Abstract

This study aims to determine the views of the Shafii and Hanafi schools on the validity of prayer imams who have not yet reached puberty, as well as to find out more about the differences in opinions of scholars from these two schools on the matter. The type of research used is qualitative descriptive research, which focuses on the study of manuscripts and texts using normative juridical approach methods and is supported by comparative approach methods. From the results of this study, it was found that the Shafii school punishes the legitimate imam of prayer who has not yet reached puberty who is mumayiz, both in the obligatory prayer and the Sunah prayer, because his ablution is considered valid and there is no problem if a makmum salat is obliged to follow the imam whose essence is the Sunah prayer. According to the Hanafi school, it is not legal for an imam to pray who has not reached puberty even though he has been mumayiz, because the position of the imam demands responsibility and guarantee, while a person who has not yet reached puberty is not included in the group that receives guarantee.

Abstract

This study aims to determine the practice and law of using the Flip application in the perspective of muamalah fiqh. The problems that the authors raise in this study are: First, how is the practice of using the Flip application in the transfer process to other banks. Second, how is the law on interbank transfers using the Flip application from a muamalah fiqh perspective. The research method used in this research is library research with a normative approach. The data used in this study came from primary and secondary data in the form of books, books, journals, articles and scientific literature related to the title of this study. The results of this study conclude that: 1) The practice used to transfer funds in the Flip application is that users only need to follow the transaction procedure they want to make by filling in the transfer request data, transferring funds in the nominal amount they want to send plus a unique code to the same Flip bank account with the user's bank, then send proof of transfer of funds via the Flip application and the user's e-mail. 2) Based on muamalah fiqh analysis, interbank fund transfer transactions through the Flip application are allowed because the transactions carried out avoid usury and garar and there are benefits to ease fund transfer transactions between different banks.

Abstract

This study aims to determine the sanctions for the murder of syibhu al-'amd in the perspective of jinayah jurisprudence and to find out the implications for the application of these sanctions. The type of research used is qualitative descriptive research (non-statistical), using library research methods and normative approach methods and philosophical methods. As a result of this study, it was found that the sanctions for the killing of syibhu al-'amd were diyat and kaffārat. So it is different from intentional murder whose punishment is qiṣāṣ, and different from accidental murder in its type of diyat, namely diyat mugallaẓah. The murder of syibhu al-'amd was deliberate in carrying out its actions, but not deliberately in killing the victim so that it deserves relief in the form of diyat payments borne by 'āqilah perpetrators and payments are not cash or given a period of three years. Another sanction for the killing of syibhu al-'amd is ta'zīr, which is enforced if the sanction is terminated for some reason. In addition, an additional sanction for the perpetrator of the murder of syibhu al-'amd is the prohibition of inheritance and wills as a consequence of the murder he committed. The implications or impacts that occur from the application of diyat sanctions on the perpetrators of the murder of syibhu al-'amd are to provide a peaceful life for the community, deter perpetrators of crime and murder, prevent from various tyrannies, and reduce the occurrence of murder. The application of diyat sanctions can also have bad implications because the perpetrator of the murder of syibhu al-'amd is not punished with qiṣāṣ sanctions, the perpetrator may think hopefully in killing, because the perpetrator thinks there is still a family that he can rely on in bearing the payment of diyat

Abstract

This study aims to determine the comparison of law in the review of muamalah fiqh and positive law against ijarah law. This research is a library research with a normative juridical legal approach and a comparative approach, which discusses doctrines or principle in legal science wich is often called theoretical research, wich includes comparative legal research. The results showed that: (1) There is an equation in the definition that both are a contract to take or benefit an item with wages within a certain period of time, in the nature of the contract that is mutually binding on both parties and both have five pillars that must be fulfilled; (2) There is a difference in the source and foundation, that muamalah fiqh is based directly on the Qur'an and Hadith, who governs life in this world and the afterlife, while positive law comes from Pancasila. UUD, KUH Perdata, KUH Pidana, which is limited to regulating the peace of life in the world. Regarding the terms of ijarah, positive law mentions the maintenance of goods, that it is not allowed during the rental time to change the form or arrangement of the goods rented, while in muamalah fiqh does not discuss it on the terms of ijarah, but it has both good and bad effects. In positive law, leasing services is a separate discussion, called an employment agreement.

Abstract

This study aims to find out how the concept of mumasalah in Islamic jurisprudence, as well as to find out more about the differences in opinions of the Shafii and Hambali schools regarding mumasalah in the punishment of kisas. The type of research used is qualitative descriptive research using library research methods and supported by comparative approach methods. From the results of this research, it was found that mumasalah in Islamic jurisprudence is a matter recognized by the Shari'a, it can even be said to be the original law of practical Islamic laws, especially the laws required of equality. The Shafii School prefers to apply mumasalah in the punishment of kisas, because they see it as more about justice for the victim's guardian, and more to ease their anger over the treatment or way the perpetrator killed the victim. The Hambali school is more inclined to apply kisas using swords

Abstract

This study aims to determine the background of the emergence of Law No. 3 of 2006 and the settlement of Islamic inheritance cases before and after the emergence of Law No. 3 of 2006, as well as the application of the concept of sadd al-zari'ah on the revocation of the right to vote on the settlement of Muslim inheritance cases in Law No. 3 of 2006. The type of research used is descriptive qualitative research, which focuses on manuscript and text studies using a normative juridical approach method and is supported by historical and conceptual approach methods. From the results of this study it was found that the revocation of the right to choose in the settlement of inheritance cases for Muslims in Law No. 3 of 2006 is in accordance with the concept of sadd al-zari'ah. The revocation prevents dualism in Islamic inheritance law and the emergence of various mafsadat.

