Abstract

The stipulation of the Omnibus Law on the Job Creation Act as a regulation that regulates various sectors aims to improve the investment climate and willingness to establish a business in Indonesia in order to create wider job opportunities so that it can absorb more of the workforce. But in fact, the enactment of the Job Creation Law has actually caused a lot of turmoil and demonstrations in various regions in Indonesia because there are articles that are considered contradictory and can degrade rights and welfare, ignore environmental sustainability and the sustainability of living together. The purpose of this research is to look at the implementation of the Job Creation Act after it is legal as a law. This study uses a juridical-normative qualitative method with a statutory approach, a conceptual approach and a historical approach. The results of this study show that there are at least 7 sectors or clusters that get enough attention because the contents of the articles in them are said to be quite controversial. These clusters include the Investment and Business Activity Ecosystem Improvement cluster, the Employment Cluster Ease, Protection, and Empowerment of Cooperatives, Enterprises, Micro, Small and Medium Enterprises, the Ease of Doing Business cluster, the Research and Innovation Support cluster, the Land Acquisition cluster, and the Government Administration Implementation cluster.

Abstract

The Badui tribe is one of the indigenous tribes in Indonesia that still survives to this day. Geographically, the Badui tribe is close to the national capital. However, this does not necessarily make the Badui tribe eliminate the customs and laws that apply to the tribe, so it often clashes with positive law in Indonesia. This study aims to identify the clash of Badui habits with positive Indonesian law. The qualitative approach method was used to collect data and analysis. Data were collected by observation and literature study. The results show that the clash between the habits that develop in the Badui community and the provisions of positive law is a factual condition that occurs in society. For this reason, it is essential to carry out legal acculturation so that the Badui Customary Law can run in harmony with positive Indonesian law.

Abstract

Implementation of the Policy on No Smoking Areas in Bandung Regency with a Study of the Bandung Regency Regional Government Office Complex in this study was conducted to determine the implementation of the policy by exploring various primary and secondary sources of information using a descriptive qualitative approach that describes a certain situation of the facts that occur in the research process, both in the form of behavior, perception, motivation, action and others without manipulating the observed phenomena. The dimensions that become a measuring tool for implementation are: Content of Policy and Context of Policy. The results showed that the Implementation of the Policy on Smokefree Areas in Bandung Regency with a Study of the Bandung Regency Regional Government Office Complex carried out by the Bandung Regency KTR Task Force was not quite optimal. Actually, in terms of the content of the policy itself, it is quite complete and detailed, which includes all the rules that limit negative smoking activities, especially in areas that have been determined in the policy content. It's just that in terms of the policy environment there are still weaknesses that make this policy not well implemented, such as still not taking firm action and imposing administrative sanctions, especially legal sanctions on policy violators.

Abstract

Disasters are a series of events that threaten and disrupt people's lives and livelihoods caused by both natural and non-natural and human factors, resulting in human casualties, environmental damage, property losses and psychological impacts. From the losses caused, alertness is needed in order to reduce the side effects that will occur. The social service is one of the government institutions that has an important role in being involved in the distribution of social assistance needed by disaster-affected communities. This role is also a form of alertness carried out by the Social Service in the implementation of disaster response. South Sulawesi Province is one of the large provinces with a high level of fire potential. This study examines the role and efforts of the social services of the South Sulawesi province in disaster response to overcome problems that occur in disaster-affected communities, for example by providing logistical assistance in the form of fulfilling needs that are lacking such as fast food, temporary tents, and the needs of women and children. Abstract

This study analyzes the use of a rapid assessment application from the Regional Disaster Management Agency (BPBD) of Central Sulawesi Province. As is known, Central Sulawesi Province is one of the areas that has a fairly high vulnerability to natural disasters. This is because this island is the meeting point of three tectonic plates, namely the Pacific Plate which moves westward, the Eurasian Plate which moves south-south, and the smaller Philippine Plate. Therefore, based on the mandate of Law Number 24 of 2007, the BPBD was formed in order to strive for the implementation and service of the community in the field of regional disaster management. This study uses a qualitative descriptive research method with data collection techniques through in-depth interviews and observation. The results show that the disaster reporting system software through this rapid assessment application has produced a high-fidelity Prototype, but this application is still not perfect and will still be developed. This research goes through a process of analysis and software design based on valid data and information from literature studies as well as field studies and interviews by BNPB officers of Central Sulawesi Province who are related to parties related to disasters.
