. Namun dalam kenyataannya, keterlibatan perempuan dalam ranah ini masih diwarnai dengan berbagai tantangan struktural, budaya, dan historis. Jepang, Indonesia, dan Taiwan merupakan tiga negara di Asia Timur dan Tenggara dengan latar belakang sejarah, budaya, dan sistem politik yang berbeda, namun pada ketiganya terdapat persamaan dinamika yang menarik dalam hal keterwakilan politik perempuan. Jepang, sebagai negara maju dengan sistem demokrasi parlementer yang stabil, justru mencatat tingkat keterwakilan perempuan di parlemen yang relatif rendah dibandingkan dengan negara-negara maju lainnya. Sebaliknya, Taiwan dianggap menjadi contoh yang lebih progresif dalam hal keterwakilan perempuan, bahkan berhasil untuk memilih presiden perempuan dalam dua periode berturut-turut dan mencapai lebih dari 40%. Walaupun belum bisa sehebat Taiwan. Setidaknya, Indonesia sebagai negara berkembang dapat unjuk gigi dengan lebih unggul dari Jepang dalam hal keterwakilan perempuan. Perempuan di parlemen Indonesia (DPR) lebih banyak dari Jepang. Keterwakilan perempuan di parlemen Indonesia sebanyak 128 dari 580. Sedangkan Jepang hanya 42 dari 466 kursi. Tetapi, keterwakilan perempuan di Indonesia belum berhasil untuk mencapai target minimal 30% yang diamanatkan oleh undang-undang.

Abstract

In recent years there have been cases of abuse of authority committed by the Polri. this has a negative impact on the image of the police in the community. in handling the case also based on the law can only be carried out through the internal Polri in this case the Propam division through the Police Code of Ethics Commission (KKEP). The research method used is a qualitative method by combining data including normative, phenomena and in-depth analysis through comparison. the results of this ethical enforcement are not transparent and do not match what violators do. So that the results of this study indicate that there is a need to strengthen the authority of kompolnas as an independent institution and police partner who is directly responsible to the President to be able to supervise and enforce ethics on the police in Indonesia. The importance of the implementation of ethical supervision and enforcement in the police by strengthening the authority of kompolnas can provide transparency and increase public confidence in the Police.

Abstract

The research aims to identify problems in the implementation of consultation as part of the mechanism of regulation formation between KPU and DPR and the government, especially in following up the Constitutional Court's decision. The research begins by first describing the dynamics of the consultation process and its results, which are passive and tend to be formalistic after the conclusion of the RDP forum is no longer binding based on the Constitutional Court Decision 92/PUU-XIV/2016. This research uses a doctrinal method that refers to the laws and regulations related to the consultation process of the KPU together with the DPR and the government in the formation of regulations. The research aims to identify problems normatively and connect them with legal facts obtained. The research uses analytic-explanatory typology by describing the existing problems to further find the causality (cause-and-effect) of a problem. The results showed that the implementation of the RDP forum was passive and did not even pay attention to the correction of substantive errors such as in PKPU related to the requirements for former convicts to run for office. This phenomenon should be an evaluative study in the legal validity and technical procedures of the RDP forum, which turns out that there is a disharmonization of consultation provisions between the Pilkada Law and the Election Law with the MD3 Law.

Abstract

This article analyzes the paradigm shift in the Transfer of Sentenced Persons (TSP) from a regime oriented towards the rehabilitation and social reintegration of prisoners to a new configuration increasingly driven by state interests, such as national security, prison population management, immigration policy, budget efficiency, diplomatic calculations, and human rights image. Based on a legal-normative approach combined with institutional analysis and a comparison of practices in various jurisdictions, this paper shows how the principle of consensualism, initially interpreted as "trilateral consent" (the sentencing state, the receiving state, and the prisoner), has fragmented into three models: compulsory, voluntary, and hybrid, with direct implications for the autonomy of prisoners in the decision-making process. This article also shows how the classic prohibition on transferring prisoners sentenced to death through the TSP scheme is reconstructed through various sentence-conversion formulas and policy engineering. At the governance level, TSP is shifting from a predominantly judicial mechanism to a series of administrative and cross-sectoral coordination decisions, with the executive and inter-ministerial networks playing a central role.

Abstract

This study examines the phenomenon of oversized coalitions in Indonesian politics and their impact on the legislative role in exercising oversight over the executive branch. In a democratic context, the presence of large coalitions in parliament is often associated with a diminished balance between the legislative and executive branches, particularly concerning the essential mechanism of checks and balances. The primary issue investigated is how this political configuration affects the effectiveness of parliamentary oversight, specifically regarding the monitoring of public policy implementation and government accountability. By employing a normative legal approach and analyzing specific public policy implementations, this research assesses the impact of oversized coalitions on the legislative body's capacity to perform its functions optimally. The findings indicate challenges in achieving effective oversight within an oversized coalitions system, particularly concerning the limited role of the opposition, which is crucial for strengthening the democratic process.

Abstract

Almost all constitutional law research applies the doctrinal method to analyze normative texts and legal logic. In the context of the development of constitutional law, this method has limitations in evaluating the effectiveness of legal norms in societal reality. This article proposes the need for a paradigm shift in the use of constitutional law research methods, which should not only rely on a doctrinal approach but also integrate empirical methods, to align the needs of constitutional law studies with the dynamics of the Indonesian state after 25 years of constitutional amendments. There are three alternative methods that can be integrated with the doctrinal method: the empirical method, the quantitative method, and the experimental method. Thru the application of various methods, constitutional law research is expected to present an analysis of normative texts based on empirical evidence to propose constitutional recommendations.

Abstract

Corruption has become an extraordinary crime that damages the integrity of the state and weakens the democratic system, including through the role of political parties that are supposed to be the main pillars of democracy. This research aims to answer the main question: can a political party be dissolved because it is proven to have committed a corruption crime? Using a normative-juridical research method, this paper examines the provisions in the Anti-Corruption Law, the Political Party Law, and the Constitutional Court Law and is associated with the e-KTP corruption case study. The results show that normatively political parties can be categorized as corporations, making it possible to be held criminally liable. However, in practice, there is no mechanism that explicitly allows the dissolution of parties due to corruption. Therefore, regulatory reform is needed to clarify the legal status of political parties as criminal subjects and make corruption a reason for party dissolution through the Constitutional Court.

Abstract

The mechanism for selection and election of constitutional judges in Indonesia currently still shows a diversity of procedures in each proposing institution, namely the Supreme Court, DPR and President. The process implemented does not fully reflect the principles of transparency, participation, objectivity and accountability as mandated in the Law on the Constitutional Court. Therefore, it is necessary to standardize the procedures for selection and selection of constitutional judges to ensure a more professional system and integrity. One of the solutions offered is the establishment of an independent institution responsible for the selection and recruitment of constitutional judges with a system that is more open and involves community participation. In this case, the Judicial Commission has the capacity as an institution that can carry out the selection of constitutional judges in a more transparent and accountable manner. Apart from that, as a comparison, this research also analyzes the selection mechanism for constitutional judges in Thailand, which shows that the selection system in that country involves more various stakeholders, so it is considered more inclusive and credible. Thus, the reconstruction of the constitutional judge selection mechanism in Indonesia needs to consider a more standardized and participatory model to produce judges who are professional, have integrity, and are able to maintain the independence of the constitutional justice institution.