Abstract

This study aims to determine the views of the Mālikiyyah and Shafiʻiyyah schools on the validity of prayer for hemorrhoid sufferers and to find out the similarities and differences between these two schools on the matter. The type of research used is qualitative descriptive research using library research methods and with normative and comparative approach methods. From the results of this study, it was found that the status of the validity of prayer in the Mālikiyyah school was valid because they considered the blood coming out of the rectum not including hadas and the unclean law was excused on emergency grounds. While the Shafiʻiyyah school views hemorrhoid blood as divided into two categories, those that come out of the rectum including hadas so that the prayer is void, then the validity of the prayer is void if the hemorrhoid is internal and valid if the hemorrhoid is externa. The unclean law is forgiven on condition that he must clean every time he wants to pray and must wrap his rectum.

Abstract

This study aims to determine the practice of buying and selling imported used clothing at Senggol Market, Parepare City in a review of Muamalah Fiqh and Permendag Number 40 of 2022. This research uses qualitative methods in the form of field research with normative juridical, empirical juridical, and sociological approaches . The results of the study show that: first, the practice of buying and selling imported used clothing at Senggol Market, Parepare City involves three parties, namely distributors, sellers, and buyers. The seller orders and buys imported clothes from the distributor in the form of sacks and then resells them on the market in units to the buyer. Second, when viewed from the contract between the seller and the buyer, the practice of buying and selling imported used clothing at Senggol Market, Parepare City, is generally appropriate and fulfills the provisions of the pillars and conditions of sale and purchase according to fiqh muamalah. Meanwhile, if viewed from the contract between the seller and the distributor using the wholesale system, the practice of buying and selling imported used clothing at Senggol Market in Parepare City contains elements of garar (unclearness), but is included in the category of garar yasīr (light garar) which is permissible and does not damage the validity of the contract. Third, imported used clothes are goods that are prohibited from being imported into Indonesian customs territory in the perspective of positive law as regulated because they are deemed to be harmful to society and the domestic industrial market.

Abstract

This study aims to know and understand the rules of al-Yaqīnu Lā Yazūlu Bi al-Syak and its application in taking ahad hadith. The problems that the authors raise in this study are; First, what is the position of the Rule of al-Yaqīnu Lā Yazūlu Bi al-Syak in Islamic law. Second, how is the application of the Rule of al-Yaqīnu Lā Yazūlu Bi al-Syak in taking ahad hadith. This research uses a descriptive research type (illustration) by using the library research method (literature review) and using a normative and philosophical juridical approach. The research results found are as follows; First, the Rules of al-Yaqīnu Lā Yazūlu Bi al-Syak is one of the qawāid kubrā, where Islamic law can be applied with this Rule. The rule of al-Yaqīnu Lā Yazūlu Bi al-Syak is the basis of an essential belief, this rule is based on texts, so that it becomes a secondary source of law. The rule of al-Yaqīnu Lā Yazūlu Bi al-Syak is considered as a consideration for a mujtahid in taking law or practice, to maintain basic matters; religion, soul, reason, and belief. Second, the application of the Rule of al-Yaqīnu Lā Yazūlu Bi al-Syak in taking hadiths is seen from two sides: (1) from the point of view of true belief, namely the release of the heart from doubts. (2) in it there is a belief that returns to a mujtahid in the form of the benefits of the practice contained in the contents of the hadith ahad.

Abstract

This study aims to find out the considerations and decisions of the Indonesian Ulema Council (MUI) in legal matters regarding the provision of insurance to employees who have been laid off due to a bankrupt company. This research uses descriptive-qualitative research that focuses on manuscript and text studies. The results of the research found are as follows: first, the law of layoff insurance products due to bankruptcy companies is permissible as long as the insurance provided follows the provisions set by the MUI and does not violate the principles of sharia insurance. Second, the Indonesian Ulema Council (MUI) in compiling and establishing fatwa number 149 of 2022 uses the istiṣlāh or maslahah al-mursalah method. This determination is in accordance with the objectives of maqāṣid al-syarῑ'ah. In insurance, the maqāṣid al-syarῑ'ah of the permissibility of an insurance contract include maintaining religion where the implementation of sharia insurance must be in accordance with sharia principles, protecting the life of the insurance participant taking care of himself and his family if one day he is laid off and unable to meet his needs, insurance the sharia that he does is part of guarding the soul, guarding the mind, which can be seen from sharia insurance helping insurance participants in controlling their desires from carrying out insurance contracts that are not in accordance with Islamic law, protecting assets, namely by the existence of the principle of sharia insurance by prohibiting usury in This insurance is part of protecting assets, protecting offspring, namely by maintaining religion, soul, mind, and assets, the insurance that applies can be ensured that it is halal for him to give to his family.
